अधिसूचना
क्र. एफ 7-1 / तीन- जेल / 2023.- कारागार अधिनियम , 1894 (1894 का सं. 9) की धारा 59 एवं सहपठित धारा 36- क द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा , छत्तीसगढ़ जेल नियम, 1968 में निम्नलिखित अग्रतर संशोधन करती है, अर्थात्ः-

उक्त नियमों में, -
1. नियम 2 में,-
(एक) खण्ड (ग ) के पश्चात्, निम्नलिखित खण्ड अन्तःस्थापित किया जाये , अर्थात्ः- (ग-1) "सामान्य निधि" से अभिप्रेत है पात्र पीड़ितों को प्रतिकर देने के प्रयोजन हेतु बंदियों द्वारा उपार्जित मजदूरी के भाग से जेल के लिये सृजित निधि;
(ग-2) " समिति" से अभिप्रेत है अधिनियम की धारा 36 - क के उपबंधो के अधीन जेल के लिये गठित ऐसी समिति , जो ऐसी जेल के लिये सृजित सामान्य निधि में से पात्र पीड़ितों को दी जाने वाली प्रतिकर की राशि नियत करने के लिये है;
(दो) खण्ड (झ) के पश्चात्, निम्नलिखित खण्ड जोड़ा जाये , अर्थात्: -
(ञ) " मजदूरी" से अभिप्रेत है किसी बन्दी द्वारा किसी दिन, जेल के अधीक्षक द्वारा , जेल में उसे दिये गये कार्य या सेवा के बदले में, उपार्जित धन । 2. नियम 647 के पश्चात्, निम्नलिखित नियम अन्तःस्थापित किया जाए , अर्थातः- "647- क.- समिति का गठन और उसकी बैठकें. -
(1) प्रत्येक केन्द्रीय जेल , जिला जेल एवं उप जेल की समिति में , निम्नलिखित शामिल होंगे:-

सदस्य
(दो) पुलिस अधीक्षक
सदस्य- सचिव (तीन) केन्द्रीय / जिला / उप - जेल के जेल अधीक्षक-

(2 ) समिति की बैठकें तीन माह में एक बार अथवा ऐसे अन्तरालों से होगी , जैसा कि समिति के अध्यक्ष द्वारा विनिश्चित किया जाये ।
(3) समिति, सामान्य निधि से प्रतिकर के भुगतान का प्रबन्ध करेगी । समिति द्वारा , उसकी बैठकों में शासन द्वारा निर्धारित प्रक्रिया का पालन करते हुए , राज्य शासन द्वारा निर्धारित प्रतिकर के भुगतान के संबंध में , आवश्यक निर्णय लिया जायेगा ।
(4) ऐसा बंदी, जो 3 वर्ष या उससे अधिक की सजा से दण्डित किया गया हो , द्वारा कारित अपराध की दशा में पीड़ित , इस नियम के अधीन प्रतिकर राशि के भुगतान हेतु पात्र होगा ।
(5) प्रत्येक ऐसे पात्र पीड़ित के संबंध में विचार करने के उपरांत, नियम 647 - क ( 1 ) के अंतर्गत गठित समिति के अनुमोदन के आधार पर ही भुगतान होगा । राज्य शासन द्वारा समय - समय पर प्रतिकर राशि का निर्धारण किया जायेगा और तद्नुसार, पीड़ित पक्ष को प्रतिकर की राशि का भुगतान एकमुश्त किया जायेगा । (
6) पीड़ित पक्ष के परिवार से अभिप्रेत है,-
(क) यदि पीड़ित विवाहित है - पति / पत्नी , बच्चे;
(ख ) यदि पीड़ित अविवाहित है माता - पिता एवं भाई - बहन ।
(7) इस नियम के अधीन भुगतान की प्रक्रिया / तरीका एवं अन्य आवश्यक प्रक्रियाओं का निर्धारण समय - समय पर करने के लिये राज्य शासन सक्षम होगा ।
647- ख.- मजदूरी तथा सामान्य निधि का प्रबन्ध. -
(1 ) नियम 647 में यथा उपबंधित कार्यों और इन नियमों में यथा उपबंधित सेवायें देने हेतु मजदूरी , राज्य शासन द्वारा समय - समय पर, नियत एवं अधिसूचित की जायेगी ।
(2) नियम 647 में वर्णित कार्यों के लिए जेल में उपलब्ध कार्य की मात्रा एवं इन नियमों में यथा उपबंधित सेवाओं पर विचार करने के पश्चात्, जेल अधीक्षक, बंदियों को नियोजन उपलब्ध करायेगा और बंदियों के चयन के लिए प्राथमिकता निम्नलिखित क्रम में होगी:-
(क) कठोर कारावास के साथ आजीवन कारावास की सजा भुगत रहे बन्दी;
(ख) अन्य बन्दी , जो कि कठोर कारावास की सजा भुगत रहे हों ;
(ग ) साधारण कारावास की सजा भुगत रहे बन्दी , जो कार्य करने के इच्छुक हों;
(घ) उप - जेलों में , यदि उपरोक्त प्रवर्ग के बन्दी उपलब्ध न हों, तो स्वेच्छा से सेवाएं देने के इच्छुक विचाराधीन बन्दियों को नियोजित किया जा सकता है । 422(1)

(3) ( क) बंदी द्वारा एक माह में उपार्जित मजदूरी के पचास प्रतिशत को सामान्य निधि में जमा किया जायेगा;
(ख) प्रत्येक जेल में सामान्य निधि का गठन किया जायेगा, जिसमें खण्ड ( क ) में यथा वर्णित मजदूरी जमा की जायेगी । निधि का नियन्त्रण , सम्बन्धित जिले के जिला मजिस्ट्रेट एवं सम्बन्धित जेल के जेल अधीक्षक द्वारा किया जायेगा;
(
ग) सामान्य निधि की रकम , सम्बन्धित जेल के जेल अधीक्षक के नाम से कोषालय में खोले गये वैयक्तिक जमा खाते में जमा की जायेगी;
(घ ) सामान्य निधि से प्रतिकर की ऐसी रकम का भुगतान, अपराध के पात्र पीड़ित को एवं उसकी मृत्यु हो जाने पर पात्र पीड़ित के परिवार के सदस्य को किया जायेगा , जैसा कि समिति द्वारा विनिश्चित किया जाये । (4 ) प्रत्येक बंदी की मजदूरी का शेष पचास प्रतिशत , संबंधित बंदी के नाम से खोले गये बैंक खाते में जमा किया जायेगा । यह खाता, जेल के निकट स्थित किसी भी राष्ट्रीयकृत बैंक में खोला जा सकेगा ।
(5 ) प्रत्येक बंदी , कार्य या सेवा से एक साप्ताहिक छुट्टी का हकदार होगा , जैसा कि जेल अधीक्षक द्वारा विनिश्चय किया जाए । कार्यों या सेवाओं में नियोजित बन्दियों के मामलें में , जेल अधीक्षक यह सुनिश्चित करेगा कि उनके नियोजन का प्रबंध ऐसी रीति से किया गया है कि उन्हें सप्ताह में एक साप्ताहिक छुट्टी प्राप्त हो सके । "

NOTIFICATION
No. F 7-1 / Three - Jail / 2023 .— In exercise of the powers conferred by Section 59 read with Section 36 - A of the Prison Act, 1894 (No. IX of 1894) , the State Government , hereby , makes the following further amendment in the Chhattisgarh Prisons Rules , 1968 , namely: -
AMENDMENT
In the said rules , -
1 . In rule 2 , -
(i ) after clause (c ) , the following clauses shall be inserted , namely: - (c - 1 ) " Common Fund " means the fund created for a jail from the part of the wages earned by prisoners for the purpose of giving compensation to the deserving victims .
(c - 2 ) " Committee " means the Committee constituted for a jail under the provision of Section 36 - A of the Act for fixing amount of compensation to be given to the deserving victims from the common fund created for such jail .
( ii ) after clause ( i ) , the following clause shall be added , namely : - (j ) "Wages " means the amount of the money earned by a prisoner in a day in lieu of the task or the service assigned to him /her in the jail by the superintendent of the jail .
2. After rule 647, the following rule shall be inserted , namely : -
" 647 - A.- Constitution of the Committee and its meetings.-
( 1 ) The Committee in each of Central Jail , District Jail and Sub - Jail shall consist of: -
Chairman
( i ) District Magistrate
Member
( ii ) Superintendent of Police
- Member - Secretary ( iii ) Jail Superintendent of Central /District/Sub - Jail 422 ( 3 )

2. The Meetings of the Committee shall be held once in three months or at such intervals as may be decided by the Chairman of the Committee.
3. The committee shall manage the payment of compensation from the general fund . Necessary decision shall be taken by the committee in its meeting regarding the payment of the compensation fixed by the State Government in compliance of the procedure prescribed by the Government .
4. In the case of a crime committed by a prisoner , who has been sentenced to 3 years or more , the victim will be eligible for payment of the compensation amount under this rule.
5. After considering each such victim eligible , the payment will be made only with the approval of the committee constituted under Rule 647A (1 ) . The compensation amount will be fixed by the State Government from time to time , and accordingly , the compensation amount will be paid in a lump sum to the victim party .
6. The family of the victim party means , -
(a) If the victim is married - Husband/ Wife , Children ;
(b) If the victim is unmarried -Parents and Siblings .
7. The State Government will be able to determine from time to time the process /method of payment and other necessary procedures under this rule.
647 - B . Management of wages and common fund . -
(1) Wages for the tasks as provided in rule , 647 and for rendering services as provided in these rules shall be fixed and notified by the State Government from time to time .
(2) After considering the volume of work available in the Jail for the tasks mentioned in rule 647 and the services as provided in these rules , the Superintendent shall provide employment to the prisoners and the priority for the selection of prisoners shall be in the following order :
(a) Prisoner undergoing life imprisonment with rigorous imprisonment ;
(b) Other prisoners who are undergoing rigorous imprisonment ;
(c ) Prisoners undergoing simple imprisonment , who are willing to work;
(d) In Sub -jails under trial prisoners who are willingly ready to render their services may be employed if the prisoners of above category are not available .

(
3 ) ( a) Fifty percent of the wages earned by the prisoner in a month shall be deposited in the common fund ;
(b) A common fund shall be constituted in every jail , in which wages as mentioned in clause ( a) shall be deposited . The fund shall be controlled by the District Magistrate of the district concerned and the Jail Superintendent of the jail concerned ;
(c) The amount of the general fund shall be deposited in the personal deposit account opened at the Treasury in the name of the Superintendent of the concerned jail ;
(d) Such amount of compensation from the General Fund shall be paid to a deserving victim of the offence and in case of death of the deserving victim to the family member of the victim as decided by committee .
(4 ) The remaining fifty percent of wages of each prisoner shall be deposited in bank account opened in name of the prisoner concerned . This account can be opened in any nationalized bank located near the jail .
(5) Every prisoner shall be entitled to one weekly off from work or service , as may be decided by the Superintendent of Jail . In the case of prisoners employed in the task or the services , the Superintendent of the jail shall ensure that management of their employment is made in such a manner that they may get one weekly off in a week . "
