आ.अ. 85.—यतः, भारत निर्वाचन आयोग द्वारा दिनांक 07.05.2024 की अधिसूचना सं0 464/ईपीएस/2024(7) के अनुसरण में ओड़िशा राज्य की लोक सभा के लिए साधारण निर्वाचन 2024 आयोजित किया गया था; और

यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन मे, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और

(205)206 THE GAZETTE OF INDIA : AUGUST 15, 2026/SHRAVAN 24, 1948 [PART II—SEC. 3(iii)] यतः, ओड़िशा राज्य के 05-मयूरभंज (अ.ज.जा.) संसदीय निर्वाचन क्षेत्र के साधारण निर्वाचन, 2024 का परिणाम रिर्टर्नग ऑफिसर द्वारा दिनांक 04.06.2024 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 04.07.2024 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) अंतर्गत, जिला निर्वाचन अधिकारी, मयूरभंज की रिपोर्ट दिनांक शून्य जो मुख्य निर्वाचन अधिकारी, ओड़िशा से दिनांक 31.07.2024 पत्र सं0 EC-CON- COE-0103-2024-2756 (Elec.) के द्वारा हुई थी, के अनुसार श्री अंता आलोक बास्की जो ओड़िशा राज्य के 05- मयूरभंज (अ.ज.जा.) संसदीय निर्वाचन क्षेत्र, 2024 से निर्वाचन लड़ने वाले अभ्यर्थी है, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे है; और

यतः, जिला निर्वाचन अधिकारी, मयूरभंज की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री अंता आलोक बास्की को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/ODISHA/PC-05/2024/CEMS-IV दिनांक 04 नवंबर, 2024 जारी किया गया थाः, और

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार श्री अंता आलोक बास्की को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, मयूरभंज को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, मयूरभंज से दिनांक 03.12.2024 के पत्र सं0 6137/Elec के द्वार सूचित किया है कि उक्त कारण बताओ नोटिस श्री अंता आलोक बास्की के द्वारा दिनांक 02.12.2024 को प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी, मयूरभंज ने पत्र सं0 307/Elec. दिनांक 20.03.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री अंता आलोक बास्की ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्री अंता आलोक बास्की ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में उपबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; और

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग, शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निर्रर्हत घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निर्रर्हत होगा।"

यतः, तथ्यों और उपलब्ध रिकाडो के आधार पर आयोग का यह समाधान हो गया है कि श्री अंता आलोक बास्की अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नही है, और

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है ओड़िशा राज्य की लोक सभा के लिए साधारण निर्वाचन, 2024 के 05-मयूरभंज )अ.ज.जा(. संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़नेवाले अभ्यर्थी श्री अंता आलोक बास्की, स्थान –ओलिडीही, डाकघर–बोडपालसा, थाना– टायररंग, जिला–मयूरभंज, ओडिशा, पिन – 757046 इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होगें।

ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 5th June, 2026

O.N. 85.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the Election Commission of India Notification No. 464/EPS/2024/(7) dated 07.05.2024; and

WHEREAS, the result of the above-mentioned elections for 05-Mayurbhanj (ST) Parliamentary Constituency of Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of election expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer, Mayurbhanj, Odisha report dated NIL forwarded by the Chief Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31.07.2024, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Anta Alok Baskey, a contesting candidate from 05-Mayurbhanj (ST) Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Mayurbhanj, a Show-Cause notice No. 76/ODISHA/PC-05/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Anta Alok Baskey, for not lodging of his account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Anta Alok Baskey, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and WHEREAS, District Election Officer, Mayurbhanj vide his letter no. 6137/Elec dated 03.12.2024 informed that the said notice was served to Sh. Anta Alok Baskey on 02.12.2024; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no. 307/Elec dated 20.03.2026 has reported that Sh. Anta Alok Baskey, has not submitted his account of election expenses. Further, after receipt of the said notice, Sh. Anta Alok Baskey, has neither furnished any reason nor explanation to the Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three

years from the date of the order."

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Anta Alok Baskey has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Anta Alok Baskey resident of At-Olidihi, Po-Bodpalsa, PS-Tiring, Dist- Mayurbhanj, Odisha, PIN-757046, a contesting candidate from 05-Mayurbhanj (ST) Parliamentary Constituency of General Election to the Lok Sabha of Odisha , 2024, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी, मयूरभंज ने पत्र सं0 307/Elec. दिनांक 20.03.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री सुकांत हेम्ब्रम ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्री सुकांत हेम्ब्रम ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

निर्वाचन क्षेत्र से निर्वाचन लड़नेवाले अभ्यर्थी श्री सुकांत हेम्ब्रम, स्थान–रेबाना(खा), डाकघर–रेबाना पलासपाल, वाया –

भागमु ंडा, थाना – दैतारी, जिला – क्योंझर, पिन – 758080 इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद

WHEREAS, as per the District Election Officer, Mayurbhanj, Odisha report dated NIL forwarded by the Chief Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31.07.2024, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sukanta Hembram, a contesting candidate from 05- Mayurbhanj (ST) Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Mayurbhanj, a Show-Cause notice No. 76/ODISHA/PC-05/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Sukanta Hembram, for not lodging of his account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sukanta Hembram, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and

WHEREAS, District Election Officer, Mayurbhanj vide his letter no. 6137/Elec dated 03.12.2024 informed that the said notice was served to Sh. Sukanta Hembram on 22.11.2024; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no. 307/Elec dated 20.03.2026 has reported that Sh. Sukanta Hembram, has not submitted his account of election expenses. Further, after receipt of the said notice, Sh. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) अंतर्गत, जिला निर्वाचन अधिकारी, जाजपुर की रिपोर्ट दिनांक शून्य जो मुख्य निर्वाचन अधिकारी, ओड़िशा से दिनांक 31.07.2024 पत्र सं0 EC-CON- COE-0103-2024-2756 (Elec.) के द्वारा हुई थी, के अनुसार श्री मंटू सेठी जो ओड़िशा राज्य के 08-जाजपुर (अ.जा.) संसदीय निर्वाचन क्षेत्र, 2024 से निर्वाचन लड़ने वाले अभ्यर्थी है, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे है; और,

यतः, जिला निर्वाचन अधिकारी, जाजपुर की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री मंटू सेठी को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/ODISHA/PC-08/2024/CEMS-IV दिनांक 04.11.2024 जारी किया गया थाः, और

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार श्री मंटू सेठी को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, जाजपुर को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, जाजपुर से दिनांक 19.11.2024 के पत्र सं0 7012/Elec के द्वार सूचित किया है कि उक्त कारण बताओ नोटिस श्री मंटू सेठी के द्वारा दिनांक 13.11.2024 को प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी, जाजपुर ने पत्र सं0 173/Elec. दिनांक 27.02.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री मंटू सेठी ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्री मंटू सेठी ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में उपबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 15, 2026/श्रावण 24, 1948 211 (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; और

O.N. 87.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the Election Commission of India Notification No. 464/EPS/2024/(7) dated 07.05.2024; and

WHEREAS, the result of the above-mentioned elections for 08-Jajpur (SC) Parliamentary Constituency of Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of election expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer, Jajpur, Odisha report dated NIL forwarded by the Chief Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31.07.2024, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Mantu Sethi, a contesting candidate from 08-Jajpur (SC) Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Jajpur, a Show-Cause notice No. 76/ODISHA/PC-08/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Mantu Sethi, for not lodging of his account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Mantu Sethi, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Jajpur within 20 days from the date of receipt of the Notice; and

WHEREAS, District Election Officer, Jajpur vide his letter no. 7012/Elec dated 19.11.2024 informed that the said notice was served to Sh. Mantu Sethi on 13.11.2024, and

WHEREAS, the District Election Officer, Jajpur in his Supplementary Report, vide its letter no. 173/Elec dated 27.02.2026 has reported that Sh. Mantu Sethi, has not submitted his account of election expenses. Further, after receipt of the said notice, Sh. Mantu Sethi, has neither furnished any reason nor explanation to the Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

आ.अ. 90.—यतः, भारत निर्वाचन आयोग द्वारा दिनांक 29.04.2024 की अधिसूचना सं0

464/ईपीएस/2024(6) के अनुसरण में ओड़िशा राज्य की लोक सभा के लिए साधारण निर्वाचन 2024 आयोजित किया

गया था; और

यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन मे, निर्वाचन लड़ रहा प्रत्येक

अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन

अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता

(एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 15, 2026/श्रावण 24, 1948 217 यतः, ओड़िशा राज्य के 17-पुरी संसदीय निर्वाचन क्षेत्र के साधारण निर्वाचन, 2024 का परिणाम रिर्टर्नग ऑफिसर द्वारा दिनांक 04.06.2024 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 04.07.2024 थी; और

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) अंतर्गत, जिला निर्वाचन अधिकारी, पुरी की रिपोर्ट दिनांक शून्य जो मुख्य निर्वाचन अधिकारी, ओड़िशा से दिनांक 31.07.2024 पत्र सं0 EC-CON-COE- 0103-2024-2756 (Elec.) के द्वारा हुई थी, के अनुसार श्रीमती शोभा पांडे जो ओड़िशा राज्य के 17-पुरी संसदीय निर्वाचन क्षेत्र, 2024 से निर्वाचन लड़ने वाली अभ्यर्थी है, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहीं है; और,

यतः, जिला निर्वाचन अधिकारी, पुरी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्रीमती शोभा पांडे को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/ODISHA/PC-17/2024/CEMS-IV दिनांक 04.11.2024 जारी किया गया थाः, और

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार श्रीमती शोभा पांडे को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी पुरी को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, पुरी से दिनांक 02.05.2025 के पत्र सं0 420/Elec के द्वार सूचित किया है कि उक्त कारण बताओ नोटिस श्रीमती शोभा पांडे के द्वारा दिनांक 25.03.2025 को प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी, पुरी ने पत्र सं0 444/Elec. दिनांक 13.05.2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती शोभा पांडे ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्रीमती शोभा पांडे ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में उपबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि ओड़िशा राज्य की लोक सभा के लिए साधारण निर्वाचन, 202417-पुरी संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़नेवाले अभ्यर्थी श्रीमती शोभा पांडे, स्थान-जूनुषपटाना, डाकघर-कॉलेज स्वायर, थाना-मालगोडाउन, जिला- कटक, पिन-753003 (ओडिशा) इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगी।

O.N. 90.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the Election Commission of India Notification No. 464/EPS/2024/(6) dated 29.04.2024; and

WHEREAS, the result of the above-mentioned elections for 17-Puri Parliamentary Constituency of Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of election expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer, Puri, Odisha report dated NIL forwarded by the Chief Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31st July, 2024, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Smt. Sobha Pandey, a contesting candidate from 17-Puri Parliamentary Constituency of Odisha has failed to lodge her account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Puri, a Show-Cause notice No. 76/ODISHA/PC-17/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Smt. Sobha Pandey, for not lodging of her account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Smt. Sobha Pandey, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Puri within 20 days from the date of receipt of the Notice; and

WHEREAS, District Election Officer, Puri vide his letter no. 420/Elec dated 02.05.2025 informed that the said

notice was served to Smt. Sobha Pandey on 25.03.2025; and

WHEREAS, the District Election Officer, Puri in his Supplementary Report, vide its letter no. 444/Elec. dated 13.05.2025 has reported that Smt. Sobha Pandey, has not submitted her account of election expenses. Further, after receipt of the said notice, Smt. Sobha Pandey, has neither furnished any reason nor explanation to the Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three

years from the date of the order."

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Smt. Sobha Pandey resident of AT-Junushpatna, PO-College Square, PS- Malgodown, Dist-Cuttack PIN-753003, a contesting candidate from 17-Puri Parliamentary Constituency of General Election to the Lok Sabha of Odisha , 2024, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, जिला निर्वाचन अधिकारी, मयूरभंज ने अपने पत्र सं 0 361/Elec. दिनांक 10.04.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री बेनुधर मोहपात्रा ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है और इस के अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत श्री बेनुधर मोहपात्रा ने विधि के अंतर्गत यथाविहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दियाहै; और

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no. 361/Elec. dated 10.04.2026 has reported that Sh. Benudhar Mohapatra, has not submitted his account of election expenses and further, after receipt of the said notice, Sh. Benudhar Mohapatra, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

यतः, जिला निर्वाचन अधिकारी, मयूरभंज की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री राम कु मार सोरेन को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/OD-LA/27/2024/CEMS-IV दिनांक 08.01.2025 जारी किया गया था; और

यतः, जिला निर्वाचन अधिकारी ,मयूरभंज ने अपने पत्र सं 0 361/Elec. दिनांक 10.04.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राम कु मार सोरेन ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है और इसके अतिरिक्त उक्त नोटिस की पावती/चस्पा के उपरांत श्री राम कु मार सोरेन ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है;और222 THE GAZETTE OF INDIA : AUGUST 15, 2026/SHRAVAN 24, 1948 [PART II—SEC. 3(iii)] यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Ram Kumar Soren, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Mayurbhanj vide his letter no. 176/Elec dated 21.02.2025 informed that the said notice had been affixed on the boundary wall in the presence of the Sarpanch and Ward Member on 31.01.2025; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no. 361/Elec. dated 10.04.2026 has reported that Sh. Ram Kumar Soren, has not submitted his account of election[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 15, 2026/श्रावण 24, 1948 223 expenses and further, after receipt of the said notice, Sh. Ram Kumar Soren, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act; and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order."

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Ram Kumar Soren has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. यतः, जिला निर्वाचन अधिकारी, मयूरभंज ने अपने पत्र सं0 361/Elec. दिनांक 10.04.2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती बसंती टुडू ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है और इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्रीमती बसंती टुडू ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

यतः, तथ्यों और उपलब्ध रिकाडो के आधार पर आयोग का यह समाधान हो गया है कि श्रीमती बसंती टुडू अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रही हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नही है; और

यत ,:तथ्यों और उपलब्ध रिकाडो के आधार पर आयोग का यह समाधान हो गया है कि श्री राधाकृ ष्ण मोहंता अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नही है; और

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि ओड़िशा राज्य की विधान सभा के लिए साधारण निर्वाचन, 2024 के 34-मोरादा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़नेवाले अभ्यर्थी श्री राधाकृ ष्ण मोहंता निवासी ग्राम/पोस्ट – करमसोल, थाना–बेतनोटी, जिला–मयूरभंज, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होंगे।

O.N. 95.— WHEREAS, the General Election to Legislative Assembly of Odisha, 2024 was held in pursuance of Notification No. 8209-EC-CON-COE-0080/2024-/Elec. dated 07.05.2024; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 15, 2026/श्रावण 24, 1948 229 WHEREAS, the result of the above-mentioned elections for 34-Morada Assembly Constituency of Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of election expenses was 04.07.2024; and

WHEREAS, on the basis of the said report of the District Election Officer, Mayurbhanj, a Show-Cause notice No. 76/OD-LA/34/2024/CEMS-IV, dated 08.01.2025 was issued under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Radhakrishna Mohanta for not lodging of his account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Radhakrishna Mohanta, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Mayurbhanj vide his letter no. 176/Elec dated 21.02.2025 informed that the said notice Notice was served to Sh. Radhakrishna Mohanta on 07.08.2024; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no. 361/Elec. dated 10.04.2026 has reported that Sh. Radhakrishna Mohanta, has not submitted his account of election expenses and further, after receipt of the said notice, Sh. Radhakrishna Mohanta, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act; and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three

years from the date of the order."

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार श्री अन्ता आलोक बास्के को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, मयूरभंज को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था;और

यतः, जिला निर्वाचन अधिकारी, मयूरभंज से दिनांक 21.02.2025 के पत्र सं0 176/Elec के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस को दिनांक 30.01.2025 को श्री अन्ता आलोक बास्के की चाची (रूपी टुडू) के द्वारा प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी, मयूरभंज ने अपने पत्र सं 0 361/Elec. दिनांक 10.04.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री अन्ता आलोक बास्के ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है और इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत श्री अन्ता आलोक बास्के ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है ;और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा 10क में अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

यतः, जिला निर्वाचन अधिकारी, मयूरभंज से दिनांक 21.02.2025 के पत्र सं0 176/Elec के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस को दिनांक 01.02.2025 को श्री सुनाराम हेम्ब्रम के द्वारा प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी, मयूरभंज ने अपने पत्र सं 0 361/Elec. दिनांक 10.04.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री सुनाराम हेम्ब्रम ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है और इस के अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत श्री सुनाराम हेम्ब्रम ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है ; और

यत:, लोक प्रतिनिधित्व अधिनियम,1951 की धारा10क में अनुबंधित किया गया है कि:-

O.N. 98.— WHEREAS, the General Election to Legislative Assembly of Odisha, 2024 was held in pursuance of Notification No. 8209-EC-CON-COE-0080/2024-/Elec. dated 07.05.2024; and

WHEREAS, on the basis of the said report of the District Election Officer, Mayurbhanj, a Show-Cause notice No. 76/OD-LA/28/2024/CEMS-IV, dated 08.01.2025 was issued under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Sunaram Hembram for not lodging of his account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sunaram Hembram, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Mayurbhanj vide his letter no. 176/Elec dated 21.02.2025 informed that the said notice Notice was served to Sh. Sunaram Hembram on 01.02.2025; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no. 361/Elec. dated 10.04.2026 has reported that Sh. Sunaram Hembram, has not submitted his account of election expenses and further, after receipt of the said notice, Sh. Sunaram Hembram, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or

of three years from the date of the order."

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Sunaram Hembram has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. यतः, जिला निर्वाचन अधिकारी, सम्बलपुर ने पत्र सं0 2990/Elec. दिनांक 17 फरवरी,2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री लक्ष्मण कु मार भोई ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्री लक्ष्मण कु मार भोई द्वारा दिनांक 04.12.2024 को एक अभ्यावेदन प्रस्तुत किया गया था, जिसके संबंध में आयोग द्वारा जिला निर्वाचन अधिकारी से टिप्पणियाँ प्राप्त करने हेतु पत्र भेजा गया। अपनी रिपोर्ट में जिला निर्वाचन अधिकारी ने बताया है कि निर्वाचन व्यय का लेखा प्रस्तुत न कर पाने के संबंध में अभ्यर्थी द्वारा दिए गए कारणों के समर्थन में कोई दस्तावेज संलग्न नहीं किया गया है। अतः लोक प्रतिनिधित्व अधिनियम, 1951 के प्रावधानों के अनुसार आवश्यक कार्रवाई की जा सकती है। इसके अतिरिक्त, श्री लक्ष्मण कु मार भोई द्वारा निर्वाचन व्यय का कोई लेखा प्रस्तुत नहीं किया गया है।

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में उपबंधित किया गया हैकि :-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

Whereas, District Election Officer, Sambalpur vide his letter no. 2990/Elec dated 17.02.2025 informed that the said notice was served to his wife on 14.11.2024, and

WHEREAS, the District Election Officer, Sambalpur in his Supplementary Report, vide its letter no. 2990/Elec. dated 17.02.2025 has reported that Sh. Laxman Kumar Bhoi, has not submitted his account of election expenses. Further, after receipt of the said notice, Sh. Laxman Kumar Bhoi, submitted a representation dated 04.12.2024, regarding which a letter was sent by the Commission for comments from the District Election Officer. In his report the DEO stated that the reasons submitted by the candidate about his inability to submit his accounts of election expenses are without any supporting document. Therefore, necessary action may be taken as per provisions under the R.P. Act, 1951. Additionally, Sh. Laxman Kumar Bhoi has not submitted any account of expenses; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

यतः, जिला निर्वाचन अधिकारी, क्योन्झर ने पत्र सं0 216/Elec. दिनांक 6 मार्च, 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री पिताबासा नाईक ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्री पिताबासा नाईक ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

O.N. 101.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the Election Commission of India Notification No. 464/EPS/2024/(6) dated 29th April, 2024. And

WHEREAS, the result of the above-mentioned elections for 04-Keonjhar (ST) Parliamentary Constituency of Odisha was declared by the Returning Officer on 4th June, 2024 and hence the last date for lodging the account of Election Expenses was 4th July, 2024; and

WHEREAS, as per the District Election Officer, Keonjhar, Odisha report dated 09.07.2025 forwarded by the Chief Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31st July, 2024, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Pitabasa Naik, a contesting candidate from 04- Keonjhar (ST) Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Keonjhar , a Show-Cause notice No. 76/ODISHA/PC-04/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Pitabasa Naik, for not lodging of his account of Election Expenses; and,

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Pitabasa Naik, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Keonjhar within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Keonjhar vide his letter no. 4345/Elec dated 22.11.2024 informed that the said notice was served to his son on 20.11.2025, and

WHEREAS, the District Election Officer, Keonjhar in his Supplementary Report, vide its letter no. 216/Elec. dated 06.03.2025 has reported that Sh. Pitabasa Naik, has not submitted his account of election expenses. Further, after receipt of the said notice, Sh. Pitabasa Naik, has neither furnished any reason nor explanation to the Commission of India, for failure to lodged the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that: -

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order."

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Pitabasa Naik has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार श्री राजेंद्र डालाबेहेरा को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, गंजम को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, गंजम ने पत्र सं0 676/Elec. दिनांक 9 सितंबर, 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राजेंद्र डालाबेहेरा ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्री राजेंद्र डाला बेहेरा ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में उपबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) अंतर्गत, जिला निर्वाचन अधिकारी, के न्द्रपाड़ा की रिपोर्ट दिनांक शून्य जो मुख्य निर्वाचन अधिकारी, ओड़िशा से दिनांक 31.07.2024 पत्र सं0 EC-CON- COE-0103-2024-2756 (Elec.) को प्राप्त हुई थी, के अनुसार श्री श्रीराम पांडे जो ओड़िशा राज्य के 15-के न्द्रपाड़ा संसदीय निर्वाचन क्षेत्र, 2024 से निर्वाचन लड़ने वाले अभ्यर्थी है, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे है; और,

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री श्रीराम पांडे को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/ODISHA/PC-15/2024/CEMS-IV दिनांक 04 नवंबर, 2024 जारी किया गया थाः, और

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार श्री श्रीराम पांडे को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को248 THE GAZETTE OF INDIA : AUGUST 15, 2026/SHRAVAN 24, 1948 [PART II—SEC. 3(iii)] अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, के न्द्रपाड़ा को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः, जिला निर्वाचन अधिकारी, के न्द्रपाड़ा से दिनांक 03 अप्रैल, 2025 के पत्र सं0 98/Elec के द्वार सूचित किया है कि उक्त कारण बताओ नोटिस श्री श्रीराम पांडे के पुत्र के द्वारा दिनांक 24 जनवरी, 2025 को तामील किया गया था; और

यतः, जिला निर्वाचन अधिकारी, के न्द्रपाड़ा ने पत्र सं0 122/Elec. दिनांक 2 मई, 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री श्रीराम पांडे ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस की पावती/चस्पा के उपरांत, श्री श्रीराम पांडे ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में उपबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

यतः, तथ्यों और उपलब्ध रिकाडो के आधार पर आयोग का यह समाधान हो गया है कि श्री श्रीराम पांडे अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नही है, और

अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है ओड़िशा राज्य की लोक सभा के लिए साधारण निर्वाचन, 2024 के 15-के न्द्रपाड़ा संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री श्रीराम पांडे स्थान-जूनुषपटाना, डाकघर-कॉलेज स्वायर,थाना-मालगोडाउन, जिला-कटक, पिन-753003 (ओडिशा) इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद्का का सदस्य चुने जाने अथवा होने के लिए निर्रर्हत होगें।

ORDER

New Delhi, the 12th February, 2026

O.N. 104.— WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the Election Commission of India Notification No. 464/EPS/2024/(7) dated 07th May, 2024. And

WHEREAS, as per the District Election Officer, Kendrapara, Odisha report dated NIL forwarded by the Chief Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31st July, 2024, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sriram Pandey, a contesting candidate from 15- Kendrapara Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Kendrapara , a Show-Cause notice No. 76/ODISHA/PC-15/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the[भाग II—खण्ड 3(iii)] भारत का राजपत्र : अगस्त 15, 2026/श्रावण 24, 1948 249 Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Sriram Pandey, for not lodging of his account of Election Expenses; and,

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sriram Pandey, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Kendrapara within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Kendrapara vide his letter no. 98/Elec dated 03.04.2025 informed that the said notice was served to his son on 24.01.2025, and

WHEREAS, the District Election Officer, Kendrapara in his Supplementary Report, vide its letter no. 122/Elec. dated 02.05.2025 has reported that Sh. Sriram Pandey, has not submitted his account of election expenses. Further, after receipt of the said notice, Sh. Sriram Pandey, has neither furnished any reason nor explanation to the Commission of India, for failure to lodged the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order."

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Sriram Pandey has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Sriram Pandey resident of At- Junush Patna, PO- College Square, PS- Mal Godown, Dist- Cuttack, a contesting candidate from 15-Kendrapara Parliamentary Constituency of General Election to the Lok Sabha of Odisha , 2024, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
