क्रमांक एफ 12-4/2020/मबावि/50 (पार्ट).— किशोर न्याय (बालकों की देखरेख और संरक्षण) अधिनियम, 2015 (2016 का 2) की धारा 4 की उप-धारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए तथा राज्य स्तरीय चयन समिति की अनुशंसा के अनुसार, राज्य सरकार, एतद्द्वारा नीचे उल्लेखित तालिका के कॉलम क्रमांक (3) में उल्लेखित व्यक्तियों को, कॉलम क्रमांक (2) में उल्लेखित तत्संबंधी जिले के किशोर न्याय बोर्ड में, सामाजिक कार्यकर्ता के रूप में, नीचे उल्लेखित शर्तों के अध्यधीन रहते हुये, नियुक्त करती है, अर्थात :-

(1) यह नियुक्तियां अभ्यर्थियाें द्वारा प्रस्तुत आवेदन पत्र एवं व्यक्तिगत वार्तालाप मे दी गई जानकारी तथा उपलब्ध कराये गये दस्तावेजों के आधार पर की गई है। किसी भी स्तर पर गलत जानकारी या विसंगति अथवा शिकायत की दशा मे राज्य शासन को संबंधित व्यक्ति का चयन निरस्त करने का अधिकार होगा। इस संबंध मे कोई अभ्यावेदन स्वीकार्य नही होगा।
(2) किशोर न्याय बोर्ड के सामाजिक कार्यकर्ताआें की पदावधि, इस अधिसूचना जारी होने के दिनांक से तीन वर्ष की कालावधि के लिये होगी।
(3) बोर्ड, संप्रेक्षण गृह के परिसर में या जिला बाल संरक्षण समिति द्वारा विनिश्चित स्थान पर अपनी बैठक आहूत करेगी, जिसमे विहित तिथि/समय पर सदस्यों की उपस्थिति अनिवार्य होगी।
(4) किशोर न्याय बोर्ड के सामाजिक कार्यकर्ताआें की नियुक्ति, किशोर न्याय (बालकों की देखरेख और संरक्षण) अधिनियम, 2015 (2016 का 2) की धारा (4) की उप-धारा (7) के प्रावधानों के अनुसार समाप्त की जा सकेगी। (5) कंडिका क्रमांक 4 के अतिरिक्त, बोर्ड के सामाजिक कार्यकर्ता, एक माह का नोटिस देकर किसी भी समय त्यागपत्र दे सकेंगे।(6) नियुक्त सामाजिक कार्यकर्ता किशोर न्याय (बालकों की देखरेख एवं संरक्षण) अधिनियम, 2015 (2016 का 2) तथा किशोर न्याय (बालकों की देखरेख एवं संरक्षण) नियम, 2016 के अनुसार कार्य करेंगे। (7) यदि नियुक्त सामाजिक कार्यकर्ता, किसी ऐसे व्यवसाय/सेवा में है, जो किशोर न्याय बोर्ड केे सदस्य के रूप में उनके कार्यो को प्रभावित कर सकते है, तो उन्हें अपनी वर्तमान सेवा/व्यवसाय का कार्य स्थगित करना होगा। (8) किशोर न्याय बोर्ड में नियुक्त सामाजिक कार्यकर्ता यदि अधिवक्ता है, तो बोर्ड में अपने कार्यकाल के दौरान प्रेक्टिस नहीं करेंगे तथा इस हेतु उन्हें किशोर न्याय बोर्ड में अपने कार्यकाल की अवधि तक छत्तीसगढ़ राज्य अधिवक्ता परिषद् से अपना पंजीयन/सनद् स्थगित कराना होगा तथा उन्हें इस संबंध में सुसंगत दस्तावेज विभाग को उपलब्ध कराना होगा। इसके पश्चात ही वे किशोर न्याय बोर्ड में उपस्थिति दे सकेंगें।
(9) यह नियुक्त पुलिस सत्यापन होने तक प्रावधिक मानी जायेगी। यदि किसी नियुक्त अभ्यर्थी के पुलिस सत्यापन मे विपरीत टीप प्राप्त होती है तो उसकी नियुक्ति तत्काल प्रभाव से समाप्त मानी जायेगी।

NOTIFICATION
No. F 12-4/2020/WCD/50/ (Part).— In exercise of the powers conferred by the sub- section (1) of Section 4 of the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016) and as per the recommendations of the State level Selection Committee, the State Government, hereby, appoints the following person mentioned in column number (3) of the table mentioned below in the Juvenile Justice Board of the corresponding District mentioned in column number (2) as Social worker, subject to the conditions mentioned below namely:-

(1) These appointments have been done on the basis of information given in the application & personal intraction and documents submitted by the applicants. In case of wrong information or discrepancy or complaint at any level, state goverment shall have the rights to cancel the appointment of the concerned person and no representation shall be acceptable in this regards.
(2) The term of the Social worker of the Juvenile Justice Board shall be for a period of three years from the date of the issue of this Notification.
(3) The Board shall hold its meetings in the premises of the Observation Home or at any place decided by the District Child Protection Committee, in witch presence of the Social workers on the prescribed date/time shall be mandatory.
(4) Appointment of the Social workers of the of the Juvenile Justice Board may be terminated in accordance with the provisions of sub- Section (7) of Section 4 of the Juvenile Justice (Care and Protection of Children) Act, 2015 (No.2 of 2016).
(5) Besides serial no. 4 Social workers of the Board may resign at any time by giving one month's notice.
(6) Appointed Social workers shall function according to the Juvenile Justice (Care and Protection of Children) Act, 2015 (No.2 of 2016) & the Juvenile Justice (Care and Protection of Children) Rules, 2016.
(7) If the appointed Social worker is in a profession/service, which can affect his work as a member of the Juvenile Justice Board, then he will have to postpone his work of existing profession/service.
(8) In the Social worker appointed in the Juvenile Justice Board If the selected member is in a profession/service, which can affect his work as a member of the Child Welfare Committee, then he will have to postpone his work of existing profession/service.
(9) If the social worker appointed in the Juvenile Justice Board is an advocate, then he will not practice during his/her tenure in the Board and for this he will have to postpone his registration/Sanad with the Chhattisgarh State Advocate Council till the period of his tenure in the Juvenile Justice Board and he will have to The relevant documents will have to be made available to the department. Only after this they will be able to appear in the Juvenile Justice Board.
(10) This appointment will be considered provisional till the police verification. If any adverse comment is found in police verification of appointed candidate, his appointment will be considered terminated with immediate effect.

(3) बालक कल्याण समिति, किशोर न्याय (बालकों की देखरेख और संरक्षण) अधिनियम 2015 (2016 का 2) की धारा 28 की उप-धारा (1) के अनुसार अपनी बैठक आहूत करेगी, जिसमें विहित तिथि/समय पर अध्यक्ष/सदस्य की उपस्थिति अनिवार्य होगी।
(4) बालक कल्याण समिति, बाल गृह के परिसर में या जिला बाल संरक्षण समिति द्वारा विनिश्चित स्थान पर अपनी बैठक आहूत करेगी।
(5) बालक कल्याण समिति के सदस्यों की नियुक्ति, किशोर न्याय (बालकों की देखरेख और संरक्षण) अधिनियम, 2015 (2016 का 2) की धारा (27) की उप-धारा (7) के प्रावधानों के अनुसार समाप्त की जा सकेगी। (6) कंडिका क्रमांक 5 के अतिरिक्त, समिति के अध्यक्ष/सदस्य, एक माह का नोटिस देकर किसी भी समय त्यागपत्र दे सकेंगे।
(7) समिति, किशोर न्याय (बालकों की देखरेख एवं संरक्षण) अधिनियम, 2015 (2016 का 2) तथा किशोर न्याय (बालकों की देखरेख एवं संरक्षण) नियम, 2016 के अनुसार बालकों के कल्याण एवं संरक्षण के लिये कार्य करेंगी।

(7) Committee shall function for the welfare and protection of the children in accordance with the Juvenile Justice (Care and Protection of Children) Act, 2015 (No.2 of 2016) & the Juvenile Justice (Care and Protection of Children) Rules, 2016.
(8) If the appointed member is in a profession/service, which can affect his work as a member of the Child Welfare Committee, then he will have to postpone his work of existing profession/service.
