क्रमांक एफ 10-7/2019/16. - कारखाना अधिनियम, 1948 (1948 का 63) की धारा 41 द्वारा प्रदत्त शक्तियों
को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ कारखाना नियम, 1962 में निम्नलिखित और संशोधन करती
है, अर्थात् :-

उक्त नियमों में,-
नियम 73 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाये, अर्थात् :-
(1) अधिनियम या नियमों के किसी भी प्रावधानों के अधीन यथा आवश्यक
व्यक्तिगत सुरक्षा उपकरण (पीपीई), सभी श्रमिकों को अनिवार्य रूप से प्रदान किया जाना चाहिए और ऐसे
व्यक्तिगत सुरक्षा उपकरण, प्रासंगिक राष्ट्रीय मानक के अनुरूप होंगे। अधिभोगियों के लिए आवश्यक है कि
श्रमिकों को ऐसे व्यक्तिगत सुरक्षा उपकरण का उपयोग कराये और अधिभोगी द्वारा उन्हें उचित स्थिति में
अनुरक्षित रखा जाये। ऐसे सभी व्यक्तिगत सुरक्षा उपकरण की व्यवस्था के लिए श्रमिकों से अधिभोगी द्वारा
किसी भी प्रकार का कोई भी शुल्क नहीं लिया जायेगा।
(2) उप-नियम (1) के प्रावधानों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, कारखानों में उपयोग हेतु
विभिन्न प्रकार के व्यक्तिगत सुरक्षा उपकरणों के लिए नियम, नीचे दिये गये अनुसार होंगे :-
वे सभी कर्मी, जिनके ऐसी किसी भी जोखिम के सम्पर्क में आने की
संभावना है, जिसके कारण उनके सिर में चोट लग सकती है, उन्हें प्रासंगिक राष्ट्रीय
मानकों के अनुरूप सुरक्षा हेलमेट प्रदान किये जायेंगे। ऐसे व्यक्तिगत सुरक्षा उपकरण के
उचित उपयोग हेतु सभी श्रमिकों को पर्याप्त रूप से प्रशिक्षित किया जायेगा। जब कोई
कार्य, ऊंचाई पर किया जा रहा हो, तो ऐसे सभी सुरक्षा हेलमेट, एक नेप पट्टे के साथ
प्रदान किये जायेंगे। प्रभाव विरोधक किसी भी सुरक्षा हेलमेट का पुनः उपयोग नहीं किया
जाएगा। आकृति या आकार में किसी भी विकृति की जांच के लिए आवधिक सफाई
और दृष्टिक निरीक्षण किया जायेगा।
ऐसे श्रमिक, जो किसी ऐसे जोखिम के संपर्क में आते हैं, जिससे उन्हें
ऊपर से गिर रही सामाग्रियों के माध्यम से उनके पैर या नाखून में अथवा अन्य नुकिली
वस्तुओं से उनके तल्ले को भेद कर, क्षति कारित होने की संभावना हो सकती है, को
सुरक्षात्मक जूते प्रदान किये जायेंगे। कार्यस्थल पर उपयोग किये जाने वाले जूतों का प्रकार
और प्रकृति का विनिश्चय, ऐसे कार्य स्थल पर किये जा रहे कार्य की प्रकृति के आधार पर
अधिभोगी द्वारा किया जायेगा। त्वचा के संक्रामक कवक संक्रमण, जिससे स्केलिंग, पपड़ी
उभरना (फ्लेकिंग) और प्रभावित जगहों पर खुजली होती हो, से बचाव हेतु उचित
कीटाणुशोधन किया जायेगा। सुरक्षात्मक जूते पहनने के उपरांत श्रमिकों को अंतर्वर्धित
नाखून, मेटाटार्सलगिया (प्रपदिकार्ति), एड़ी स्पर (गांठ), हैमर टो (मुड़े पंजे) तथा नस की
क्षति से बचाने के लिए उचित चिकित्सीय देखभाल की जायेगी।
औद्योगिक उपक्रमों में उड़ने वाले कण और टुकड़े,
खतरनाक सामग्री और पिघली हुई धातु की हानिकारक धूल, गैसों या वाष्प, एरोसोल और
विकिरण जैसे जोखिम, जिससे दृष्टिदोष अथवा आखों को क्षति पहुंचने की संभावना हो,
उससे श्रमिकों की आंखो को सुरक्षा प्रदान करने हेतु प्रासंगिक राष्ट्रीय मानक लागू किया
जायेगा। चिकित्सा लेंसों से आंखों की अतिरिक्त सुरक्षा का उपयोग करते हुए यह सुनिश्चित
करेंगे कि सुरक्षात्मक चश्में, चिकित्सा लेंस की उचित प्रास्थिति में व्यवधान उत्पन्न न करे।
वेल्डिंग, कटिंग
और समतुल्य कार्य, जिसमें गैस फ्लेम या इलेक्ट्रिक आर्क का उपयोग किया जा रहा हो, के
दौरान हानिकारक विकिरण, चिंगारी और गर्म धातु के कणों से आपरेटरों के कंधे से ऊपर
बचाव हेतु आशयित अपेक्षित चश्मे, हाथ की ढाल और हेलमेट के लिए, प्रासंगिक राष्ट्रीय
मानक का अनुपालन किया जायेगा।
प्रासंगिक राष्ट्रीय मानक के अनुरूप उपयुक्त दस्ताने,
चमड़े के दस्ताने एवं जाली के दस्ताने का उपयोग श्रमिकों के हाथों को चोट लगने से
बचाने के लिए किया जायेगा। जहाँ त्वचा द्वारा हानिकारक पदार्थों का अवशोषण, गंभीर
जख्म या कटने फटने (पंगु), तीव्र घर्षण, वेधन, रासायनिक जलन, थर्मल जलन एवं अधिक
हानिकारक तापमान जैसे जोखिम के सम्पर्क में हाथ आते हों, वहां सुरक्षात्मक दस्ताने
उपलब्ध कराये जायेंगे। एप्रन के लिए प्रासंगिक राष्ट्रीय मानक के अनुरूप उपयुक्त
सुरक्षात्मक कपड़े (रबरयुक्त, अम्ल तथा क्षार प्रतिरोधी) का उपयोग, ऐसे श्रमिकों की सुरक्षा
के लिये किया जायेगा, जिनके किसी ऐसे जोखिम के संपर्क में आने की संभावना हो,
जिससे उनकी त्वचा को क्षति पंहुच सकती हो ।
शोर के जोखिम के प्रभाव से सुरक्षा
प्रदान की जायेगी, जब ध्वनि का स्तर निर्धारित मानकों से अधिक हो। कान की उपयुक्त
सुरक्षा चयनित करते समय, प्रासंगिक राष्ट्रीय मानक का अनुपालन किया जायेगा। कान में
संक्रमण, स्राव, दर्द आदि के कारण श्रवण क्षमता में ह्नास को रोकने के लिये उपयोग किये
जाने वाले पुनः प्रयोज्य कान रक्षिका का आवधिक कीटाणुशोधन किया जायेगा।
श्रमिकों को धूल, धुएं, गैसों, कणों (पार्टिकुलेट्स) आदि से उनकी
श्वसन सुरक्षा हेतु जोखिम की प्रकृति के आधार पर प्रासंगिक राष्ट्रीय मानक के अनुरूप
श्वसन सुरक्षा उपकरण, कारखाने के अधिभोगी द्वारा प्रदान किए जायेंगे। व्यक्तिगत श्वसन
सुरक्षा उपकरण के उपयोग के कारण होने वाले उत्तेजक त्वचा प्रदाह (इरिटेंट डर्मेटाइटिस),
नाक सेतु घाव (नोज ब्रिज शोर्स) आदि से बचाव के लिए नैदानिक परीक्षण और समुचित
चिकित्सा परीक्षण किया जायेगा।
जोखिम की प्रकृति के आधार पर समुचित व्यक्तिगत सुरक्षा
उपकरण, प्रासंगिक राष्ट्रीय मानक के अनुसार श्रमिकों को अधिभोगी द्वारा प्रदान किये
जायेंगे, इनमें निम्नलिखित शामिल होंगे :-
(क) स्वतंत्र रूप से सुरक्षित जीवनरेखा सहित सुरक्षा कवच, जहाँ अन्य समुचित साधनों
के माध्यम से भी, गिरने से सुरक्षा प्रदान नहीं की जा सकती हो;
(ख) जीवन रक्षा वस्त्र और रक्षा पेटी, जहाँ पानी में गिरने का जोखिम हो;
(ग) विशिष्ट कपड़ा या परावर्तक उपकरण अथवा अन्यथा स्पष्ट रूप से दिखाई देने
वाली सामग्री, जहाँ चलते वाहनों से जोखिम का नियमित संपर्क होता हो।
(3) निरीक्षक, किये जा रहे कार्य तथा प्रक्रिया में निहित जोखिम की प्रकृति को दृष्टिगत रखते हुए, ऐसे
कर्मकार, जिनको विशिष्ट जोखिम के सम्पर्क में रहना पड़ता हो, के बचाव हेतु प्रासंगिक राष्ट्रीय
मानक के अनुरूप कोई भी व्यक्तिगत सुरक्षा उपकरण, जो कि आवश्यक हो, को प्रदान करने हेतु,
अधिभोगी या प्रबंधक को लिखित में आदेशित कर सकेगा।

NOTIFICATION
Serial No. F 10-7/2019/16 .- In exercise of the powers conferred by Section 41 of the Factories Act, 1948 (No. 63 of 1948), the State Government, hereby, makes the following further amendment in the Chhattisgarh Factories Rules, 1962, namely :-
AMENDMENT
In the said rules,-
For rule 73, the following shall be substituted, namely:-
"73. Personal Protective Equipments.- (1) All workers should be mandatorily provided with Personal Protective Equipments (PPEs) as required under any of the provisions of the Act or the Rules and such PPEs shall conform to the relevant National Standard. The occupiers shall require the workers to use such PPEs and the same shall be maintained in proper working conditions by the occupier. No charge what so ever shall be levied by the occupier from the workers for provision of such PPEs.
(2) Without prejudice to the generality of the provisions of sub-rule (1), rules for various types of PPEs for use in factories shall be as below:-
(i) Safety Helmet- All workers who are likely to be exposed to any hazard which may cause head injury shall be provided with safety helmets conforming to relevant National Standards. All the workers shall be adequately trained on proper use of such PPEs. When work at height is being carried out such safety helmet shall be provided with a nape strap. No safety helmet which has resisted an impact shall be reused. Periodic cleaning and visual inspection to check any deformation in size or shape shall be carried out.
(ii) Protective Footwear- Protective footwear should be provided to workers who are exposed to hazards which are likely to cause injury to them by way of materials being dropped on their feet or nail or other sharp objects penetrating their sole. The type and nature of foot wear to be used at workplaces shall be decided by the occupier based on nature of work being carried at such work places. Proper disinfection shall be carried out to prevent contagious fungal infection of the skin that causes scaling, flaking and itching of the affected areas. Proper medical care shall be carried out to prevent workers from suffering from ingrown nails, metatarsalgia, heel spur, hammer toes and nerve damage after wearing safety shoe.
(iii) Safety Goggles and Spectacles- The relevant National Standard shall be applicable in industrial undertakings to provide protection for the eyes of the workers against hazards such as flying particles and fragments, splashing materials and molten metal's harmful dust, gases or vapours, aerosols and radiations which are likely to impair vision or damage the eyes. Additional eye protection over their prescription lenses shall be used ensuring that the protective eyewear does not disturb the proper positioning of the prescription lenses.
(iv) Equipment for eye and face protection during welding – Relevant National Standard shall be followed for the requirements of goggles, hand shield and helmet intended to protect an operator above the shoulder from harmful radiation, spark and particles of hot metal during welding, cutting and similar operations employing a gas flame or electric arc.
(v) Gloves and Protective Clothing - Suitable gloves, leather gauntlets and mittens conforming to relevant National Standard shall be used for protection of hand of the workers from getting injured. Such protective gloves shall be provided where the hands are exposed to hazards such as those from skin absorption of harmful substances, severe cuts or lacerations, severe abrasions, punctures, chemical burns, thermal burns and harmful temperature extremes. Suitable protective clothing as per relevant National Standard available for apron (Rubberized, acid and alkali resistant) shall be used for protection of workers who are likely to be exposed to any hazard which may cause injury to their skin.
(vi) Ear Protection when exposed to noise- Protection against the effects of noise exposure shall be provided when the sound levels exceed the prescribed standards. The relevant National Standard shall be followed while selection of suitable ear protection. Periodic disinfection of reusable ear protectors shall be carried out to eliminate hearing loss caused by infection, discharge, pain etc., in the ear.
(vii) Respiratory Protection- Respiratory Protection equipment based on the nature of hazard as per the relevant National Standard shall be provided by the occupier of the factory to the workers for their respiratory protection against dust, fumes, gases, particulates etc. Clinical examination and appropriate medical tested shall be undertaken to avoid Irritant dermatitis, nose bridge sores, etc. because of prolong use of respiratory personal protective equipment.
(viii) Other Protective Equipment – Appropriate personal protective equipment based on the nature of hazards as per the relevant National Standard shall be provided by the occupier to the workers, these shall include the following:-
(a) Safety harnesses with independently secured lifelines where protection against falls cannot be provided by other appropriate means;
(b) Life vests and life preservers where there is a danger of falling into water;
(c) Distinguishing clothing or reflective devices or otherwise conspicuously visible material when there is regular exposure to danger from moving vehicles.
(3) The Inspector may, having regard to the nature of the hazards involved in work and process being carried out, order the occupier or the manager in writing to supply to the workers exposed to particular hazard any personal protective equipment conforming to relevant National Standard as may be found necessary."
