NOTIFICATION
No. F 1-26/ 2020 /17 / 1 - In exercise of the powers conferred under Section 2 , 3 and 4 of the Epidemic Disease Act , 1897 ( No. 3 of 1897) and the enabling clause 12 ( ix) of the Chhattisgarh Epidemic Disease , COVID - 19 Regulations , 2020 , the State Government, in order to address the management of Covid - 19 patients in terms of oxygen supply and increasing demand of medical oxygen , the " Oxygen Production Units " located in the State of Chhattisgarh are hereby directed that -
1. They should ensure that production of oxygen is uninterrupted and as per their maximum production capacity .
2. 80% of the production to be used only for medical oxygen and to be supplied to the hospitals in Chhattisgarh .
3. Production units can divert only up to 20 % of the oxygen generated for industrial use .
4. Priority shall be given , to the hospitals over industries . In case , need increases for medical oxygen gas , in such situation the allocated 20 % of the oxygen gas for the industries may also be used for the treatment of Covid - 19 patients .
Whereas the Lack of medical oxygen may affect the management of critically ill patients and also May adversely affect the final outcome of the Covid- 19 patients . Therefore , for the proper implementation of above provisions , the Competent Authority shall be Controller , Food and Drug Administration , Government of Chhattisgarh at the State level . At district level , the Collector shall be the Competent Authority .
The industry/factory whoever violates the above instruction shall be prosecuted under clause 14 of the Chhattisgarh Epidemic Disease , COVID- 19 Regulations , 2020 .
This notification shall come in to effect immediately and could remain in operation till 31st December , 2020 .
