क्रमांक/एफ 8-2 / 2020 / 10-2.- वन्यजीव ( संरक्षण) अधिनियम , 1972 (1972 का सं. 53) की धारा 64 सहपठित धारा 6 की उप-धारा (2) एवं (3) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुये , राज्य सरकार, एतद्वारा, राज्य वन्यजीव बोर्ड के गठन एवं कार्यकरण के लिये निम्नलिखित नियम बनाती है, अर्थात्:-
नियम
ये नियम छत्तीसगढ़ राज्य वन्यजीव बोर्ड नियम, 2022 कहलायेंगे । 1.
संक्षिप्त नाम एवं प्रारंभ.- (1)
(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2.
परिभाषायें. (1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -
(
क) ' अधिनियम' से अभिप्रेत हैं वन्य प्राणी (संरक्षण) अधिनियम , 1972 ( 1972 का सं. 53) ;
(ख) 'अध्यक्ष' से अभिप्रेत है राज्य वन्यजीव बोर्ड का अध्यक्ष;
(ग) ' बोर्ड' से अभिप्रेत है अधिनियम की धारा 6 की उप- धारा (1 ) के तहत् गठित छत्तीसगढ़ राज्य वन्यजीव बोर्ड ।
(2) अन्य सभी शब्द और अभिव्यक्तियां, जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं है, के क्रमशः वहीं अर्थ होंगे जैसा कि अधिनियम में उनके लिये समनुदेशित है ।
3. राज्य वन्यजीव बोर्ड का गठन. (1 ) अधिनियम की धारा 6 की उप- धारा (1 ) में अंतर्विष्ट प्रावधानों के अनुसार राज्य वन्यजीव बोर्ड का गठन किया जायेगा ।
(2) वे सदस्य, जो पदेन सदस्य हो, से भिन्न सदस्यों की पदावधि 2 वर्ष की होगी ।
(3) विधानसभा के सदस्य, जिन्हें बोर्ड में नामांकित किया गया है , विधानसभा के सदस्य नहीं होने की स्थिति में , बोर्ड के सदस्य भी नही रहेंगे ।
(4) अधिनियम की धारा 6 की उप- धारा ( 1 ) के खण्ड (घ) एवं (ड.) में निर्दिष्ट रिक्तियों को, अध्यक्ष के अनुमोदन से राज्य शासन द्वारा नामांकन द्वारा भरे जायेंगे ।
(5) अधिनियम की धारा 6 की उप -धारा ( 1 ) के खण्ड ( ड.) के अधीन नामांकन , नीचे दी गई तालिका में उल्लिखित विषय विशेषज्ञों से किया जायेगाः-

नोटः - तात्कालिक आवश्यकताओं का ध्यान में रखते हुये, राज्य सरकार उपरोक्त तालिका में उल्लिखित विषय विशेषज्ञों में संशोधन कर सकेगी ।
4. बैठक -(1 ) बोर्ड की बैठक एक वर्ष में कम- से - कम दो बार ऐसे स्थान में होगी , जैसा कि अध्यक्ष के अनुमोदन से विनिश्चित किया जाये ।
(2) सदस्य- सचिव, कार्यसूची तैयार करेगा तथा अभिहित दिनांक एवं समय पर बोर्ड की बैठक आहुत करने के लिये अध्यक्ष का अनुमोदन लेगा ।
(3) सदस्य- सचिव, बैठक की कार्यवाही विवरण तैयार करेगा तथा अध्यक्ष के अनुमोदन के पश्चात् उसे समस्त सदस्यों को वितरित करेगा ।
(4 ) सदस्य - सचिव , पूर्व की बैठकों में लिए गए निर्णयों पर कार्रवाई प्रतिवेदन प्रस्तुत करेगा । (5) बोर्ड का कोई भी कार्य या कार्यवाही , केवल उसमें किसी रिक्ति होने या उसके गठन में किसी त्रुटि होने या बोर्ड की प्रक्रिया में किसी अनियमितता के कारण, जिससे कि मामले के गुणागुण पर कोई प्रभाव नहीं पड़ता है, अविधिमान्य नहीं होगी ।
(6) यदि बोर्ड की कोई कार्यवाही परिभ्रमण के माध्यम से संपादित किया जाता है , तो सदस्य- सचिव, बोर्ड के निर्णयों का अभिलेखीकरण करते हुये , बोर्ड के अध्यक्ष के अनुमोदन हेतु प्रस्तुत करेगा । 5. सदस्यों का हटाया जाना. राज्य शासन, अधिनियम की धारा 6 की उप - धारा (1 ) के खण्ड (घ ) एवं (ड. ) के अंतर्गत नामांकित बोर्ड के किसी भी सदस्य को, अध्यक्ष के पूर्व अनुमोदन से, हटा सकेगा, यदि नामांकित सदस्य,-
(क) विकृत चित्त हो और किसी सक्षम चिकित्सा बोर्ड द्वारा इस प्रकार घोषित किया गया हो; या (ख) अनुन्मोचित दिवालिया हो; या
(ग ) नैतिक अधमता अन्तर्वलित किसी अपराध का सिद्धदोष ठहराया गया हो; या
(घ) अध्यक्ष के पूर्व अनुमोदन के बिना, बोर्ड के तीन या अधिक बैठकों में निरंतर अनुपस्थित रहा हो; या (ङ) अधिनियम या इन नियमों के किन्हीं उपबन्धों का उल्लंघन किया हो ।
टीप - बोर्ड के बैठकों में परोक्षी की उपस्थिति मान्य नहीं की जायेगी ।
6. सदस्यों द्वारा हित का प्रकटीकरण. यदि बोर्ड के समक्ष विचाराधीन किसी प्रस्ताव में , बोर्ड के किसी सदस्य या उसके परिवार के किसी सदस्य का कोई हित जुड़ा हुआ हो, तो संबंधित सदस्य द्वारा इस संबंध में बोर्ड के समक्ष प्रकटीकरण करना अनिवार्य होगा ।
7. गणपूर्ति. - ( 1 ) बोर्ड की बैठक में कार्यवाही के संपादन हेतु अपेक्षित गणपूर्ति, सदस्यों के कुल संख्या की एक तिहाई होगी । छत्तीसगढ़ राजपत्र, दिनांक 26 सितम्बर 2022
1190(1) (2) यदि किसी भी समय गणपूर्ति नहीं होती है, तो अध्यक्ष या बैठक की अध्यक्षता करने वाले व्यक्ति द्वारा बैठक की अपेक्षित गणपूर्ति पूर्ण होने तक स्थगित की जायेगी ।
8. राज्य बोर्ड की बैठक हेतु आमंत्रिती. राज्य बोर्ड का अध्यक्ष , वन्यजीव प्रबंधन, संरक्षण एवं संबंद्ध क्षेत्र में अनुभव रखने वाले व्यक्ति या व्यक्तियों को बोर्ड की किसी बैठक में आमंत्रित कर सकेगा ।
9. सदस्यों का त्याग पत्र. (1 ) नामांकित सदस्य , अध्यक्ष को अपना स्व - हस्ताक्षरित त्याग - पत्र प्रस्तुत करते हुये , बोर्ड से अपना पद त्याग सकेगा ।
(2) अध्यक्ष को नामांकित सदस्य का त्याग - पत्र स्वीकार करने की शक्ति होगी । सदस्य- सचिव , सदस्य के त्याग - पत्र स्वीकार करने की सूचना, राज्य शासन को तथा अपनी आगामी बैठक में , बोर्ड को देगा।
(3 ) सदस्य, अध्यक्ष द्वारा त्याग - पत्र स्वीकार करने के दिनांक से अथवा त्याग - पत्र प्रस्तुत करने के दिनांक से तीस दिवस के भीतर, जो भी पहले हो , बोर्ड का सदस्य नहीं रह जायेंगा ।
10. राज्य बोर्ड के सदस्यों को यात्रा एवं अन्य भत्ता.- ( 1 ) बोर्ड के पदेन सदस्य को, शासन के सुसंगत नियमों के अनुसार यात्रा भत्ता आहरित करने की पात्रता होगी ।
(2) नियम 3 के उप- नियम (4) के अधीन बोर्ड के नामांकित सदस्यों को, उसी दर में यात्रा भत्ता एवं दैनिक भत्ता प्राप्त करने की पात्रता होगी , जैसा कि राज्य शासन के प्रथम श्रेणी अधिकारियों को अनुज्ञेय है ।
(3 ) रेल्वे / बस द्वारा किए गए यात्रा व्यय की प्रतिपूर्ति , सदस्यों द्वारा उपगत वास्तविक व्यय की सीमा में की जायेगी ।
(4 ) बोर्ड के ऐसे सदस्य , जो विधानमंडल के भी सदस्य होंगे , के मामले में , निम्नलिखित प्रावधान लागू होंगेः
(क) रेल्वे अथवा बस द्वारा किए गए यात्रा व्यय की प्रतिपूर्ति नहीं की जायेगी, यदि सदस्य विधानसभा सचिवालय द्वारा जारी निःशुल्क पास धारित करता हो ।
(ख) विधानसभा सत्र आयोजित रहने के दौरान बैठक आहुत करने पर, सदस्यों को बैठक में उपस्थिति के लिये यात्रा भत्ता एवं दैनिक भत्ता प्राप्त करने की पात्रता नहीं होगी । 11. नियमों का निर्वचन.- जहां इन नियमों के निर्वचन के संबंध में कोई संदेह उद्भूत हो, वहां प्रकरण को उसके अभिमत एवं विनिश्चय के लिये राज्य शासन को निर्दिष्ट किया जायेगा । इस विषय पर राज्य शासन का निर्णय अंतिम एवं बंधनकारी होगा ।

NOTIFICATION
No./ F 8-2 / 2020/10-2.- In exercise of the powers conferred by Section 64 read with sub - section ( 2) and (3 ) of Section 6 of the Wildlife ( Protection) Act , 1972 (No. 53 of 1972) , the State Government , hereby , makes the following rules for constituting and functioning the State Wildlife Board , namely : -
RULES
1. Short title and commencement.- ( 1 ) These rules may be called the Chhattisgarh State Wildlife Board Rules , 2022 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2.Definitions . ( 1 ) In these rules , unless the context otherwise requires , -
(a) "Act " means the Wildlife ( Protection ) Act , 1972 ( No. 53 of 1972) ;
(b ) "Chairperson " means the Chairperson of the State Wildlife Board ;
(c) "Board" means the State Wildlife Board of Chhattisgarh , constituted under sub - section ( 1 ) of Section 6 of the Act .
(2 ) All other words and expressions used in these rules but not defined shall have the same meanings respectively assigned to them in the Act .
3. Constitution of the State Wildlife Board.- ( 1 ) The State Wildlife Board shall be constituted in accordance with the provisions contained in sub - section ( 1 ) of Section 6 of the Act .
(2) The term of office of the members other than those who are ex - officio members shall be for a period of 2 years .

1190(3) (3 ) The Member of Legislative Assembly, nominated to the Board , shall cease to be a member of the Board , on his having ceased to be a Member of Legislative Assembly .
(4 ) The vacancies referred to in clauses (d) and ( e) of sub- section ( 1 ) of Section 6 of the Act shall be filled by nomination by the State Government with the approval of the Chairperson .
(5) Nomination under clause ( e) of sub- section ( 1 ) of Section 6 shall be done from the subject experts mentioned in the below table: -

Note: In pursuance of the extant needs the State Government may amend the subject experts mentioned in the above table .
4. Meetings.- ( 1 ) The Board shall ordinarily meet atleast twice in a year at a place as decided with the approval of the Chairperson .
(2) The Member - Secretary shall prepare agenda and take approval of the Chairperson for convening the meeting of the Board on the designated date and time .
(3 ) The Member- Secretary shall prepare the minutes of the meeting and circulate it to all members after obtaining approval of the Chairperson .

(4) The Member- Secretary shall present the action taken report on the decisions taken in the previous meetings .
(5) Any action or proceeding of the Board shall not be invalid due to vacancy or procedural errors in its formation or irregularity in the procedure of the Board which do not impinge on the merits of the matter .
(6) If any business of the Board is transacted by circulation , the Member - Secretary shall prepare a record of the decision of the Board and submit for approval by the Chairperson of the Board .
5. Removal of the Members . The State Government may , with the prior approval of the Chairperson remove any member of the Board nominated under clause ( d) and (e) of sub- section (1 ) of Section 6 of the Act , if a nominated member , -
( a) is of unsound mind and stands so declared by a competent Medical Board ; or
(b ) is an un - discharged insolvent ; or
(c) is convicted of any offence including moral turpitude ; or
(d ) is absent in three or more successive meetings of the Board without the prior approval of the Chairperson ;
(e) contravenes any provisions of the Act and these Rules .
Note: - No Proxy shall be allowed in the meetings of the Board .
6 . Disclosure of interest by members . If any member of the Board or his family members has any interest in a proposal submitted for consideration of the Board , then the member concerned must be disclosed , before the Board in this regard .
7. Quorum . ( 1 ) The quorum necessary for the transaction of business at a meeting of the Board shall be one - third of the total number of members .

(2) If at any time there is no quorum , the Chairperson or the person presiding over the meeting shall adjourn the meeting until there is necessary quorum .
8. Invitees to the State Board meetings . The Chairperson of the State Board may invite any person or persons having experience in the wild life management , conservation and allied fields to attend any meeting of the Board .
9. Resignations of members .- ( 1 ) Nominated member may resign from the Board by presenting resignation letter in his own signature to the Chairperson .
(2) The Chairperson has the power to accept the resignation of nominated member . The Member -Secretary shall inform the acceptance of the resignation of the member to the State Government and the Board in its next meeting .
(3 ) The member shall cease to be member of the Board from the date of acceptance of the resignation by the Chairperson or within thirty days from the date of presenting resignation letter whichever is earlier
10. Travelling and other Allowances to the members of the State Board . ( 1 ) Ex - officio members of the Board will be eligible to draw travelling allowances as per relevant Government rules .
(2 ) The members of the Board nominated under sub - rule (4 ) of rule 3 shall be entitled to travelling allowances and daily allowances at the rates as are admissible to first class officers of the State Government .
(3) Journey performed through Railway / Bus shall be reimbursed to the extent of actual expenditure incurred by the member .
(4) In case of Members of the Board who are also the members of the Legislature following provisions shall be applicable: - छत्तीसगढ़ राजपत्र, दिनांक 26 सितम्बर 2022

(a) Journey performed by Bus / Rail shall not be reimbursed if the member holds free pass issued by the Legislature Secretariat .
(b) For the meetings convene during on - going sessions of the Assembly , the members shall not be entitled to travelling and daily allowances for attending the meeting.
11. Interpretation of the rules.- Where any doubts arise as to the interpretation of these rules , the matter shall be referred to the State Government for its opinion and decision . The decision of the State Government in such matters shall be final and binding .
