No. F 5-3112017118. - In exercise of the powers conferred by clause (c) of sub-section (l) of Section 427 of the Chhattisgarh Municipal Corporation Act, 1956 (No. 23 of 1956), the Municipal Corporation of Raipur, hereby, makes the following byelaws for management and regulation of Municipal fund and gratuity, namely:-
BYELAWS
l. Short title and commencement. - (1) These Byelaws may be called the Municipal Cotporation Raipur (Payment of Gratuity) Byelaws, 2018.

2. Definitions .- (l) In these byelaws, unless the context otherwise requires ,-
(a) "Act" means the Chhattisgarh Municipal Corporation Act, 1956 (1t{o. 23 of 1956); (b) "Corporation" means the Chhattisgarh Municipal Corporation, Raipur and its successors m mterest;
(c) "Employee" means an employee or an officer of Municipal Corporation, Raipur in terms of clause 3;
(d) "Government" means the Government of Chhattisgarh; (e) "Gratuity Law" means the Payment of Gratuity Act, 1972 (Central Act No. 39 of 1972), as amended fiom time to time and the rules fiamed under it and instmctions issued by the Government under such rules.
{2) Words and expressions used herein but not defined shall have the sarne meaning as assigned to them in the Chhattisgarh Municipal Corporation Act, 1956 (No.23 of 1956) or the Payment of Gratuity Act,7972 (Central Act No.39 of 1972).
Byelaws to apply only on certain Employees. - The provisions contained in these byelaws shall apply only on such employees who -
(a) were in service as regular employees of the Corporation on the flrst day of November, 2004, and;
(b) are not covered by the Chhattisgarh New Pension Rules, 195 I as amended from time to time and/or Chhattisgarh Services (Gratuity, Pension and Retirement) Rules, 1956.

Payment of Gratuity. - (1) All employees covered under clause 3 shall be eligible to receive gratuity. (2) The amount of gratuity, terms of payment and manner of payment shall be governed by the Payment of Gratuity Act:
Provided that all employees eligible to receive gratuity according to clause 3 shall be covered under these byelaws even ifthey have retired or have expired.
5.
Gratuity Fund.- (l) The Corporation shall provide an estimate every year, for the liability of payment falling during the coming financial year arising on account of these byelaws. (2) The amount as estimated in sub-clause (l) above shall be included in the annual budget estimates of the Corporation as a separate sub-head under Salary and Allowances.
(3) In any year, if the actual liability of gratuity exceeds the estimate in the budget, the Corporation shall make alternate arrangements for its payment and shall not keep the payment pending till the next financial year.
