NOTIFICATION

No. F ⁰l-²³l³llest.l²⁰l⁴. - In exercise of the powers conferred by the proviso to Article ³⁰⁹ of the Constitution of India, the Governor of Chhattisgarh, hereby, makes the following rules relating to the recruitment and conditions of Service of the Chhattisgarh Water Resources Departmint (Class-IV) Services, namely:-

RULES

1. Short title and Commencement :- (l) These rules may be called the Chhattisgarh Water Resources Department (Class-IV) Service Recruitment Rules, 2018.

(2) These rules shall come into force from the date of its publication in the OfficialGazette.

2. Application.- These rules shall apply to the posts specified in column (2) of the Schedule as appinded to these rules.

3. Definitions : - In these rules, unless the context otherwise requires, -

a. "Appointing Authority" in respect of the service means the Appoint Authority as mentioned in column (13) of the Schedule;

b. "Government" means the Government of Chhattisgarh;

c. "Governor" means the Governor of Chhattisgarh;

d. "Other Backward Class" means Other Backward Classes of citizens has specified by the State Govemment vide Notification No. F-8-5-XXV-4-84, dated 26th December,l984, as amended from time to time;

e. "Schedule" means the Schedule appended to these rules;

f. "Scheduled Castes" means the scheduled castes as specified in relation to this State under Articles 341 of the Constitution of India.

C. "Scheduled Tribes" means the Scheduled Tribes as specified in relation to this State under Articles - ³⁴² of the Constitution of India.

h. "Service" means the Chhattisgarh Water Resources (Class-VI) Service;

i. " State" means the State of Chhattisgarh;

4. Classification and Scale of pay, etc :- The classification of the service, the number of posts included and the service and the scales of pay attached thereto the method of recruitment to the posts, age limit, qualifications and other conditios of service relating to the posts shall be as specified in the Sihedule appinded to these rules :

Provided that the Government may, from time to time, add to or reduce the number of posts and pay scale included in the Service, either on a permanent or temporary basis.

5. Method of Recruitment - Recruitment to the Service, after the commencement of these rules, shall be made by the following methods, namely :-

(a) by direct recruitment, through competitive examination or selection on the basis of merit;

(b) by promotion of members of the service as specified in colunm (2) of Schedule.

6. Reservation:-- (l) Reservation for the posts of direct recruitment shall be made in accoudance with the provisions of the Chhattisgarh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Aur Anya Pichhade Vargaon Ke Liye Arakshan) Adhiniyam, 1994 (No.21 of 1994) and instructions issued from time under the said Act by the General Administration Department of the Government shall apply.

(2) Reservation in promotion for the candidates of Scheduled Castes and Scheduled Tribes shall be made in accordance with the provisions of the Chhattisgarh Public Services (Promotion) Rules,2003.

(3) Reservation for women candidates shall be made in acordance with the provisions of the Chhhattisgarh Civil Service (Special Provision for Appointment of Women) Rules, 1997.

7.

Relaxation - Nothing in these Rules shall be construed to limit or abridge the power of the Governor to deal with the case of any person, to whom these rules apply in such manner, as may appeax to him to bejust and proper :

Provided that the case shall not be dealt with in any manner less favorable to him than that provided in these rules.

8.

Saving - Nothing in these Rules shall affect the reservation and other conditions required to be provided for Scheduled Caste, Scheduled Tribe and Other Backward Classes, for Ex-servicemen, Compassionate appointment to one member of the family of the Government employees who dies during service period, persons with disability and other persons belonging to other categories and shall be regulated in accordance with rules made or orders issued by the State Government, from to time in this regard.

9. Repeal:- All rules, corresponding to these rules and in force immediately before the commencement of these rules are hereby repealed in respect of matters covered by these rules :

Provided that any order made or any action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules.
