अधिसूचना
क्रमांक 499/116/2023/वित्त/नियम/चार.⸺ भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, छत्तीसगढ़ के राज्यपाल, एतद्द्वारा, छत्तीसगढ़ सिविल सेवा (पेंशन) नियम, 1976 में निम्नलिखित और संशोधन करते है, अर्थात्ः-
संशोधन
उक्त नियमों में, -
1. नियम 42 में,-
(1) शीर्षक में, शब्द एवं अंक ''20 वर्ष की अर्हताकारी सेवा पूर्ण करने पर सेवानिवृत्ति'' के स्थान पर, शब्द एवं अंक ''17 या 20 वर्ष की अर्हताकारी सेवा पूर्ण करने पर सेवानिवृत्ति'' प्रतिस्थापित किया जाये;
2. प्ररुप 28 के स्थान पर, निम्नलिखित प्रारुप प्रतिस्थापित किया जाये, अर्थात्ः- ''प्रारूप 28 (नियम 42 (1) (ए) देखिये)
प्रति, .................................. ..................................
चूंकि, मैंने 17 वर्ष की अर्हता सेवा पूर्ण कर ली है और अब मैं सरकारी सेवा से छत्तीसगढ़ सिविल सेवा (पेंशन) नियम, 1976 के नियम 42 के उप-नियम (1) के खण्ड (क) के अधीन तारीख ..................... से सेवानिवृत्त होना चाहता हूँं, अतः तद्नुसार उसकी सूचना एतद्द्वारा दी जा रही है।
अथवा
चूंकि, मैंने 17 वर्ष की अर्हता सेवा पूर्ण कर ली है और अब मैं सरकारी सेवा से छत्तीसगढ़ सिविल सेवा (पेंशन) नियम, 1976 के नियम 42 के उप-नियम (1) के खण्ड (क) के अधीन तारीख ..................... से सेवानिवृत्त होना चाहता हूूँं, अतः तद्नुसार उसकी सूचना एतद्द्वारा दी जा रही है;
और चूंकि, इस सूचना की कालावधि ................................... दिन से कम पड़ती है, अतः उपरोक्त दिनों के वेतन तथा भत्ते की रकम चालान क्रमांक............... तारीख के अधीन जमा कर दी गई है, जिसकी प्रति इसके साथ संलग्न है।
अथवा
चूंकि, मैंने 17 वर्ष की अर्हता सेवा पूर्ण कर ली है और अब मैं सरकारी सेवा से छत्तीसगढ़ सिविल सेवा (पेंशन) नियम, 1976 के नियम 42 के उप-नियम (1) के खण्ड (क) के अधीन तत्काल अर्थात् तारीख ............ ......... से सेवानिवृत्त होना चाहता हूूँं, अतः तद्नुसार उसकी सूचना, एतद्द्वारा दी जा रही है।
उक्त खण्ड द्वारा अपेक्षित किये गये अनुसार छः मास की सूचना के बदले में छः मास के वेतन तथा भत्ते की रकम चालान क्रमांक ................. तारीख ........................ के अधीन जमा कर दी गई है, जिसकी एक प्रति संलग्न है।
सरकारी सेवक के हस्ताक्षर तथा पदनाम'' यह अधिसूचना, राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगी।
छत्तीसगढ़ के राज्यपाल के नाम से तथा आदेशानुसार, अतीश पाण्डेय, संयुक्त सचिव.

NOTIFICATION
Sl. No. 499/116/2023 / Finance / Rules / Four.⸺ In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Chhattisgarh, hereby, makes the following further amendment in the Chhattisgarh Civil Services (Pension) Rules, 1976, namely:-
AMENDMENT
In the said rules,-
1. In rule 42,- (1) In Heading, for the words and figure "Retirement on completion of 20 years qualifying service" the figure and words "Retirement on completion of 17 or 20 years qualifying service" shall be substituted;
(2) In clause (a) of sub-rule (1), for the words and figure "after completing 20 years qualifying service", the words and figure "after completing 17 years qualifying service" shall be substituted;
(3) In Note 1 of sub-rule (1), for the words and figure "he has in fact, completed 20 years qualifying service for pension", the words and figure "he has in fact, completed 17 years qualifying service for pension" shall be substituted.
2. For Form 28, the following Form shall be substituted, namely:-

To, ……………………. …………………….
Whereas, I have completed 17 years qualifying service and now desire to retire form Government service under clause (a) of sub-rule (1) of Rule 42 of the C.G. Civil Services (Pension) Rules, 1976, with effect from ………, a notice whereof is hereby given accordingly;
Or
Whereas, I have completed 17 years qualifying service and now desire to retire from Government service under clause (a) of sub-rule (1) of Rule 42 of the C.G. Civil Services (Pension) Rules, 1976, with effect from……….., a notice whereof is hereby given accordingly;
And whereas, the period of this notice falls short of ………. Days, the pay and allowances for the days aforesaid have been credited under challan No……… dated………, a copy where of is enclosed herewith;
Or
Whereas, I have completed 17 years qualifying service and now desire to retire from Government service under clause (a) of sub-rule (1) of Rule 42 of the C.G. Civil Services (Pension) Rules, 1976, forthwith that is to say with effect from……….., a notice whereof is hereby given accordingly;
The pay and allowances for six months have been credited under Challan No………..dated…………., a copy whereof is enclosed, in lieu of six months notice as required by the said cause.

This Notification shall come into force from the date of its publication in the Official Gazette.
