क्रमांक एफ 10-35/2019/वा.क.(आब.)/पांच(56).⸺ छत्तीसगढ़ आबकारी अधिनियम, 1915 (क्र. 2 सन् 1915) की धारा 8 के खण्ड (ग), धारा 62 की उप-धारा (1) एवं उप-धारा (2) के खण्ड (च), (छ), (ज) सहपठित धारा 62 की उप-धारा (3) के परंतुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, मोलासिस के आसवनी में स्प्रिट आसवन हेतु या वैज्ञानिक, औद्योगिक, कृषि, शैक्षणिक, औषधीय, पशु आहार इत्यादि के रूप में उपयोग के प्रयोजन हेतु आपूर्ति, आधिपत्य, विक्रय, उपयोग, परिवहन, आयात, निर्यात, अनुज्ञप्ति एवं अनुज्ञा-पत्रों के संबंध में नियंत्रण और विनियमन के उद्देश्य से निम्नलिखित नियम बनाती है, अर्थात् :-
नियम
1. संक्षिप्त नाम, विस्तार तथा प्रारम्भ.- (1) ये नियम छत्तीसगढ़ मोलासिस नियंत्रण एवं विनियमन नियम, 2022 कहलायेंगे।
(2) इनका विस्तार सम्पूर्ण छत्तीसगढ़ राज्य में होगा।
(3) ये नियम राजपत्र में इनके प्रकाशन की तिथि से प्रवृत्त होंगे।
2. परिभाषाएं.- (1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) ''अधिनियम'' से अभिप्रेत है समय-समय पर यथा-संशोधित, छत्तीसगढ़ आबकारी अधिनियम, 1915 (क्र. 2 सन् 1915);
(ख) ''आबकारी वर्ष'' से अभिप्रेत है एक अप्रैल से प्रारंभ होकर, कैलेण्डर वर्ष के 31 मार्च समाप्त होने वाला वित्तीय वर्ष;
(ग) ''मोलासिस'' से अभिप्रेत है गुड़ या शक्कर के विनिर्माण के अंतिम चरण में निकलने वाली गाढ़ी, गहरी रंगीन चाशनी, जो तरल रूप में शक्कर से युक्त हो, जिसका किण्वन किया जा सके;
टीपः- पशुआहार हेतु प्रयुक्त सामान्य मोलासिस, बैगो-मोलासिस है।
(घ) ''शक्कर कारखाना'' से अभिप्रेत है वह स्थान, जहां बिजली के सहयोग से, खुली प्रक्रिया या वैक्यूम प्रक्रिया द्वारा शक्कर, खाण्डसारी शक्कर या गुड़ का विनिर्माण किया जाता हो;
(ड.) ''शक्कर कारखाने का स्वामी'' से अभिप्रेत है वह व्यक्ति, जिसका शक्कर कारखाने से संबंधित समस्त कार्य पर पूर्णतः नियंत्रण है;
(च) ''विहित प्ररूप'' से अभिप्रेत है इन नियमों से संलग्न प्ररूप; (छ) ''अनुज्ञापन प्राधिकारी'' से अभिप्रेत है आबकारी आयुक्त अथवा जिले का कलेक्टर;
(ज) ''अनुज्ञप्तिधारी'' से अभिप्रेत है ऐसा व्यक्ति, जो इन नियमों के अंतर्गत स्वीकृत अनुज्ञप्ति धारण करता हो;
(झ) ''अनुज्ञप्त परिसर'' से अभिप्रेत है वह परिसर, जिसके संबंध में इन नियमों के अंतर्गत कोई अनुज्ञप्ति जारी की गई हो;
(ञ) ''मोलासिस का उत्पादक'' से अभिप्रेत है कारखाने का स्वामी या उस स्थान का प्रबंधक, जहां पर गुड़ या शक्कर के विनिर्माण के समय मोलासिस का उत्पादन होता है;
(ट) ''अनुज्ञप्ति'' से अभिप्रेत है इन नियमों के अंतर्गत स्वीकृत अनुज्ञप्ति/अनुज्ञप्तियां;
(ठ) ''कलेक्टर'' से अभिप्रेत है जिले के राजस्व प्रशासन का मुख्य अधिकारी;
(ड) ''आबकारी आयुक्त'' से अभिप्रेत है छाीसगढ़ आबकारी अधिनियम, 1915 के अन्तर्गत नियुक्त/परिभाषित आबकारी आयुक्त;
(ढ) ''आबकारी अधिकारी'' से अभिप्रेत है छत्तीसगढ़ आबकारी अधिनियम, 1915 के अंतर्गत नियुक्त/परिभाषित आबकारी अधिकारी, जो कि आबकारी उप निरीक्षक से निम्न श्रेणी का नहीं होगा।
(2) शब्द और अभिव्यक्तियां, जो कि इन नियमों में प्रयुक्त है, किन्तु परिभाषित नहीं है, के वही अर्थ होंगे, जैसा कि उक्त अधिनियम में उनके लिये समनुदेशित है।
3. मोलासिस के उपयोग पर प्रतिबंध.- मोलासिस का उपयोग निम्नांकित उद्देश्य के अतिरिक्त नहीं किया जा सकेगा :-
(1) अधिनियम के अंतर्गत स्थापित आसवनी में स्प्रिट के आसवन हेतु।
(2) किसी भी वैज्ञानिक, औद्योगिक, औषधीय, कृषि, पशु आहार, शैक्षणिक अथवा इस प्रकार के अन्य उद्देश्य हेतु, जिसे समय-समय पर आबकारी आयुक्त द्वारा विनिश्चित किया जा सकेगा।
4. अनुज्ञप्ति एवं अनुज्ञापत्र.- (1) इन नियमों के अंतर्गत विहित अनुज्ञप्ति, अनुज्ञापत्र एवं आवेदन पत्र के प्ररूप निम्नानुसार हैं :-

| (दो) | प्ररूप एम-1(क) (नियम 5 के अंतर्गत) | एम-1 अनुज्ञप्ति हेतु आवेदन पत्र का प्ररूप |
| (तीन) | प्ररूप एम-2 (नियम 6 के अंतर्गत) | मोलासिस निर्माता को छोड़कर अन्य व्यक्ति के लिए मोलासिस के कब्जे एवं उपयोग हेतु अनुज्ञप्ति |
| (चार) | प्ररूप एम-2(क) (नियम 6 के अंतर्गत) | एम-2 अनुज्ञप्ति हेतु आवेदन पत्र का प्ररूप |
| (पांच) | प्ररूप एम-3 (नियम 7 के अंतर्गत) | मोलासिस निर्माता को छोड़कर अन्य व्यक्ति के लिए मोलासिस के कब्जे एवं विक्रय हेतु अनुज्ञप्ति |

(2) प्ररूप एम-1 में अनुज्ञप्ति, आबकारी आयुक्त द्वारा जारी की जायेगी। शेष समस्त अनुज्ञप्तियां, संबंधित जिले के कलेक्टर द्वारा जारी की जायेगी।
(3) इन नियमों के अंतर्गत अनुज्ञप्ति, केवल उन्हीं आवेदकों को प्रदान की जा सकेगी, जो इस अधिनियम तथा इसके अंतर्गत बनाये गये नियमों के अधीन अनुज्ञप्ति धारण करने हेतु पात्र हो।
(4) आवेदक द्वारा इन नियमों के अंतर्गत किसी अनुज्ञप्ति हेतु विहित प्ररूप में आवेदन के साथ आवेदन शुल्क प्रति आवेदन रू. 500/- (पांच सौ रूपये) देय होगा।
5. मोलासिस निर्माता द्वारा कब्जा एवं विक्रय.- (1) कोई भी व्यक्ति, जो मोलासिस का निर्माता है तथा उसको कब्जे में रखकर उसका विक्रय करना चाहता है, वह आबकारी आयुक्त को विहित प्ररूप एम-1 (क) में आवेदन प्रस्तुत करेगा।
(2) आबकारी आयुक्त, प्ररूप एम-1 (क) में आवेदन प्राप्त होने पर, आवश्यक जांच उपरांत संतुष्ट होने पर विहित प्ररूप एम-1 में अनुज्ञप्ति, निम्नानुसार उत्पादन की मात्रा के आधार पर, अग्रिम वार्षिक अनुज्ञप्ति फीस जमा करने पर प्रदान करेगा :-
(क) यदि मोलासिस का वार्षिक उत्पादन 10,000 मीट्रिक टन से अधिक न हो -रू. 50,000/- (ख) यदि मोलासिस का वार्षिक उत्पादन 10,000 मीट्रिक टन से अधिक किन्तु 20,000 मीट्रिक टन तक हो -रू 1,00,000/-
(ग) यदि मोलासिस का वार्षिक उत्पादन 20,000 मीट्रिक टन से अधिक हो, -रू 1,50,000/- स्पष्टीकरणः- प्ररूप एम-1 में मोलासिस के कब्जे एवं विक्रय हेतु अनुज्ञप्ति तब तक स्वीकृत नहीं की जायेगी, जब तक कि मोलासिस स्वयं के शक्कर या गुड़ की उत्पादक इकाई में एक उप उत्पाद के रूप में शक्कर या गुड़ के विनिर्माण प्रक्रिया के समय उत्पादित न होता हो।
(3) अनुज्ञप्ति का नवीनीकरण ः- राज्य सरकार द्वारा यथा विहित वार्षिक अनुज्ञप्ति फीस, जो कि पुनरीक्षित की जा सकेगी, का अग्रिम संदाय किये जाने पर तथा अनुज्ञप्तिधारी के अच्छे आचरण, उचित अभिलेख और अनुज्ञप्ति की शर्तों तथा अधिनियम और उसके अधीन बनाये गये नियमों के प्रावधानों के अनुपालन के आधार पर, नियम 5 के उप-नियम (2) के अधीन अनुज्ञप्ति प्रत्येक वर्ष नवीनीकृत की जा सकेगी।
6. मोलासिस का कब्जा एवं उपयोग.- (1) मोलासिस निर्माता के सिवाय अन्य कोई भी व्यक्ति, जो मोलासिस का कब्जा एवं उपयोग करना चाहता है, वह अनुज्ञापन प्राधिकारी को विहित प्ररूप एम-2 (क) में आवेदन प्रस्तुत कर सकेगा।
(2) उप-नियम (1) के अंतर्गत आवेदन प्राप्त होने पर, अनुज्ञापन प्राधिकारी, आवश्यक जांच उपरांत संतुष्ट होने पर, विहित प्ररूप एम-2 में अनुज्ञप्ति, निम्नानुसार मोलासिस की मात्रा के आधार पर अग्रिम वार्षिक अनुज्ञप्ति फीस जमा करने के पश्चात्, प्रदान करेगा :-
(एक) किसी भी शासकीय उद्देश्य या शैक्षणिक, वैज्ञानिक, औषधीय या नमूना के उद्देश्य हेतु अनुज्ञप्ति फीस- रू. 50,000/-
(दो) कृषि उद्देश्य हेतु अनुज्ञप्ति फीस- रू. 50,000/-
(तीन) कोई अन्य व्यवसायिक उद्देश्य हेतु, जहां पर मोलासिस की मात्रा :-
(क) 10,000 मीट्रिक टन तक -रू. 50,000/-
(ख) 10,000 मीट्रिक टन से अधिक किन्तु 20,000 मीट्रिक टन तक-रू. 1,00,000/- (ग) 20,000 मीट्रिक टन से अधिक - रू. 1,50,000/-
(3) अनुज्ञप्ति का नवीकरणः- राज्य सरकार द्वारा विहित अनुसार वार्षिक अनुज्ञप्ति फीस, जो कि पुनरीक्षित की जा सकेगी, का अग्रिम संदाय किये जाने पर तथा अनुज्ञप्तिधारी के अच्छे आचरण, उचित अभिलेख और अनुज्ञप्ति की शर्तों तथा अधिनियम एवं उसके अधीन बनाये गये नियमों के प्रावधानों के अनुपालन के आधार पर, नियम 6 के उप-नियम (2) के अधीन अनुज्ञप्ति प्रत्येक वर्ष नवीनीकृत की जा सकेगी।
7. मोलासिस का कब्जा एवं विक्रय.- (1) मोलासिस निर्माता के सिवाय अन्य कोई भी व्यक्ति, जो मोलासिस का कब्जा एवं विक्रय करना चाहता है, वह अनुज्ञापन प्राधिकारी को विहित प्ररूप एम-3(क) में आवेदन पत्र प्रस्तुत कर सकेगा।
(2) उप-नियम (1) के अंतर्गत आवेदन प्राप्त होने पर, अनुज्ञापन प्राधिकारी, आवश्यक जांच उपरांत संतुष्ट होने पर, विहित प्ररूप एम-3 में अनुज्ञप्ति, वार्षिक अनुज्ञप्ति फीस रूपये 1,00,000/- अग्रिम जमा करने के पश्चात्, प्रदान करेगा।
(3) अनुज्ञप्ति का नवीनीकरण :- राज्य सरकार द्वारा विहित अनुसार वार्षिक अनुज्ञप्ति फीस, जो कि पुनरीक्षित की जा सकेगी, का अग्रिम संदाय किये जाने पर तथा अनुज्ञप्तिधारी के अच्छे आचरण, उचित अभिलेख और अनुज्ञप्ति की शर्तों तथा अधिनियम एवं उसके अधीन बनाये गये नियमों के प्रावधानों के अनुपालन के आधार पर, नियम 7 के उप-नियम (2) के अधीन अनुज्ञप्ति प्रत्येक वर्ष नवीनीकृत की जा सकेगी।
8. केवल पशुआहार हेतु मोलासिस का क्रय, कब्जा एवं उपयोग.- (1) इन नियमों में किसी प्रावधान के होते हुए भी, कोई भी व्यक्ति, जो मोलासिस निर्माता नहीं है केवल पशुआहार हेतु बैगो-मोलासिस का क्रय, कब्जा एवं उपयोग करना चाहता है वह प्रतिमाह बैगो-मोलासिस की आवश्यक मात्रा का उल्लेख करते हुए अनुज्ञापन प्राधिकारी को विहित प्ररूप एम-4(क) मे आवेदन प्रस्तुत कर सकेगा। (2) उप-नियम (1) के अंतर्गत आवेदन प्राप्त होने पर, अनुज्ञापन प्राधिकारी, आवश्यक जांच उपरांत संतुष्ट होने पर, विहित प्ररूप एम-4 में अनुज्ञप्ति, वार्षिक अनुज्ञप्ति फीस रूपये 25,000/- अग्रिम जमा करने के पश्चात,् प्रदान करेगा।
(3) अनुज्ञप्ति का नवीनीकरण :- राज्य सरकार द्वारा विहित अनुसार वार्षिक अनुज्ञप्ति फीस, जो कि पुनरीक्षित की जा सकेगी, का अग्रिम संदाय किये जाने पर तथा अनुज्ञप्तिधारी के अच्छे आचरण, उचित अभिलेख और अनुज्ञप्ति की शर्तों तथा अधिनियम एवं उसके अधीन बनायें गये नियमों के प्रावधानों के अनुपालन के आधार पर, नियम 8 के उप-नियम (2) के अधीन अनुज्ञप्ति प्रत्येक वर्ष नवीनीकृत की जा सकेगी।
9. अनुज्ञप्ति अवधि एवं फीस की गणना.- (1) कोई भी व्यक्ति, मोलासिस का विक्रय नहीं कर सकता, जब तक कि वह इन नियमों के अंतर्गत विहित प्ररूप एम-1 (नियम 5 अनुसार) या प्ररूप एम-3 (नियम 7 के अनुसार) या प्ररूप एम-4 (नियम 8 के अनुसार) में अनुज्ञप्ति धारित न करता हो।
(2) इन नियमों के अंतर्गत अनुज्ञप्ति/अनुज्ञप्तियां, आबकारी वर्ष अर्थात् दिनांक 01 अप्रैल से दिनांक 31 मार्च तक के लिये जारी की जायेगी। यदि कोई अनुज्ञप्ति/अनुज्ञप्तियां, आबकारी वर्ष के दौरान जारी की जाती है, तो उसकी अवधि 31 मार्च को समाप्त मानी जायेगी।
(3) यदि इन नियमों के अंतर्गत अनुज्ञप्ति/अनुज्ञप्तियां, आबकारी वर्ष के किसी भाग के लिए जारी की जाती है, तो अनुज्ञप्ति फीस की राशि, उस सम्पूर्ण आबकारी वर्ष की अनुज्ञप्ति फीस के बराबर होगी। 10. अनुज्ञप्ति मात्रा में कमी अथवा वृद्धि करना.- (1) अनुज्ञापन प्राधिकारी, इन नियमों के अंतर्गत स्वीकृत की गई किसी भी अनुज्ञप्ति/अनुज्ञप्तियों में वर्णित मोलासिस की मात्रा को आवश्यकतानुसार कम अथवा अधिक कर सकेंगे।
(2) यदि अनुज्ञप्ति अवधि के दौरान अनुज्ञप्त मात्रा में वृद्धि की जाती है, तो बढ़ी हुई मात्रा के लिए देय अनुज्ञप्ति फीस का अग्रिम संदाय करना अनिवार्य होगा।
(3) यदि अनुज्ञप्ति अवधि के दौरान अनुज्ञप्त मात्रा में कमी की जाती है, तो पूर्व में संदाय अनुज्ञप्ति फीस वापसी योग्य नहींं होगी।
11. राज्य के भीतर मोलासिस पर शुल्क.- इन नियमों के अंतर्गत स्वीकृत की गई अनुज्ञप्ति/अनुज्ञप्तियों के अंतर्गत राज्य के भीतर मोलासिस पर मोलासिस शुल्क रू 200/-प्रति टन की दर से देय होगा। मोलासिस पर शुल्क का भुगतान क्रेता द्वारा किया जायेगा। ऐसा शुल्क, मोलासिस परिवहन हेतु अनुज्ञापत्र प्राप्त करने के पूर्व जमा किया जायेगा।
स्पष्टीकरण ः- विहित प्ररूप एम-3 के अन्तर्गत अनुज्ञप्तिधारी से मोलासिस क्रय करने पर मोलासिस पर शुल्क देय नहीं होगा।
12. आयात.- (1) प्ररूप एम-1/एम-2/एम-3/एम-4 का अनुज्ञप्तिधारी, जो मोलासिस का आयात करना चाहता है, विहित प्ररूप एम-5(क) में अनुज्ञापन प्राधिकारी के समक्ष आवेदन प्रस्तुत करेगा। सम्यक् जांच के उपरान्त अनुज्ञापन प्राधिकारी, प्ररूप एम-5 में अनुज्ञापत्र जारी करेगा।
(2) आयात अनुज्ञापत्र हेतु, रू. 400/- प्रति टन की दर से आयात शुल्क देय होगा। जमा किया गया शुल्क, वापसी योग्य नहीं होगा।
(3) आयात अनुज्ञापत्र, विहित प्ररूप एम-5 में होगा तथा निम्नानुसार प्रेषित किया जायेगा :-
| भाग (एक) | -जारी करनेे वाले प्राधिकारी के कार्यालय में कार्यालयीन प्रति के रूप मेें रखा जायेगा। |
| भाग (दो) | -मोलासिस की आपूर्ति करने वाले व्यक्ति को भेजा जायेगा। |
| भाग (तीन) | -आवेदक को दिया जायेगा, जिसे वह परिवहन के समय मोलासिस के साथ रखेगा तथा अंतिम में आयातकर्ता के अभिलेख के रूप में रहेगा। |
| भाग (चार) | -जहां से मोलासिस का आयात किया जा रहा है, उस स्थान के आबकारी आयुक्त/आबकारी अधिकारी को प्रेषित किया जायेगा। |
13. निर्यात.- (1) विहित प्ररूप एम-1/एम-3 का अनुज्ञप्तिधारी, विहित प्ररूप एम-6(क) में अनुज्ञापन प्राधिकारी को आवेदन प्रस्तुत करेगा। सम्यक् जांच के उपरांत अनुज्ञापन प्राधिकारी, प्ररूप एम-6 में निर्यात अनुज्ञापत्र जारी करेगा।
(2) निर्यात अनुज्ञापत्र हेतु, रू. 200/- प्रति टन के समतुल्य निर्यात शुल्क देय होगी। इस प्रकार जमा शुल्क वापसी योग्य नहीं होगा। (3) निर्यात अनुज्ञापत्र, विहित प्ररूप एम-6 चार भाग में होगा तथा निम्नानुसार प्रेषित किया जायेगाः-
| भाग (एक) | -जारी करनेे वाले प्राधिकारी के कार्यालय में कार्यालयीन प्रति के रूप में रखा जायेगा। |
| भाग (दो) | -मोलासिस की आपूर्ति करने वाले के पास रखा जायेगा। |
| भाग (तीन) | -आवेदक को दिया जायेगा, जिसे वह परिवहन के समय मोलासिस के साथ रखेगा तथा अंतिम में प्राप्तकर्ता के अभिलेख के रूप में रहेगा। |
| भाग (चार) | -जहां पर मोलासिस का निर्यात किया जा रहा है, उस स्थान के आबकारी आयुक्त/आबकारी अधिकारी को प्रेषित किया जायेगा। |
14. परिवहन अनुज्ञापत्र.- (1) इन नियमों के अधीन कोई व्यक्ति या अनुज्ञप्तिधारी, जो मोलासिस का परिवहन करना चाहता है, अनुज्ञापन प्राधिकारी को परिवहन अनुज्ञापत्र प्राप्त करने हेतु प्ररूप एम-7(क) में आवेदन प्रस्तुत करेगा।
(2) उक्त उप-नियम के अंतर्गत आवेदन प्राप्त होने पर, अनुज्ञापन प्राधिकारी, यदि आवश्यक समझे, परिवहन अनुज्ञापत्र हेतु आवश्यक जांच करा सकेगा, किन्तु यदि दी गई जानकारी से संतुष्ट हो तथा वहां अनुज्ञापत्र देने में कोई आपत्ति न हो, तो वह विहित प्ररूप एम-7 में, रू. 200/- प्रति परिवहन, परिवहन शुल्क के रूप में जमा करने पर, परिवहन अनुज्ञापत्र जारी कर सकेगा।
(3) परिवहन अनुज्ञापत्र, विहित प्ररूप एम-7 चार भाग में होगा तथा निम्नानुसार प्रेषित किया जायेगा :-
| भाग (एक) | -जारी करनेे वाले प्राधिकारी के कार्यालय में कार्यालयीन प्रति के रूप में रखा जायेगा। |
| भाग (दो) | -मोलासिस की आपूर्ति करने वाले व्यक्ति को दिया जायेगा। |
| भाग (तीन) | -आवेदक को दिया जायेगा, जिसे वह परिवहन के समय मोलासिस के साथ रखेगा तथा अंतिम में आवेदक के अभिलेख के रूप में रहेगा। |
| भाग (चार) | -जहां से मोलासिस परिवहन किया जा रहा है, उस स्थान के आबकारी अधिकारी को प्रेषित किया जायेगा। |
15. मोलासिस का संग्रहण एवं मापन (गेजिंग).- (1) अनुज्ञप्तिधारी, जिनके पास विहित प्ररूप एम-1/एम-2/ एम-3/एम-4 अनुज्ञप्ति हो, जिसमें मोलासिस संग्रहित किया गया हो, उन संग्रहित टैंक/पात्र को सम्यक् रूप से क्रमांकित किया जाकर संग्रहित किया जायेगा तथा उस पर संग्रहण क्षमता का उल्लेख किया जायेगा। इन संग्रहित टैंक/पात्र को हमेशा अच्छी स्थिति में साफ-सुथरा रखा जायेगा।
(2) मोलासिस संग्रहण हेतु स्थापित समस्त संग्रहित टैंक/पात्र का मापन (गेजिंग), आबकारी आयुक्त द्वारा विहित प्रक्रिया के अनुसार किया जायेगा।
16. मोलासिस का हटाया जाना एवं अनुज्ञप्ति से संबंधित विवरण प्रदर्शित करना.- (1) विहित आधिपत्य सीमा की मात्रा के सिवाय, वैध परिवहन अनुज्ञापत्र के बिना, कोई भी अनुज्ञप्तिधारी, मोलासिस की किसी भी मात्रा को अनुज्ञप्त परिसर से नहीं हटायेगा और न ही किसी को ऐसा करने की अनुमति देगा।
(2) अनुज्ञप्तिधारी, अपने परिसर में अनुज्ञप्ति को प्रदर्शित करेगा तथा अनुज्ञप्ति से संबंधित विवरण, साइन बोर्ड के माध्यम से भी प्रदर्शित करेगा।
17. मोलासिस का लेखा तथा निरीक्षण इत्यादि.- (1) स्वीकृत अनुज्ञप्ति/अनुज्ञप्तियों के परिसर में संग्रहित मोलासिस का समग्र लेखा, विहित प्ररूप एम-8 एवं टैंक/पात्र वार लेखा, विहित प्ररूप एम-8(क) में संधारित किया जायेगा।
(2) जांचकर्ता अधिकारी द्वारा मांग किये जाने पर, मोलासिस की गुणवत्ता जांच हेतु अनुज्ञप्तिधारी, किसी भी टैंक/पात्र से मोलासिस को, बिना किसी मूल्य के, उपलब्ध करायेगा।
(3) उपरोक्त प्रयोजनों के लिए, अनुज्ञप्तिधारी, एक निरीक्षण पुस्तिका संधारित करेगा तथा मांग किये जाने पर, जांचकर्ता अधिकारी के समक्ष उपलब्ध करायेगा।
(4) अनुज्ञप्तिधारी, मांग किये जाने पर जांचकर्ता अधिकारी के समक्ष लेखा पंजी, अनुज्ञप्ति, निरीक्षण पुस्तिका प्रस्तुत करेगा। अनुज्ञप्तिधारी, अनुज्ञप्त परिसर में मोलासिस संग्रहण हेतु धारित समस्त टैंक/पात्र को निरीक्षण हेतु खुला रखेगा। 18. व्यवसाय का समापन.- किसी अनुज्ञप्तिधारी, जो अपना व्यवसाय समाप्त करना चाहता हो, वह एक माह पूर्व अनुज्ञापन प्राधिकारी को सूचना देगा। अनुज्ञापन प्राधिकारी, इन नियमों के अधीन आवश्यक जांच के उपरांत आवेदन का निराकरण करेगा।
19. घरेलू प्रयोजन हेतु मोलासिस का कब्जा एवं परिवहन.- (1) उपरोक्त नियमों में उल्लिखित नियमों के होते हुए भी, कोई व्यक्ति, बिना किसी अनुज्ञप्ति या अनुज्ञापत्र के, केवल घरेलू उपयोग हेतु एक निश्चित मात्रा तक मोलासिस कब्जे में रख सकेगा तथा उसका परिवहन कर सकेगा। उक्त प्रयोजन हेतु मोलासिस की अनुज्ञेय मात्रा, एक समय में 20 कि.ग्रा. होगी।
(2) घरेलू उपयोग हेतु मोलासिस का क्रय, केवल एम-3 के अनुज्ञप्तिधारी से ही किया जा सकेगा। (3) एम-3 अनुज्ञप्तिधारी, घरेलू उपयोग हेतु मोलासिस के क्रेता का विवरण एक पंजी में संधारित करेगा। 20. हानियां, उनकी सीमा एवं शास्ति.- (1) इन नियमों के अंतर्गत स्वीकृत अनुज्ञप्ति/अनुज्ञप्तियों हेतु मोलासिस की हानि की सीमा निम्नानुसार होगीः-
(एक) भण्डारण हानिः- मोलासिस की भण्डारण हानि की स्वीकृत सीमा, एक समय में धारित मोलासिस की कुल मात्रा का अधिकतम 1ः होगी।
(दो) परिवहन हानिः- परिवहन के दौरान कुल मात्रा का अधिकतम 1ः अनुज्ञेय होगा। (तीन) रेकिंग हानिः- रेकिंग के दौरान मोलासिस की कुल मात्रा का 1ः अनुज्ञेय होगा। (चार) अन्य हानि :- उपरोक्त उल्लिखित हानि के अलावा अन्य किसी भी प्रकार की हानि के संबंध में, आबकारी आयुक्त द्वारा लिया गया निर्णय/आदेश, अंतिम होगा। (2) स्वीकृत सीमा से अधिक हानि होने पर, रूपये 10/- प्रति कि.ग्रा. तक की दर से शास्ति, अधिरोपित की जा सकेगी।
21. शास्तियां.- किसी नियम अथवा अनुज्ञप्ति की किन्हीं शर्तों के भंग या उल्लंघन की स्थिति में, छाीसगढ़ आबकारी अधिनियम, 1915 की धारा 48 की उप-धारा (1) के अधीन विहित शास्ति की सीमा के होते हुए भी, अनुज्ञापन प्राधिकारी, इस नियम के प्रावधान के अधीन रू. 10,000/- से अनधिक शास्ति अधिरोपित कर सकेगा।
22. अनुज्ञप्ति का निलम्बन एवं निरस्तीकरण.- अनुज्ञापन प्राधिकारी, इन नियमों के अधीन बनाये गये किसी नियम या अधिनियम के किसी प्रावधान या अधिनियम के अधीन बनाये गये किसी नियम या आबकारी आयुक्त के किसी आदेश या निर्देश का उल्लंघन होने पर, अधिनियम के अधीन अनुज्ञप्ति को निलंबित या निरस्त कर सकेगा।
23. प्रतिभूति.- इन नियमों के अंतर्गत स्वीकृत अनुज्ञप्ति का अनुज्ञप्तिधारी द्वारा अनुज्ञप्ति की शर्तों के उल्लंघन पर अधिरोपित शास्ति की पूर्ति के अनुक्रम में, अनुज्ञप्ति फीस के 25ः के समतुल्य राशि नगद या बैंक गारंटी के रूप में प्रतिभूति देगा। अनुज्ञप्तिधारी, तत्काल शास्ति भुगतान करने के लिए उत्तरदायी होगा। यदि अनुज्ञप्तिधारी अधिरोपित शास्ति का भुगतान करने में असफल रहता है, तो रकम, नगद या बैंक गारंटी के रूप में जमा प्रतिभूति से वसूल कर ली जायेगी। ऐसी वसूल की गई रकम की पूर्ति, अनुज्ञप्तिधारी द्वारा 7 दिन के भीतर किया जायेगा।
24. कठिनाईयों का निराकरण.- छत्तीसगढ़ मोलासिस नियंत्रण एवं विनियमन नियम, 2022 के संबंध में कोई संदेह या विवाद की दशा में, आबकारी आयुक्त द्वारा लिया गया निर्णय/निर्देश, अंतिम होगा।
25. निरसन.- इन नियमों के तत्स्थानी तथा इन नियमों के प्रारंभ से तत्काल पूर्व प्रवृा समस्त नियम, इन नियमों के अंतर्गत आने वाले विषयों के संबंध में एतद्द्वारा निरसित किये जाते हैं।

शर्तें
1. अनुज्ञप्तिधारी, आबकारी आयुक्त की अनुमति के बिना, अनुज्ञप्त परिसर से भिन्न किसी भी अन्य स्थान पर न तो मोलासिस का भण्डारण करेगा और न ही उसका विक्रय करेगा।
2. अनुज्ञप्तिधारी, आबकारी आयुक्त की लिखित अनुमति के बिना, अनुज्ञप्त परिसर में उत्पादित मोलासिस से भिन्न किसी भी अन्य मोलासिस को, न तो प्राप्त करेगा और न भण्डारण करेगा।
3. अनुज्ञप्तिधारी, ऐसे व्यक्तियों को मोलासिस का विक्रय नही करेगा, जो विहित प्ररूप एम-2, एम-3, या एम-4 में मोलासिस की अनुज्ञप्ति धारित न करते हों।
4. अनुज्ञप्तिधारी, अनुज्ञप्ति की अवधि के दौरान भंडारण टैंक या अन्य पात्र से नियम 3 के उद्देश्यों हेतु निर्धारित मोलासिस की अधिकतम मात्रा .......... टन को छोडकर किसी भी अन्य उद्देश्य के लिये उपयोग नही करेगा। 5. अनुज्ञप्तिधारी, विहित पंजी में नियमित दैनिक लेखा संधारित करेगा और जांचकर्ता प्राधिकारी द्वारा निरीक्षण के लिये मांगे जाने पर, लेखा पंजी, निरीक्षण पुस्तिका, समस्त प्राप्त अनुज्ञापत्र एवं समस्त सुसंगत अभिलेख जांच हेतु प्रस्तुत करेगा।
6. अनुज्ञप्तिधारी, प्रारंभिक बचत, आमद/उत्पादन, विक्रय एवं अंतिम बचत की मासिक विवरणी आगामी माह की 07 तारीख तक जिले के संबंधित आबकारी अधिकारी के माध्यम से आबकारी आयुक्त को प्रस्तुत करेगा। अनुज्ञप्तिधारी, ऐसी विवरणी और अन्य सूचनाएं भी, जो समय समय पर उपायुक्त, सहायक आयुक्त, एवं जिला आबकारी अधिकारी द्वारा अपेक्षित किया जाये, प्रस्तुत करेगा।
7. अनुज्ञप्तिधारी, अनुज्ञप्त परिसर, भंडारण टैंक की समुचित देखरेख तथा मोलासिस संग्रहण के समस्त पात्रों के साथ ही अनुज्ञप्त परिसर कीे सफाई एवं स्वच्छता के लिये, उत्तरदायी होगा।
8. छत्तीसगढ आबकारी अधिनियम, 1915 (क्र. 2 सन् 1915) के किसी उपबंध अथवा उसके अधीन बनाये गए किसी नियम अथवा आबकारी आयुक्त द्वारा जारी किये गए किसी आदेश के उल्लंघन पर, यह अनुज्ञप्ति, निलंबित अथवा रदद् किये जाने के अध्यधीन होगी।
9. अनुज्ञप्ति जारी होने के साथ, अनुज्ञप्तिधारी, अनुज्ञप्ति की शर्तों तथा राज्य शासन/आबकारी आयुक्त/कलेक्टर/उपायुक्त आबकारी/सहायक आयुक्त आबकारी/जिला आबकारी अधिकारी के आदेशों/निर्देशों से आबद्ध होगा ।

शर्तें
1. अनुज्ञप्तिधारी, अनुज्ञापन प्राधिकारी की अनुमति के बिना, अनुज्ञप्त परिसर से भिन्न किसी भी अन्य स्थान पर, न तो मोलासिस का भण्डारण करेगा और न ही उसका विक्रय करेगा।
2. अनुज्ञप्तिधारी, अपने अनुज्ञप्त परिसर में किसी भी समय निर्धारित मोलासिस की अधिकतम मात्रा.......................से अधिक संग्रहण नहीं करेगा।
3. अनुज्ञप्तिधारी, निर्धारित कुल मात्रा...............क्विंटल से अधिक मात्रा का भण्डारण नहीं करेगा तथा अनुज्ञप्तिधारी, अनुज्ञप्ति अवधि के दौरान..........................................क्विंटल से अधिक मात्रा में विक्रय नही करेगा।
4. अनुज्ञप्तिधारी, निम्न व्यक्तियों को मोलासिस का विक्रय नहीं करेगा :-
(क) ऐसा व्यक्ति, जो विहित प्ररूप एम-2/ एम-3/ एम-4 में मोलासिस की अनुज्ञप्ति धारित न करता हो ।
(ख) छत्तीसगढ मोलासिस नियंत्रण एवं विनियमन नियम, 2022 के नियम 19 के अंतर्गत घरेलू कार्य हेतु स्वीकृत निर्धारित मात्रा से अधिक मात्रा में मोलासिस का किसी भी व्यक्ति को विक्रय नहीं करेगा। 5. अनुज्ञप्तिधारी, विहित पंजी में नियमित दैनिक लेखा संधारित करेगा और जांचकर्ता प्राधिकारी द्वारा निरीक्षण के लिये मांगे जाने पर, लेखा पंजी, निरीक्षण पुस्तिका, समस्त प्राप्त अनुज्ञापत्र एवं समस्त सुसंगत अभिलेख जांच हेतु प्रस्तुत करेगा।
6. अनुज्ञप्तिधारी, जिले के संबंधित आबकारी अधिकारी के माध्यम से अनुज्ञापन अधिकारी को प्रारंभिक बचत, आमद/उपयोग एवं अंतिम बचत की मासिक विवरणी आगामी माह की 07 तारीख तक प्रस्तुत करेगा। अनुज्ञप्तिधारी, ऐसी विवरणी और अन्य सूचनाएं भी, जो उपायुक्त, सहायक आयुक्त एवं जिला आबकारी अधिकारी द्वारा अपेक्षित किया जाये, प्रस्तुत करेगा।
7. छत्तीसगढ आबकारी अधिनियम, 1915 (क्र. 2 सन् 1915) के किसी उपबंध अथवा उसके अधीन बनाये गए किसी नियम अथवा आबकारी आयुक्त द्वारा जारी किये गए किसी आदेश के उल्लंघन पर, यह अनुज्ञप्ति, निलंबित अथवा रदद् किये जाने के अध्यधीन होगी।
8. अनुज्ञप्ति जारी होने के साथ, अनुज्ञप्तिधारी, अनुज्ञप्ति की शर्तों तथा राज्य शासन/आबकारी आयुक्त/कलेक्टर/उपायुक्त आबकारी/सहायक आयुक्त आबकारी/जिला आबकारी अधिकारी के आदेशों/निर्देशों से आबद्ध होगा ।

शर्तें
1. अनुज्ञप्तिधारी, बैगो मोलासिस को एम-1 या एम-3 अनुज्ञप्तिधारी से क्रय करने के पश्चात् स्वंय के अनुज्ञप्त परिसर मे लाने तक के परिवहन के दौरान मार्ग में नही खोलेगा।
2. अनुज्ञप्तिधारी, बैगो मोलासिस का उपयोग पशुआहार के अतिरिक्त किसी अन्य प्रयोजन के लिय नहीं करेगा।
3. अनुज्ञप्तिधारी, विहित पंजी में नियमित दैनिक लेखा संधारित करेगा और जांचकर्ता प्राधिकारी द्वारा निरीक्षण के लिये मांगे जाने पर, लेखा पंजी, निरीक्षण पुस्तिका, समस्त प्राप्त अनुज्ञापत्र एवं समस्त सुसंगत अभिलेख जांच हेतु प्रस्तुत करेगा।
4. अनुज्ञप्तिधारी, जिले के संबंधित आबकारी अधिकारी के माध्यम से अनुज्ञापन अधिकारी को प्रारंभिक बचत, आमद/उपयोग एवं अंतिम बचत की मासिक विवरणी आगामी माह की 07 तारीख तक प्रस्तुत करेगा। अनुज्ञप्तिधारी, ऐसी विवरणी और अन्य सूचनाएं भी, जो उपायुक्त, सहायक आयुक्त एवं जिला आबकारी अधिकारी द्वारा अपेक्षित किया जाये, प्रस्तुत करेगा।

NOTIFICATION
No. F 10-35/2019/C.T.(Ex.)/V(56).⸺ In exercise of the powers conferred by clause (c) of Section 8, sub-section (1) and clause (f), (g), (h) of sub-section (2) of Section 62 read with proviso to sub-section (3) of Section 62 of the Chhattisgarh Excise Act, 1915 (No. 2 of 1915), the State Government, hereby, makes the following rules, for the purposes of control and regulation of supply, possession, sale, consumption, transport, import, export, license and permits for the use of molasses for distillation of spirit in distillery or for purpose to use as scientific, industrial, agricultural, educational, medicine, cattle-feed etc. of Molasses, namely:-
RULES
1. Short title, extent and commencement.- (1) These rules may be called the Chhattisgarh Molasses Control and Regulation Rules, 2022.
(2) It shall extend to the whole State of Chhattisgarh.
(3) These rules shall come into force on the date of their publication in the Official Gazette.
2. Definitions.- (1) In these rules, unless the context otherwise requires,
(a) "Act" means, the Chhattisgarh Excise Act, 1915 (No. 2 of 1915), as amended from time to time;
(b) "Excise Year" means, the financial year which starts from 1st April of the calendar year ending at 31st of March;
(c) "Molasses" means, the thick, dark coloured syrup obtained at the end of manufacture of sugar and jaggery which in the liquid form contains sugar, which can be fermented;
Note:- The general molasses used in the cattle feed are Bago-Molasses;
(d) "Sugar mill" means place where sugar, unprocessed sugar or jaggery is manufactured through open process or vaccum process, with the use of electricity;
(e) "Owner of sugar mill" means the person who has the entire control over all the works related to sugar mill;
(f) "Prescribed forms" means, the forms attached with these rules;
(g) "Licensing authority" means, the Excise Commissioner or Collector of the district;
(h) "Licensee" means, a person holding appropriate license under these rules;
(i) "License premises" means, the premises for which a license has been issued under these rules;
(j) "Producer of molasses" means the owner of the mill or manager of the place where molasses is being produced during the manufacture of sugar or jaggery;
(k) "License" means, the license/ licenses approved under these rules;
(l) "Collector" means the chief officer of the revenue administration of the district;
(m) "Excise Commissioner" means, the Excise Commissioner appointed/ defined under Chhattisgarh Excise Act. 1915;
(n) "Excise Officer" means an Excise officer appointed/defined under Chhattisgarh Excise Act. 1915 who shall not be below the rank of Excise Sub-Inspector.
(2) The words and expressions used in these rules, but not defined, shall have the same meaning as assigned to them in the said Act.
3. Restriction on the use of molasses.- The use of molasses could not be done except in following objectives :-
(1) For the distillation of spirit in the distilleries established under the Act. (2) Any scientific, industrial, medicinal, agricultural, cattle feed, educational or such other objectives which could be decided time to time by the Excise Commissioner.
4. License and Permits.- (1) Forms of following license, permit and application have been prescribed in these rules :-

(2) Form M-1 license shall be issued by the Excise Commissioner. All other licenses shall be issued by the Collector of the district concerned.
(3) The license under these rules may be provided to only those applicants who are eligible to hold a license under the Act and rules made thereunder.
(4) An application fees of Rs. 500 (five hundred) per application has to be submitted along with the application form prescribed for any license under these rules.
5. Possession and sale by a manufacturer of molasses.- (1) Any person, who is a manufacturer of molasses and expects to sell it after possession, shall present an application in the prescribed Form M-1 (a) before the Excise Commissioner. (2) On the receipt of an application in Form M-1(a), the Excise Commissioner, on being satisfied after necessary verifications shall provide a license in Form M-1 after the deposition of annual license fees in advance, prescribed on the basis of quantity of production as per following :-
(a) If the annual production of molasses is not more than 10,000 metric tons – Rs. 50,000/-
(b) If the annual production of molasses is more than 10,000 metric tons but up to 20,000 metric tons – Rs.1,00,000/-
(c) If the annual production of molasses is more than 20,000 metric tons – Rs1,50,000/-
Explanation- The M-1 license for possession and sale of molasses shall not be provided unless the molasses is produced as a by-product in the process of production of sugar or jaggery in his own sugar or jaggery production unit.
(3) Renewal of license:- On the deposition of annual license fees as prescribed by the state government, which may be subject to revision, in advance and on the basis of good conduct, proper records and follow of license conditions and provisions under the act and rules thereof, the license under sub-rule 2 of rule 5 may be renewed annually.
6. Possession and use of molasses.- (1) Any person, except the manufacturer of molasses, who expects to possess and use molasses, can apply to the licensing authority, in the prescribed Form M-2(a).
(2) On the receipt of an application under sub-rule (1) the licensing authority, on being satisfied after necessary verifications shall provide a license in Form M-2 after the deposition of annual license fees in advance, prescribed on the basis of quantity of molasses as per following :-
(i) For any government purpose or educational, scientific, medicinal or sampling purpose, the license fees - Rs. 50,000/-
(ii) License fees for the agricultural purpose - Rs. 50,000/-
(iii) For any other commercial purpose where the quantity of molasses :-
(a) Up to 10,000 metric tons - Rs. 50,000/-
(b) More than 10,000 metric tons - Rs. 1,00,000/-
but up to 20,000 metric tons
(c) More than 20,000 metric tons - Rs. 1,50,000/-
(3) Renewal of license- On the deposition of annual license fees as prescribed by the State Government, which may be subject to revision, in advance and on the basis of good conduct, proper records and follow of license conditions and provisions under the Act and Rules thereof, the license under sub-rule (2) of rule 6 may be renewed annually.
7. Possession and sale of molasses.- (1) Any person, except the manufacturer of molasses, who expects to possess and sell molasses, can apply to the licensing authority in the prescribed Form M-3 (a).
(2) On the receipt of an application under sub-rule (1), the licensing authority, on being satisfied after necessary verifications shall provide a license in Form M-3, after the deposition of annual license fees of Rs. 1,00,000/- in advance.
(3) Renewal of license- On the deposition of annual license fees as prescribed by the State Government, which may be subject to revision, in advance and on the basis of good conduct, proper records and follow of license conditions and provisions under the act and rules there-of, the license under sub-rule (2) of rule 7 may be renewed annually.
8. Purchase, possession and use of molasses for cattle-feed only.-
(1) Even after any provisions in these rules, any person who is not a manufacturer of molasses, wants to purchase, possess and use Bago molasses for cattle feed only, he can apply to the licensing authority in the prescribed Form M-4 (a) with the description of quantity of Bago molasses needed per month.
(2) On the receipt of an application under sub-rule (1), the licensing authority, on being satisfied after necessary verifications shall provide a license in Form M-4, after deposition of annual license fees, of Rs. 25,000/- , in advance.
(3) Renewal of license:- On deposition of annual license fees, as prescribed by the State Government, which may be subject to revision, in advance and on the basis of good conduct and follow of license conditions and provisions under the act and rules thereof, the license under sub-rule (2) of rule 8 may be renewed annually.
9. Period of license and calculation of fees.- (1) No person can sell the molasses unless he possesses a license in Form M-1 (as per rule 5) or in Form M-3 (as per rule 7) or in Form M-4 (as per rule 8) under these rules.
(2) The license/licenses under these rules shall be issued for an Excise year i.e. from 01st April to 31st March. If any license/licenses has been issued during the excise year, its period shall end on 31st March.
(3) If any license/licenses under these rules is issued for any part of the Excise year, then the amount of license fees shall be the same as that of the entire Excise Year.
10. To increase or decrease the licensed quantity.- (1) The licensing authority could increase or decrease the quantity of molasses mentioned in the license/licenses approved under these rules, as per the need.
(2) If the licensed quantity is increased during the license period, then the advance deposition of payable increase in license fees shall be compulsory.
(3) If the licensed quantity is decreased during the license period, then the deposited license fees prior shall not be refunded.
11. Duty on molasses within the State.- The molasses duty at the rate Rs. 200/- per ton shall be applicable on the molasses within the state, upon the license/licenses approved under these rules. The duty on molasses shall be payable by the purchaser. Such duty shall be deposited prior to the receipt of permit for transportation of the molasses.
Explanation- The duty on molasses shall not be payable on the purchase from the licensee under Form M-3.
12. Import.- (1) A license holder under Form M-1/M-2/M-3/M-4/, who desires to import the molasses, shall present an application in prescribed Form M-5(a), before the licensing authority. After due verification, the licensing authority shall issue a permit in Form M-5.
(2) An import fees of Rs.400/- per ton shall be payable for on import permit. The deposited fees shall not be refundable.
(3) The import permit shall be in the prescribed Form M-5 and shall be issued as follows :-
| Part(I) | - Shall be kept as office copy in the office of the issuing authority. |
| Part(II) | - Shall be sent to the supplier of molasses. |
| Part(III) | - Shall be given to the applicant which shall accompany the molasses during transportation and finally be the record of importer. |
| Part(IV) | - Shall be sent to Excise Commissioner/Excise officer of the place from where molasses is being imported. |
13. Export.- (1) A license holder under prescribed Form M-1/M-3 shall apply before the licensing authority in the Form M-6(a). After due verification the licensing authority shall issue an Export permit in the Form M-6.
(2) An export fee equivalent to Rs. 200/- per ton shall be payable for export permit. The fees deposited for the purpose shall be non-refundable.
(3) The export permit shall be in the prescribed Form M-6 in four parts and shall be issued as follows:-
| Part(I) | - Shall be kept as office copy in the office of the issuing authority. |
| Part(II) | - Shall be kept to the supplier of the molasses. |
| Part(III) | - Shall be given to the applicant which shall accompany the molasses during transportation and finally be the record of the receiver. |
| Part(IV) | - Shall be sent to Excise Commissioner/Excise officer of the place from where molasses is being exported. |
14. Transport permit.- (1) A person or a licensee under these rules, wishing to transport the molasses, shall apply to the licensing authority for receiving the transport permit, in Form M-7(a).
(2) Under said sub-rule, on the receiving application, licensing authority if finds necessary may get necessary verification for transport permit, but if on satisfaction on the information's furnished and there is no objection to provide permit, then on deposition of Rs. 200/- in prescribed Form M-7 per transportation as transport fees, the transport permit may be issued.
(3) The Transport permit shall be in the prescribed Form M-7 in four parts and shall be issued as follows:-
| Part(I) | - Shall be kept as office copy in the office of the issuing authority. |
| Part(II) | - Shall be provided to the supplier the molasses. |
| Part(III) | - Shall be given to the applicant which shall accompany the molasses during transportation and finally be the record of the applicant. |
| Part(IV) | - Shall be sent to Excise officer of the place from where molasses is being transported. |
15. Storage and measurement (gauging) of molasses.- (1) The licensees having license in Form M-1/M-2/M-3/M-4, in which molasses in being stored, shall be stored in storage tanks/containers duly provided with the serial number and storage capacity mentioned on them. These storage tanks/containers shall always be kept in good condition and clean.
(2) All the storage tanks/containers established for the storage of molasses shall be gauged through the prescribed process by Excise Commissioner.
16. Removal of molasses and display of description regarding license.- (1) Any licensee shall neither remove any quantity of molasses beyond prescribed possession limit, from its licensed premises without valid transport permit nor allow anybody to do so.
(2) The licensee shall display the license in its premises and shall also display the details regarding the license, through sign board.
17. Accounts and inspection etc. of molasses.- (1) The storage of molasses in the premises of the license/licenses approved, shall be done with the maintenance of total accounts of molasses in the prescribed from M-8 and tank/container wise in the Form M-8(a).
(2) The licensee shall provide molasses from any tank/container, as desired by the investigating officer, for checking the quality of the molasses, without cost.
(3) The licensee shall maintain an inspection note-book for the above purposes and shall present before the investigating officer on demand.
(4) The licensee shall present the accounts register, license, inspection notebook, before the investigating officer, on demand. The licensee shall provide open all the tanks/containers for storage of molasses in the licensed premises, for investigation.
18. Closure of business.- Any licensee, who desires to close his business shall inform the licensing authority one month in advance. The licensing authority shall dispose such application after necessary investigations under the rules.
19. Possession and transport of molasses for domestic purpose.-
(1) Even after the rules mentioned in the above rules, any person can possess and transport molasses up to a specific quantity for domestic use without any license and permit. The permissible limit of molasses for the above purpose shall be 20k.g. at a point of time.
(2) The purchase of molasses for the domestic use shall be done only from the license M-3 holder.
(3) The M-3 licensee shall maintain the details of the purchaser of molasses for domestic use, in a register.
20. Losses, its limit and penalty.- (1) The losses of molasses for the license/licenses approved in these rules shall be limited as follows:-
(i) Storage losses:- The approved limit of storage losses of molasses shall be maximum 1% of the total quantity of molasses stored at a point of time.
(ii) Transit losses:- Maximum 1% of the total quantity being transported, shall be permissible.
(iii) Racking losses:- Total of 1% of the quantity molasses under racking shall be permissible.
(iv) Other losses:- Apart from the above mentioned losses, for any other losses incurred the decision/orders of the Excise Commissioner shall be final.
(2) A penalty of upto Rs.10/- per kilo gram may be imposed on any losses above the approved limits.
21. Penalties.- Notwithstanding the limit of penalty prescribed under sub-section (1) of Section 48 of the Chhattisgarh Excise Act, 1915, the licensing authority, in the event of any breach or contravention of any rules or conditions of license, may impose a penalty not exceeding Rs.10,000/- under the provisions of this rule. 22. Suspension and cancellation of license.- The licensing authority may suspend or cancel the license under provisions of Act, on the breach of any rules made under these rules or provisions of the Act or any rules made under the Act or any orders or instructions of Excise Commissioner.
23. Security.- The licensee approved under these rules shall present a security in the form of cash or bank guarantee of an amount equivalent to 25% of the license fees in order to fulfill the penalty imposed on the breach of any license condition by the licensee. The licensee shall be liable to pay the penalty immediately. In case the licensee fails to pay the penalty imposed, the amount shall be recoverable from the security deposited in the form of cash/bank guarantee. The depleted amount shall be fulfilled by the licensee within a period of 7 days.
24. Removal of difficulties.- In case of any doubt or dispute regardin the Chhattisgarh Molasses Control and Regulation Rules, 2022, the decision/instructions of the Excise Commissioner, shall be final.
25. Repeal.- All rules corresponding to these rules and in force immediately before the commencement of these rules are hereby repealed in respect of matter covered by these rules.

CONDITIONS
1. The licensee shall neither store or sell the molasses from any other place than the approved premises, without the permission of Excise Commissioner.
2. The licensee shall neither receive or store any molasses other than that manufactured within the premises, without the written permission of Excise Commissioner.
3. The licensee shall not sell the molasses to any person/persons who does not possess the molasses license in the prescribed Form M-2, M-3 or M-4.
4. The licensee shall not use the molasses for any other purpose except the maximum quantity of …………….. tons prescribed for the purpose in rule 3, from the storage tank or other container during the license period.
5. The licensee shall maintain daily accounts regularly in the prescribed register and shall present the accounts register, inspection note book, all the permits received and all relevant documents for inspection on demand by the inspecting officer.
6. The licensee shall present the monthly statement regarding opening balance, receipt/production, sale and closing balance to the Excise Commissioner through the concerned excise officer of the district, by the 07th of the next month. The licensee shall also furnish all such statements and other information as desired by the Deputy Commissioner, Assistant Commissioner and District Excise Officer.
7. The licensee shall be responsible for proper maintenance of the licensed premises, storage tanks and take care about the cleanliness of all the containers for the storage of molasses as well as the licensed premises.
8. This license shall be subject to suspension or cancellation on the breach of any provisions of the Chhattisgarh Excise Act, 1915 (No. 2 of 1915) or any rules framed under it or on the breach of any orders issued by the Excise Commissioner. 9. With the issue of the licensee, the licensee shall abide by license conditions and the orders/instructions issued by the State Government/Excise Commissioner/Collector/Deputy Commissioner Excise/ Assistant Commissioner Excise/District Excise Officer.

CONDITIONS
1. The licensee shall neither store or use the molasses at any other place than the approved premises, without the permission of the licensing authority.

The licensee shall also furnish all such statements and other information as desired by the Deputy Commissioner, Assistant Commissioner and District Excise Officer.
6. The licensee shall be responsible for proper maintenance of the licensed premises, storage tanks and take care about the cleanliness of all the containers for the storage of molasses as well as the licensed premises.
7. This license shall be subject to suspension or cancellation on the breach of any provisions of the Chhattisgarh Excise Act, 1915 (No. 2 of 1915) or any rules framed under it or on the breach of any orders issued by the Excise Commissioner. 8. With the issue of the license, the licensee shall abide by license conditions and the orders/instructions issued by the State Government/Excise Commissioner/Collector/Deputy Commissioner Excise/Assistant Commissioner Excise /District Excise Officer.
