अधिसूचना
क्रमांक एफ 3-53/2020/वा.क.(पं.)/पांच(92).— रजिस्ट्रीकरण अधिनियम, 1908 (1908 का सं. 16) की धारा 78 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, इस विभाग की अधिसूचना क्रमांक एफ 3-53/2020/वा.क.(पं.)/पांच/(19), दिनांक 4 फरवरी, 2022 में निम्नलिखित अग्रतर संशोधन करती है तथा उक्त अधिनियम की धारा 79 द्वारा अपेक्षित अनुसार प्रकाशित करती है, अर्थात्ः-
संशोधन
उउक्क्तत अअध्धििाससूूचचननाा ममेेंं,,--
1. अनुच्छेद-एक के सरल क्रमांक (क) एवं उनसे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित सरल क्रमांक प्रतिस्थापित किया जाए, अर्थात् :-
"(क) "छत्तीसगढ़ बाजार मूल्य मार्गदर्शक सिद्धांतों का बनाया जाना और उनका पुनरीक्षण नियम, 2000" में यथा परिभाषित बाजार मूल्य मार्गदर्शक सिद्धांत के अनुसार अचल संपत्ति के बाजार मूल्य का 4 %" अचल संपत्ति के (1) विक्रय, या (2) विनिमय, या (3) दान, जो परिवार के सदस्यों से भिन्न व्यक्ति के पक्ष में हो, की दशा में 2. अनुच्छेद-एक की टिप्पणी 1 एवं 2 तथा उनसे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित टिप्पणी प्रतिस्थापित की जाए, अर्थात् :-
"1. विभाजन विलेख की दशा में 2. हकत्याग विलेख की दशा में - (क) जो परिवार के सदस्यों से अतिरिक्त किसी अन्य के पक्ष में हो, 500.00 रू. संपत्ति के जिस भाग का त्याग किया जा रहा है, उसके बाजार मूल्य का 4 % 500.00 रू." (ख) परिवार के सदस्य के पक्ष में हो, स्पष्टीकरण :- इस प्रयोजन हेतु परिवार में रिश्तेदार से अभिप्रेत है पिता, माता, पति या पत्नी, पुत्र, पुत्री, पुत्रवधु, भाई, बहन तथा पौत्र-पौत्री (जिसमें पुत्र के पुत्र एवं पुत्री तथा पुत्री के पुत्र एवं पुत्री सम्मिलित हैं।) 3. अनुच्छेद-एक की टिप्पणी 3 एवं उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित टिप्पणी जोड़ी जाए, अर्थात्ः- 500.00 रू.
"4. परिवार के सदस्यों के पक्ष में दान, जो कि बिना किसी प्रतिफल के हो, स्पष्टीकरण ः- इस प्रयोजन हेतु, दानदाता के संबंध में परिवार से अभिप्रेत है दानदाता का पिता, माता, पति या पत्नी, पुत्र, पुत्री, पुत्रवधु, भाई, बहन और पौत्र-पौत्री (जिसमें पुत्र के पुत्र एवं पुत्री तथा पुत्री के पुत्र एवं पुत्री सम्मिलित हैं।) 5. 'विक्रय प्रमाण पत्र' की दशा में नीलामी राशि का 4 %" 4. अनुच्छेद-सात के स्थान पर, निम्नलिखित अनुच्छेद प्रतिस्थापित किया जाए, अर्थात् :-
"अनुच्छेद-सात फीस (रुपये में) साधारण शुल्क के अतिरिक्त, रुपये 25,000.00 (क) रजिस्ट्रार द्वारा किसी भी दस्तावेज के रजिस्ट्रीकरण के लिये अतिरिक्त शुल्क टीप ः- इस अनुच्छेद के अधीन अतिरिक्त फीस, वसीयतों तथा दत्तक ग्रहण के अधिकार पत्रों के रजिस्ट्रीकरण पर देय नहीं होगी, वह ऐसे मामलों में भी उद्ग्रहणीय नहीं होगी, जिनमें सब-रजिस्ट्रार किसी निष्पादन में हितबद्ध होने के कारण या किसी अन्य दूसरे पर्याप्त कारण से स्वयं रजिस्ट्रीकरण करने के लिये असमर्थ हों।" 5. अनुच्छेद-चौदह के फीस कॉलम के सरल क्रमांक (2) एवं (3) के स्थान पर, अंक तथा चिन्ह "रुपये 1000.00" के स्थान पर, अंक तथा चिन्ह "रुपये 25,000.00" क्रमशः प्रतिस्थापित किया जाए।
6. अनुच्छेद-बाईस के सरल क्रमांक 4 एवं उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित सरल क्रमांक जोड़ा जाए, अर्थात् :-
"5. पक्षकार द्वारा विशेष टाईम स्लॉट के माध्यम से पंजीयन करवाये
रूपये 15,000.00" जाने हेतु अतिरिक्त फीस 2. यह अधिसूचना छत्तीसगढ़ राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगी।

NOTIFICATION
No. F 3-53/2020/CT(R.)/V(92).— In exercise of the powers conferred by Section 78 of the Registration Act, 1908 (No. 16 of 1908), the State Government, hereby, makes the following further amendment in the Department's Notification No. F 3-53/2020/CT(R)/V/ (19), dated 4th February, 2022 and published as required by Section 79 of the said Act, namely:-
AMENDMENT
IInn tthhee ssaaiidd nnoottiiffiiccaattiioonn,,--
1. For serial number (a) of Article-I and entries relating thereto, the following serial number shall be substituted, namely:-
"(a) In case of immovable property – (1) Sale, or (2) Exchange, or (3) Gift, in favour of persons other than family member.
4% of the market value of the immovable property as per the market value guidelines as defined in the Chhattisgarh Preparation and Revision of Market Value Guideline Rules, 2000." 2. For Note 1 and 2 of Article-I and entries relating thereto, the following Note shall be substituted, namely:-
"1.In case of partition deed Rs. 500.00 2. In case of relinquishment deed – (a) in favour of someone other than the members of the family, (b) In favour of the family member
4% of the market value of the part of the property being relinquished. Rs. 500.00" Explanation:- For this purpose, family in relation means the father, mother, husband or wife, son, daughter, daughter-in-law, brother, sister and grand-children (includes son's son and daughter and daughter's son and daughter)." 3. After Note 3 of Article-I and entries relating thereto, the following Note shall be added, namely:-
| "4. Gift in favour of family members without consideration, Explanation :- For this purpose, family in relation to the donor shall mean the donor's father, mother, husband or wife, son, daughter, daughter-in-law, brother, sister and grandchildren, (includes son's son and daughter and daughter's son and daughter). |
4. For Article-VII, the following Article shall be substituted, namely:-
"ARTICLE-VII Fee (In Rupees) (a) Additional fee for registration of any document by the Registrar Rs. 25,000.00 in addition to the Ordinary Fee Note: The Additional fee under the Article is not payable on the registration of wills and authorities to adopt, nor will it be levied in cases where the Sub-Registrar owing to his being interested in the execution or for any other sufficient reason is unable to register himself." 5. For Serial Number 2 and 3 of Article-XIV of the Fee column, for the figure and symbol "Rs. 1000.00", the figure and symbol "Rs. 25,000.00" shall be substituted, respectively.
6. After Serial Number 4 of Article-XXII and entries relating thereto, the following Serial No. shall be added, namely:-
"5. Additional fee for registration through special time Rs. 15,000.00" slot by the party 2. This notification shall come into force from the date of its publication in the Chhattisgarh Gazette.
