CHAPTER-1

PRELIMINARY

1- Short title and commencement.-(1) These rules may be called the Chhattisgarh KrishiUpajMandi (Establishment of Private Market Yard/Private Sub-Market Yard/Private Farmer Consumer Yard) Rules, 2OlB. (21 It shall come into force on such date as the State Government may appoint by notification .in the Official Gazette"

Definitions.- In these rules, unless the context otherwise requires- (a) "Accounts Officer" means Accounts Officer of the Chhattisgarh State Agricultural Marketing Board;

(b) "Additional Director"means Additional Director of the Chhattisgarh State Agricultural Marketing Board;

(c) "Adhiniyam" means the Chhattisgarh KrishiUpajMandi Adhiniyam,lg72 (No.24 of r973);

(d) "Agricuitural Produce" means all produce of agriculture, horticulture, animal , husbandry, apiculture, pisciculture or forest as speci{ied in Schedule of the Adhiniyam;

(e) "Board" means the Chhattisgarh State Agricultural Marketing Board;

(f) "Bye-laws" means the bye-1aws made under Section 80; (g) "Collector" means District Collector;

(h) "Divisional OfIice" means office established by the Board in Revenue Divisions;

(i) "Farmer Producer Organization" means an organization which is built up by the share hoiderconsisting of farmer producers for the purpose of agricultural activities and is a body corporate/company registered under the Companies Act, 2013 (No. 1B of 2013), and is engaged in trading related activities of the transaction of primary produce and works foi the benefit of the farrner producer and part of its benefit be divided among the farmer producers and remaining amount be invested in its share capital or reserve fund;

|j) "Financial Year" means the period from ¹st April to ³¹st March; (k) "Joint Director" means Joint l)irector of the Chhattisgarh State Agricultural Marketing Board;

(1) "Managing Director" means the Managing Director of the Chhattisgarh State Agriculture Marketing Board appointed under the Adhiniyamand he sha11 also be the Commissioner,Mandi, Chhattisgarh ;

(m) "Manufacture" means conversion of original look, size, shape and the properties of the agricultural produce into other product having new and different look, shape and t-.he properties or mixture/combination thereof for the commercial purpose;

(n) "Manufacturer" means a person who manufactures from an agriculture produce by manual or mechanical means;

"Market Area"means the area for which a market is established under Section4;

(p)

"Market Committee" means a committee constituted under Section 11;

(q)

"Market" means a market established under Section 4;

(r)

"Market yard or special produce market yard or sub-market yard or farmer consumer sub-market yard" in relation to a market area means a specified place declared to be a market yard or special produce market yard or sub-market yard or farmer consumer sub-market yard under clause (a) of sub-section (2) of Section 5;

(s)

"Notified Agricultural Produce" in relation to a market means all such produce specified in the Schedule of the Adhiniyam;

(t)

"Private market yardf private sub-market yard/private farmer consumer yard" means such place other than the yards notified by the State Government in the market area, where infrastructure has been developed by a personf organization f farrrrer producer organization for marketing of notified agricultural produce holding a registration/license for this purpose under the Adhiniyam;

(u)

"Processing" means powdering, crushing, decorticating, husking, parboiling, ginning, pressing, curing or any other treatment to which an agricultural produce or its product is subjected to before final consumption;

(v)

"Processor" means a person who processes agricultural produce by manual or mechanical means;

(w)

"Registered Person/ Organization" means a person/ organization, who is registered in Mandi Board for establishment of private market yard/private sub-market yard/private farmer consumer yard;

(x)

"Secretary" means the Secretary of a Market Committee.

(v)

"Section" means the Section of the Adhiniyam;

"State Government" means the Government of Chhattisgarh.

CHAPIER-II

trST,+,BLISHMENT OF PRIVATE MARKET YARD / PRIVATE SUB MARKET YARD / PRIVATE FARMER CONSUMER YARD

3. Application for grant of registration.= (1) Every person/organizationlFarmer producer organization who desires to establish a private market yard or Private sub-market yard or private farmer consumer yard in one or more than one market area, shall apply for grant of a registration or renewal thereof, in the prescribed FORM 'A' to the Board, along with the documents prescribed in that Form, with the registration fee as mentioned in sub-rule (4), after fulfilling the following conditions:- (a) (il For establishment of private market yard at district head quarters withrn the limits of municipal body, there should be with the applicant a minimum of 10 acres of land with clear title or leasehold having the lease agreement for a minimum period of thirty years with undisputed possession,

(ii) For establishment of private market yard at places other than those covered under sub-rule (a)(i) of rule 3, or for establishment of private sub- market yard at any place, there should be with the applicant a minimurn of 5 acres of land with clear title or leasehold having the lease agreement for a minimum period of thirty years with undisputed possession.

(b) For establishment of private farmer consumer yard, there should be with the applicant a minimum of 1 acre of land with clear title or leasehold having the lease agreement for a minimum period of thirty years withundisp uted possession.

4. Registration fee.- (1) Registration fee for establishing a private market yard/private sub- market yard at district head quarters within limits of municipal body shall be rupees fifty thousand, and for establishing a private market yardlprivate sub-market yard for all other places shal1 be tr,venty five thousand only.

(2) Registration fee for establishing a farmer-consumer yard shall be rupees ten thousand only.

5. Bank guarantee.- (1) While applying for registration to establish a private market yard/private sub market yard at district head quarters within the limits of municipal body, a bank guarantee worth rupees fifty lacs shall be deposited with the Managing Director and while applying for a registration to establish a private market yard/private sub-market yard at all other places a bank guarantee worth rupees twenty five lacs shall be deposited with the Managing Director. However any Government organisation or local authority shal1 be exempted from this sub-rule.

(2) While applying for registration to establish a private farmer consumer yard, a bank guarantee worth rupees ten lacs sha11 be deposited with the Managing Director. However any Government organisation or loca1 authority shall be exempted from this sub-rule.

6. Examination and veri{ication of application and documents.-The Managing Director shall, upon deposition of the necessary registration fee, get all the documents submitted by the applicant along with the application examined and verified as per requirements.

7. Issuance or refusal of permission for project.-In case of a new project, the Managing Director shall within 30 days from the date of submission of application,-

issue a letter of permission for the project specifying the period for completion which shall not be more than two years.

refuse to issue permission letter for the reasons to be recorded in writing and communicated to the applicant, however no letter of refusal under this rule shall be issued unless a reasonable opportunity of being heard is given to the applicant:

Provided that the amount of registration fee paid by the applicant shall be refunded if the registration is not granted for any reason after deducting fifty percent of the fees towards processing expenses.

B. Establishment of necessary infrastructure by applicant.- (1) For establishment of private market yard at district head quarters within the limits of municipal body, the applicant r,yill have to establish necessary infrastructure like boundary wall, exit and entry gate, light, drainage, auction hall, auction sheds, godowns, cold storages, electrical weigh bridges, internal roads, drinking water, parking and toilets etc., with a minimum investment of rupees five crores only excluding the cost of land"

(2) For establishment of private market yard at places other than those covered under sub-rule (a)(i) of rule 3, or for establishment of private sub-market yard at any place, the applicant will have to establish necessary infrastructure like boundary wall, exit and entry gate, light, drainage, auction hall, auction sheds, godowns, cold storages, electrical weigh bridges, internal roads, drinking water, parking and toilets etc., with a minimum investment of rupees five crores only excluding the cost of land.

(3) For e3tablishment of private farmer consumer market yard, the applicant will have to establish necessary infrastructure like sales platform/shops, sheds, drinking water facilities, toilets, internal roads, electricity, drainage etc., with a minimum investment rupees fifty lacs only excluding the cost of land.

9, Time period and extension of project.-In case of new projects, the applicant shal1 complete the project within the period specified in such permission letter and if the applicant is unable to complete the project within the specified period, he may apply to the Managing Director for an extension explaining the reasons for seeking extension of the period. The Managing Director after inspection of the project may consider and grant extension of time which shall not exceed one.year

10. Inspection, enquiry ancl grant of registration.-In case of new projects, after completion of the project and for existing projects at the time of applic?tion, the applicant shall give intimation to the Managing Director. The Managing Director after inspection and enquiry if found suitable may subject to the provisions of Section 32-B of the Adhiniyam, grant registration in Form C' for establishment of a private market yardl private sub-market yard/private farmer consumer yard subject to the conditions specified therein.

¹¹. Application for renewal.-The registration holder of private market yard/private sub- market yardlprivate farmer consumer yard may sutrmit application for rener,val of registration in Form 'B' to the Board. The Managing Director after making such enquiries as deemed fit, may renew the registration of the private market yardlprivate sub-market yard /private former consumer yard for marketing of notified agricultural produce: Provided that every application for renewal of registration shal1 be made at least one month before the expiry of its period. If the application for renewal of registration is in accordance with the provisions of the Adhiniyam and Rules, the registration shall be deemed valid until otherwise orders are passed on such application. Issuance or refusal of grant of registration.-The Managing Director, after giving the applicant an opportunity of being heard, for the reasons to be recorded in writing, may refuse to grant or refuse to rener,v the registration to the applicant who is either insolvent or otherwise disqualified under the Adhiniyam and Rules.

Period of registration.-A registration granted under sub-rule (10) shall remain in force until the expiry of tenth financial year from the grant of registration including the year in which it was granted.

t4. Collection of market fee"-The registered holder of Private market yard/Private sub-market yard sha1l collect the market fee from, the buyers as per the provisions of the Adhiniyam and shall pay 25oh of the market fee to the Chhattisgarh State Agriculture marketing Board.

Collection of service charges"- As per sub-section (B) of Section 19 of the Chhattisgarh KrishiUpajMandiAdhiniyarn 1972 (No. 24 of 19731 registered holder of private farmer consumer yard shall collect service charges/user charges from the sellers at such rate as may be specified in bye-laws of concerned Agricultural Produce Market Committee. Limit on sell in private farmer consumer yard"-The seller farmer in the private farmer consumer yard shall not be permitted to sell more than ten Kilograms of fruits and vegetables or other perishable agricultural produce and fifty Kilograms of food grains or other non-perishable agricultural produce to one consumer in a day.

2. This registration is not transferable. 3. This registration may be suspended or cancelled in accordance with the provisions of the said Adhiniyam and the rules made thereunder and if the register holder commits any act or abstains from carrying out his normal business in the market/yard with the intention of willfully obstructing, suspending or stopping the marketing of agricuitural produce in the market area, the registration may be suspended or cancelled.

4. In the event of suspension or cancellation of this registration, it shall be surrendered to the Board.

5" The registration holder shall not adulterate or cause any notified agricultural produce to be adulterated.

6. The registration holder shall help and comply with the directions issued by the Gbvernment of the Chhattisgarh/Managing Director/Joint Director/Secreta4z of concern Agricultural Produce Market Committee in preventing evasion of market fees. ⁷ . The registration holder after grant of registration by the Board shall within a period of fifteen days inform about the authorized representative of the registration holder who shall be responsible on his behalf.

8. The registration holder shall maintain books, registers and records in respect of the agricultural produce in the manner, required by the Managing Director or any person authorized by him"

10. The registration holder shall, if notified agricultural produce is sold through his agency or by him, pay to the seller the price of the agricultural produce so sold on the same day by cash or cheque as the case may be.

¹ 1. The registration holder shall not solicit or receive any fees or recover any charges other than those which he is entitled to receive or recover in accordance with the provisions of the Adhiniyam and the mles.

\2. The registration holder shall not make or recover any trade allowance other than those prescribed.

13. The registration holder shall provide for authorized weights and measures. 14. The registration holder shall pay to the measurer and hamals, etc., at the rates approved by the Managing Director.

15. The registration holder shall inform the Managing Director any change in the constitution of the registration holder.

77. The registration holder shall not invoive in any misconduct or illegal stocking of notified agricultural produce for a long period with an intention to create artificial scarcity which leads to price rise.

18. In case the registration issued is defaced, misplaced, torn, lost or accidentally destroyed, etc., a duplicate registration on payment of Rs"100/- may be issued" 19. The registration granted under this certificate unless renewed remains in force till the end of tenth year including the year in which it has been granted.
