अधिसूचना
क्र./154/एफ-04/48/2010/14-2.⸺ छत्तीसगढ़ कृषि उपज मण्डी (राज्य विपणन विकास निधि) नियम, 2018 में संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार, छत्तीसगढ़ कृषि उपज मण्डी अधिनियम, 1972 (क्र. 24 सन् 1973) की धारा 79 की उप-धारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 79 की उप-धारा (1) द्वारा अपेक्षित किये गये अनुसार, उन समस्त व्यक्तियों, जिनके कि इससे प्रभावित होने की संभावना है, की जानकारी के लिये एतद्द्वारा प्रकाशित किया जाता है तथा एतद्द्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस सूचना के राजपत्र में प्रकाशन की तारीख से पन्द्रह दिवस के अवसान के पश्चात्, विचार किया जायेगा।
कोई आपत्ति या सुझाव, जो उक्त प्रारूप के संबंध में किसी व्यक्ति से, विनिर्दिष्ट कालावधि के पूर्व, कृषि उत्पादन आयुक्त, छत्तीसगढ़ शासन, कृषि विभाग, महानदी भवन, मंत्रालय, नवा रायपुर अटल नगर, जिला रायपुर के कार्यालय में, कार्यालयीन समय में प्राप्त हों, पर छत्तीसगढ़ शासन द्वारा विचार किया जायेगा।
प्रारूप संशोधन
उक्त नियमों में,-
1. नियम 6 के उप-नियम (1) के खण्ड (ज) के पश्चात्, निम्नलिखित अन्तःस्थापित किया जाये, अर्थात्ः- ''(झ) राज्य सरकार की पूर्व अनुमति या निर्देश से, मंडी बोर्ड के अनुमोदन के पश्चात् कृषक हित के किसी अन्य प्रयोजन हेतु''।
2. नियम 9 के उप-नियम (1) में,-
(एक) शब्द ''भुगतान हेतु किया जायेगा'' के पश्चात्, पूर्ण विराम चिन्ह ''।'' के स्थान पर, कोलन चिन्ह ''ः'' प्रतिस्थापित किया जाये; और
(दो) निम्नलिखित अन्तःस्थापित किया जाये, अर्थात्ः-
''परन्तु यह कि बोर्ड, आरक्षित निधि खाता में मंडी बोर्ड की सकल प्राप्तियों के पन्द्रह प्रतिशत के अलावा अतिरिक्त राशि, अधिकतम वार्षिक सीमा निर्धारित करते हुए, समय-समय पर जमा कर सकेगा।'' अटल नगर, दिनांक 13 जनवरी 2022 क्रमांक/154/एफ-04/48/2010/14-2.⸺ भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में इस विभाग की अधिसूचना क्रमांक/154/एफ-04/48/2010/14-2 दिनांक 13-01-2022 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No./154/F-04/48/2010/14-2.⸺The following draft of amendment in the Chhattisgarh Krishi Upaj Mandi (State Marketing Development Fund) Rules, 2018, which the State Government in exercise of the powers conferred by sub-section (1) of Section 79 of the Chhattisgarh Krishi Upaj Mandi Adhiniyam, 1972 (No. 24 of 1973), proposes to make, is hereby, published as required by sub-section (1) of Section 79 of the said Adhiniyam for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of fifteen days from the date of publication of this notice in the Official Gazette.
Any objection or suggestions regarding the said draft received from any person before the specified period, in office hours in office of the Agriculture Production Commissioner, Government of Chhattisgarh, Department of Agriculture, Mahanadi Bhawan, Mantralaya, Nava Raipur Atal Nagar, District Raipur shall be considered by the Government of Chhattisgarh.
DRAFT AMENDMENT
In the said rules,-
1. After clause (h) of sub-rule (1) of rule 6, the following shall be inserted, namely:-
''(i) With the prior sanction or direction of the State Government, after approval of Mandi Board for any other purpose of farmer's interest.''
2. In sub-rule (1) of rule 9,-
(i) after the words "prescribed by Board", for the punctuation full stop ".", the punctuation colon ":" shall be substituted; and
(ii) the following shall be inserted, namely:-
"Provided that the Board may deposit additional amount from time to time in the reserve fund account by fixing the maximum annual limit in addition to fifteen percent of aggregate receipts of Mandi Board."
