NOTIFICATION
Nq. F 7-712004112. - In exercise of the powers conferred by Section 15 of the Mines and Minerals (Development and Regulation) Act ,1957 (No. 67 of 1957), the State Government, hereby, makes the following further amendment in the Chhattisgarh Minor Mineral Ordinary Sand (Quarrying and Trade) Rules, 2019, namely:-
AMENDMENT
In the said Rules-
1. In rule 2, in sub-rule (l), in clause (c), the following shall be substituted, namely;-
"(c) "Preferred Bidder" "means the bidder specified in clause (iii) of sub-rule (4) of rule 6." 2. In rule 3, in sub-rule (5), the following shall be substituted, namely :-
'(5) ln scheduled area's, the provision of the Panchayats (extension of the scheduled areas) Act, 1996 (No. 40 of 1996) shall be followed."
3. In rule 5, after sub-rule (2), the following shall be inserted, namely :-
"(3) After the declaration of Preferred Bidder, Bid securities of all other bidders except the preferred bidder, shall be returned. The bid security deposited by the preferred bidder shall be returned on submission of the performance security."
4. In rule 6, in sub-rule (1), in clause (a), the following shall be substituted, namely :-
'
'(a) the bidder shall be a person who is domicile of Chhattisgarh, or a company/firm/society/ cooperative society duly registered under the relevant act/rules and otherwise satisfr all the conditions specified in these rules.
provided that, if the bidder is a company/firm/society/cooperative society, minimum three- fourth ofthe shareholding ofsuch company/firm/ society/cooperative society, shall be possessed by the holder, who are domicile of Chhattisgarh".
5. In rule 9, in sub-rule (1), in clause (h), for the words "Qualified Person", the words "Recognized Qualified Person" shall be substituted.
6. In rule 9, in sub-rule (1), in clause (s), for the words "fifth day", the words "tenth day" shall be substituted.
