No. 665770-HII(2)-2026/6401.—In exercise of the Powers conferred by sub-section (i) of Section 17 of the Industrial Disputes Act, 1947 (Central Act No. 14 of 1947) read with Government of India, Ministry of Labour & Employment's Notification No. S-11025/21/2003-IR(PL) dated 28.7.2004, the undersigned hereby publish the following award bearing reference No. 11/2025 dated 12.05.2026 delivered by the Presiding Officer, Industrial Tribunal-cum-Labour Court, UT Chandigarh between:
SAKIL / SHAKIL ANSARI S/O SH. HUSAIN ANSARI, AGED 49 YEARS, R/O # 2599/ C, RAMDARBAR, PHASE – 2, CHANDIGARH. (WORKMAN)

M/S B.M. PHARMACEUTICALS THROUGH ITS PROPRIETOR / OCCUPIER & MANAGER, PLOT NO. 47-48, INDUSTRIAL AREA, PHASE – II, CHANDIGARH. (MANAGEMENT)
AWARD
1. Workman Sakil / Shakil Ansari has presented the Industrial Dispute in hand under Section 2A(2) of the Industrial Disputes Act, 1947 (here-in-after in short called 'ID Act').
2. Case of the workman in nutshell is that the workman was appointed by the management as Chowkidar / Guard w.e.f. 01.11.1996. His last drawn wages were Rs.15,300/- per month. Since his joining the workman had continuously worked with the management up to 03.12.2005 and thereafter his services were transferred to M/s Scoot Edil, Plot No.56, JharMajra, Baddi, District Solan, H.P., where he worked till 30.11.2017. On 01.12.2017 he was again directed to work at M/s B. M. Pharmaceuticals at Chandigarh (management). He was covered under ESI scheme in the year 2011. The management was entirely satisfied with his work & conduct. On 29.09.2023, the management issued letter whereby his services were terminated w.e.f. 28.10.2023. The management had neither issued any memo or charge sheet nor conducted any inquiry before terminating his services. The management had also neither paid or offered notice pay in lieu of notice nor paid compensation to him. Job of the workman still exists with the 1462 CHD. ADMN GAZ. AUG. 25, 2026 (BHDR. 03, 1948 SAKA) management and juniors to him were retained in service by the management. The management has violated provisions of Section 25F, 25G & 25H of the ID Act. Prayer was made for reinstatement of the workman with continuity of service and full back wages along with interest @ 15% per annum and all other consequential benefits.

The management contested the claim of the workman by filing written statement raising preliminary objections inter alia on the ground that no cause of action accrued to the workman against the answering management as the services of the workman were terminated with one month's advance notice. It is stated that the workman joined the management as Security Guard on 01.12.2017. The workman was an obstructionist employee as he was working in sync with the requirement of the job. The workman despite receiving multiple oral and written warnings did not mend his work conduct. The answering management had issued a notice dated 29.09.2023 to the workman for termination of service. All the benefits, as per his entitlement, had been disbursed to the workman and the same were duly received by him.
The management had not violated the principles of natural justice as well as provisions of the ID Act. Prayer was made for dismissal of the claim of the workman.
4. The workman filed rejoinder to the written statement wherein he reiterated the contents of claim statement and opposed the averments made by in written statement.
5. From the pleadings of the parties, following issues were framed vide order dated20.08.2025 :-
1. Whether the services of the workman were terminated illegally by the management, if so, to what effect and to what relief he is entitled to ?OPW
2. Whether the present claim statement is not maintainable ? OPM
3. Relief.
6. Thereafter, both the parties were called upon to lead their respective evidence.
7. Despite availing several opportunities, the workman did not lead any evidence. Today i.e. on 12.05.2026 neither the workman nor anyone on his behalf has appeared before the Court.
8. I have gone through the case file. In the case in hand, as per claim of the workman, he was aggrieved that his services were terminated illegally by the management. However, as per record, the workman has failed to lead any evidence and none has appeared on behalf of the workman before the Court to pursue his case. It seems that the workman is not interested in perusing the matter. Accordingly, the industrial dispute in hand stands declined for want of prosecution. Appropriate Government be informed accordingly. File be consigned to records after due compliance.
