क्र./3906/एफ-11/03/2023/14-2.⸺ छत्तीसगढ़ कृषि उपज मंडी अधिनियम, 1972 (क्र. 24 सन् 1973) की धारा 79 की उप-धारा (1) तथा उप-धारा (2) के खण्ड (दो) के उप-खण्ड (बत्तीस) के अधीन प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, उक्त अधिनियम की धारा 39 के खण्ड (आठ) के उप-खण्ड (च) के अधीन मंडी समिति निधि से मंडी क्षेत्र के विकास के लिए निम्नलिखित नियम बनाती है, अर्थात्ः-
नियम
1. संक्षिप्त नाम.-
(1) यह नियम, मंडी समिति निधि से मंडी क्षेत्र के विकास के लिए नियम, 2023 कहलायेगा।
(2) यह नियम राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगा।
2. मंडी समिति निधि से मंडी क्षेत्र के विकास के लिए विहित रीति.-
मण्डी समितियों के पास मण्डी प्रांगण एवं मण्डी क्षेत्र में विभिन्न तरह के निर्माण कार्य कराने के लिए मंडी समिति निधि एवं स्थाई निधि रहती है। मण्डी समिति प्रत्येक वर्ष माह फरवरी में जब अपने अगले वर्ष के बजट का निर्माण करेगी तब वह यह अनुमान करेगी कि उक्त वित्तीय वर्ष में मण्डी समिति को कितनी आय होने की संभावना है। संभावित आय में से स्थाई निधि, आरक्षित निधि, बोर्ड शुल्क, स्थापना व्यय, स्टेशनरी व्यय एवं अन्य आवश्यक व्यय घटाने के पश्चात् जो राशि शेष बचती है, उसे निर्माण कार्यों के लिए संभावित उपलब्ध राशि माना जायेगा। इसके पश्चात् यह गणना की जायेगी कि पूर्व से स्वीकृत एवं निर्माणाधीन कार्यों पर अगले वर्ष के दौरान कितना व्यय संभावित है। मण्डी को, निर्माण कार्यों के लिए उपलब्ध होने वाली कुल राशि में से उपरोक्तानुसार राशि घटाई जायेगी। इसके पश्चात् जितनी राशि शेष बचती है उतनी ही राशि निर्माण कार्यों के लिए उपलब्ध राशि होगी। किसी भी स्थिति में अधिक राशि के कार्य प्रस्तावित न किया जाये। छत्तीसगढ़ कृषि उपज मंडी (निधि विनिधान रीति) नियम, 1975 के नियम 3 के उप-नियम (1) के अनुसार मंडी समिति निधि के अधिशेष के विनिधान की रीति के अधीन मंडी वर्ष की समाप्ति में बचत मंडी समिति निधि के अधिशेष राशि को, वर्ष की समाप्ति के 3 माह के अंदर स्थाई निधि में जमा की जायेगी। वार्षिक कार्य योजना के अतिरिक्त मंडी समिति में उपलब्ध मंडी समिति निधि/स्थाई निधि से मंडी समिति द्वारा पृथक से भी निर्माण कार्य प्रस्तावित किये जा सकते हैं।
मंडी प्रांगण/उपमंडी प्रांगण में प्रस्तावित कार्यों के अतिरिक्त मंडी क्षेत्र के विकास के लिए निम्नलिखित निर्माण कार्यों की सूची, प्रथम स्तरीय प्राक्कलन के आधार पर तैयार की जायेगी-
1. ग्रामों में सड़क निर्माण एवं ग्रामोंं को मुख्य मार्ग से जोड़े जाने हेतु पहुंच विहिन सड़काें का निर्माण। 2. मुख्य मार्ग की ऐसी पुल-पुलिया का निर्माण, जिसकी अधिकतम लागत 20-25 लाख हो।
3. ग्राम पंचायत में किसान भवन का निर्माण, (अधिकतम लागत 20 लाख तक)।
4. ग्राम पंचायत में सामुदायिक भवन निर्माण, (अधिकतम लागत 20 लाख तक)।
5. धान उपार्जन केन्द्रों में सुविधाएं एवं अधोसंरचना निर्माण।
6. ग्राम पंचायतों में सांस्कृतिक मंच/शेड का निर्माण, (अधिकतम लागत 15 लाख तक)।
7. ग्राम पंचायतों में व्यवसायिक परिसर/दुकान निर्माण, (अधिकतम लागत 20 लाख तक)।
8. ग्रामों में सी.सी.रोड़ निर्माण की स्वीकृति (अधिकतम लागत 20 लाख तक)।
9. उपरोक्त कार्य के अलावा अन्य कार्य माननीय अध्यक्ष, मंडी बोर्ड की अनुमति से किये जा सकेेंगे।
वार्षिक कार्य योजना के अतिरिक्त, प्रस्तावित कार्यों की स्वीकृति/अनुमोदन, प्रबंध संचालक मंडी बोर्ड/संचालक कृषि विपणन से प्राप्त करनी होगी।
मंडी समिति से तकनीकी स्वीकृति के लिए प्रकरण प्राप्त होने पर, 15 दिवस के अंदर, बोर्ड के उप अभियंता द्वारा प्रत्येक कार्य का स्थल पर ट्रायल पिट लिया जाकर, उप अभियंता तथा सहायक अभियंता द्वारा प्राक्कलन तैयार किया जायेगा तथा वे यह सुनिश्चित करेंगे कि उनके द्वारा तैयार किया गया प्राक्कलन, विस्तृत रूपांकन एवं नक्शे, तकनीकी दृष्टि से सही हैं तथा प्राक्कलन में दरें बोर्ड द्वारा अनुमोदित मापदण्डों के आधार पर प्राक्कलित की गई है। प्रत्येक कार्य के लिए प्रस्तावित लागत के आधार पर तकनीकी स्वीकृति, बोर्ड के सक्षम तकनीकी अधिकारी द्वारा प्रदाय की जायेगी। तकनीकी स्वीकृति प्रदान करने वाले अधिकारी की यह सुनिश्चित करने की जबाबदेही होगी कि प्रस्ताव, तकनीकी दृष्टि से परिपूर्ण हो तथा उसमें भविष्य में कोई संशोधन या परिवर्तन करने की आवश्यकता न हो। तकनीकी स्वीकृति के साथ प्रत्येक निर्माण कार्य को पूर्ण करने के लिए सक्षम अधिकारी द्वारा चरणबद्ध समय सीमा निर्धारित की जायेगी।
छत्तीसगढ़ कृषि उपज मंडी अधिनियम, 1972 (क्र. 24 सन् 1974) की धारा 25-क की उप-धारा (4) के अनुसार निर्दिष्ट स्थाई निधि से भिन्न अपनी निधि तथा स्थाई निधि में से निर्माण कार्यों के प्रशासकीय स्वीकृति के समस्त अधिकार मंडी समिति को है, लेख है कि मंडी समिति, छत्तीसगढ़ कृषि उपज मंडी (निधि विनिधान रीति) नियम, 1975 के नियम 3 के उप-नियम (1) के अनुसार मंडी समिति निधि के अधिशेष के विनिधान की रीति के तहत स्थाई निधि में जमा राशि स्थाई प्रकृति के मद में उपयोग की स्वीकृति, संचालक कृषि विपणन से प्राप्त की जाकर, व्यय कर सकती है।
तकनीकी स्वीकृति प्राप्त होने के पश्चात् 1 माह के भीतर, मंडी समिति द्वारा अपनी बैठक में प्रशासकीय स्वीकृति हेतु निर्णय लिया जायेगा। मंडी समिति से अनुमोदन प्राप्त होने के उपरांत प्रशासकीय स्वीकृति, अध्यक्ष/भारसाधक अधिकारी तथा सचिव के संयुक्त हस्ताक्षर से जारी किये जायेंगे। बिना तकनीकी स्वीकृति के प्रकरण में प्रशासकीय स्वीकृति जारी नहीं की जायेगी। यदि मण्डी समिति आवश्यक समझे तो, प्रशासकीय स्वीकृति देने के पूर्व राज्य मण्डी बोर्ड के अन्य किसी वरिष्ठ तकनीकी अधिकारी से प्रकरण में अभिमत प्राप्त कर सकेगी। मंडी समितियों द्वारा कराये जाने वाले निर्माण कार्यों हेतु निविदायें आमंत्रित कर, कार्य संपादित कराना होगा तथा निविदा आमंत्रण प्रक्रिया, निविदा खोलना एवं निविदा की स्वीकृति, अनुबंध निष्पादन, कार्य निष्पादन, माप पुस्तिका भरा जाना, भुगतान पद्धति, कार्य पूर्णता प्रमाण पत्र एवं सम्पति पंजी का संधारण, परिसम्पतियों का रख-रखाव, अनुश्रवण एवं निरीक्षण के संबंध में, प्रबंध संचालक मंडी बोर्ड द्वारा पूर्व में तथा समय-समय पर जारी निर्देशों का पालन मंडी समिति को करना होगा।

NOTIFICATION
No./3906/ F-11/03/2023/14-2.⸺In exercise of the powers conferred by sub-section (1) and sub-clause (xxxii) of clause (ii) of sub-section (2) of Section 79 of the Chhattisgarh Krishi Upaj Mandi Adhiniyam, 1972 (No. 24 of 1973), the State Government, hereby, makes the following rules for Development of the Market Committee Fund under sub-clause (f) of clause (8) of the Section 39 of the said Adhiniyam, namely:-
RULES
1. Short title.-
(1) These rules may be called the Rules for Development of the Market Area from the Market Committee Fund, 2023.
(2) These rules shall come into force from the date of publication in the Official Gazette.
2. Prescribed manner for development of the market area from the Market Committee Fund.-
The Market Committees have a Market Committee Fund and a Permanent Fund to carry out various types of construction work in the market yard and market area. Every year in the month of February, when the Market Committee prepares its budget for the next year, it will estimate how much income the Market Committee is likely to earn in the said financial year. The amount that remains after deducting the permanent fund, reserve fund, board fee, establishment expenses, stationery expenses and other necessary expenses from the possible income will be considered as the possible amount available for construction works. After this, it will be calculated how much expenditure is likely to be incurred during the next year on previously approved and under construction works. The above amount will be deducted from the total amount available to the market for construction works. After this, the amount remaining will be the amount available for construction works. Under no circumstances should work be proposed for a higher amount. Under the method of investing the surplus in the Market Committee Fund according to sub-rule (1) of rule 3 of the Chhattisgarh Krishi Upaj Mandi (Nidhi Vinidhan Riti) Niyam, 1975, the surplus amount of the Savings Market Committee Fund at the end of the market year shall be deposited to Permanent Fund within 3 month of the end of the year. Apart from the annual work plan, construction work can also be proposed separately by the market committee from the Market Committee Fund/ Permanent Fund available in the market committee.
In addition to the proposed works in the market area/sub-market area, the following list of construction works for the development of the market area will be prepared on the basis of first level estimate -
1. Construction of roads in villages and Construction of inaccessible roads to connect villages with main roads.
2. Construction of such bridges and culverts on the main road, the maximum cost of which is Rs 20-25 lakh.
3. Construction of Kisan Bhawan in Gram Panchayat, (maximum cost up to Rs 20 lakh).
4. Construction of community building in Gram Panchayat, (maximum cost up to Rs 20 lakh).
5. Creation of facilities and infrastructure in paddy procurement centres.
6. Construction of cultural stage/shed in Gram Panchayats (maximum cost up to Rs 15 lakh).
7. Construction of commercial premises/shops in Gram Panchayats (maximum cost up to Rs 20 lakh).
8. Approval of construction of CC roads in villages (maximum cost up to Rs 20 lakh).
9. Apart from the above work, other work can be done with the permission of the Honorable Chairman, Mandi Board.
In addition to the Annual Action Plan, sanction/ approval of the proposed works will have to be obtained from the Managing Director Market Board/Director Agricultural Marketing.
After receiving the case for technical approval from the market committee, within 15 days, the Deputy Engineer of the Board will conduct a trial pit at the site of each work and the estimate will be prepared by the Deputy Engineer and Assistant Engineer and they will ensure that the estimate prepared by them, detailed designs and maps are technically correct and the rates in the estimate have been estimated on the basis of parameters approved by the Board.
Technical approval will be given by the competent technical officer of the Board on the basis of proposed cost for each work. The officer granting technical approval will be responsible to ensure that the proposal is technically complete and there is no need to make any amendments or changes in it in future. Stage-wise time limit should be set by the competent authority for completing each construction work with technical approval.
According to sub-section (4) of Section 25-A of the Chhattisgarh Krishi Upaj Mandi Adhiniyam, 1972 (No. 24 of 1973), the Market Committee has all the rights to administratively approve construction works from its own fund and the permanent fund other than the specified permanent fund. It is written that the Market Committee, According to sub-rule (1) of rule 3 of the Chhattisgarh Krishi Upaj Mandi (Nidhi Vinidhan Riti) Niyam, 1975, approval for using the amount deposited in the permanent fund for items of permanent nature under the method of investment of the surplus in the market committee fund shall be obtained from the Director of Agricultural Marketing and can be spent.
After receiving the technical approval, the decision for administrative approval will be taken by the Market Committee in its meeting within 1 month. After getting approval from the market committee, administrative approval shall be issued with the joint signature of the Chairman/Officer-in-charge and the Secretary. Administrative approval shall not be issued in case without technical approval. If the Market Committee deems it necessary, it may obtain opinion on the case from any other senior technical officer of the State Market Board before giving administrative approval.
For the construction works to be done by the market committees, the work will have to be done by inviting tenders and regarding the tender invitation process, opening of tender and acceptance of tender, contract execution, work execution, filling of measurement book, payment method, work completion certificate, maintenance of property register and maintenance, monitoring and inspection of assets, the Market Committee will have to follow the instructions issued earlier and from time to time by the Managing Director Market Board.
