क्रमांक एफ 10-46/2021/वाक/पांच(74).⸺ राज्य सरकार, छत्तीसगढ़ माल और सेवा कर अधिनियम, 2017 (2017 का 7) की धारा 164 द्वारा प्रदत्त शक्तियों के प्रयोग करते हुए, परिषद् की सिफारिशों पर, छत्तीसगढ़ माल और सेवा कर नियम, 2017 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्ः-
1. संक्षिप्त नाम और प्रारंभ — (1) इन नियमों का संक्षिप्त नाम छत्तीसगढ़ माल और सेवा कर (सातवां संशोधन) नियम, 2021 है ।
(2) इन नियमों में अन्यथा उपबंधित के सिवाए, ये नियम 20 अगस्त, 2021 से प्रवृत्त माने जायेंगे ।
2. छत्तीसगढ़ माल और सेवा कर नियम, 2017 में,-
(i) नियम 26 के उपनियम (1) में,-
(क) चौथे परंतुक में, "31 अगस्त, 2021" अंकों, अक्षरों और शब्दों के स्थान पर, "31 अक्तूबर, 2021" अंक, अक्षर और शब्द प्रतिस्थापित किये जाएंगे;
(ख) 1 नवंबर, 2021 से सभी परंतुकों का लोप किया जाएगा;
(ii) 1 मई, 2021 से, नियम 138ङ में, चौथे परंतुक के पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्ः-
"परंतु यह भी कि उक्त निर्बंधन 1 मई, 2021 से 18 अगस्त, 2021 की अवधि के दौरान उस दशा मे लागू नहीं होगा, जहां, यथास्थिति, प्ररूप जीएसटीआर-3ख में विवरणी या प्ररूप जीएसटीआर-1 में जावक प्रदायों का विवरण या प्ररूप जीएसटी सीएमपी-8 में विवरण मार्च, 2021 से मई, 2021 की अवधि के लिए प्रस्तुत नहीं किया गया है।";
(iii) प्ररूप जीएसटी एएसएमटी-14 में,-
(क) "आपका रजिस्ट्रीकरण" शब्दों के पश्चात्, ",आदेश प्रतिनिर्देश सं. ..............., तारीख .............. द्वारा," शब्द अंतःस्थापित किए जाएंगे ;
(ख) "क्यों रजिस्ट्रीकरण के लिए दायी होने के बावजूद रजिस्ट्रीकरण के बिना कारबार संचालन के लिए" शब्दों का लोप किया जाएगा;
(ग) अंत में, "पदनाम" के पश्चात् "पता" शब्द अंतःस्थापित किया जाएगा।

क्रमांक एफ 10-46/2021/वाक/पांच(74).⸺ भारत के संविधान के अनुच्छेद 348 के खंड (3) के अनुसरण में, इस विभाग की अधिसूचना क्रमांक एफ 10-46/2021/वाक/पांच(74), दिनांक 13-10-2021 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. 32/2021 – State Tax
No. F 10-46/2021/CT/V(74).⸺ In exercise of the powers conferred by section 164 of the Chhattisgarh Goods and Services Tax Act, 2017 (7 of 2017), the State Government, on the recommendations of the Council, hereby makes the following rules further to amend the Chhattisgarh Goods and Services Tax Rules, 2017, namely: —
1. Short title and commencement. - (1) These rules may be called the Chhattisgarh Goods and Services Tax (Seventh Amendment) Rules, 2021.
(2) Save as otherwise provided in these rules, they shall be deemed to have come into force from 29 August, 2021.
2. In the Chhattisgarh Goods and Services Tax Rules, 2017, —
(i) in sub-rule (1) of rule 26,-
(a) in the fourth proviso, for the figures, letters and words ―31st day of August, 2021‖, the figures, letters and words ―31st day of October, 2021‖ shall be substituted;
(b) with effect from the 1st day of November, 2021, all the provisos shall be omitted;
(ii) with effect from the 1st day of May, 2021, in rule 138E, after the fourth proviso, the following proviso shall be inserted, namely:-
―Provided also that the said restriction shall not apply during the period from the1st day of May, 2021 till the 18th day of August, 2021, in case where the return in FORM GSTR-3B or the statement of outward supplies in FORM GSTR-1 or the statement in FORM GST CMP-08, as the case may be, has not been furnished for the period March, 2021 to May, 2021.‖;
(iii) in FORM GST ASMT-14, -
(a) after the words, ―with effect from ------‖, the words, ―vide Order Reference No. -------, dated ------‖ shall be inserted;
(b) the words, ―for conducting business without registration despite being liable for registration‖ shall be omitted;
(c) at the end after ―Designation‖, the word ―Address‖ shall be inserted.

क्रमांक एफ 10-46/2021/वाक/पांच(75).⸺ राज्य सरकार, छत्तीसगढ़ माल और सेवा कर अधिनियम 2017 (2017 का 7) की धारा 128 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, परिषद की सिफारिशों पर, छत्तीसगढ़ शासन के वाणिज्यिक कर विभाग की अधिसूचना सं. 76/2018-राज्य कर क्रमांक एफ-10-65/2018/वाक/पांच(123) दिनांक 31 दिसंबर, 2018, जिसे छत्तीसगढ़ के राजपत्र (असाधारण) में, क्रमांक 523 तारीख 31 दिसंबर, 2018, में प्रकाशित किया गया था, में निम्नलिखित और संशोधन करती है, अर्थात्ः-
उक्त अधिसूचना में, नौवें और दसवें परंतुकों में, "अगस्त, 2021 के 31वें दिन" अंकों, अक्षरों और शब्दों के स्थान पर, जहां कहीं भी वे आते हैं, "नवंबर, 2021 के 30 वें दिन" अंको, अक्षरों और शब्दों को प्रतिस्थापित किया जायेगा।
2. इस अधिसूचना को 29 अगस्त, 2021 से लागू माना जायेगा ।

No. F 10-46/2021/CT/V(75).⸺ In exercise of the powers conferred by section 128 of the Chhattisgarh Goods and Services Tax Act, 2017 (7 of 2017), the State Government, on the recommendations of the Council, hereby makes the following further amendments in the notification of the State Government, on the recommendations of the Council, hereby makes the following amendment in the Notification No. 76/2018-State Tax, No. F 10-65/2018/CT/V (123), Chhattisgarh Commercial Tax Department, dated the 31st December, 2018, published in the Gazette (Extraordinary) of Chhattisgarh, No. 523, dated the 31st December, 2018, namely:–
In the said notification, in the ninth and tenth provisos, for the figures, letters and words "31st day of August, 2021", where ever they occur, the figures, letters and words "30th day of November, 2021" shall be substituted.
2. This notification shall be deemed to have come into force with effect from the 29th day of August, 2021.

क्रमांक एफ 10-46/2021/वाक/पांच (76).⸺ छत्तीसगढ़ शासन के वाणिज्यिक कर विभाग की अधिसूचना सं. 35/2020-राज्य कर क्रमांक एफ-10-83/2020/वाक/पांच(118) दिनांक 19 नवम्बर, 2020, जिसे छत्तीसगढ़ के राजपत्र (असाधारण) में, क्रमांक 615 तारीख 1 दिसम्बर, 2020 में और अधिसूचना सं. 14/2021-राज्य कर क्रमांक एफ 10-38/2021/वाक/पांच(46) दिनांक 18 जून, 2021, जिसे छत्तीसगढ़ के राजपत्र (असाधारण) में, क्रमांक 356 तारीख 28 जून, 2021 में, प्रकाशित किया गया था, को आंशिक रूप से संशोधित करते हुए एकी—त माल और सेवा कर अधिनियम, 2017 (2017 का 13) की धारा 20 के साथ पठित छत्तीसगढ़ माल और सेवा कर अधिनियम, 2017 (2017 का 7) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 168क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार, परिषद् की सिफारिशों पर, यह अधिसूचित करती है कि जहां उक्त अधिनियम की धारा 29 की उपधारा (2) के खंड (ख) या खंड (ग) के अधीन किसी रजिस्ट्रीकरण को रद्द कर दिया गया है और उक्त अधिनियम की धारा 30 की उपधारा (1) के अधीन रजिस्ट्रीकरण के रद्द करने का प्रतिसंहरण करने के लिए आवेदन करने की समयसीमा 1 मार्च, 2020 से 31 अगस्त, 2021 की समयावधि के दौरान आती है, तो ऐसा आवेदन करने की समयसीमा का 30 सितंबर, 2021 तक विस्तार किया जाएगा ।
2. इस अधिसूचना को 29 अगस्त, 2021 से लागू माना जाएगा ।

No. 34/2021 – State Tax
No. F 10-46/2021/CT/V(76).⸺ In partial modification of the State Government, on the recommendations of the Council, hereby makes the following amendment in the Notification No. 35/2020-State Tax, No. F 10-83/2020/CT/V(118), Chhattisgarh Commercial Tax Department, dated the 19th November, 2020, published in the Gazette (Extraordinary) of Chhattisgarh, No. 615, dated the 1st December, 2020, and the State Government, on the recommendations of the Council, hereby makes the following amendment in the Notification No. 14/2021-State Tax, No. F 10-38/2021/CT/V(46), Chhattisgarh Commercial Tax Department, dated the 18th June, 2021, published in the Gazette (Extraordinary) of Chhattisgarh, No. 356, dated the 28th June, 2021, in exercise of the powers conferred by section 168A of the Chhattisgarh Goods and Services Tax Act, 2017 (7 of 2017) (hereafter in this notification referred to as the said Act), read with section 20 of the Integrated Goods and Services Tax Act, 2017 (13 of 2017), the State Government, on the recommendations of the Council, hereby notifies that where a registration has been cancelled under clause (b) or (c) of sub-section (2) of section 29 of the said Act and the time limit for making an application of revocation of cancellation of registration under sub-section (1) of section 30 of the said Act falls during the period from the 1stday of March, 2020 to 31st day of August, 2021, the time limit for making such application shall be extended up to the 30thday of September, 2021.
2. This notification shall be deemed to have come into force with effect from the 29th day of August, 2021.
