अधिसूचना
क्रमांक एफ 4-46/तीन-जेल/NHRC/2022.— राज्य शासन एतद्द्वारा छत्तीसगढ़ राज्य की जेलों में निरूद्ध बंदियों की मृत्यु के कारण मुआवजे के भुगतान के लिए निम्नानुसार नीति तैयार करता हैः-
1. बीमारी सहित प्राकृतिक मृत्यु के मामलों में मुआवजा देय नही होगा।
2. अप्राकृतिक मृत्यु के निम्नलिखित मामलों में भी मुआवजा देय नही होगाः-
(अ) यदि जेल या जेल के बाहर विधिपूर्ण अभिरक्षा से भागने के दौरान मृत्यु होती है।
(ब) यदि मृत्यु किसी प्राकृतिक आपदा/विपत्ति के कारण होती है।
3. निम्नलिखित मामलों में अप्राकृतिक मृत्यु के कारण बंदियों के परिजनों या उनके कानूनी उत्तराधिकारियों को मुआवजे का भुगतान किया जाएगा :-
(अ) बंदियों के बीच आपसी झगड़े के कारण मृत्यु हो जाने पर - रूपये 07.50 लाख
(ब) जेल स्टॉफ द्वारा प्रताड़ना/मारपीट के कारण मृत्यु होने पर - रूपये 07.50 लाख
(स) जेल अधिकारियों/कर्मचारियों के द्वारा कर्तव्य में लापरवाही/ उदासीनता बरते जाने के कारण मृत्यु होने पर - रूपये 05.00 लाख
(ड) चिकित्सा अधिकारियो/पैरा मेडिकल स्टॉफ की लापरवाही के कारण उपचार के दौरान मृत्यु होने पर - रूपये 05.00 लाख
(य) बंदी द्वारा यदि जेल प्रशासन की प्रताड़ना से व्यथित होकर आत्महत्या कारित की गई हो - रूपये 05.00 लाख
4. संबधित जेल अधीक्षक विस्तृत रिपोर्ट, न्यायिक/मजिस्ट्रीयल जांच रिपोर्ट, पोस्टमार्टम रिपोर्ट, मृत्यु के अंतिम कारण की रिपोर्ट, बंदी के जेल प्रवेश के समय की मेडिकल हिस्ट्री व बंदी को पूर्व में दिए गए चिकित्सकीय उपचार का विवरण (यदि कोई हो)े के साथ महानिदेशक जेल छत्तीसगढ़ राज्य को पैरा-03 में प्रावधान अनुसार उचित मुआवजा राशि स्वीकृत करने के लिए राज्य शासन को भेजने के लिए प्रेषित करेगा।
5. यह नीति, इस नीति की अधिसूचना की तिथि या उसके बाद छत्तीसगढ़ राज्य की जेलों में अप्राकृतिक मृत्यु के शिकार होने वाले बंदियों के संबंध में जैसा स्वीकार्य है, लागू होगी। 7. उक्त व्यय मांग संख्या 05 मुख्य शीर्ष 2056 (आयोजनेत्तर) जेलें 101 जेलें 0938 केन्द्रीय, जिला एवं उप जेल 31 क्षतिपूर्ति 004 अन्य मुआवजा मद के अधीन विकलनीय होगा। छत्तीसगढ़ के राज्यपाल के नाम से तथा आदेशानुसार,

क्रमांक एफ 4-46/तीन-जेल/NHRC/2022.— भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में इस विभाग की अधिसूचना क्रमांक एफ 4-46/तीन-जेल/NHRC/2022, दिनांक 14-08-2023 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. F 4-46/Three-Jail/NHRC/2022.— The State Goverment, hereby formulate the following policy for payment of compensation on account of death of prisoners confined in the jails of Chhattisgarh:-
1. Compensation will not be admissible in cases of natural deaths including due to illness.
2. Compensation will not be admissible in the following cases of unnatural deaths:-
(A) If the death occurs during escape from jails or from lawful custody outside the jails.
(B) If the death occurs due to any natural disaster/calamity.
3. Compensation will be paid to the next of kin or legal heirs of prisoners on account of unnatural deaths, in the following cases:-
(A) In case of death due to mutual quarrel between the prisoners - Rs. 7.50 lakhs.
(B) In case of death due to torture/ beating by prison staff - Rs. 7.50 lakhs.
(C) In case of death due to negligence/ indifference in duty by prison officers/employees - Rs. 5.00 lakhs.
(D) In case of death during treatment due to negligence by medical officers/para medical staff - Rs. 5.00 lakhs
(E) If the prisoner has committed suicide by being distressed by
the harassment of the prison administration - Rs. 5.00 lakhs
4. The superintendent prison concerned shall send detailed report along with copy of the Judicial/magisterial enquiry report, postmortem report, final cause of death report, medical history at the time of admission in prison and details of medical treatment (if any) given to the prisoner prior to his custodial death, to the Director General of Prisons, Chhattisgarh, for onward submission to the State Government for grant of appropriate compensation, as per the provision of Para-3 above.
5. This policy shall be appilcable, as admissible, in respect of prisoners who suffer unnatural deaths in the jails of Chhattisagarh on or after the date of notification of this policy.
6. Additional Chief Secretary/Principle Secretary, Jail Department shall be authorized to sanction the above said compensation.
7. The said expenditure will be deductable under demand number 05 major head 2056 (non-planning) jails 101 jails 0938 central, district and sub-jails 31 compensation 004 other compensation items.
