Notification

No. 56/2019(V)/PPS-III—In pursuance of sub-paragraph (2) of paragraph 17 of the Election Symbols (Reservation & Allotment) Order, 1968, the Election Commission of India hereby makes the following amendments to its Notification No. 56/2019/PPS-III, dated 15th March, 2019, as amended from time to time, namely :—

1. In Table II (State Parties), appended to the said Notification :—

(i) Against Sl. No.14, 19 & 26 in respect of People's Democratic Front, All India N.R.Congress and Rashtriya Lok Dal respectively, the following entries shall be substituted under Column No. 5 respectively :—

(ii) Against Sl. No.4 related to Bihar, after the existing entries, the following entries shall be inserted under Column Nos.3, 4 & 5 respectively :

2. In Table III (Registered un-recognised parties), appended to the said Notification : —

(i) After the existing entries at Sl. No.2628, the following entries shall be inserted under Column Nos. 1, 2 & 3, respectively :—

(ii) Against Sl. No.689, in respect of 'Communist Party of India (Marxist- Leninist) (Liberation)', the existing entries shall be deleted.

(iii) Against Sl. No.914, in respect of 'Indian Unity Centre', the existing entries under column 3 shall be substituted by the entries "Vill. & P.O.Somruk, P.S.Uluberia, Distt.Howrah, Pin- 711316, West Bengal.

(iv) Against Sl. No.1514, in respect of 'Peoples Movement of India', the existing entries under column 3 shall be substituted by the entries "9/215/15, Yojna – 3, Aavas Vikas Colony, Jhoonsi, Allahabad, Uttar Pradesh – 211 019.

(v) Appended to the amending Notification dated 30.09.2020 in Hindi version, against Sl. No.2603, in respect of 'Rashtriya Jan Kalyan Party Secular, the existing entries under column 2 shall be substituted by the entries "रा(cid:231)(cid:282)(cid:547)य जन क(cid:227)याण पाट(cid:569) से(cid:200)युलर".

सं.56/2019(v) रा.दल.अनु-III.— निर्वाचन प्रतीक (आरक्षण तथा आबंटन) आदेश, 1968 के पैरा 17 के उप पैरा 2 के अनुसरण में, भारत निर्वाचन आयोग, अपनी अधिसूचना सं. 56/2019/रा.दल.अनु.III, तारीख 15.03.2019, में एत(cid:7375)ारा निम्नलिखित और संशोधन करता है, अर्थातः—

1. उ(cid:200)त अ(cid:876)धसूचना से संल(cid:202)न सlरणी - II (रा(cid:207)यीय दल) म(cid:581) –

(i) (cid:7059).सं. 14, 19 व 26 अर्थात् पीपुल्स डेमो(cid:7⁰⁵⁹)े टिक (cid:7⁰⁸⁰)न्ट, ऑल इंडिया एन. आर. काँ(cid:⁷⁰⁶1)ेस तथा राष्ट्रीय लोक दल से संबंधित स्तम्भ 5 पर विद्यमान प्रविष्टियों को विलोपित किया जाएगा ।

(ii) (cid:272)म सं. 4 पर (cid:874)व(cid:622)यमान, (cid:466)बहार से संबं(cid:876)धत (cid:232)त(cid:224)भ 3, 4 व 5 के अ(cid:219)तग(cid:91)त, (cid:874)व(cid:622)यमान (cid:292)(cid:874)व(िcid:231)टय(cid:585) के प(cid:230)चात ्, (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत (cid:292)(cid:874)व(िcid:231)टयाँ (cid:272)मशः अ(cid:219)तः(cid:232)था(cid:874)पत क(cid:551) जाएंगी -

2. उक्त अधिसूचना से संल(cid:7336) सारणी – III (रजिस्ट्रीकृ त अमान्यता प्राप्त दल) में-

(i) स्तम्भ 1, 2 व 3 के अन्तर्गत (cid:7059)म सं.2628 पर विद्यमान प्रविष्टियों के प(cid:7391)ात् निम्नलिखित प्रविष्टियाँ (cid:7059)मशः अन्तःस्थापित की जाएंगी : -

(ii) (cid:7059)म सं.689 के सामने 'कम्यूनिष्ट पार्टी ऑफ इंडिया (माक्र्ससिस्ट - लेनिनिस्ट) (लिबरेशन)' के संबंध में विद्यमान प्रविष्टियों को विलोपित किया जाएगा ।

(iii) (cid:7059)म सं.914 के सामने 'इं(cid:875)डयन यु(cid:467)न(cid:465)ट स(cid:581)टर' के संबंध में स्तम्भ 3 पर विद्यमान प्रविष्टियों को, प्रविष्टियों "गाँव तथा पो.ओ.सोम(cid:7271)क,पो.स.उलुबेरिया,जिला-हावड़ा-711316,प(िcid:7391)म बंगाल" से प्रतिस्थापित किया जाएगा । (iv) (cid:7059)म सं.1514 के सामने 'पीपुल्स मूवमेंट ऑफ इ(िcid:7003)डया' के संबंध में स्तम्भ 3 पर विद्यमान प्रविष्टियों को, प्रविष्टियों "9/215/15, योजना-3, आवास विकास कॉलोनी, झू ंसी, इलाहाबाद, उत्तर प्रदेश-211 019" से प्रतिस्थापित किया जाएगा ।

(v) दिनांक 30.9.2020 की संशोधित हिन्दी अधिसूचना के (cid:7059)म सं.2603 के सामने स्तम्भ 2 पर विद्यमान प्रविष्टियों अर्थात् 'जन कल्याण पार्टी सेक्युलर' को, प्रविष्टियों 'राष्ट्रीय जन कल्याण पार्टी सेक्युलर' से प्रतिस्थापित किया जाएगा ।

Order under Section 144 Cr.P.C.

The 9th March, 2021

No. DM/MA/2021/4656.—Whereas, the Chandigarh Administration has earmarked the Rally Ground, Sector 25, Chandigarh for taking out processions, rallies, dharnas, etc. and no permission has been granted by the Chandigarh Administration to organize processions, rallies, dharnas, etc. elsewhere in the city other than the designated location, i.e., Rally Ground, Sector 25, Chandigarh and the same has been done to avoid traffic congestion, keeping in view of the convenience of the general public.

Whereas, it has been made to appear to me that certain groups of people plans to organize processions, rallies, dharnas, etc., and resort to other agitation methods in the city other than the earmarked/designated place i.e. Rally Ground, Sec 25, Chandigarh and whereas, there is an apprehension that such groups/organizations/unions may cause obstruction, annoyance or injury to the persons lawfully employed or other general public and endanger human life and property, disturb public peace and tranquility and cause riots and affrays.

And therefore I, Mandip Singh Brar, I.A.S., District Magistrate, Chandigarh, am of the opinion that taking out procession, rally, protest, strike, making speeches, raising slogans by gathering/assembly of 5 or more people etc. within the territory of U.T., Chandigarh other than Rally Ground, Sec 25, Chandigarh, would cause obstruction, annoyance or injury to persons lawfully employed or other general public, disturb public peace and tranquility and cause riots and affrays and that Immediate action is necessary for the prevention of the same.

Now therefore, I, Mandip Singh Brar, I.A.S., District Magistrate, Chandigarh, in exercise of the power vested u/s 144 of Cr. P.C., do hereby order as a measure of emergency that the public in general or any member thereof is prohibited from taking out procession, rally, protest, strike, making speeches, raising slogans of gathering/assembly of 5 or more people etc. within the territory of U.T., Chandigarh other than Rally Ground, Sec-25, Chandigarh, for a period of 60 days.

Further, prior permission for organizing procession, rally, protest, strike, making speeches, raising slogans, gathering/assembly of 5 or more people etc. at Rally Ground, Sector-25, Chandigarh must be obtained from the Competent Authority, i.e., the District Magistrate/concerned Sub Divisional Magistrate, U.T., Chandigarh :

Provided that the above order shall not apply to—

(I) The police or Para-military or military persons or any other Government servant on official duties;

(II) The processions or meetings for which prior permission in writing of the District Magistrate/concerned Sub Divisional Magistrate, Chandigarh, has been obtained;

(III) The customary and ritualistic procession in connection with weddings and funerals.

This order shall come into force from zero hours on 19.03.2021 and shall be effective for a period of sixty days up to and including 17.05.2021.

In view of the emergent nature of the order, it is being issued ex parte and is addressed to the public in general. Any breach of this order would invite action under section 188 of the Indian Penal Code.

This order shall be promulgated by affixing copy thereof at the Notice Boards of the office of the undersigned as well as the District Courts, Chandigarh and publication in the newspapers having circulation in the area, through the office of the D.P.R., Chandigarh.
