(E),- Whereas by the notification of the Government of lndia in the Ministry of Coal, number S.O. 2002(E), dated the 20h July, 2015 issued under sub- section (1) of section 7 of the Coal Bea.ring Areas (Accuisition and Development) A,ct, 1957 QA of 1957) (hereinafter referred to as the said Act) and published in the Gazette of lndia,'Part Il, Section 3, Sub-section (ii), dated the 20th July, 2015, the Central Government gave notice of its intention to acquire 1050.593 heciares (approximately) or 2596.02 acres (approximately) land as all rights in orover such lands specified inthe Schedule appencied to ihat noiificaiion

And whereas, the competent authority in pursuance of section 8 of the said Act has made his report to the Central Government;

And whereas, the Central Government after considering ihe aforesaid report and after consulting ihe Government of Chhattisgarh, is satisfied that the lands measuring 1050.593 hectares (approximately) or 2596.A2 acres (approximately) with all rights in or over such l.ands aB desdribed in Schedule appended heieto, should 6e acquired;

Nowtherefore, in exercise of the powers conferred by sub- section (1)olsection I of the said Act, the Centr:dl Government hereby declares that the land measuring 1.050.593 hectares (approximately) or 2596.02 acres (approximately) with all rights in or over such lands as described in Schedule appended hereto are hereby acquired.

NOTIFICATION

S.O. .-Whereas on the publication of the notification of the

Government of lndia in the Ministry of Coal, number S.O, 2420(E), daled the 1Srh June, 2018, published in the Gazette of lndia, Part ll, Section 3, Sub-section (ii) dated the 14th June, 2018, issued under sub-section (1) of section I of the Coal Bearing Areas (Acquisition and Development) Act, 1957 {20 of 1957) (hereinafter referred to as the said Act), the land and all rights in or over the lands described in the Schedule appended to the said notification (hereinafter referred to as the said land) vesied absolutely in the Central Governmeni free from all encumbrances under sub-section (1) of section 10 of the said Act:

And whereas the Central Government is satisfied that the Rajasthan Rajya Vidyut Utpadan Nigam Limited, a Government of Rajasthan Undertaking (hereinafter referred to as "the Government Company" ) is willing to comply with such terms and conditions as the Central Government ihinks fit to impose in this behalf;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 1 1. of the said Act, the Central Government hereby directs that all rights in or pverthe said land so vested shall, with effect from the 14th June, 2018 instead of continuing to vest in the Central Government, be deemed to have been vested in the said Government Company, subject to the following terms and condiiions namely:-

(1) the. Government Company shall make all payments in respect of t compensation, interest, -damages, etc. and the .like, as determined

under the provisions of the said Act and other releva'nt law;

(2) a Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining the amount payable by the Government ' Company under condition (1) and allexpenditure incurred in connection

with any such Tribunal and persons appointed to assist the Tribunal - shall be borne by the said Government Company and similarly, all expenditure incurred in respect of all legal proceedings like appeals, etc., for or in connection with the rights, in or over the said land, so vested, s.hall also be borne by the Government Company; l

(3) the Governmeni Company shall indemnify the Central Governrnent, its officials against any other expenditure that may be necessary in connection with any proceedings by or againsi the Central Government or its otficials regarding the aforesaid rights in the said land so vested:

(4) the Government Company shall have no power to transfer the aforesaid rights in the said land so vested, to any other person without the prior approval of the Central Government; and
