अधिसूचना
क्रमांक एफ 1-34/2018/29-2.⸺ छत्तीसगढ़ माल और सेवा कर अधिनियम, 2017 (क्र. 7 सन् 2017) की धारा 57 के प्रावधानों के अधीन प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, उपभोक्ता अधिकारों के प्रति जागरूकता लाने तथा उपभोक्ताओं के सशक्तीकरण के लिये निम्नलिखित नियम बनाती है, अर्थात्ः-
नियम
1. संक्षिप्त नाम, विस्तार तथा प्रारंभ.- (1) ये नियम छत्तीसगढ़ राज्य उपभोक्ता कल्याण निधि नियम, 2022 कहलायेंगे।
(2) इनका विस्तार संपूर्ण छत्तीसगढ़ राज्य में होगा।
(3) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त हाेंगे।
2. परिभाषाएं.- (1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) ''अधिनियम'' से अभिप्रेत है उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का सं. 35);
(ख) ''आवेदक'' से अभिप्रेत है कोई एजेंसी/संगठन, जो उपभोक्ता कल्याण गतिविधियों में लगा हो तथा जो कंपनी अधिनियम, 1956 (1956 का सं. 1) या तत्समय प्रवृत्त किसी विधि के अधीन तीन वर्ष की कालावधि के लिये रजिस्ट्रीकृत है, जिसमें ग्राम/मंडल/समिति स्तर/उपभोक्ता सहकारी सोसाइटी विशेष रूप से महिला, अनुसूचित जाति/अनुसूचित जनजाति या राज्य/केन्द्र सरकार द्वारा प्रायोजित या चलाये जा रहे संगठन/सोसाइटी सम्मिलित हैं। तथापि, तीन वर्ष की कालावधि के लिए रजिस्ट्रीकरण संबंधी अपेक्षा, राज्य/केन्द्र सरकार द्वारा स्थापित एजेंसी/सोसाइटी पर लागू नहीं होगी;
(ग) ''आवेदन'' से अभिप्रेत है इन नियमों के प्रयोजन के लिए इन नियमों से संलग्न प्ररूप-क में आवेदन;
(घ) ''उपभोक्ता'' का वही अर्थ है जो उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का सं. 35) की धारा 2 की उप-धारा (7) में उसके लिये समनुदेशित है तथा इसमें वे उपभोक्ता वस्तुएं सम्मिलित हैं, जिन पर शुल्क का भुगतान किया गया है;
(ड.) ''छत्तीसगढ़ उपभोक्ता कल्याण निधि'' से अभिप्रेत है राज्य सरकार द्वारा स्थापित की गई निधि;
(च) ''समिति'' से अभिप्रेत है नियम 5 के अधीन गठित समिति;
(छ) ''उपभोक्ता का कल्याण'' में सम्मिलित है उपभोक्ता के अधिकारों का संवर्धन तथा संरक्षण।
(2) शब्द या अभिव्यक्तियाँ, जो इन नियमों में प्रयुक्त हैं तथा परिभाषित नहीं हैं, किन्तु अधिनियम में परिभाषित है, के वही अर्थ होंगे, जैसा कि अधिनियम में क्रमशः उनके लिए समनुदेशित हैं। 3. राज्य उपभोक्ता कल्याण निधि की स्थापना.- (1) छत्तीसगढ़ माल और सेवा कर अधिनियम, 2017 (क्र. 7 सन् 2017) एवं केन्द्रीय माल और सेवा कर अधिनियम, 2017 (2017 का सं. 12) के प्रावधानों के अंतर्गत राज्य उपभोक्ता कल्याण निधि की स्थापना की जायेगी। निधि के कोष में निम्नलिखित सम्मिलित होंगेः- (एक) छत्तीसगढ़ माल और सेवा कर अधिनियम, 2017 की धारा 54 की उप-धारा (5) के अंतर्गत निधि में जमा की गई राशि;
(दो) केन्द्रीय माल और सेवा कर अधिनियम, 2017 की धारा 54 की उप-धारा (5) के अंतर्गत केन्द्र सरकार द्वारा दिया गया कोई अनुदान अथवा प्रारंभिक धन;
(तीन) निधि में जमा राशि के निवेश से अर्जित कोई आय।
(2) निधि की राशि, एक पृथक सब्याज बैंक खाते में जमा की जायेगी। खाते में जमा ब्याज की राशि को राज्य/स्थानीय स्तर के कार्यक्रमों के वित्त पोषण हेतु उपयोग किया जायेगा।
4. उपभोक्ता कल्याण निधि के लेखे तथा अभिलेखों का संधारण.- राज्य उपभोक्ता कल्याण निधि से संबंधित उचित तथा पृथक खाता, आयुक्त/संचालक, खाद्य, नागरिक आपूर्ति और उपभोक्ता संरक्षण द्वारा संधारित किया जायेगा तथा उसे उसी रीति से प्रचालित किया जायेगा, जैसा कि राज्य के लोक खातों में किसी अन्य संव्यवहार के लिये किया जाता है तथा यह छत्तीसगढ़ राज्य के महालेखाकार द्वारा लेखा परीक्षा के अध्यधीन होगा।
5. समिति का गठन.- (1) राज्य सरकार, राज्य उपभोक्ता कल्याण निधि में जमा धनराशि की स्वीकृति के लिए तथा उपभोक्ता के कल्याण हेतु इन नियमों के प्रयोजनों को क्रियान्वित करने की अनुशंसा करने के लिए एक स्थायी समिति का गठन करेगी।
(2) समिति में निम्नलिखित सदस्य सम्मिलित होंगे, अर्थात्ः-
(क) प्रमुख सचिव/सचिव, अध्यक्ष छत्तीसगढ़ शासन, खाद्य, नागरिक आपूर्ति तथा उपभोक्ता संरक्षण विभाग.
(ख) सचिव, छत्तीसगढ़ शासन, उपाध्यक्ष वित्त विभाग या उसका प्राधिकृत नामनिर्देशिती.
(ग) सचिव, छत्तीसगढ़ शासन, सदस्य स्वास्थ्य एवं परिवार कल्याण विभाग या उसका प्राधिकृत नामनिर्देशिती.
(घ) सचिव, छत्तीसगढ़ शासन, सदस्य स्कूल शिक्षा विभाग या उसका प्राधिकृत नामनिर्देशिती.
(ड.) संयुक्त सचिव सदस्य उपभोक्ता मामले विभाग, भारत सरकार या उसका नामनिर्देशिती.
(च) आयुक्त/संचालक, सदस्य जनसंपर्क, छत्तीसगढ़ (छ) आयुक्त/संचालक, सदस्य-सचिव खाद्य, नागरिक आपूर्ति तथा उपभोक्ता संरक्षण, छत्तीसगढ़
(ज) रजिस्ट्रार, छत्तीसगढ़ सदस्य राज्य उपभोक्ता विवाद प्रतितोषण आयोग
(झ) राज्य स्तरीय स्वैच्छिक उपभोक्ता कल्याण सदस्य संगठन का एक प्रतिनिधि, जिसके पास कार्य निष्पादन का अच्छा अनुभव (गुड ट्रैक रिकार्ड) हो या उपभोक्ता आंदोलन का कोई विशेषज्ञ, जिसे स्वैच्छिक उपभोक्ता संगठन/गैर-सरकारी संगठन में कार्य करने में सक्रिय रूचि और अनुभव हो, जिसे राज्य सरकार द्वारा नामनिर्देशित किया जायेगा।
6. कार्य संचालन की प्रक्रिया.- (1) समिति, जब एवं जैसा आवश्यक समझे, बैठक करेगी, किन्तु किन्हीं दो बैठकों के बीच तीन माह से अधिक का अंतराल नहीं होना चाहिये।
(2) समिति, अपनी बैठक ऐसे समय तथा ऐसे स्थान पर करेगी, जैसा कि अध्यक्ष या उसकी अनुपस्थिति में समिति का उपाध्यक्ष उचित समझे।
(3) समिति की बैठक की अध्यक्षता, अध्यक्ष द्वारा की जायेगी तथा उसकी अनुपस्थिति में, उपाध्यक्ष द्वारा समिति की बैठक की अध्यक्षता की जायेगी।
(4) समिति की प्रत्येक बैठक, प्रत्येक सदस्य को लिखित सूचना, जो ऐसी सूचना जारी होने की तारीख से 10 दिन से कम की न हो, देकर आहुत की जायेगी।
(5) समिति की बैठक की प्रत्येक सूचना में बैठक का स्थान, तारीख तथा घंटे विनिर्दिष्ट होंगे तथा उसमें संव्यवहृत किया जाने वाला कार्य का विवरण भी अन्तर्विष्ट होगा।
(6) समिति की कोई भी कार्यवाही मान्य नहीं होगी, जब तक कि उसकी अध्यक्षता, अध्यक्ष या उपाध्यक्ष द्वारा न की गई हो और उसमें कम से कम तीन सदस्य उपस्थित न हों।
7. समिति के कार्य.- (1) समिति, आवेदकों को उनकी वित्तीय स्थिति, कार्य का प्रकार या उनकी परियोजना या क्रियाकलापों के उद्देश्यों को ध्यान में रखते हुए, अनुदान सहायता मंजूर करने के लिये राज्य शासन को अनुशंसा करेगी।
(2) समिति, निधि के प्रबंधन तथा प्रशासन के लिए मार्गदर्शी सिद्धांत बनायेगी।
8. समिति की शक्तियाँ.- समिति को निम्नलिखित शक्ति होगी-
(1) किसी आवेदक से या राज्य सरकार द्वारा सम्यक् रूप से प्राधिकृत किसी अधिकारी से ऐसी कोई भी लेखा पुस्तकें, दस्तावेज, लिखित या किसी भी वस्तु को, जैसा कि आवेदन के मूल्यांकन के लिए आवश्यक हो, प्रस्तुत करने की अपेक्षा करना;
(2) किसी आवेदक से, किसी ऐसे परिसर में, प्रवेश तथा निरीक्षण की अनुमति देने की अपेक्षा करना, जिसके बारे में यह कहा जाता है कि वहाँ पर राज्य सरकार के सम्यक् रूप से प्राधिकृत अधिकारी द्वारा उपभोक्ता कल्याण गतिविधियाें को चलाया जाता है;
(3) अनुदान के समुचित उपयोग को सुनिश्चित करने के लिये आवेदकों के लेखों का लेखा परीक्षण कराना;
(4) किसी आवेदक से, किसी चूक या उसकी ओर से किसी सारगर्भित जानकारी के अधिक्रमण की दशा में, स्वीकृत किये गये अनुदान को समिति को एकमुश्त प्रतिदाय करने तथा उक्त अधिनियम एवं उसके अधीन बनाये गये नियमों के अधीन अभियोजन की अपेक्षा करना;
(5) किसी आवेदक या आवेदकों के किसी वर्ग को, अनुदान के उपयोग की आवधिक रिपोर्ट प्रस्तुत करने की अपेक्षा करना;
(6) वास्तविक असंगति, सारवान विशिष्टियों में गलती के अंतर्वलित होने के आधार पर अपने समक्ष रखे गये आवेदन को अस्वीकार करना;
(7) अधिनियम के उपबंधों के अनुसार किसी आवेदक से देय किसी राशि की वसूली करना। 9. उपभोक्ता कल्याण निधि से अनुदान के प्रयोजन.- समिति, निम्नलिखित प्रयोजनों के लिए अनुदान स्वीकृत करने की अनुशंसा करेगीः-
(1) केन्द्र या राज्य सरकार द्वारा विनिर्दिष्ट की गई योजनाओं के कार्यान्वयन के लिये।
(2) ऐसी अन्य गतिविधियां, जैसा कि राज्य सरकार द्वारा, उपभोक्ताओं के हितों के संवर्धन एवं संरक्षण के लिये तथा राज्य में उपभोक्ता आंदोलन को सशक्त करने हेतु आवश्यक समझा जाये।

NOTIFICATION
No. F 1-34/2018/29-2.⸺ In exercise of the power conferred under provisions of Section 57 of the Chhattisgarh Goods and Services Tax Act, 2017, (No.7 of 2017), the State Government, hereby, makes the following rules for awareness of consumer rights and empowerment of consumers, namely:-
RULES
1. Short title, extent and commencement. - (1) These rules may be called the Chhattisgarh State Consumer Welfare Fund Rules, 2022.
(2) They extends to the whole State of Chhattisgarh.
(3) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. – (1) In these rules, unless the context otherwise requires, -
(a) "Act" means Consumer Protection Act, 2019 (No. 35 of 2019);
(b) "Applicant" means any agency/organization engaged in consumer welfare activities and registered for period of three years under the Companies Act, 1956 (No. 1 of 1956) or under any other law for the time being in force, including Village/Mandal/Samiti Level/Consumer Co-Operative Society Especially Women, Scheduled Castes/Scheduled Tribes or State/Central Government sponsored run organization/societies. However, the requirements of registration for three years will not be applicable to Agencies/Societies set-up by the State/Central Government;
(c) "Application" means an application in Form-A appended to these rules for the purpose of these rules;
(d) "Consumer" has the same meaning as assigned to it in sub-section (7) of Section 2 of the Consumer Protection Act, 2019 (No. 35 of 2019) and includes consumer of goods on which duty has been paid;
(e) "Chhattisgarh Consumer Welfare Fund" means the fund established by the State Government;
(f) "Committee" means the Committee constituted under rule 5;
(g) "Welfare of the consumer" includes promotion and protection of rights of consumer.
(2) Words or Expressions used and not defined in these rules but defined in the Act shall have the same meaning as respectively assigned to them in the Act.
3. Establishment of State Consumer Welfare Fund. - (1) There shall be established a State Consumer Welfare Fund under the provisions of the Chhattisgarh Goods and Services Tax Act 2017 (No. 7 of 2017) and Central Goods and Service Tax Act, 2017 (No.12 of 2017). The corpus of the fund shall consist of:-
(i) The amount credited to the fund under sub-section (5) of Section 54 of the Chhattisgarh Goods and Services Tax Act, 2017;
(ii) Any grant or seed money provided by the Central Government under sub- section (5) of Section 54 of the Central Goods and Services Tax Act, 2017;
(iii) Any income from the investment of the amount credited to the Fund.
(2) The fund shall be credited in a separate interest bearing bank account. Interest accrued in the account shall be utilized for financing state/local level programmes.
4. Maintenance of accounts and records of Consumer Welfare Fund.- A proper and separate account related to the State Consumer Welfare fund shall be maintained by the Commissioner/Director, Food, Civil Supplies and Consumer Protection and operate in the same manner as for any other transactions in the Public account of the State and shall be subjected to audit, by the Accountant General of the Chhattisgarh State.
5. Formation of the Committee.- (1) The State Government shall constitute a Standing Committee for sanctioning of the money credited to the State Consumer Welfare Fund and for recommending the Welfare of the consumers to carry out the purposes of these rules.
(2) The Committee shall consist of the following Members namely:-
(a) The Principal Secretary/Secretary, Chairman Government of Chhattisgarh, Department of Food, Civil Supplies
and Consumer Protection.
(b) Secretary, Government of Chhattisgarh Department of Finance or his authorized nominee. Vice-Chairman (c) Secretary, Government of Chhattisgarh Department of Health and Family Welfare Member or his authorized nominee.
(d) Secretary, Government of Chhattisgarh,
Department of School Education Member or his authorized nominee
(e) Joint Secretary, Department of Consumer Member Affairs, Government of India or
his nominee
(f) Commissioner /Director, Public Relations, Chhattisgarh Member
(g) Commissioner/Director, Food, Civil Supplies and Member- Secretary Consumer Protection, Chhattisgarh.
(h) Registrar, Chhattisgarh State Disputes Redressal Commission. Member
(i) A representative of State Level Voluntary Consumer Welfare Organization having
good track record or an expert in the consumer movement having active interest and experience regarding working of Voluntary Consumer Organization/Non- Government Organization shall be nominated by the State Government. Member 6. Procedure of conduct of business.- (1) The Committee shall meet as and when it deems necessary, but not more than three months shall intervene between any two meetings.
(2) The Committee shall meet at such time and place as the Chairman, or in his absence the Vice-Chairman of the Committee may deem fit.
(3) The meeting of the Committee shall be presided over by the Chairman, and in his/her absence, the Vice Chairman shall preside over the meeting of the committee.
(4) Each meeting of the Committee shall be called, by giving notice in writing to every member of not less than ten days from the date of issue of such notice.
(5) Every notice of the meeting of the committee shall specify the place and the date and hour of the meeting and shall contain statement of business to be transacted there at.
(6) No proceeding of the Committee shall be valid, unless it is presided over by Chairman or Vice-Chairman and a minimum of three other members are present.
7. Functions of the Committee.-(1) The Committee shall recommend to the Government for sanction of grant-in-aid to applicants by taking into account their financial status, type of work or objectives of their project or activity.
(2) The Committee shall make guidelines for management and administration of the Fund.
8. Powers of the Committee.- Committee shall have the power.-
(1) to require from any applicant or any officer duly authorized by the State Government, to produce any such account books, documents, in written or any object, as necessary for the assessment of the application;
(2) to require any applicant to allow entry and inspection of any premises, about which it is stated that activity in such premises is carried on for the welfare of the Consumer by a duly Authorized Officer of the State Government;
(3) to audit the accounts of the applicants for ensuring proper utilization of the grant;
(4) to require any applicant, in case of any default or suppression of material information on his part, to refund in lump sum the sanctioned grant to the committee and to be subject to prosecution under the said Act and rules made thereunder.
(5) to require any applicant or any class of applicants, to submit a periodical report utilization of the grant;
(6) to reject an application placed before it on the basis of involvement of factual inconsistency, inaccuracy in material particulars;
(7) to recover any sum due from any applicant in accordance with the provisions of the Act.
9. Purpose of grants from the Consumer Welfare Fund.- The Committee shall recommend sanction of grants for the following purposes:-
(1) Execution of schemes specified by Central or State Government.
(2) Such other activities as may be considered necessary by the State Government for promotion and protection of interests of the Consumers and to strengthen the consumer movement in the State.
