No.1825/Fl-2l2}l8l13lllED.- Whereas, the Chhattisgarh State Electricity Regulatory Commission consisting of two members including Chairperson was constituted vide this department's Notification No. 4321P.-352103, Raipur dated I ltti May, 2004 under Section 82 of the Electricity Act, 2003 Qrlo. ³⁶ of ²⁰⁰³);

And Whereas, as per the directions given in para I 14 of the Hon'ble Supreme Court of India in Civil Appeal Nos. 14697, 13451 of 2015 State of Gujarat and Others Vs. Utility Users' Welfare Association and Others, it is mandatory that there should be a person of law as a member of the said Commission;

Now Therefore, in compliance of the said direction dated l2th April,2018 of the Hon'ble Supreme Court of India and in exercise of the powers conferred by Section 82 of the said Act, the State Government, hereby, reconstitutes the said Chhattisgarh State Electricity Regulatory Commission as a three member Commission including Chairperson, amongst whom one member shall be a person of law, who is, or has been holding a judicial office or is a person possessing professional qualifications with substantial experience in the practice of law, who has the requisite qualifications to have been appointed as a Judge of High Court or a District Judge.

This notification shall come into force from the date of its publication in the Official Gazette"
