NOTIFICATION

No. R-⁷³³/^{35 12016}/^3511093. - In exercise of the powers conferred by sub-section (l ) of Section ⁵ of the Chhattisgarh Educational Institutions (Reservation in Admission) Act, 2012 (No.9 of 2012), the State Governm'ent, hereby, makes the following rules relating to the reservation in admission to the seats of State quota in under graduate, post-graduate, Ph.D. and other courses conducted by the colleges affitiated to the Chhattisgarh Karndhenu Vishwayidyalaya, namely :-

RULES

l. Short title and commencement.- (l) These rules may be called the Chhattisgarh Kamdhenu Vishwavidyalaya, (Reservation in Admission) Rules, 20 I 8.

(2) It shatl come into force from the date of its publication in the Official Gazette.

3. Definitions.- In these rules, unless the context otherwise requires,-

(a) "Agency" means an agency authorized by the Government of the Chhattisgarh or by the Central Government to conduct the entrance examination;

(b) "Bonafide Resident" means any applicant, who is aresident of the State of Chhattisgarh, as defined under circular, notification or orders issued by the Government of Chhattisgarh, from time to time;

(c) "Category" means Scheduled Castes, Scheduled Tribes, Other Backward Classes (non- cremyJayer) and unreserved Category;

(d) "Class" means women or persons with disabilities;

(e) "College" means the colleges affiliated to the Chhattisgarh Kamdhenu Vishwavidyalaya;

(D "Council" means the Veterinary Council of India, New Delhi; Indian Council of Agricultural Research (ICAR) New Delhi and Academic, Administrative, Executive Council of, the University;

(g) "Courset' means a Graduation, Post-Graduation, Ph.D., Degree and Diploma Courses;

(h) "Director" means the Director, Veterinary Services, Covernment of Chhattisgarh;

(i) "Directorate" means the Directorate of Veterinary Services, Government of Chhattisgarh;

{{^{{FOOTNOTE 0)}}}} "Entrance Examination":- means the National Eligibility Entrance Test (NEET) and PET for Under Graduate and Common Entrance Test (CET) for Post Graduate and Ph.D:

(k) "Final Admission Process" means process for admission of candidates to the seats left vacant after the final phase of counselling, on or before the last date of admission as specified by the Hon'ble Supreme Court, at the place of allotment;

. (l) "In-Service candidate, means staff in service under the Veterinary Services Department of the State Government on regular basis, who have completed five years of Government service as on l " January of the admission year;

' (m) "Minority College or Institution" means a college or institution run by person or group of persons declared religious or linguistic minority under clause (l) of Article 30 of the Constitution of India and are recognized under the Acts and Rules notified by the Government of Chhauisgarh;

(n) "No-CIass" means a candidate who does not fall under ahy class defined in clause (d) of rule 2;

(o) "Persons with disability" means persons with disability as defined under clause (s) of Section 2 of the Rights of Persons with Disabilities Act,2016 (No. 49 of 2016) and who, according to the norms prescribed by the Veterinary Council of India, New Delhi and the Indian Council of Agricultural Research New Delhi/ State Govemment, are eligible for admission in Graduate, Post graduate, Ph.D or Diploma courses;

(p) "State Government" means the Government of Chhattisgarh;

(q) " U nivtirsity ",means the Chhattisgarh Kamdhenu Vishwavidyalaya, Durg;

"Vice Chancellor" means the Vice Chancellor of the Universitv.

4. Reservation of seats.- Reservations on the seats in the colleges shall be given in the following manner:-

(l) Vertical reservation of 32Yo, 12Yo and l4o/o shall be given to the Scheduled Tribes, Scheduled Castes and Other Backward Classes (Non-creamy-layer) children of bonafide residence of the State of Chhattisgarh respectively.

Candidates claiming eligibility in Scheduled Tribes or Scheduled Castes or Other Backward Classes (Non- creamy layer) category will have to furnish permanent Caste Certificate issued by the Competent Authority, as prescribed in the rules or instructions issued by the General Administration Department of the Government, from time to time. lt shall be mandatory to submit the caste verification certificate in the prescribed format before the counselling. (a) 5 percent horizontal reservation shall be provided for children ofpermanent farmers.

(b) 5 seats shall be reserved in fisheries colleges for children of permanent fishermen, whose livelihood is based completely on fisheries i.e. catching, selling and breeding offishes, etc.

Explanation- Benefits of Reservation to candidates of this Category, shall be given only to those, who have passed any two examinations from the Primary (Class 5th), Secondary (Class VIII), Matriculation/High School (Class X) and Higher Secondary (Class Xll) from schools in rural area as a regular student. This rule shall be equally applicable for the students who have passed examination as private student.

(c) Freedom fighter: 3%o Horizontal reservation shall be available for Children and grandchildren of freedom fighter.

(d) Defence personnel (ln-service and retired): 3Yo Horizontal reservation shall be available for Children ofDefence personnel (ln-service and retired).

(e) Women: 30o/ohorizontal reservation shall be available for Bonafide Resident women under all categories.

(0 Persons with Disabilities:3%o Horizontal reservation shall be available for Bonafide Resident persons with disabilities under all categories.

One seat shall be reserved for the displaced and are residing in the the Faculty of Veterinary, Dairy and (g) Displaced category of Jammu and Kashmir: children of Jammu and Kashmir, who are Chhattisgarh from on or before 01.01.2016, in Fishery in the under graduate course.

(h) Admission to the ln-service candidates of Directorate of Veterinary Department: - Admission shall be provided to In-service candidates of Directorate of Veterinary Services, Chhattisgarh in the under graduate courses ofVeterinary faculty on basis of merit list of NEET (UG) in the specified seats under Admission rules.

(i) Admission to the In-service candidates of Directorate of Fishery Depaltment, Chhattisgarh: - Admission shall be provided to In-service candidates of Directorate of Fishery Department, Chhattisgarh in the undergraduate courses of fishery faculty on basis of merit list of NEET (UG) in the specified seats under admission rules.

(j) Admission by Veterinary Council of India, New Delhi and Indian Council of Agricultural Research, New Delhi:-

(i) Admission shall be provided on the reconmendation of Veterinary Council of India, New Delhi in 15%o seats of total approved seats for B. V. Sc. and A.H. course;

(ii) ¹⁵%o seats shall be filled on recommendation of the Indian Council of Agricultural Research, New Delhi frorn total number of seats for B.F.Sc. Course;

(iii) l57o seats shall be filled on the recommendation of Indian Council of Agricultural Research, New Delhi from total number of seat for B.Tech Course.

Explanation-At the time of calculation of percentage under reserved seats, if the numerical digit is 0.5 or greater then it shall be considered as one and if less than 0.5, then it shall be considered zero. These rules shall be applicable only while determining the number of seats and it shall not be applicable while calculation of the minimum percentage.

(4) Rules related to relaxation for age to reserved candidate ofstate shall be applicable as per instructions issued from time to time by General Administration Department of State Government.
