NOTIFICATION

No. F ¹-⁵/²⁰¹⁴/¹⁸. - In exercise of the powers conferred by sub-section (²) of Section ¹⁴ of the Chhattisgarh Municipal Corporation Act, 1956 (No 23 of 1956) and sub-section (2) of Section 32 of the Chhattisgarh Municipalities Act, 1961 (No 37 of 196l) and in consultation with the State Election Commission, the State Government, hereby, makes following amendments in the Chhattisgarh Nagarpalika Nirvachan Niyam, 1994, namely :-

AMENDMENT

In the said rules.-

l. After Rule 3, the following shall be inserted, namely:-

*3-A. Breach of official duties in relation to preparation of electoral rolls, etc.-

(1) If any Registration Officer/Assistant Registration offrcer or ary person deployed to perform any official duty in relation to revision or rectification ofany entry, which is to be included or excluded in or fiom electoral roll, without reasonable cause, is guilty of any act or omission in breach of such official duty which he is bound to discharge ulder the provisions of these rules, he shall be pwrishable with imprisonment for a term which shall not be less than three months but which may extend to 2 yeats with fme.

(2) No court shall take cognizance under sub-rule (1), unless a complaint in writing is filed by the State Election Commission or Collector and District Election Officer of the concerned district himself or by any other omcer not below the rank of Deputy Collector authorized by him.

3-8. Making false declarations. If any person makes,-

(a) in connection with the preparation, revision or correction ofan electoral roll; or (b) in relation to inclusion or exclusion of any entry in or from an electoral roll, a statement or declaration in writing, which is false and which he either knows or believes to be false or does not believe to be true, he shall be punishable with imprisonment for a term which may extend to one year, or with fine or with both."

2. In Rule 5, after sub-rule (2), the following shall be inserted, namely :-

\2-A) Registration officer shall authorize an employee to receive claim or objection on draft electoral roll. This employee shall be authorized with reference to wards.,'

3. For Rule 25-A, the following shall be slrbstituted, namely:-

"25-A. Affidavit to be filled along with nomination paper.- (l) Under the provisions of sub-rule (l) ofrule ²⁵, every candidate [and concerned mayor/president in case ofrecall fiom his post], who is submitting his nomination for election of Mayor or Councilor of Municipal Corporation or President or Councilor of Municipal Council or President or Councilor of Nagar Panchayat before the retuming officer shall, necessarily enclose an affidavit swom before Magistrate offirst class or notary in Form 3-A.

(2) Every candidate shall declare information relating to,-

(i) Whether he is convicted./ discharged/acquitted in any criminal case in the

past or he is accused in any pending criminal case? Ifso, the details thereof;

(iD The assets (immovable, movable, bank balances etc) of a candidate and of his/her spouse and that of dependants, which he and his.&er spouse and dependent childrcn are jointly or separately owns or is beneficiary;

(iiD Liabilities, ifany, towards any public financial institution; (iu) Dues, ifany, towards the Central Govemment or State Government;

(v) The educational qualifications ofthe candidate;

in an affidavit, in such format and in such manner, as may be prescribed by the State Election Commission, while filling his nomination paper before Retuming Offtcer.

(3) Ifaffidavit is not enclosed then nomination paper shall be rejected.

(4) The Retuming Officer, after fumishing of information to him under sub-rule (2), as soon as possible, shall disseminate the information so received by affrxing a copy of affidavit at a conspicuous place in his office lor the purpose of information to electoral of the concemed ward for which the nomination has been filed and shall make available the information so received on demand by any candidate/electoral, and shall also disseminate publically said information through media. .

(5) Ifany candidate/electoral files any affidavit contrary to ary information contained in the aflidavit filed by any candidate under sub-rule (2), then it shall also be disseminated in a manner prescribed in under sub-rule (4).

(6) Returning Offrcer shall not conduct any inquiry in relation to the Information given in the affidavit."

4. In Rule 26, for sub-rule (l), the following shall be substituted, namely :-

'(l) No candidate shall be deemed to be duly nominated for election unless he has deposited or caused to be deposited in cash, either before or at the time of presentation of his nomination paper before the retuming officer under Rule 25, the following amount, namely :-

(a) for the seat of"Councilor", -

(D ofNagar Panchayat, a sum ofRupees 1000/-; (ii) ofMunicipal Council, a sum ofRupees 3000/-; (iii) of Municipal Corporalion, a sum of Rupees 5000/-;

(b) for the seat ofPresident ofNagax Panchayat, a sum ofRupees 10,000/-; (c) for the seat of President ofMunicipal Council, a sum of Rupees 15,000/-; (d) for the seat ofMayor ofMunicipal corporation, a sum ofRupees 20,000i-:

Provided that where a candidate is a woman or a member of Scheduled Castes or Scheduled Tribes or Other Backward Classes, he/she shall be required to deposit only halfofthe above prescribed amount under this rule."

ln Rule 28, in sub-rule (8), after the words "the Retuming Officer", the punctuation and words ",according to the categories specified in sub-rule (2) ofRule 30," shall be inserted.

6.

In Rule 30.-

(a) in sub-rule (l), after the words 'the Retuming Officer", the punctuation and words ",according to the categories specified in Form- 10," shall be inserted; and

(b) for sub-rule (2) and (3), the following shall be substituted, namely :-

"(2) For the purpose of listing ofnames under sub-rule (l), candidates shall be classified into following categories, namely:-

(D candidates ofrecognized political parties (National or State Party); (ii) candidate of registered political parties, other than the candidates mentioned

in clause (1);

(iii) othercandidates.

(3) Categories mentioned in sub-rule (2) shall be in prescribed marner and names of candidates in every category shall be in alphabetical order and the addresses and other specifications ofthe candidates as given in the nomination paper shall also be in order."

(b) after sub-rule (3), the following shall be added, namely :-

'(4) The alphabetical order referred in sub-rule (1), shall be determined with reference to the name and/or surname ofthe candidates in such mamer as may be prescribed by the State Election Commission."

7. In Rule 31, in sub-rule (1), after clause (d), the following shall be added, namely:-

"(e) Candidates of un-recognized political parties shall be allotted symbols of their choice from prescribed non-allotted symbols;

{{^{{FOOTNOTE (0}}}} Symbols shall be allotted in the following mamer, namely :-

firstly, reserved symbol to the candidates ofrecognized National Political Parties;

secondly, reserved symbol to the candidates ofrecognized State Political Parties;

thirdly, symbol of their choice from non-allotted s),mbols to the candidates of un-recognized registered parties and

fourthly, symbol oftheir choice from non-allotted symbols to independent candidates:

Provided that preference shall be given to the candidates of m-recognized political parties over independent candidates in allotment ofsl,rnbols;

(e) if any political party which is recognized as State Party in any other State sets-up their candidate in the State of Chhattisgarh, then such candidate may be allotted the symbol reserved for that political party in that State, in which it is recognized State Party, notwithstanding that such symbol is prescribed in the list of free s),rnbols of the State of Chhattisgarh, on fulfillment of each ofthe following conditions, namely:-

O that the candidate has made a declaxation ofthis intention in his nomination paper; (iD distdct unit ofthe concerned political party has by an Authorized Office Bearer has given a written notice in Form 8 under sub-rule (2) of Rqle 3 l, which should have been received by the retuming officer by 3:00 pm on the last day for withdrawal of candidature;

(iii) such Office Bearer should be authorized by tlre state urit of that political party in Form 9 under sub-rule (2) of Rule 3l and his specimen signature should have been received by the retuning oflicer by 3:00 pm on the last day for withdrawal of candidatue :

Provided that, ifnotice of such intention that, a candidate has been set-up by political party, by Authorized Office Bearer of that political party, has not been received in stipulated time, then, the candidate shall be considered as independent candidate.

(iv) No message or photocopy of any letter received by fax in relation to above shall either be accepted for certification or satisfaction nor it shall be admissible as evidence."

In Rule 63-B,-

(a) in sub-rule (l), after the words "ballot unit", the words and parenthesis ..and every ballot paper (label)" shall be inserted; and

(b) in clause (a) of sub-rule (4), for the words "name and symbol,,, the words ,,name, photo and slrnbol " shall be substituted.

9. After Rule 74, the following shall be inserted, namely :

"74-4. Power of District Election Officer to correct clerical or mathematical errors:-

(l) At any time but not after 7 days from declaration of result under Rule 39 ot 74, the District Election Officer may, either on suo moto or on a report of Returning Officer, amend by an order, any clerical or mathematical error or mistake in Form 2l A, Result of counting, Form- 224 Final result sheet, Form 23, Form 23 A, Declaration cum retum of election, as the case may be:

Provided that, no such correction or amendment shall be made unless a notice of date, time and place for making such amendment is given to all the candidates contesting election in the ward or constituency in question.

Q) Order passed by District Election Officer under sub-rule (1) shall be in writing and shall contain the reasons for passing such order and District Election Officer shall send duly amended signed and certified copy of Form 23 or Form 23 A as the case may be, to the Returning Oflicer to grant certificate of election to the cardidate declared elected as the result of such election.

(3) Nothing contained in sub-rule (l) shall confer any power or authority on District Election Officer to direct the opening of envelope, containing counted ballot papers, or to direct recor.mting of votes by Detachable Memory Module (DMM) or by Control Unit.

(4) If Returning Officer has issued any candidate, a certificate ofelection in Form 24 under Rule 75 before an order under sub-rule (1) is passed by District Election Officer, such certiflcate of election shall be deemed to have been iecalled and shall be considered to be rejected." 10.
