NOTIFICATION

No.Fl5-69/2016/15-1.- Inexerciseofthepowersconferredbysub-section(5)ofSection50-Breadwith Section 95 ofthe Chhattisgarh Co-operative SocietiesAct, 1960 (¹.{o. XVII of 1961), the State Government, hereby, makes the following rules relating to recruitment and conditions of the Class-IV Services of State Co-operative Election Commission, namely :-

RUIES

1. Short title and commencement. - (l) These rules may be called the State Co-operative Election Commission (Class-IV) Service Recruitment Rules, 2018.

@ These rules shall come into force from the date of its publication in the OfficialGazelte.

2. Application. - These rules shall apply to the posts as specified in column (2) of the Schedule as appended to these rules.

3. Definitions. - In these rules, unless the context otherwise requires,-

(a) "Appointing Authority" in respect of services means the Appointing Authority as mentioned in column (13) ofthe Schedule;

O) "Government" means the Government of Chhattisgarh; (c) "Governor" means the Govemor of Chhattisgarh; (d) "Other Backward Classes" means the Other Backward Classes of citizens as specif,red by the State Government videNotificationNo. F-8-5-XXV-4-84,dated26th December, 1984, as amended fromtime to time;

(e) "Schedule" means the Schedule appended to these rules; (D "scheduled Castes" means the Scheduled Castes as specified in relation to this State under Article 34i ofthe Constitution of India;

(g) "Scheduled Tribes" means the Scheduled Tribes as specified in relation to this State underArticle 342 of the constitution of india;

(h) "Service" means the State Co-operative Election Commission (Class-IV) Services; (1) "State" means the State of Chhattisgarh.

4. Classification and scale of pay, etc. - The classification of the service, the number of posts included in the service and the scale of pay attached thereto, the method of recruitment to the posts, age limit, qualifications andotherconditionsofservicerelatingtothepostsshallbeas specified in the Schedule appended to these rules :

Provided that the Government may, from time to time, add to or reduce the number of posts and pay scale included in the service, either on a permanent or temporary basis.

5" Method of recruitment. - Recruitmentto the service, afterthe commencement ofthese rules, the posts shall be filied by direct recruitment, through competitive examination or selection on the basis of merit;

6. Reservation.-(l) Reservationforthepostsofdirectrecruitmentshall be made in accordance with the provisions of the Chhattisgarh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Aur Anya Pichhade VargaonKeLiyeArakshan)Adhiniyam,1994(No.2lof 1994)andinstructionsissuedfromtimetotimeunder the saidAct by the General Administration Department of the Government shall apply.

@ Reservation in promotion for the candidates of Scheduled Castes and Scheduled Tribes shall be made in accordance with the provisions of the Chhattisgarh Public Services (Promotion) Rules, 2003.

(3) Reservation for women candidates shall be made in accordance with the provisions ofthe Chhattisgarh Civil Service (Special Provision forAppoinfrnent ofWomen) Rules, 1997.

⁷. Relaxation. - Nothing in these rules shall be construed to limit or abridge the power ofthe Governor to deal with thecaseofanyperson,towhomtheserulesapplyinsuch manner, as may appear to him to be just and proper:

Provided that the case shall not be dealt with in any manner less favourable to him than that provided in these rules.

8.

Saving. - Nothing in these rules shall affect the reservation and other conditions required to be provided for Scheduled Castes, Scheduled Tribes and Other Backward Classes, for Ex-servicemen, Compassionate appointment to one member ofthe family of the Govemment employees who dies during service period, persons with disability and other persons belonging to other categories and shall be regulated in accordance with the rules made or orders issued by the State Government, from time to time, in this regard.

9.

Repeal. - All rules, corresponding to these rules and in force immediately before the commencement of these rules are hereby repealed in respect of matters covered by these rules :

Provided that any order made or any action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules.
