अधिसूचना
क्रमांक एफ 10-14/2023/वा.क.(आब.)/पांच(58) .— छत्तीसगढ़ आबकारी अधिनियम, 1915 (क्र. 2 सन् 1915) की धारा 18 की उप-धारा (1) के खण्ड (ख) तथा धारा 62 की उप-धारा (1) एवं उप-धारा (2) के खण्ड (च), (छ), (ज) एवं (झ) सहपठित उप-धारा (3) के परंतुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ भांग नियम, 2021 में निम्नलिखित संशोधन करती है, अर्थात् -
संशोधन
उक्त नियमों में,-
1. नियम 4 के उप-नियम (4) में, शब्द एवं अंक ''रू. 500/- (पांच सौ रूपये मात्र)'' के स्थान पर, शब्द एवं अंक ''रू. 1000/- (एक हजार रूपये मात्र)'' प्रतिस्थापित किया जाये।
2. नियम 5 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाये, अर्थात्ः-
''5. भांग का थोक कब्जा एवं विक्रय.-
(1) इन नियमों के अधीन भांग के थोक कब्जे एवं विक्रय हेतु प्ररूप एच.डी.-1 में अनुज्ञप्ति जारी की जा सकेगी। भांग के थोक कब्जे एवं विक्रय हेतु राज्य के भीतर केवल एक अनुज्ञप्ति जारी किया जायेगा। एक से अधिक आवेदकों की स्थिति में, लॉटरी पद्धति द्वारा अनुज्ञप्तिधारी का चयन किया जायेगा। अनुज्ञप्तिधारी का चयन प्रतिवर्ष किया जायेगा।
(2) कोई भी व्यक्ति, जो भांग का थोक में कब्जा एवं विक्रय करना चाहता है, आबकारी आयुक्त के समक्ष नियम 4 में यथा विहित प्ररूप एच.डी.-1(क) में आवेदन प्रस्तुत कर सकेगा।
(3) उपरोक्त उप-नियम (2) के अधीन आवेदन प्राप्त होने पर, आबकारी आयुक्त, सम्यक् जांच के उपरांत संतुष्ट होने पर, रूपये 25,00,000/- (पच्चीस लाख रूपये मात्र) की अग्रिम वार्षिक अनुज्ञप्ति शुल्क तथा यथा निर्धारित प्रतिभूति निक्षेप के भुगतान पर विहित प्ररूप एच.डी.-1 में अनुज्ञप्ति जारी करेगा।'' ''(3) उपरोक्त उप-नियम (2) के अधीन आवेदन प्राप्त होने पर, अनुज्ञापन प्राधिकारी, सम्यक् जांच के उपरांत संतुष्ट होने पर, अनुसूचित क्षेत्र में रूपये 2,00,000/- (दो लाख रूपए मात्र) एवं गैर अनुसूचित क्षेत्र में रूपये 3,00,000/- (तीन लाख रूपए मात्र) की अग्रिम वार्षिक अनुज्ञप्ति शुल्क तथा यथा निर्धारित प्रतिभूति निक्षेप के भुगतान पर, विहित प्ररूप एच.डी.-2 में अनुज्ञप्ति प्रदान करेगा।''

NOTIFICATION
No. F 10-14/2023/CT(Ex.)/V(58) .— In exercise of the powers conferred by clause (b) of sub-section (1) of Section 18 and sub-section (1) and clause (f), (g), (h) and (i) of sub-section (2) read with the proviso to sub-section (3) of Section 62 of the Chhattisgarh Excise Act, 1915 (No. II of 1915), the State Government, hereby, makes the following amendment in the Chhattisgarh Bhang Rules, 2021, namely:-
AMENDMENT
In the said rules,-
1. In sub-rule (4) of rule 4, for the words and figure "Rs.500/- (Rs. Five hundred only)", the words and figure "Rs. 1000/- (Rs. One thousand only)" shall be substituted.
2. For rule 5, the following shall be substituted, namely:-
"5. Wholesale Possession and Sale of Bhang.-
(1) The Licence for Wholesale Possession and Sale of Bhang under these rules may be issued in Form H.D-1. Only one license shall be issued within the State for Wholesale Possession and Sale of Bhang. In case of more than one applicant, the licensee shall be selected by lottery system. The licensee shall be selected every year.
(2) Any person who desires wholesale possession and sale of Bhang, may present an application before the Excise Commissioner in Form H.D-1(A), as prescribed in rule 4.
(3) The Excise Commissioner, on receipt of application under above mentioned sub-rule (2), after being satisfied upon due verifications, shall issue the license in prescribed Form H.D-1 on payment of advance annual license fees of Rs. 25,00,000/- (Rs. Twenty five lakhs only) and furnishing of security deposit as determined."
3. For sub-rule (3) of rule 6, the following shall be substituted, namely:-
"(3) The Licensing Authority, on receipt of application under above mentioned sub-rule (2) and after being satisfied upon due verifications, shall grant the license in prescribed Form H.D-2, on payment in advance the annual license fees of Rs. 2,00,000/- (Rs. Two lakhs only) for the license in a Scheduled Areas and that of Rs. 3,00,000/- (Rs. Three lakhs only) for the license in a Non-Scheduled Areas, along with furnishing of security deposit as determined."
