अधिसूचना
क्रमांक एफ 13-03/2014/20-3. ⸺ छत्तीसगढ़ अशासकीय विद्यालय फीस विनियमन अधिनियम, 2020 (क्र. 16 सन् 2020) की धारा 15 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुये, राज्य सरकार, एतद्द्वारा, अशासकीय विद्यालयों के फीस के विनियमन के लिये निम्नलिखित नियम बनाती है, अर्थात् :-
नियम
1. संक्षिप्त नाम तथा प्रारंभ.- (1) ये नियम छत्तीसगढ़ अशासकीय विद्यालय फीस विनियमन नियम, 2020 कहलायेंगे।
(2) ये नियम राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. परिभाषायें.- (1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) ''अधिनियम'' से अभिप्रेत है छत्तीसगढ़ अशासकीय विद्यालय फीस विनियमन अधिनियम, 2020 (क्र. 16 सन् 2020);
(ख) ''प्ररूप'' से अभिप्रेत है इन नियमों द्वारा विहित प्ररूप;
(ग) ''अशासकीय विद्यालय प्रबंधन समिति'' से अभिप्रेत है अशासकीय विद्यालय के प्रबंधन (संचालन) हेतु पंजी—त समिति (सोसाइटी)।
(2) शब्द एवं अभिव्यक्तियाँ, जो इसमें प्रयुक्त हैं, किन्तु परिभाषित नहीं है, के वही अर्थ होंगे, जो अधिनियम में क्रमशः उनके लिये समनुदेशित है।
3. अधिनियम में उपबंधित विभिन्न समितियों में सदस्यों का नामांकन.- (1) छत्तीसगढ़ शासन स्कूल शिक्षा विभाग के कोई अधिकारी, जो व्याख्याता की श्रेणी से निम्न का न हो, को अधिनियम की धारा 3 के खण्ड (ख) के अंतर्गत नोडल अधिकारी के रूप में कलेक्टर द्वारा नामांकित किया जायेगा, किन्तु कलेक्टर, कारणों को लेखबद्ध करते हुए, छत्तीसगढ़ शासन के किसी अन्य अधिकारी को अधिनियम की धारा 3 के खण्ड (ख) के अंतर्गत नोडल अधिकारी के रूप में नामांकित कर सकेगा। (2) अधिनियम की धारा 3 के खण्ड (ख) के अंतर्गत नामांकित नोडल अधिकारी से प्रस्ताव प्राप्त करने के आधार पर, कलेक्टर, अधिनियम की धारा 3 के खण्ड (ग) के अंतर्गत अभिभावकों को सामान्य रूप से नामांकित करेगा, किन्तु कलेक्टर, कारणों को लेखबद्ध करते हुए, नोडल अधिकारी के प्रस्ताव को अस्वीकार कर सकेगा तथा किसी अन्य अभिभावक को नामांकित कर सकेगा।
(3) अधिनियम की धारा 3 के खण्ड (घ) के अंतर्गत अभिभावकों को, अशासकीय विद्यालय के प्राचार्य द्वारा स्वविवेक से नामांकित किया जायेगा।
(4) कलेक्टर, अधिनियम की धारा 4 के खण्ड (ख) के अंतर्गत जिला कोषालय अधिकारी को सामान्य रूप से नामांकित करेगा, किन्तु कलेक्टर, कारणों को लेखबद्ध करते हुए, किसी अन्य शासकीय लेखाधिकारी को अधिनियम की धारा 4 के खण्ड (ख) के अंतर्गत नामांकित कर सकेगा।
(5) कलेक्टर, अधिनियम की धारा 4 के खण्ड (ग) के अंतर्गत नामांकन के लिये जिला शिक्षा अधिकारी से परामर्श करेगा और जिला शिक्षा अधिकारी द्वारा सुझाए गए व्यक्ति को अधिनियम की धारा 4 के खण्ड (ग) के अधीन प्रख्यात शिक्षाविद् के रूप में सामान्य रूप से नामांकित करेगा, किन्तु कलेक्टर, कारणों को लेखबद्ध करते हुए, किसी अन्य व्यक्ति को अधिनियम की धारा 4 के खण्ड (ग) के अंतर्गत प्रख्यात शिक्षाविद् के रूप में नामांकित कर सकेगा।
(6) कलेक्टर, अधिनियम की धारा 4 के खण्ड (घ) के अंतर्गत नामांकन के लिये शासकीय अधिवक्ता से परामर्श करेगा और शासकीय अधिवक्ता द्वारा सुझाए गए व्यक्ति को अधिनियम की धारा 4 के खण्ड (घ) के अंतर्गत प्रख्यात कानूनविद् के रूप में सामान्य रूप से नामांकित करेगा, किन्तु कलेक्टर, कारणों को लेखबद्ध करते हुए, किसी अन्य व्यक्ति को अधिनियम की धारा 4 के खण्ड (घ) के अंतर्गत प्रख्यात कानूनविद् के रूप में नामांकित कर सकेगा।
(7) कलेक्टर, अधिनियम की धारा 4 के खण्ड (ङ) एवं (च) के अंतर्गत नामांकन के लिये जिला शिक्षा अधिकारी से परामर्श करेगा और जिला शिक्षा अधिकारी द्वारा सुझाए गए व्यक्तियों को अधिनियम की धारा 4 के खण्ड (ङ) एवं (च) के अधीन सामान्य रूप से नामांकित करेगा, किन्तु कलेक्टर, कारणों को लेखबद्ध करते हुए, किन्हीं अन्य व्यक्तियों को अधिनियम की धारा 4 के खण्ड (ङ) एवं (च) के अंतर्गत नामांकित कर सकेगा। (8) समिति में किन्हीं सदस्यों का नामांकन नही होने की स्थिति में भी, समितियां, अपना कार्य कर सकेगी और समितियों द्वारा की गई किसी कार्यवाही को, समिति में सदस्यों के नामांकन नहीं होने के कारण, अवैध नहीं माना जायेगा।
4. अधिनियम में उपबंधित विभिन्न समितियों के नामांकित सदस्यों का हटाया जाना.- यदि कलेक्टर को इस बात का समाधान हो जाता है कि किसी समिति के नामांकित सदस्य का, उस समिति के नामांकित सदस्य के रूप में कार्य करना उचित नहीं है, तो कलेक्टर, ऐसे नामांकित सदस्य को हटाने का आदेश दे सकेगा। 5. शुल्क का निर्धारण.- (1) शुल्क निर्धारण का प्रस्ताव प्ररूप-1 में होगा।
(2) यदि किसी अशासकीय विद्यालय के द्वारा प्रथम बार फीस निर्धारण का प्रस्ताव विद्यालय फीस समिति के समक्ष अधिनियम के प्रावधानों में विहित समय-सीमा के भीतर प्रस्तुत नहीं किया जाता है, तो विद्यालय फीस समिति में कलेक्टर द्वारा नामांकित नोडल अधिकारी, ऐसे अशासकीय विद्यालय के प्रबंधन को 1 सप्ताह के भीतर प्रथम बार फीस निर्धारण का प्रस्ताव विद्यालय फीस समिति के समक्ष प्रस्तुत करने का लिखित निर्देश दे सकेगा और यदि अशासकीय विद्यालय प्रबंधन, प्रथम बार फीस निर्धारण का प्रस्ताव 1 सप्ताह के भीतर विद्यालय फीस समिति के समक्ष प्रस्तुत नहीं करता है, तो विद्यालय फीस समिति, ऐसे अशासकीय विद्यालय प्रबंधन से बिना प्रस्ताव प्राप्त हुए ही, ऐसे अशासकीय विद्यालय के लिये प्रथम बार फीस निर्धारण कर सकेगी और यदि 1 सप्ताह की समय-सीमा समाप्त होने के पश्चात् भी, विद्यालय फीस समिति का अध्यक्ष, फीस निर्धारण के लिए विद्यालय फीस समिति की बैठक नहीं बुलाता है, तो विद्यालय फीस समिति में कलेक्टर द्वारा नामांकित नोडल अधिकारी, फीस निर्धारण करने के लिये विद्यालय फीस समिति की बैठक बुला सकेगा और नोडल अधिकारी द्वारा इस प्रकार बुलाई गई बैठक में, यदि विद्यालय फीस समिति का अध्यक्ष अनुपस्थित रहता है, तो ऐसी बैठक की अध्यक्षता, नोडल अधिकारी द्वारा की जाएगी।
6. अशासकीय विद्यालयों द्वारा संधारित किए जाने वाले अभिलेख.-
(1) शुल्क पंजी;
(2) शिक्षकों एवं कर्मचारियों का वेतन संदाय पंजी; (3) अशासकीय विद्यालय में सामग्री की स्टॉक पंजी;
(4) व्यय पंजी, व्हाऊचर, कैशबुक;
(5) सीए से कराए गए वार्षिक ऑडिट की रिपोर्ट;
(6) प्रवेश रजिस्टर;
(7) छात्र उपस्थिति रजिस्टर;
(8) शिक्षक एवं कर्मचारियों की उपस्थिति का रजिस्टर;
(9) भवन किराया रजिस्टर; (10) छत्तीसगढ़ शासन स्कू्ल शिक्षा विभाग द्वारा समय-समय पर दिए गए निर्देशों के अनुसार अन्य अभिलेख।

NOTIFICATION
F-No.13-03/2014/20-3. ⸺ In exercise of the powers conferred by Section 15 of the Chhattisgarh Non- Government Schools Fees Regulation Act, 2020 (No.16 of 2020), the State Government, hereby, makes the following rules for regulating fees of the Non-Government Schools, namely : -
RULES
1. Short title and commencement.- (1) These rules shall be called the Chhattisgarh Non-Government Schools Fees Regulation Rules, 2020.
(2) These rules shall come into force from the date of its publication in the Official Gazette.
2. Definitions.- (1) In these rules, unless the context otherwise requires,–
(a) "Act" means the Chhattisgarh Non-Government Schools Fees Regulation Act, 2020 (No.16 of 2020);
(b) "Form" means form prescribed by these rules;
(c) "Non-Government School Management Society" means the society registered for the Management of Non-Government School.
(2) Words and expressions used herein but not defined, shall have the same meaning, as respectively assigned to them in the Act
3. Nomination of members in different committees provided in the Act.- (1) An officer of the School Education Department, Government of Chhattisgarh, not below the rank of a lecturer shall be nominated by the collector as nodal officer under clause (b) of Section 3 of the Act, but the collector may nominate any other officer of Government of Chhattisgarh as nodal officer under clause (b) of Section 3 of the Act for reasons to be recorded in writing.
(2) Collector shall ordinarily nominate guardians under clause (c) of Section 3 of the Act on the basis of the proposal received from nodal officer nominated under clause (b) of Section 3 of the Act, but Collector may reject the proposal of the nodal officer and nominate any other guardian for reasons to be recorded in writing.
(3) Guardians under clause (d) of Section 3 of the Act, shall be nominated by the Principal of the Non-Government School as per his discretion.
(4) Collector shall ordinarily nominate District Treasury Officer under clause (b) of Section 4 of the Act, but Collector may nominate any other Government Accounts Officer under clause (b) of Section 4 of the Act for reasons to be recorded in writing.
(5) Collector shall consult the District Education Officer for nomination under clause (c) of Section 4 of the Act and shall ordinarily nominate the person suggested by the District Education Officer as Eminent Educationist under clause (c) of Section 4 of the Act but Collector may nominate any other person as Eminent Educationist under clause (c) of Section 4 of the Act for reason to be recorded in writing.
(6) Collector shall consult the Government Pleader for nomination under clause (d) of Section 4 of the Act and shall ordinarily nominate the person suggested by the Government Pleader as Eminent Jurist under clause (d) of Section 4 of the Act but Collector may nominate any other person as Eminent Jurist under clause (d) of Section 4 of the Act for reason to be recorded in writing.
(7) The Collector shall consult the District Education Officer for nomination under clause (e) and (f) of Section 4 of the Act and shall ordinarily nominate the persons suggested by the District Education Officer under clause (e) and (f) of Section 4 of the Act but Collector may nominate any other persons under clause (e) and (f) of Section 4 of the Act for reasons to be recorded in writing.
(8) Committees may conduct their business even if any members are not nominated in the committee and any proceedings made by the committees shall not be considered illegal because members have not been nominated in the committee.
4. Removal of the nominated members of different committees provided in the Act.– If the Collector is satisfied that it is not proper for a nominated member of any committee to serve as a nominated member that committee, the Collector may order the removal of such nominated member.
5. Fixation of Fees.– (1) Fees fixation proposal shall be in Form-1.
(2) If the proposal for first time fixation of fees is not submitted to the School Fees Committee by a Non-Government School within the time limit prescribed in provisions of the Act, the Nodal Officer nominated in the School Fees Committee by the Collector may give written instructions to the Management of such Non-Government School to submit the proposal for first time fees fixation within 1 week to the School Fees Committee and if the Management of the Non-Government School does not submit the proposal for the first time fees fixation within 1 week to School Fees Committee, the School Fees Committee may fix the first time fees of such Non-Government School without a proposal from the Non-Government School Management and if the Chairman of the School Fees Committee does not call a meeting of the School Fees Committee for fixation of fees even after the end of the time limit of 1 week, the Nodal Officer nominated by the Collector in the School Fees Committee may call the meeting of the School Fees Committee for fixation of fees and if the chairman of the School Fees Committee remains absent from such a meeting by the Nodal Officer, the Nodal Officer shall preside of the meeting so called.
6. Records to be kept by Non-Government Schools–
(1) Fees register; (2) Salary payment register of teachers and employees; (3) Stock register of the Non-Government School; (4) Expenditure register, voucher, cashbook; (5) Audit reports of annual audit by CA; (6) Admission register; (7) Student attendance register; (8) Attendance register of teachers and employees; (9) Building rent register; (10) Other records as per the instructions issued by School Education Department, Government of Chhattisgarh, from time to time.
