क्रमांक एफ 1-29/2015/17-1.⸺ छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 (क्र. 23 सन् 2010) की धारा 18 की उप-धारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन नियम, 2013 में अग्रतर संशोधन का निम्नलिखित प्रारूप प्रस्तावित करती है, उक्त अधिनियम की धारा 18 की उप-धारा (1) द्वारा अपेक्षित किये गए अनुसार, उन समस्त व्यक्तियों, जिनके इससे प्रभावित होने की संभावना है, की जानकारी के लिए एतद्द्वारा प्रकाशित किया जाता है तथा एतद्द्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस सूचना के राजपत्र में प्रकाशन की तारीख से तीस दिवस के अवसान केे पश्चात् विचार किया जायेगा।
उक्त प्रारूप के संबंध में कोई आपत्ति या सुझाव, विनिर्दिष्ट कालावधि के पूर्व, प्रमुख सचिव, स्वास्थ्य एवं परिवार कल्याण विभाग, छत्तीसगढ़ शासन, मंत्रालय, महानदी भवन, कैपिटल काम्प्लेक्स, नवा रायपुर अटल नगर, जिला रायपुर के कार्यालय में, कार्यालयीन समय में प्राप्त होने पर, छत्तीसगढ़ शासन द्वारा विचार किया जायेगा।
संशोधन प्रारुप
उक्त नियमों में,-
1. नियम 11 के उप-नियम (1) के खण्ड (छ) के पश्चात्, निम्नलिखित जोड़ा जाये, अर्थात्ः-
''(ज) समस्त क्लीनिक (ओपीडी, डेंटल, फिजियोथेरेपी, पैथोलॉजी लैब, डायग्नोस्टिक सेंटर, डे-केयर सेंटर, इत्यादि) को, छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत आवेदन करना होगा एवं आवेदन के साथ, इनके द्वारा समस्त निर्धारित मापदण्डों का पालन किये जाने संबंधी शपथ-पत्र प्रस्तुत किये जायेंगे। आवेदक के आवेदन तथा शपथ पत्र के आधार पर, आवेदित समस्त क्लीनिक, स्वतः पंजीकृत माने जायेंगे एवं उक्त लाइसेंस की प्रति, आवेदक द्वारा आनॅलाईन डॉउनलोड किये जायेंगे। जिले में संचालित एवं आवेदित ऐसे क्लीनिक के 10% संस्थाओं का, धारा 8 की उप-धारा (3) के अनुसार निरीक्षण किया जायेगा एवं कमी पाये जाने की दशा में, संबंधित क्लीनिक के द्वारा 01 माह के भीतर उक्त कमियों को दूर किया जाना होगा, अन्यथा लाईसेंस निरस्त किया जा सकेगा। (झ) 1-10 बिस्तर तक अस्पतालों/नर्सिंगहोम/मेटरनिटी होम इत्यादि को छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत आवेदन करना होगा एवं आवेदन के साथ, इनके द्वारा समस्त निर्धारित मापदण्डों का पालन किये जाने संबंधी शपथ-पत्र प्रस्तुत किये जायेंगे। आवेदक के आवेदन तथा शपथ पत्र के आधार पर, आवेदित समस्त अस्पतालों /नर्सिंगहोम/मेटरनिटी होम इत्यादि, स्वतः पंजीकृत माने जायेंगे एवं उक्त लाइसेंस की प्रति, आवेदक द्वारा आनॅलाईन डाउनलोड किये जा सकेंगे। जिले में संचालित एवं आवेदित ऐसे अस्पतालों/नर्सिंगहोम/मेटरनिटी होम इत्यादि के 100% संस्थाओं का, धारा 8 की उप-धारा (3) के अनुसार 3 माह के भीतर निरीक्षण किया जायेगा एवं कमी पाये जाने की दशा में, संबंधित क्लीनिक के द्वारा 01 माह के भीतर उक्त कमियों को दूर किया जाना होगा, अन्यथा लाईसेंस निरस्त किया जा सकेगा।
() 11-30 बिस्तर तक निजी अस्पतालों / नर्सिंगहोम / मेटरनिटी होम इत्यादि को, छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत आवेदन करना होगा तथा आवेदन के पश्चात् 03 माह के भीतर, मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी के द्वारा, आवेदित समस्त संस्थाओं का, धारा 8 के उप-धारा (3) अनुसार निरीक्षण कर, नियमानुसार लाईसेंस जारी किया जायेगा। मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी के द्वारा उक्त प्रकिया समयानुसार नहीं किये जाने की स्थिति में, संस्थायें, छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत स्वतः पंजीकृत माने जायेंगे, तत्पश्चात् उक्त लाइसेंस की प्रति, आवेदक द्वारा ऑनलाईन डॉउनलोड किया जा सकेगा। भविष्य में लाइसेंस जारी किये गये संस्थाओं में किसी भी प्रकार की कमी पाये जाने की स्थिति में, मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी एवं संस्था प्रभारी, स्वयं जिम्मेदार होंगे और निजी अस्पतालों/नर्सिंगहोम/मेटरनिटी होम इत्यादि के लाइसेंस को निलंबित किया जायेगा। निजी अस्पतालों / नर्सिंगहोम / मेटरनिटी होम इत्यादि को, 1 माह के भीतर कमियों को दूर करना होगा, ऐसा नहीं कर पाने की स्थिति में, लाइसेंस को निरस्त किया जायेगा। (ट) 30 से अधिक बिस्तरों के अस्पताल/नर्सिंगहोम/मेटरनिटी होम इत्यादि में छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 एवं नियम 2013 के अंतर्गत पंजीकरण तथा लाइसेंस जारी किये जाने हेतु, पूर्व से लागू समस्त नियम (फायर सेफ्टी एवं बायो मेडिकल वेस्ट के अनापत्ति प्रमाण पत्र को छोड़कर) पूर्ववत् जारी रहेगा।''
2. नियम 11 के उप-नियम (2) खण्ड (च) के पश्चात्, निम्नलिखित जोड़ा जाये, अर्थात्ः-
''(छ) समस्त क्लीनिक (ओपीडी, डेंटल, फिजियोथेरेपी, पैथोलॉजी लैब, डायग्नोस्टिक सेंटर, डे-केयर सेंटर, इत्यादि) को, छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत आवेदन करना होगा एवं आवेदन के साथ, इनके द्वारा समस्त निर्धारित मापदण्डों का पालन किये जाने संबंधी शपथ-पत्र प्रस्तुत किये जायेंगे। आवेदक के आवेदन तथा शपथ पत्र के आधार पर, आवेदित समस्त क्लीनिक, स्वतः पंजीकृत माने जायेंगे एवं उक्त लाइसेंस की प्रति, आवेदक द्वारा आनॅलाईन डॉउनलोड किये जायेंगे। जिले में संचालित एवं आवेदित ऐसे क्लीनिक के 10% संस्थाओं का, धारा 8 की उप-धारा (3) के अनुसार निरीक्षण किया जायेगा एवं कमी पाये जाने की दशा में, संबंधित क्लीनिक के द्वारा 01 माह के भीतर उक्त कमियों को दूर किया जाना होगा, अन्यथा लाईसेंस निरस्त किया जा सकेगा। (ज) 1-10 बिस्तर तक अस्पतालों/नर्सिंगहोम/मेटरनिटी होम इत्यादि को छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत आवेदन करना होगा एवं आवेदन के साथ, इनके द्वारा समस्त निर्धारित मापदण्डों का पालन किये जाने संबंधी शपथ-पत्र प्रस्तुत किये जायेंगे। आवेदक के आवेदन तथा शपथ पत्र के आधार पर, आवेदित समस्त अस्पतालों/नर्सिंगहोम/मेटरनिटी होम इत्यादि, स्वतः पंजीकृत माने जायेंगे एवं उक्त लाइसेंस की प्रति, आवेदक द्वारा आनॅलाईन डाउनलोड किये जा सकेंगे। जिले में संचालित एवं आवेदित ऐसे अस्पतालों/नर्सिंगहोम/मेटरनिटी होम इत्यादि के 100% संस्थाओं का, धारा 8 की उप-धारा (3) के अनुसार 3 माह के भीतर निरीक्षण किया जायेगा एवं कमी पाये जाने की दशा में, संबंधित क्लीनिक के द्वारा 01 माह के भीतर उक्त कमियों को दूर किया जाना होगा, अन्यथा लाईसेंस निरस्त किया जा सकेगा।
(झ) 11-30 बिस्तर तक निजी अस्पतालों / नर्सिंगहोम / मेटरनिटी होम इत्यादि को, छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत आवेदन करना होगा तथा आवेदन के पश्चात् 03 माह के भीतर, मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी के द्वारा, आवेदित समस्त संस्थाओं का, धारा 8 के उप-धारा (3) अनुसार निरीक्षण कर, नियमानुसार लाईसेंस जारी किया जायेगा। मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी के द्वारा उक्त प्रकिया समयानुसार नहीं किये जाने की स्थिति में, संस्थायें, छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 तथा नियम 2013 के अंतर्गत स्वतः पंजीकृत माने जायेंगे, तत्पश्चात् उक्त लाइसेंस की प्रति, आवेदक द्वारा ऑनलाईन डॉउनलोड किया जा सकेगा। भविष्य में लाइसेंस जारी किये गये संस्थाओं में किसी भी प्रकार की कमी पाये जाने की स्थिति में, मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी एवं संस्था प्रभारी, स्वयं जिम्मेदार होंगे और निजी अस्पतालों/नर्सिंगहोम/मेटरनिटी होम इत्यादि के लाइसेंस को निलंबित किया जायेगा। निजी अस्पतालों / नर्सिंगहोम / मेटरनिटी होम इत्यादि को, 1 माह के भीतर कमियों को दूर करना होगा, ऐसा नहीं कर पाने की स्थिति में, लाइसेंस को निरस्त किया जायेगा। (ञ) 30 से अधिक बिस्तरों के अस्पताल/नर्सिंगहोम/मेटरनिटी होम इत्यादि में छत्तीसगढ़ राज्य उपचर्यागृह तथा रोगोपचार संबंधी स्थापनाएं अनुज्ञापन अधिनियम, 2010 एवं नियम 2013 के अंतर्गत पंजीकरण तथा लाइसेंस जारी किये जाने हेतु, पूर्व से लागू समस्त नियम (फायर सेफ्टी एवं बायो मेडिकल वेस्ट के अनापत्ति प्रमाण पत्र को छोड़कर) पूर्ववत् जारी रहेगा।''
3. अनुसूची-1 के भाग-क के सरल क्रमांक 7, भाग-ख के सरल क्रमांक 7, भाग-ग के सरल क्रमांक 6, भाग-घ के सरल क्रमांक 5, भाग-ड. के सरल क्रमांक 10 का लोप किया जाए।
4. अनुसूची-2 के फार्म सी ई 1 के सरल क्रमांक 10 एवं 11, फार्म सी ई 2 के सरल क्रमांक 10 एवं 11, फार्म सी ई 3 के सरल क्रमांक ग एवं घ का लोप किया जाए।

NOTICE
No. F 1-29/2015/17/1.⸺ In exercise of the powers conferred by sub-section (1) of Section 18 of the Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Adhiniyam, 2010 (No. 23 of 2010), the State Government, hereby, proposes the following draft of further amendment in the Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Niyam, 2013, which is hereby, published as required by sub-section (1) of Section 18 of the said Act, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of thirty days from the date of publication of this notification in the Official Gazette.
Any objection or suggestions regarding the said draft upon receiving before the specified period, in office hours in office of the Principal Secretary, Department of Health and Family Welfare, Government of Chhattisgarh, Mahanadi Bhawan, Mantralaya, Capitol Complex, Naya Raipur Atal Nagar, District Raipur shall be considered by the Government of Chhattisgarh.
DRAFT AMENDMENT
In the said rules,-
1. After clause (g) of sub-rule (1) of rule 11, the following shall be added, namely:-
''(h) All clinics (OPD, Dental, Physiotherapy, Pathology Lab, Diagnostic Centre, Day-Care Centre, etc.) will have to apply under Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Adhiniyam, 2010 and Rules 2013, along with the application, they will submit an affidavit that they have followed all the prescribed standards. On the basis of the applicant's application and affidavit, all the clinics applied will be considered automatically registered and a copy of the said license may be downloaded online by the applicant. 10% institutions of Such clinics operated and applied for in the district will be inspected as per sub-section (3) of Section 8 and in case any deficiencies are found, the said deficiencies will have to be rectified by the concerned clinic within 01 month, otherwise the license may be cancelled.
(i) Hospitals/nursing homes/maternity homes etc. with 1-10 beds will have to apply under the Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Adhiniyam, 2010 and Rules 2013, and along with the application, they will submit an affidavit that they have followed all the prescribed standards. On the basis of the applicant's application and affidavit, all the hospitals/nursing homes/maternity homes etc. applied will be considered automatically registered and a copy of the said license may be downloaded online by the applicant. 100% institutions of Such hospitals/nursing homes/maternity homes etc. operated and applied for in the district will be inspected within three months as per sub-section (3) of Section 8 and in case any deficiencies are found, the said deficiencies will have to be rectified by the concerned clinic within 01 month, otherwise the license may be cancelled.
(j) Private hospitals/nursing homes/maternity homes etc. up to 11-30 beds will have to apply under the Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Adhiniyam, 2010 and Rules 2013 and within 03 months after the application, the license will be issued as per rules by the Chief Medical and Health Officer for all institutions applied, by inspecting as per sub-section (3) of Section 8 and license will be issued as per rules. In case the Chief Medical and Health Officer does not complete the said process in time, the institution will be considered automatically registered under the Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Adhiniyam, 2010 and Rules 2013, thereafter, a copy of the said license may be downloaded online by the applicant. In case any deficiency is found in the institutions issued licenses in future, the Chief Medical and Health Officer and the institution in-charge will themselves be responsible and the licenses of private hospitals/nursing homes/maternity homes etc. will be suspended. Private hospitals/nursing homes/maternity homes etc. will have to rectify the deficiencies within 1 month, failing which the license will be cancelled.
(k) All previously applicable rules for registration and issuance of license under the Chhattisgarh State Upcharyagriha Tatha Rogopchar Sambandhi Sthapanaye Anugyapan Adhiniyam, 2010 and Rules 2013 in hospitals/nursing homes/maternity homes etc. with more than 30 beds (except the no objection certificate for fire safety and bio-medical waste) will continue as before."

3. In Schedule-1, serial number 7 of Part A, serial number 7 of Part B, serial number 6 of Part C, serial number 5 of Part D and serial number 10 of Part E shall be omitted.
4. In Schedule-II, serial number 10 and 11 of Form CE-1, serial number of 10 and 11 of Form CE-2 and serial number c and d of Form CE-3 shall be omitted.
