क्रमांक/2485/एफ-16/01/पौ.सं./2012/14-2.⸺ कीटनाशी अधिनियम, 1968 (1968 का सं. 46) की धारा 37 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ कीटनाशी अपील नियम, 2021 बनाती है, जिसे उक्त अधिनियम की धारा 37 की उप-धारा (1) द्वारा अपेक्षित किये गये अनुसार पूर्व में प्रकाशित किया जा चुका है, अर्थातः-
नियम
1. संक्षिप्त नाम तथा प्रारंभ.- (1) ये नियम छत्तीसगढ़ कीटनाशी अपील नियम, 2021 कहलायेंगे.
(2) ये नियम राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे.
2. परिभाषाएं.- (1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) ''अधिनियम'' से अभिप्रेत है कीटनाशी अधिनियम, 1968 (1968 का सं. 46);
(ख) ''धारा'' से अभिप्रेत है अधिनियम की धारा.
(2) शब्द और अभिव्यक्तियां, जो इसमें प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, उनके क्रमशः वही अर्थ होंगे, जो अधिनियम में उनके लिये समनुदेशित हैं.
3. अपील.- (1) धारा 15 की उप-धारा (1) के अधीन अपील निम्नानुसार की जायेगी,-
(अ) यदि ऐसा विनिश्चय, कीटनाशी निर्माण की अनुज्ञप्ति से संबंधित हो, तो संचालक, कृषि, छत्तीसगढ़, रायपुर को.
(ब) यदि ऐसा विनिश्चय, कीटनाशी के विक्रय, स्टॉक या विक्रय हेतु प्रदर्शन या वितरण से संबंधित हो तो,-
(एक) राज्य अनुज्ञप्ति हेतु संचालक, कृषि, छत्तीसगढ़, रायपुर को; और
(दो) जिला अनुज्ञप्ति हेतु संबंधित संभाग के संयुक्त संचालक, कृषि को.
(2) अपील लिखित में होगी तथा उनमें विभिन्न शीर्षकों के अधीन वे आधार संक्षिप्त में उपवर्णित किए जायेंगे, जिस पर अपील की गई है.
(3) प्रत्येक अपील लिखित में दायर की जायेगी; अपीलार्थी द्वारा या तो व्यक्तिगत या सम्यक् रूप से प्राधिकृत अभिकर्ता के द्वारा या सम्यक् रूप से पंजीकृत राष्ट्रीय डाक सेवा के माध्यम से भेजी जा सकेगी.
(4) राज्य स्तर में प्रत्येक अपील हेतु रू. 500 का शुल्क एवं जिला स्तर में प्रत्येक अपील हेतु रू. 200 का शुल्क देय होगा। कोषालय चालान तथा उस निर्णय की प्रतिलिपि, जिसके विरूद्ध अपील की गई है, अपील के साथ संलग्न की जायेगी.
(5) अपील करने के लिये देय फीस शीर्ष 0435-अन्य कृषि कार्यक्रम, 800-अन्य प्राप्तियां, 0242-नियंत्रित वस्तुओं (कीटनाशी औषधि) पर लाइसेंस शुल्क, 0243-विविध, 0244-प्रशासकीय प्रभार के अंतर्गत जमा की जायेगी.
4. अपीलीय अधिकारी द्वारा अनुसरण की जाने वाली प्रक्रिया.- अधिनियम के अधीन अपीलों को विनिश्चित करने हेतु अपीलीय अधिकारी, उसी प्रक्रिया का अनुसरण करेगा, जिसे न्यायालय द्वारा सिविल प्रक्रिया संहिता, 1908 (1908 का 5) के अधीन मूल न्यायालय के डिक्री या आदेश के विरूद्ध अपीलों के विनिश्चय के लिये अनुसरण किया जाता है.

No./2485/F-16/01/Plant Prot./ 2012/14-2.⸺ In exercise of the powers conferred by Section 37 of the Insecticides Act, 1968 (No. 46 of 1968), the State Government, hereby, makes the Chhattisgarh Insecticides Appeal Rules, 2021, the same having been previously published as required by sub-section (1) of Section 37 of the said Act, namely:-
RULES
1. Short title and commencement.- (1) These rules may be called as the Chhattisgarh Insecticides Appeal Rules, 2021.
(2) These rules shall come into force from the date of its publication in the Official Gazette.
2. Definitions.- (1) In these rules, unless the context otherwise requires,-
(a) "Act" means the Insecticides Act, 1968 (No. 46 of 1968);
(b) "Section" means the Section of the Act.
(2) words and expressions used herein but not defined shall have the same meanings as respectively assigned to them under the Act.
3. Appeal.- (1) Appeal under sub-section (1) of Section 15 shall lie,-
(A) if the decision is related to license to Manufacture of Insecticides, then to director, Agriculture, Chhattisgarh, Raipur.
(B) if the decision is related to License to sell, stock or exhibit for sale or distribute insecticides,-
(i) Director, Agriculture, Chhattisgarh, Raipur for State License, and
(ii) Joint Director, Agriculture of the concerned Division for District License.
(2) Appeal must be in writing and the grounds under various headings on which the appeal is done, must be described in brief.
(3) Each appeal shall be filed in writing; either individually by the appellant, or by a duly authorized agent can be sent through duly registered nationalized postal service.
(4) A fee of Rs.500 is be payable for each appeal at state level and Rs. 200 is be payable for each appeal at district level. Treasury Invoice and a copy of the decision against which the appeal has been prefered must be annexed with appeal.
(5) The fees payable for the appeal will be credited to 0435-Other Agriculture Programmes, 800-Other Receipts 0242-License Fee on Controlled Goods (Insecticidal Dispenser) 0243-Miscellaneous, 0244-Administrative Charges.
4. Procedure to be followed by the Appellate Authority.-To decide the appeals under the Act, the Appellate Authority shall follow the same procedure which is followed by a Court, to decide the appeals against the decree or order of original court, under the Code of Civil Procedure, 1908 (No. 5 of 1908).
