अधिसूचना
क्रमांक/एफ 15-30/15-2/2020/1.⸺ छत्तीसगढ़ सहकारी सोसाइटी अधिनियम, 1960 (क्र. 17 सन् 1961) की धारा 95 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ सहकारी सोसाइटी नियम, 1962 में निम्नलिखित और संशोधन करती है, अर्थात् :-
संशोधन
उक्त नियमों में,-
नियम 43-ख के स्थान पर निम्नलिखित प्रतिस्थापित किया जाए, अर्थात् :-
''43-ख. किसी सोसाइटी के बोर्ड की शक्तियों का प्रयोग करने हेतु रजिस्ट्रार द्वारा प्राधिकृत किया जाना.- (1) अधिनियम की धारा 49 की उप-धारा (8) के उपबंधों के अध्यधीन रहते हुए, रजिस्ट्रार किसी सोसाइटी की बोर्ड की शक्तियों का प्रयोग करने हेतु किसी शासकीय अधिकारी को प्राधिकृत कर सकेगा :
परन्तु यह कि रजिस्ट्रार, लिखित आदेश द्वारा किसी व्यक्ति (अशासकीय) अथवा व्यक्तियों की समिति (अशासकीय) को भी किसी ऐसी सोसाइटी के बोर्ड की शक्तियों का प्रयोग करने हेतु अधिकृत कर सकेगा :
परन्तु यह और कि व्यक्तियों की समिति (अशासकीय) की दशा में, रजिस्ट्रार उक्त प्रयोजन हेतु गठित समिति के सदस्यों में से किसी एक व्यक्ति को अध्यक्ष तथा किसी एक व्यक्ति को उपाध्यक्ष पदनामित कर सकेगा।
(2) कोई भी व्यक्ति (अशासकीय) अथवा व्यक्तियों की समिति (अशासकीय), इस उप-धारा के अधीन रजिस्ट्रार द्वारा इस प्रकार प्राधिकृत किये जाने हेतु पात्र नहीं होगी, यदि :-
(क) वह, उस सहकारी सोसाइटी अथवा बैंक, यथास्थिति, के बोर्ड के सदस्य के रूप में कार्य करने का कम से कम चार वर्ष का अनुभव नहीं रखता हो;
परन्तु यह कि, इस खण्ड के उपबंध नवीन पंजीकृत सोसाइटीयों पर लागू नही होंगे;
(ख) वह, नियम 44 में उल्लेखित निरर्हताओं में से किसी से ग्रसित हो;
(ग) वह, किसी न्यायालय, लोक आयोग अथवा राज्य आर्थिक अपराध अन्वेषण ब्यूरो द्वारा भ्रष्टाचार के प्रकरण में, दण्डित किया गया हो :
परन्तु यह कि किसी भी प्रकार की सोसाइटियों के मामले में, राज्य सरकार, इस उप-नियम के उपबंधों में छूट प्रदान कर सकेगी।
(3) इस नियम के अंतर्गत छानबीन समिति, किसी ऐसे पात्र व्यक्ति (अशासकीय) अथवा व्यक्तियों की समिति (अशासकीय) के नाम की अनुशंसा रजिस्ट्रार को ऐसी रीति में करेगा, जैसा कि उसके द्वारा उचित समझी जाए :
परन्तु यह कि रजिस्ट्रार, लिखित आदेश द्वारा, उसके द्वारा इस नियम के अधीन प्राधिकृत किये गये व्यक्ति (अशासकीय) अथवा व्यक्तियों की समिति (अशासकीय) को, किसी भी समय, उस संबंध में बिना कोई कारण बताये हटा सकेगा।
(4) उप-नियम (3) में उल्लेखित छानबीन समिति में निम्नलिखित सदस्य सम्मिलित होंगे, अर्थात् :-़ (क) ऐसी सोसाइटी के मामलें में, जिसका कार्य क्षेत्र एक जिला तक सीमित हो-
(एक) जिले के कलेक्टर - अध्यक्ष
(दो) जिले का उप/सहायक रजिस्ट्रार - सदस्य (पदेनसचिव)
- सदस्य
(तीन) ऐसी सहकारी सोसाइटी द्वारा निष्पादित कार्यों से संबंधित प्रशासकीय विभाग का जिलाधिकारी
किसी ऐसी सहकारी सोसाइटी द्वारा निष्पादित कार्य (कारोबार), एक से अधिक विभाग से संबंधित होने की दशा में, इस प्रयोजन हेतु ऐसे विभागों से कलेक्टर द्वारा नामांकित एक अधिकारी, सदस्य होगा।
(ख) ऐसी सोसाइटी के मामले, जिसके कार्य क्षेत्र का विस्तार एक से अधिक जिले किन्तु एक राजस्व संभाग तक सीमित हो -
(एक) राजस्व संभाग का आयुक्त - अध्यक्ष
(दो) संभाग का संयुक्त रजिस्ट्रार
- सदस्य (पदेनसचिव) (तीन)
- सदस्य
ऐसी सहकारी सोसाइटी द्वारा निष्पादित कार्यों से संबंधित प्रशासकीय विभाग का जिलाधिकारी
किसी ऐसी सहकारी सोसाइटी द्वारा निष्पादित कार्य (कारोबार), एक से अधिक विभाग से संबंधित होने की दशा में, इस प्रयोजन हेतु ऐसे विभागों से संभागायुक्त द्वारा नामांकित एक अधिकारी, सदस्य होगा।
(ग) ऐसी सोसाइटी के मामले में, जिसके कार्यक्षेत्र का विस्तार राज्य में एक से अधिक राजस्व संभाग तक हो -
(एक) अपर मुख्य सचिव, छत्तीसगढ़ शासन - अध्यक्ष
(दो) सचिव, छत्तीसगढ़ शासन, सहकारिता विभाग - सदस्य
(तीन) रजिस्ट्रार, सहकारी सोसाइटियां, छत्तीसगढ़ - सदस्य (पदेनसचिव) रजिस्ट्रार, अधिनियम की धारा 49 की उप-धारा (8) के उपबंधों के अध्यधीन रहते हुए, छानबीन समिति द्वारा की गई अनुशंसा के आधार पर, किसी ऐसी सोसाइटी के बोर्ड की शक्तियों का प्रयोग करने हेतु, किसी व्यक्ति (अशासकीय) अथवा व्यक्तियों की समिति (अशासकीय) को प्राधिकृत कर सकेगा।''

क्रमांक/एफ 15-30/15-2/2020/1.⸺ भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में, इस विभाग की अधिसूचना क्रमांक/एफ 15-30/15-2/2020/1 दिनांक 21-01-2021 का अंगे्रजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No./F 15-30/15-2/2020/1.⸺ In exercise of the powers conferred by Section 95 of the Chhattisgarh Co-operative Societies Act, 1960 (No. 17 of 1961), the State Government, hereby, makes the following further amendment in the Chhattisgarh Co-operative Societies Rules, 1962, namely:-
AMENDMENT
In the said rules,-
For rule 43-B, the following shall be substituted, namely:-
"43-B. Authorization by the Registrar to exercise the powers of Board of any Society.- (1) Subject to the provision of sub-section (8) of Section 49 of the Act, the Registrar may authorize any Government official to exercise the powers of the board of any society:
Provided that the Registrar may by order in writing also authorize any person (non-official) or committee of persons (non-official) to exercise the powers of the board of any such society:
Provided further that in case of a committee of (non-official) persons, the Registrar may designate one of the members of the committee constituted for the said purpose as the Chairman and one of the persons as the Vice-Chairman.
(2) No person (non-official) or committee of persons (non-official) shall be eligible for such authorization by the Registrar under this sub-section, if:-
(a) He does not have at least four years experience of working as member of the board of the Co-operative society or bank, as the case may be:
Provided that, the provisions of this clause shall not apply to newly registered societies;
(b) He is suffering from any of the disqualifications mentioned in rule 44;
(c) He has been punished in case of corruption by any Court of law, Lok Ayog or the State Bureau of Investigation of Economic Offences:
Provided that, in case of any type of societies, the State Government may grant exemption in the provisions of this sub- rule.
(3) The screening committee shall recommend the name of eligible person (non-official) or committee of persons (non-official) to Registrar under this rule, in such a manner as it may be deemed fit:
Provided that the Registrar at any time may by order in writing remove person (non-official) or committee of persons (non-official) authorized by him under this rule, without assigning any reason thereof.
(4) The screening committee mentioned in sub-rule (3) shall consists of the following members, namely :-
(a) In case of a society whose area of operation is limited to one district- (i) District Collector - President (ii) Deputy/Assistant Registrar of the - Member
District
(Ex-Officio Secretary)
- Member (iii) District Officer of an Administrative Department related to the operations carried out by such Co-operative Society
In case business carried out by any such Co-operative Society relates to more than one department, one officer from such departments nominated by the Collector for this purpose shall be the Member.
(b) In case of a society whose area of operation extends to more than one district but is limited to one Revenue Division-
(i) Commissioner of Revenue Division - President (ii) Joint Registrar of Division - Member
(Ex-Officio Secretary)
- Member (iii) District Officer of an Administrative Department related to the operations carried out by such Co-operative Society
In case business carried out by any such Co-operative Society relates to more than one department, one officer from amongst such departments nominated by the Divisional Commissioner for this purpose shall be the Member.
(c) In case of a society whose area of operation extends to more than one Revenue Division in the State-
(i) Additional Chief Secretary, Government - President
of Chhattisgarh
(ii) Secretary, Government of Chhattisgarh, - Member
Department of Cooperation
(iii) Registrar, Co-operative Societies, - Member
Chhattisgarh
(Ex-Officio Secretary)
Registrar, subject to the provisions of sub-section (8) of Section 49 of the Act, may authorize any person (non-official) or committee of persons (non-official) to exercise the powers of the board of any such society on the basis of recommendations made by the screening committee."
