THE ELECTION EXPENDITURE (MAINTENANCE AND LODGING OF ACCOUNT) ORDER,20I9

No. F-68-1/Three(Two/N.P/E.E.M.L.A.1201912105-A.- Whereas the superintendence, direction and control of all elections to Municipalities in the State of Chhatttisgarh are vested in the State Election Commission by the Constitution of India;

And, Whereas, section l4-A of the Chhattisgarh Municipal Corporation Act, 1956 (No.23 of 1956) [The Chhattisgarh Municipal Corporation (Amendment) Ordinance (No. 2 of 2019)) and section 32-A of the Chhattisgarh Municipalities Act, 196l (No. 37 ot 196l) [The Chhattisgarh Municipalities (Amendment) Ordinance (No. 3 of 2019)l cast an obligation on every candidate at an election of Councillor of a Municipal Corporation or Municipal Council or Nagar Panchayat, as the case may be, to keer a separate and correct account ofall expenditure in connection with the election incurred or authorized by him or by his election agent with such particulars as may be prescribed by the State Election Commission;

And, Whereas, section l4-B of the Chhattisgarh Municipal Corporation Act, 1956 (No.23 of 1956) [The Chhattisgarh Municipal Corporation (Amendment) Ordinance (No. 2 of 2019)) and section 32-B of the Chhattisgarh Municipalities Act, 196l (No. 37 of ¹⁹⁶¹) [The Chhattisgarh Municipalities (Amendment) Ordinance (No. 3 of 2019)] cast another obligation on very contesting candidate at an election of Councillor of a Municipal Corporation or Minicipal Council or Nagar Panchayat, as the case may be, to lodge within 30(thirty) days from the date of election, with the officer notified by the State Election Commission of his election expenditure;

And, Whereas, the State Election Commission is deeply aware of the pernicious role of money power in elections and deems it necessary and expedient to curb it, interalia, by ensuring that the account ofelection expenditure to be lodged by a candidate is, as far as possible, comprehensive and reflective of the actual expenditure;

Now, Therefore, in exercise of its powers conferred by Article 243-ZA of the Constitution of India read with section l4-A of the Chhattisgarh Municipal Corporation Act, 1956 (No.23 of 1956) and section 32-A of the Chhattisgarh Municipalities Act, 196l (No. 37 of 1961) and all other powers enabling it in this behalf, in order to make the provisions of the constitution of India and the said acts more effective, the State Election Commission, In supersession of the Election Expenditure (Maintenance and Lodging Accout) Order 2019 (No. F-68-1/Three(Two)N.P./E.8.M.L.A.12019/750 dated l2th June, 2019) issued earlier the Chhattisgarh Municipal Corporation (Amendment) Ordinance (No. 2 of 2019) and the Chhattisgarh Municipalities (Amendment) Ordinance (No. 3 of 2019) hereby makes the following order :-

1. Short title, extent, application and commencement - (l) This order may be called the Election Expenditure (Maintenance and Lodging of Account) order, 2019.

(2) It extends to the whole of Chhattisgarh State. (3) It shall come into force on the date of publication in the Chhattisgarh Gazette.

2. Definations and interpretation- In this order, unless the context otherwise requires, -

(a) 'Act'means the Chhattisgarh Municipal Corporation Act, 1956 (No.23 of 1956) or the Chhattisgarh Minicipalities Act, l96l (NO. 37 of l96l), as the case may be ;

(b) Notification means the Chhauisgarh Municipal Corporation (Amended) Act (No. 2 of 2019) and the Chhattisgarh Municipalities (Amended) Act (No.3 of 2019)

(c) 'Candidate'means a person who has been duly nominated as a candidate at an election to the office of Councillor of a Municipal Corporation or Municipal Council or Nagar Panchayat;

(d) 'Sub-paragraph'means a sub-paragraph of the paragraph in which the word occurs ; (e) 'Paragraph'means a paragraph of this order ; (0 'Election' means an election to the office of Councillor of a Municipal Corporation or Municipal Council or Nagar Panchayat;

(g) 'Contesting candidate' means a person who has been duly nominated as a candidate at an election to the office of Councillor of a Municipal Corporation or Municipal Council or Nagar Panchayat and who has not withdrawn his candidature within the period specified in the election rules ;

effierrd{Mq{, frri*:r arq*t 2ore ut0 (el (h) 'Election expense' means any expenditure incurred or authorized by a candidate or his election agent in connection with an election during the period between the dates on which he has been nominated and the date on which result thereof has been declared (both days inclusive) ;

(D Election Expenditure Comptroller means Election Expenditure Comptroller appointed by District Election Officer for this purpose.

'Proforma' means a'Proforma' appended to this Order ;

C) The words and expressions used, which have both been defined in this Order shall carry the meaning assigned to them in the Chhattisgarh Municipal Corporation Act, 1956 (No. 23 of 1956) or the Chhattisgarh Municipalities Act, 196l (NO. 37 of 196l) or the Chhattisgarh Nagarpalika Nirvachan Niyam, 1994, as the case may be.

3. Particularsofaccountofelectionexpenditure-

3.1 The account ofelection expenditure to be kept by a candidate or his election agent under the Act shall contain the following particulars in respect of each item of expenditure, namely :-

Proforma-A :- Register of day to day account of election expenditure I. Head of Proforma- Name of Candidate, address, name of Municipal Corporatin/I\4unicipal Council/Nagar Panchayat and ward No., Details of Bank Account,etc.

II. Column- (1) date on which the receipVexpenditure was incurred received or authorized ; (2) Name of Candidate/Political Party/Association/Organisation and any other sources from whom the amount received

(3) Nature of receipt (head)

(iD Receipt No. (iii) Amount in Rs. (4) Nature of expenditure (item) -

(i) pattem of expenditure (For example vehicle, printing, meal etc.) ; (ii) quanttty; (iii) per unit rate (iv) Totol Expenditure ;

(5) Detail amount of the expenditure (In Rupees) -

(i) Name of the person whom the amount paid ; (iD Voucher/Receipt No. and date; (iii) Paid Amount, (iv) Balance Amount; (6) Details of the amount outstanding -

(i) name and address of person to whom the amount outstanding is payable ; (iD date and serial number of bill of amount;

(7) remarks, if any.

3.2 A voucher shall be obtained for every item of expenditure unless from the nature of the case, such as postage, travel by rail and the like, it is not practicable to obtain a voucher.

3.3 Compulsorily a bank account shall be open on a day before from date of filing of nomination paper. All election related expenditure shall be made from this account. Likewise all receip related to election shall be deposited in this account.

4. Maintenance of day to day account of election expenditure- (l) the account of election expenditure shall be maintained by a candidate or his election agent from day to day, in a register in Proforma-A, which shall be supplied to him by the Returning Officer immediately after his nomination.

(2) The particulars of every item of receip (income) and expenditure shall be entered in the register referred to in sub-paragraph (l), from day to day in the same chronological order in which the

income/ expenditure is incurred or authorised and the vouchers or bills relating to the expediture shall be maintained along with the register.

Production ofthe record ofday to day accout ofelection expenditure for inspection- (l) The register of day to day account of election expenditure together with the supporting vouchers and bills shall be produced for inspection (at any time) during the process ofelection by the candidate or his election agent, on demand of Comptroller of election expenditure and also by the Returning Officer, the District Election Officer or an Observer appointed by the Election Commisssion or Officer related to election in this behalf, forthwith and failure to do so shall be deemed to be a major default on the part of the candidate to comply with this order.

(2) Inspection of Register for election expenditure (Proforma-A) for Municipal Corporation/Tvlunicipal Council,Nagar Panchayat election shall be done by election expenditure Comptroller. Register for expenditure of candidate shall compulsorily be inspected twice on date decided by expenditure Comptroller between the date of candidature withdrawal and the date of poll. Apart from above if the expenditure Comptroller consider necessary during the election process, Comptroller may direct to produce the account of expenditure more than twice and accordingly the candidate shall have to produce account of expenditure. Candidate shall also have to produce account of expenditure as directed by District Election Officer/Returning Officer/Observer appointed by the Commission.

Abstract statement of election expenditure- Soon after declaration of the result of election every contesting candidate or his election agent shall prepare an abstract statement ofelection expenditure in part- I information related to candidate, in part-2 abstract of election expenditure of candidate, in part-3 abstract of sources of amount of expenditure made by candidate of Proforma B, clearly showing the total expenditure on various items listed therein.

Lodging of the account of election expenditure- (1) Every contesting candidate or his election agent shall lodge the account of election expenditure with the District Election Officer, within the time specified in the Act, that is, thirty days fiom the date of election.

(2) The account of election expenditure shall comprise the following documents, namely:-

(a) the register ofday to day account ofelection expenditure referred to in paragraph 4 in original,

(b) vouchers related to the entries made in the register Proforma-A, Proforma-A-1, Proforma-A-2 of election expenditure, and

(c) abstract statement ofelection expenditure, referred to in paragraph 6.

(3) The register of day to day account of election expenditure and the abstract statement of election expenditure shall be authenticated and countersigned by the candidate in case they have been prepared and signed by his election agent and the vouchers shall also be countersigned by him, before being lodged.

(4) The account of election expenditure shall be accompanied by an affidavit of the candidate in proforma-C and shall not be regarded as complete without such an affidavit.

Notice by District Election Officer for inspection of account- The District Election Officer shall, within two days from the date on which the account of election expenditure has been loged by a candidate under Paragraph ⁷ cause a notice to be affixed to his notice board, specifring -

(a) Name of Municipal Council- (b) Name of Ward and S.No. (c) Name of the candidate, (d) Date of the lodging of Account (e) Prescribed Time and Place for the inspection of account.

Inspection of account and the obtaining of copies thereof- Any person shall, on payment of a fee of fifty rupees be entitled to inspect any such account and on payment of such fee as may be fixed according to Revenue Records in this behall be entitled to obtain attested copies of such account or any part thereof.

10. Report by the District Election Officer as to the lodging of the account of election expenditure and the decision of Election Commission thereon- (l) As soon as may be afterthe expiration of the time, specified in the Act, for lodging of the account of election expenditure the District Election

(a) The name of the contesting candidate with full postal address; (b) Whether such candidate has lodge his account of election expenditure and if so, the date on which such account has been lodge; and

(c) Whether in his opinion such account has been lodged within the time and in the manner required by the Act and this Order.

(2) Where the District Election Officer is of the opinion that the account of election expenditure of any contesting candidate has not been lodged in the manner required by the Act and his Order, he shall with every such report forword to the Election Commission.

(3) Immediately after the submission of the report referred to in sub-paragraph (l) the District Election Officer shall publish a copy thereof by affixing the same to his notice board.

(4) As soon as may be after the receipt of the report referred to in sub-paragraph (l) the Election Commission shall consider the same and decide whether any contesting candidate has failed to lodge the account of election expenditure within the time and in the manner required by and Act and this Order.

(5) Whether the Election Commission decides that a contesting candidate has failed to lodge his account of election expenditure within the time and in the manner required by and Act and this Order, it shall by notice in writing call upon the candidate to show cause why he should not be disqualified under section l4-C of the Chhattisgarh Municipal Corporation Act, 1956 (No.23 of 1956) or section 32-C of the Chhattisgarh Municipalities Act, l96l (No. 37 of 1961), as the case may be, for the failure.

(6) Any contesting candidate who has been called upon to show cause under sub-paragraph (5), may within fifteen days of the receipt of such notice submit in respect of the matter a representation in writing to the Election Commission and shall at the same time send to the District Election Officer a copy of his representation.

(7) The District Election Officer, within five days of the receive thereof, forward to the Election Commission the copy of the representation with such comments as he wishes to make thereon.

ll. Power of Election Commission to issue instruction and directions- The Election Commission may issue appropriate instructions or directions -

(a) for the clarification of any provision of this Order ;

(b) for the removal of any difficulty which may arise in relation to the implementation of any such provision; and
