Notification

The 5th July, 2024

No. 16964/HIII(5)Rules/2024/9297.—In exercise of the powers conferred by Section 109 of The Waqf Act, 1995 (Central Act No. 43 of 1995) read with Government of India, Ministry of Home Affairs Notification bearing no. S.O. 1137 (E) dated 29.04.2015 and all other powers enabling him in this behalf, the Administrator, Union Territory of Chandigarh hereby make the following amendments in the Chandigarh Waqf Rules, 2024, namely :-

1. Short title and commencement-(i) These rules may be called the Chandigarh Waqf (First Amendment) Rules, 2024.

(ii) These rules shall come into force on the date of their publication in the Official Gazette.

2. In the Chandigarh Waqf Rules, 2024 :-

1. In clause (f) of sub rule (1) of rule 2 under the heading 'Definitions.-' the word "inclause" shall be substituted and read as "in clause".

2. In sub-clause (i) of clause (i) of sub rule (1) of Rule 2 the word "apper taining" shall be substituted and read as "appertaining"

3. In clause (k) of rule 5 the word "in curred" shall be substituted and read as "incurred".

4. In sub rule (2) of rule 7 the word "are turning" shall be substituted and read as "a returning".

5. In sub rule (2) of rule 10 the word "object or or" shall be substituted and read as "objector or".

6. Section 14(2) shall be inserted in the margin corresponding to sub rule (1) of Rule 11.

7. In sub-rule (4) of rule 11, the word "State of Chandigarh" shall be substituted and read as "Union Territory of Chandigarh".

8. In sub rule (1) of rule 14, the word "forth with" shall be substituted and read as "forthwith".

9. the words "if the identity of the candidate is otherwise established beyond reasonable doubt." shall be read in continuation to the Proviso to clause (e) of sub-rule (2) of Rule 16.

10. In sub rule (3) of rule 23, the word "poling" shall be substituted and read as "polling".

11. Section 14(2) shall be inserted in the margin corresponding to Rule 33.

12. In rule 33 the word "acknowledgment" shall be substituted and read as "acknowledgement".

13. Section 14(2) shall be inserted in the margin corresponding to Rule 34.

14. In clause (c) of sub rule (1) of rule 34 the word "acknowledgment" shall be substituted and read as "acknowledgement".

15. Section 14(2)(8) mentioned in margin corresponding to sub-rule(1)(c) of Rule 34 shall be deleted and further Section14(2)(8) shall be inserted in the margin corresponding to Rule 35.

16. In sub rule (4) of rule 35 '\' shall be deleted.

17. Clause (b) of sub rule (6) of Rule 35 shall be read as next paragraph.

18. Sub-rule (9) of Rule 35 shall be read as next paragraph.

19. In sub rule (3) of rule 39, the word "Chandigarh Government" shall be substituted and read as "Union Territory of Chandigarh".

20. In clause (b) of sub rule (2) of rule 46 the word "subrule" shall be substituted and read as "sub rule".

21. In sub clause (b) of sub rule (1) of rule 47 the word "acknowledgment" shall be substituted and read as "acknowledgement".

22. Sub rule (4) of Rule 53 shall be read as next paragraph.

23. In sub clause (ii) of clause (a) of sub rule (13) of rule 53 after the word Chandigarh "; or" shall be inserted.

24. In sub clause (iii) of clause (a) of sub rule (13) of rule 53 after the word Chandigarh; "or" shall be inserted.

25. In sub rule (7) of Rule 55, the word "ororiginal" shall be substituted as read as "or original".

26. In rule 57 under the heading 'Terms and conditions of appointment including salary and allowances payable to the Chairman and other members of the Tribunal, other than the ex-offcio' the word "ex-offcio" shall be substituted and read as "ex-officio".

27. In sub rule (4) of rule 58 the word "acknowledgment" shall be substituted and read as "acknowledgement".

28. In rules 62, 63, 64 & 65 "Section 109(xxv)" shall be inserted in front of headings of rules.

29. In FORM-'A' in the subject heading the word "Electoral Role"shall be substituted and read as "Electoral Roll".

30. The word "Lagislator" as mentioned in Row 1 of Column 2 of Form 'A' shall be substituted and read as "Legislator".

31. In FORM-'B' in column 3, the heading "Address of the candidiate" shall be substituted and read as "Address of the candidate".

32. In FORM-'G' in column 3, the heading "Address of the candidiate' shall be substituted and read as "Address of the candidate".

33. Further, in FORM-'G' in row 6 the word "Etc." shall be substituted and read as "So on".

34. In FORM-'J' in column 3, the heading "Address of the candidiate" shall be substituted and read as "Address of the candidate".

35. The word 'etc' in column 1 row 8 in Form 'J' shall be substituted and read as "so on".

36. In FORM-'M' "Chandigarh Waqf Rules 2018," shall be substituted and read as "Chandigarh Waqf Rules 2024,".

37. In FORM-'N' under the heading the words "CERTIFICATE OF ELECTION ELECTION" shall be substituted and read as "CERTIFICATE OF ELECTION".

38. In FORM-'O' in the row 1, the word "Paliament" shall be substituted and read as "Parliament".

39. In FORM-'R' under the heading 'Cash balance from previous year' the word "income loans" shall be substituted and read as "income".

40. In FORM-'R' under the heading 'Cash balance from previous year' in column 2 under (ii) the line "Cash balance at the end of year" shall be inserted.

41. In FORM-'S' under the heading 'DETAILS OF THE APPLICATION' point(1)(e) shall be deleted.

42. In FORM-'S' under the heading 'DETAILS OF THE APPLICATION' sub-point 3, row 5, "any applicant" shall be substituted and read as "any application".
