NOTIFICATION

No. F 6-42-2012-12.- In exercise of the powers conferred by Section 15 of the Mines and Minerals (Regulation and Development) Act, 1957 (No.67 of 1957), the State Government, hereby, makes the following fruther amendment in the Chhattisgarh Minor Mineral Rules, 2015, namely:-

AMENDMENT

In the said rules,-

l.Inrule2,-.

(i) in clause (x), words "and includes any contractor, sub-lessee and agent, ' whether appointed or not, who is acting or purporting to act on behalf of the lessee and is taking part in the management, supervision, extraction and dispatch of mineral" shall be omitted; and

(ii) in clause (ab), after the words "Oonstruction of road", the words"and withdrawal of water from mine pits, improvement work of benches of mine and installation of plant and machinery" shall be inserted.

2. In rule 3, clause (vi) shall be omitted. 3. In rule 10, in sub-rule (4),-

(a) after the word "forest land" the word "and non forest land" shall be inserted; (b) the word "and six months for non forest land" shall be omitted; (c) in the proviso, the word "of six months" shall be omitted; and (d) in the proviso, after the word "sufficient reason" the word "and an application with rupees one thousand fee in the prescribed head before the lapse of this period" shall be inserted.

"(4) After selection of preferred bidder, the amount deposited as bid security for e- auction/e-tender process by remaining bidders except preferred bidder shall be returned and after issuance of letter of intent, the amount deposited as bid security by preferred bidder may also be returned"

In rule 23-A,insub-rule (1), after clause (c), the following shall be added, namely:- "(d) Notwithstanding in sub-rule (¹)(a)(b)(c), in case of private land, composite license/quarry lease may be granted by levying premium money from the applicant at the rate prescribed by the Government, except Specified Minerals of Part-A of Schedule-I."

In rule 31,- (a) in sub-rule (2), n serial number (i), in place of the words "Rupees Five Thousand" the words "Rupees Ten Thousand" shall be substituted;

(b) In sub-rule (2), in serial number (ii), in place of the words "Rupees Ten Thousand" the words "Rupees Twenty Thousand" shall be substituted;

(c) for sub-rule (3), the following shall be substituted, namely:-

"(3) The application fee shall be deposited in the Government

Treasury under the revenue receipt head- 0835 Non-ferrous Mining and Metallurgical Industry (800) Other receipts (0229) Miscellaneous

and the original treasury receipt Challan shall be attached with the application."

7. In rule 38-A,-

(a) In sub-rule (4), in the proviso, for the words "within the period of two years from the", the words and figures'till the 3lst December,2O2O from the date of'shall be substituted;

(b) After sub-rule (7), the following shall be added, namely;-

"(8) Such quarry leases, even after the expiry of 30 years from the date of sanction, ii mineral is available in the leasehold area, the sanctioning authority on the condition of payment of premium money as fixed by the govemment, may further extend the lease for a maximum period of five years for only once with predetermined terms and conditions of the lease:

Provided that within six months from date of publication of these rules, the application shall be submitted by depositing prescribed fees of twenty thousand rupees (non-refundable) to the government treasury in ' prescribed revenue head in sub-rule 3 of the rule 31."

Inrule 42,-

(a) in sub-rule (1), for the punctuation full stop ".", the punctuation colon ":" shall be substiuted.

(b) after sub-rule (l), the following shall be inserted, namely;-

"Provided that the applications received under rule 23(d), the sanctioning authority after submission of performance security may issue letter of intent or order in the name of applicant"

(c) in sub-rule (5), after the words "forest land" the words "and non-forest land" shall be inserted;

(d) in sub-rule (5), the words "and six months for non-forest land" shall be omitted; (e) in sub-rule (5), in the proviso, the words "of six month" shall be omitted; (f) in sub-rule (5), in the proviso, after the words "sufficient reason" the words "and an application with rupees one thousand fee in prescribed head before the lapse of this period" shall be inserted; and

(g) After sub-rule (5), the following shall be added, namely:-

"(6) After selection of preferred bidder, the amount deposited as bid security for e-tender process by remaining bidders except preferred bidders shall be returned and after issuance of letter of intent, the amount deposited as bid security by preferred bidder may also be returned"

In rule 51,-

(a) in sub-rule (l), in clause (b), after the words "whichever is higher", the words "till the 2oth day of the month of January" shall be inserted;

(b) in sub-rule (l), in clause (bb), after the words "auction/tender", the symbol and words "/application" and for the words "pay the auction money" the words "/premium money" shall be inserted, respectively;

(c) in sub-rule (1), after clause (bb), the following shall be added;

"(bba) For taking auction money/premium money based on the Wholesale Price Index shall be determined as follows:-

(Clarification:- For e-auction/tender in government land, the NIT issue year shall be considered base year and for private land, the year of application received shall be considered as the base year.)"

(d) in sub-rule (19), forthe figures, words and symbol "30th June/3I December" the figures, words and symbol "31 September/3O April" shall be substituted;

(e) in sub-rule (26), for the words "ten thousand" the words "twent5/ thousand" shall be substituted;

(O in sub-rule (27), for the word "five thousand" the word "ten thousand" shall be substituted; and

(g) after sub-rule (28), the following shall be added, namely;-

"(29) In case of continuing contravention of any terms and conditions of this . rule, the sanctioning authority with reasons to be recorded in writing, may order temporary closure of all the mining operations in the lease . area."

10. In rule 56, after sub-rule (3), the following shall be added, namely:-

"(4) Where an applicant or lessee dies at any slage from the submission of application, the further proceeding shall be made in the name of the legal heir on submission of successor certificate issued by competent authority."

In Rule 58,-

ll.

(a) in sub-rule (l), in clause (iii), for the words "rupees one hundred", the words "rupees five thousand" shall be substituted; and

(b) after sub-rule (4), the following shall be added, namely:-

12. In rule 60, in the proviso, for the words "collected by the departmental officer", the word, "in the laboratory established within leasehold area by the lessee as per the

standards prescribed by the Bureau of Indian standards for analysis of samples" shall be substituted.

13. For rule 71, tlre following shall be substituted, namely;-

"71. Penalty for unauthorised extraction and transportation.- Any offence committed in contravention of provisions of these rules shall be considered an offence under the provisions of Section 21 to 23-B of the Mines and Mineral (Development and Regulation) Act, 1957 (No.67 of 1957) and shall be punishable as per the provistions made thereunder."

14. Afterrule 7l,the following shall be added, namely:-

"71-A. Royalty Clearance.- The concerned works department should deduct, the amount equivalent to the market value of minor minerals used in construction work done through contractors in Government/semi- government works department, from the bills of contractors. Contractors may be obtain Royalty Clearance Certificate through Collector concerned, by submitting an application to mining office along with valid transit passes of the mineral used, after which amount deducted by the works department may be returned and final bills settled to contractors:

Provided that the contractors fail to submit valid transit passes of the minor minerals used, agtion shall be taken under Section 2l to 23-B of the Mines and Minerals (Development and Regulation) Act, 1957 (No. 67 of 1957)." 15. In rule 76, sub-rule (3) shall be omitted.
