छत्तीसगढ़ अधिनियम (क्रमांक 9 सन् 2024)
छत्तीसगढ़ कृषि उपज मण्डी (संशोधन) अधिनियम , 2024 .
छत्तीसगढ़ कृषि उपज मण्डी अधिनियम, 1972 (क्र. 24 सन् 1973) के अग्रतर संशोचन करने हेतु अधिनियम ।
भारत गणराज्य के पचहत्तरवें वर्ष में छत्तीसगढ़ विधान मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित हो:-
1. (1) यह अधिनियन छत्तीसगढ़ कृषि उपज मण्डी (संशोधन) अधिनियम, 2024 कहलायेगा ।
संक्षिप्त नाम, विस्तार तथा प्रारंभ
(2) इसका विस्तार संपूर्ण छत्तीसगढ़ राज्य में होगा ।
यह राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगा । (3)

धारा 2 का संशोधन
छत्तीत्तगढ़ कृषि उपज मण्डी अधिनियम, 1972 (क्र. 24 सन् 1973) (जो इसमें इसके पश्चात् मूल अधिनियम के रूप में निर्दिष्ट है) की धारा 2 की उप-धारा (1 ) के खण्ड (चचचच) के पश्चात्, निम्नलिखित खण्ड अन्तःस्थापित किया जाये, अर्थात्:-
"(चचचचच) "ई-नाम (राष्ट्रीय कृषि बाजार)" से अभिप्रेत 'है कृषि एवं किसान कल्याण मंत्रालय, भारत सरकार द्वारा संचालित एक अखिल भारतीय इलेक्ट्रानिक (ऑनलाईन) कृषि व्यापार पोर्टल, जो मौजूदा कृषि उपज मण्डी समितियों को अधिसूचित कृषि उपज के कय एवं विक्रय के लिए एकीकृत करते हुये, राष्ट्रीय बाजार से जोड़ता है । "
धारा 19 का संशोचन.
3. मूल अधिनियम की धारा 19 की उप- धारा (2), (3) एवं (4) में, जहां कहीं नी शब्द "मण्डी फीस" आये हों के पश्चातु, शब्द 'तथा कृषक कल्याण शुल्क" अन्तःस्थापित किया जाए । छत्तीसगढ़ राजपत्र , दिनांक 23 सितम्बर 2024
1124(1) 4 नूल अधिनियम की धारा 19 -ख में, जहां कहीं भी शब्द "मण्डी फीस" आये हों धारा 19-ज का के पश्चात्, शब्द "तथा कृषक कल्याण शुल्क" अन्तःस्थापित किया जाए । संशोधन.
घारा 20 का 5.
संशोधन, मूल अधिनियम की धारा 20 की उप- धारा (3) में, शब्द "मण्डी फीस" के पश्चात्, शब्द तथा कृषक कल्याण शुल्क" अन्तःस्थापित किया जाए ।
धारा 23 का 6.
संशोधन.
मूल अधिनियन की धारा 23 की उप- धारा (3) में, शब्द "नष्डी फीस" के पश्चात्, शब्द "तथा कृषक कल्याण शुल्क" अन्तःस्थापित किया जाए ।

धारा 32 का त्तंशोधन.
(एक) मूल अधिनियम की धारा 32 की उप- धारा (1 ) में, पूर्ण विराम चिन्ह " ।" के स्थान पर, कोलन चिन्ह ":" प्रतिस्थापित किया जाये; और
(दो) मूल अधिनियम की धारा 32 की उप-धारा (1) के पश्चात्, निम्नलिखित परन्तुक जोड़ा जाये, अर्थात्ः-
"परन्तु अन्य प्रदेश के मंडी बोर्ड/मंडी समिति के एकल पंजीयन/अनुज्ञप्तिधारी व्यापारी / प्रसंस्करणकर्ता/विनिर्माताओं को भारत सरकार द्वारा संचालित ई-नाम (राष्ट्रीय कृषि बाजार) पोर्टल के माध्यम से अधिसूचित कृषि उपज का कयण तथा कय अधिसूचित कृषि उपज की कीमत, मंडी शुल्क, कृष्कं कल्याण शुल्क तथा अन्य देय राशियों का भुगतान इस अधिनियम के प्रावधानों के अनुसार करने पर, अनुज्ञप्ति/ पंजीयन की आवश्यकता नहीं होगी और इत्त अधिनियन के शेष प्रावधान यथावत प्रभावी होंगे ।"
8.
धारा 32-क का संशोवन.
(एक) मूल अधिनियम की धारा 32- क की उप- धारा (1 ) नें, पूर्ण विराम चिन्ह " ।" के स्थान पर, कोलन चिन्ह ":" प्रतिस्थापित किया जाये; और
(दो) मूल अधिनियम की धारा 32-क की उप-धारा (1 ) के पश्चात्, निम्नलिखित परन्तुक जोड़ा जाये , अर्थात्ः-
"परन्तु अन्य प्रदेश के मंडी बोर्ड/ मंडी समिति के एकल पंजीयन/अनुज्ञप्तिधारी व्यापारी / प्रत्तंस्करणकर्ता/विनिर्माताओं को भारत तरकार द्वारा संचालित ई-नाम (राष्ट्रीय कृषि बाजार) पोर्टल के माध्यन छत्तीसगढ़ राजपत्र , दिनांक 23 सितम्बर 2024

से अधिसूचित कृषि उपज का कयण तथा कय अधिसूचित कृषि उपज की कीमत, मंडी शुल्क, कृषक कल्याण शुल्क तथा अन्य देय राशियों का भुगतान इस अधिनियम के प्रावधानों के अनुसार करने पर, अनुज्ञप्ति/पंजीयन की आवश्यकता नहीं होगी और इस अधिनियम के शेष प्रावधान यथावत प्रभावी होंगे ।"

धारा 33-ख का संशोधन.
मूल अधिनियम की धारा 33-ख की उप-धारा (1) के. खण्ड (ख) में, शब्द "मंडी शुल्क" के पश्चात्, शब्द "तथा कृषक कल्याण शुल्क" अन्तःस्थापित किया जाए । 10.
धारा 37-क का संशोधन,
मूल अधिनियम की धारा 37- क की उप-धारा (5) में, शब्द "मंडी फीस" के पश्चात्, शब्द "तथा कृषक कल्याण शुल्क" अन्तःस्थापित किया जाए ।
11. मूल अधिनियम की धारा 43 में,-
घारा 43का संशोधन.
(एक) उप-धारा (1) में, शब्द "विपणन विकास निधि" के पश्चात्, पूर्ण विराम चिन्ह " ।" के स्थान पर, कोलन चिन्ह.":" प्रतिस्थापित किया जाये; और (दो) उप-धारा (1 ) के पश्चात्, निम्नलिखित परन्तुक जोड़ा जाए, अर्थात्ः-
"परन्तु प्रत्येक मंडी समिति, बोर्ड को कृषक कल्याण शुल्क का इतना प्रतिशत प्रतिमाह भुगतान करेगी, जैसा कि राज्य सरकार, अधिसूचना द्वारा, समय-समय पर घोषित करें, इस प्रकार भुगतान की गई तथा संग्रह की गई राशि, छत्तीसगढ़ राज्य कृषक कल्याण निधि कहलायेगी ।"
(तीन) उप-धारा (7) में, शब्द "छत्तीसगढ़ राज्य विपणन विकास निधि के पश्चात्, शब्द "छत्तीसगढ़ राज्य कृषक कल्याण निधि" अन्तःस्यापित किया जाए ।
12. मूल अधिनियम की धारा 44 के खण्ड (बारह) के स्थान पर, निम्नलिखित खण्ड धारा 44 का संशोधन
प्रतिस्थापित किया जाए, अर्थात्ः-
"(वारह) बोर्ड, भिन्न-भिन्न कृषक कल्याणोन्मुखी गतिविधियों (कृषक हित) के लिए अपने सकल वार्षिक आय की 10 प्रतिशत राशि, छत्तीसगढ़ राज्य कृषक कल्याण निधि में जमा करेगा । छत्तीसगढ़ राज्य कृषक कल्याण निधि का उपयोग, नियमों में विहित प्रयोजनों के लिए किया जा सकेगा ।" 1124(3)

13.
घारा 69 का संशोधन.

THE CHHATTISGARH KRISHI UPAJ MANDI ( SANSHODHAN)
ADHINIYAM, 2024
1973). AnAct further to amend the Chhattisgarh Krishi Upaj Mandi Adhiniyam , 1972 ( No.24 of Be it enacted by the Chhattisgarh Legislature in the Seventy Fifth Year of the Republic of India , as follows : -
1. (1) This Adhiniyam may be called the Chhattisgarh Krishi Upaj Mandi ( Sanshodhan) Adhiniyam , 2024 .
Short title , extent and commencement .
(2) Itshall extend to the whole State of Chhattisgarh .
(3) It shall come into force from the date of its publication in the Official Gazette .
2.
Amendment of Section 2 .
After clause ( ffff) of sub- section ( 1) of Section 2 of the Chhattisgarh Krishi Upaj Mandi Adhiniyam , 1972 (No. 24 of 1973) , ( hereinafter referred to as the Principal Act) , the following clause shall be inserted , namely: - "( fffff) " e - NAM ( National Agricultural Market ) " means an All- India electronic (online) agricultural trade portal operated by the Ministry of Agriculture and Farmers Welfare , Government of India, which integrates existing Agricultural Produce Market Committees for sale and purchase of notified agricultural produce , connects to the national market . "

Amendment of Section 19 .
In sub - section (2) , ( 3) and (4) of Section 19 of the Principal Act, after the words " market fees " or " market fee " wherever they occur , the words "and farmer welfare fee " shall be inserted .

Amendment of Section 19 - B In Section 19 - B of the Principal Act , after the word " market fee " wherever they occur , the words " and the farmer welfare fee" shall be inserted .

Amendment of Section 20 .
In sub - section ( 3) of Section 20 of the Principal Act , after the words " market fee " , the words " and farmer welfare fee " shall be inserted .
6.
Amendment of Section 23 .
In sub -section (3) of Section 23 of the Principal Act , after the words " market fee " , the words " and farmer welfare fee " shall be inserted .
7.
Amendment of Section 32 .
(i) In sub -section ( 1 ) of Section 32 of the Principal Act, for the punctuation full stop " . " , the punctuation colon " : " shall be substituted ; and
( ii) After sub - section ( 1) of Section 32 of the Principal Act , the following proviso shall be added , namely: - "Provided that, single registration/ licensed trader/ processor / manufacturers of Mandi Board /Mandi Committee of other State , purchase of notified agricultural produce through e - NAM (National Agricultural Market) portal operated by Government of India and License / registration shall not be required on payment of price of notified agricultural produce , market fee , farmer welfare fee and other dues as per this Act and the rest of the provisions of this Act shall be effective . "
8.
Amendment of Section 32 -A .
(i) In sub - section ( 1 ) of Section 32 - A of the Principal Act , for the punctuation full stop " . " , the punctuation colon " : " shall be substituted ; and
(ii) After sub - section ( 1 ) of Section 32 -A of the Principal Act , the following proviso shall be added , namely : - "Provided that , single registration / licensed trader/ processor/manufacturers of Mandi Board/Mandi Committee of other State , purchase of notified agricultural produce through e - NAM छत्तीसगढ़ राजपत्र, दिनांक 23 सितम्बर 2024

(National Agricultural Market) portal operated by Government of India and License / registration shall not be required on payment of price of notified agricultural produce , market fee , farmer welfare fee and other dues as per this Act and the rest of the provisions of this Act shall be effective . "
9.
Amendment of Section 33 -B .
In clause (b) of sub - section ( 1 ) of Section 33 - B of the Principal Act , after the words " market fee " , the words " and farmer welfare fee " shall be inserted .
10.
Amendment of Section 37 -Α .
In sub - section (5) of Section 37- A of the Principal Act , after the words " market fees " , the words " and farmer welfare fee " shall be inserted .

In Section 43 of the Principal Act , -
Amendment of Section 43 .
(1) in sub- section ( 1 ) , after the words " Marketing Development Fund " , for the punctuation full stop ". " , the punctuation colon " : " shall be substituted, and
(ii) after sub- section ( 1 ) , the following proviso shall be added, namely : -
"Provided that , every Market Committee shall pay to the Board such percentage of Farmers Welfare Fee as the State Government may , by notification , declare from time to time , every month , the amount so paid and collected shall be called Chhattisgarh State Farmer Welfare Fund. "
(iii) In sub - section (7) , after the words " Chhattisgarh State Marketing Development Fund" , the words "Chhattisgarh State Farmers Welfare Fund " shall be inserted .
12.
Amendment of Section44.
For clause (xii ) of Section 44 of the Principal Act, the following clause shall be substituted , namely : - " (xii ) The Board will deposit 10 percent amount of its छत्तीसगढ़ राजपत्र, दिनांक 23 सितम्बर 2024
1124 (7) gross annual income in the Chhattisgarh , State Farmer Welfare Fund for various farmer welfare oriented activities (farmers interest) . The Chhattisgarh State Farmer Welfare Fund can be used for the purposes prescribed in the rules . "
13.
Amendment of Section 69 .
In Section 69 of the Principal Act , after the words " market fee " or " market fees " wherever they occur , the words " and farmer welfare fee " shall be inserted.
