क्रमांक एफ 10-34/2022/वा.क.(पं.)/पांच(80).⸺ भारतीय स्टाम्प अधिनियम, 1899 (1899 का सं. 2) की धारा 9 की उप-धारा (1) के खण्ड (क) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, भू-संपदा (विनियमन और विकास) अधिनियम, 2016(2016 का सं. 16) की धारा 11 की उप-धारा (4) के खण्ड (च) के प्रावधानों के अधीन आवास एवं पर्यावरण विभाग अथवा छत्तीसगढ़ भू-संपदा विनियामक प्राधिकरण द्वारा अनुमोदित रहवासी कॉलोनी के प्रमोटर्स द्वारा आबंटितियों के समूह अथवा रहवासी सोसाइटी के पक्ष में कॉलोनी के सामान्य क्षेत्र (कामन एरिया) के हस्तांतरण संबंधी निष्पादित लिखतों पर, उक्त अधिनियम की अनुसूची 1-क के अनुच्छेद 23 के अंतर्गत प्रभार्य स्टाम्प शुल्क मेंं कमी करते हुए, स्टाम्प शुल्क केवल 10,000/- रूपये प्रभार्य करती है।
स्पष्टीकरण :- इस अधिसूचना के प्रयोजन हेतु, -
1. प्रमोटर्स से अभिप्रेत है भू-संपदा (विनियमन और विकास) अधिनियम, 2016 (2016 का सं. 16) के अन्तर्गत पंजीकृत प्रवर्तक/भवन निर्माता (प्रमोटर्स/बिल्डर्स)।
2. यह छूट/कमी संचालक, नगर तथा ग्राम निवेश या उनके द्वारा प्राधिकृत अधिकारी द्वारा प्रमाणित कॉलोनियोंं के सामान्य क्षेत्र के हस्तांतरण संबंधी निष्पादित लिखतोंं पर दी जायेगी।
यह अधिसूचना, राजपत्र में इसके प्रकाशन की तिथि को प्रवृत्त होगी।

NOTIFICATION
No. F 10-34/2022/CT(R)/V (80).⸺ In exercise of the powers conferred by clause (a) of sub-section (1) of Section 9 of the Indian Stamp Act, 1899 (No. 2 of 1899), the State Government, hereby, charges stamp duty only rupees 10,000/- , by reducing the stamp duty chargeable under Article 23 of Schedule 1-A of the said Act, on the instrument executed by promoters of Residential Colony to the Group of Allottees or the residential society for the transfer of common area of the colony, approved by the Housing and Environment Department or Chhattisgarh Real Estate Regulatory Authority under the provisions of clause(f) of sub-section(4) of Section 11 of the Real Estate (Regulation and Development) Act, 2016 (No. 16 of 2016).
Explanation:- For the purpose of the notification ,-
1. Promoter means Promoter/Builders registered under the Real Estate (Regulation and Development) Act, 2016 (No. 16 of 2016).
2. Exemption/Reduction shall be given on the instruments executed relating to transfer of the common areas of the colonies attested by the Director, Town and Country Planning or its authorized signatory.
The Notification shall come into force on the date of its publication in the Official Gazette.

क्रमांक एफ 10-34/2022/वा.क.(पं.)/पांच(81).⸺ रजिस्ट्रीकरण अधिनियम, 1908 (1908 का सं. 16) की धारा 78 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, इस विभाग की अधिसूचना क्र. 816-635-पांच-पृ.-आ., दिनांक 24 फरवरी 1975 सहपठित अधिसूचना क्र. एफ 3-53/2020/वा.क.(पं.)/पांच (19), दिनांक 4 फरवरी 2022 में और संशोधन करती है, अर्थात् :-

उक्त अधिसूचना मेंं, -
शीर्षक ''पंजीयन शुल्क की सारणी'' से संलग्न उप-शीर्षक ''छूट तथा मुक्ति'' में, सरल क्रमांक (63) के पश्चात् निम्नलिखित सरल क्रमांक (64) जोड़ा जाये, अर्थात् :-

No. F 10-34/2022/CT(R)/V (81).⸺ In exercise of the powers conferred by Section 78 of the Registration Act,1908 (No. XVI of 1908), the State Government, hereby, makes the following further amendment in this Department's Notification No. 816-635-Five-SR, dated 24th February, 1975 read with Notification No. F 3-53/2020/CT(R)/V(19), dated 4th February, 2022, namely :-
AMENDMENT
In the said notification, -
In sub-head "exemption and deduction" appended to the Heading "Table of registration fees", after serial number (63), the following serial number (64) shall be added, namely :-
"(64) The State Government, hereby, charges rupees 5000/-, registration fees only, by reducing the registration fees chargeable, on the instrument executed by promoters of residential colony to the Group of Allottees or the residential society for the transfer of Common Areas of the colony, approved by the Housing and Environment Department or Chhattisgarh Real Estate Regulatory Authority under the provisions of clause (f) of sub-section (4) of Section 11 of the Real Estate (Regulation and Development) Act, 2016 (No. 16 of 2016)."
