क्रमांक 187/एफ 3(5) 48/2018/सं.का.. ― छत्तीसगढ़ विधानसभा सदस्य वेतन, भत्ता तथा पेंशन अधिनियम, 1972 (क्र. 7 सन् 1973) की धारा 9 की उप-धारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ विधान सभा भूतपूर्व सदस्य (रेल द्वारा निःशुल्क अभिवहन) नियम, 1996 में निम्नलिखित और संशोधन करती है, जो 28 सितम्बर, 2020 से भूतलक्षी प्रभाव से प्रवृत्त होगा, अर्थात् :-
संशोधन
उक्त नियमों में,-
1. नियम 3 में, शब्द, अंक एवं चिन्ह ''रेल द्वारा निशुल्क रूपये 2,00,000 (दो लाख)'' के स्थान पर शब्द, अंक एवं चिन्ह'' रेल एवं वायुयान द्वारा यात्रा बोर्डिग सहित ''रूपये 4,00,000/- (चार लाख)'' प्रतिस्थापित किया जाये.
2. नियम 3 के परन्तुक में, शब्द, अंक एवं चिन्ह ''उक्त अधिनियम की धारा 5-क के (2) अधीन रेल एवं वायुयान द्वारा की गई यात्राओं पर किया गया कुल व्यय एक वित्तीय वर्ष में, रूपये 2,00,000 (दो लाख)'' से अधिक नहीं होगा'' के स्थान पर, शब्द, अंक एवं चिन्ह'' उक्त अधिनियम की धारा 5-क के (2) अधीन रेल एवं वायुयान द्वारा की गई यात्राओं पर किया गया कुल व्यय, एक वित्तीय वर्ष में, बोर्डिग सहित रूपये 4,00,000 (चार लाख) से अधिक नहीं होगा'' प्रतिस्थापित किया जाये।
3. नियम 3 के पश्चात्, निम्नलिखित अंतः स्थापित किया जाये, अर्थात् :-
''3क : (1) माननीय भूतपूर्व सदस्यों और उनके साथ चल रहे एक व्यक्ति को श्रेणी-बी अधिकारियों के समकक्ष होटल में ठहरने की पात्रता होगी। राज्य के बाहर की यात्रा हेतु वर्तमान दरें निम्नानुसार होंगी :-

एक्स, वाय एवं जेड श्रेणी के रूप में वर्गीकृत नगरों की सूची, वित्त निर्देश 6/2011 के परिशिष्ट में दी गई है। ऐसे स्थान, जो एक्स तथा वाय श्रेणी के रूप में वर्गीकृत नहीं है, जेड श्रेणी में वर्गीकृत माने जायेंगे। (2) माननीय भूतपूर्व सदस्यों के साथ चलने वाले एक व्यक्ति के लिए अतिरिक्त कमरे की आवश्यकता का निर्धारण और चयन का उत्तरदायित्व, माननीय भूतपूर्व सदस्य के विवेक पर निर्भर रहेगा।
(3) माननीय भूतपूर्व सदस्यों द्वारा होटल देयक प्रमाणीकरण उपरांत, विधान सभा सचिवालय द्वारा देयक की प्रतिपूर्ति की जावेगी।
(4) उपरोक्त ''बोर्डिंग सुविधा (होटल में ठहरने हेतु कमरे)'' वित्त विभाग द्वारा समय-समय पर जारी/पुनरीक्षित संशोधनों के अंतर्गत होगी।''
4. नियम 7 के प्रमाण-पत्र में शब्द, अंक एवं चिन्ह ''रूपये 2,00,000 (दो लाख)'' के स्थान पर, शब्द, अंक एवं चिन्ह ''रूपये 4,00,000/- (चार लाख)'' प्रतिस्थापित किया जाये।

क्रमांक 187/एफ 3(5) 48/2018/सं.का.. ― भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में छत्तीसगढ़ विधान सभा भूतपूर्व सदस्य (रेल द्वारा निःशुल्क अभिवहन) नियम, 1996 में संशोधन का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. 187/F-3(5)/2018/48/p.a. . ― In exercise of the powers conferred by sub-section (1) of Section 9 of the Chhattisgarh Vidhan Sabha Sadasya Veten Bhatta Tatha Pension Adhiniyam, 1972 (No.7 of 1973), the State Government, hereby, makes the following further amendment in the Chhattisgarh Legislative Assembly Ex-members (Free Transit by Railway) Rules, 1996, with retrospective effect from 28th September, 2020, namely :-
AMENDMENT
In the said rules,-
1. In rule 3, for the words, figure and symbol "by Rail Value upto Rupees 2,00,000 (Two Lac)", the words, figure and symbol "by Rail and Air with boarding value upto Rupees 4,00,000/- (Four Lac)" shall be substituted.
2. In proviso of rule 3, for the words, figure and symbol "by rail or air under Section 5-A(2) in the said act shall not exceed the amount of Rupees 2,00,000 (Two Lac) in financial year", the words, figure and symbol "by rail or air including boarding under Section 5-A(2) in the said Act shall not exceed the amount of Rupees 4,00,000/- (Four Lac) in a financial year" shall be substituted.
3. After rule 3, the following shall be inserted, namely :-
"3a. (1) Hon'ble Ex-members and a person accompanying them shall be eligible to stay in the hotel as equivalent to the category-B officers. The current rates for the Journey of outside the State are as follows :-

List of classified cities as category X, Y and Z shall be given in Annexure of Finance Instruction 6/2011. Such places, which are not classified as category X and Y, shall be deemed to be classified in category Z.
(2) For staying one person with Hon'ble Ex-members, the responsibility of the determination and selection of need of extra rooms shall depend on the discretion of Hon'ble Ex-member.
(3) After certification of Hotel bill by the Hon'ble Ex-member, the bill shall be reimbursed by the Legislative Secretariat.
(4) "Boarding facility (Rooms for staying in the hotel)" as above shall be under the amendment issued/revised by the Finance Department from time to time.
4. In certificate of rule 7, for the words, figure and symbol "Rupees 2,00,000 (Two Lac)", the words, figure and symbol "Rupees 4,00,000/- (Four Lac)" shall be substituted.
