क्रमांक/1360/2024/22-1/5572.— छत्तीसगढ़ पंचायत निर्वाचन नियम, 1995 में अग्रतर संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार, राज्य निर्वाचन आयोग के परामर्श से, छत्तीसगढ़ पंचायत राज अधिनियम, 1993 (क्र. 1 सन् 1994) की धारा 95 की उप-धारा (1) सहपठित धारा 43 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 95 की उप-धारा (3) के द्वारा अपेक्षित किये गये अनुसार, उन समस्त व्यक्तियों, जिनके कि इससे प्रभावित होने की संभावना है, की जानकारी के लिए एतद्द्वारा प्रकाशित किया जाता है, तथा एतद्द्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस सूचना के राजपत्र में प्रकाशन की तारीख से सात दिवस के अवसान के पश्चात् विचार किया जाएगा।
कोई आपत्ति या सुझाव, जो उक्त प्रारूप के संबंध में किसी व्यक्ति से, विनिर्दिष्ट कालावधि के पूर्व, संयुक्त सचिव, छत्तीसगढ़ शासन, पंचायत एवं ग्रामीण विकास विभाग, कक्ष क्रमांक ै.3.31ए मंत्रालय, महानदी भवन, नवा रायपुर अटल नगर, जिला रायपुर के कार्यालय में, कार्यालयीन समय के दौरान प्राप्त हो, पर छत्तीसगढ़ शासन द्वारा विचार किया जाएगा।
संशोधन प्रारूप
उक्त नियम में,-
1. नियम 4 के उप-नियम (1) के परन्तुक के स्थान पर, निम्नलिखित परन्तुक प्रतिस्थापित किया जाए, अर्थात् :-
''परन्तु अनुसूचित क्षेत्रों में, अनुसूचित जातियों और अनुसूचित जनजातियों के लिए स्थानों का आरक्षण, अधिनियम की धारा 129-ङ के उपबंधों के अनुसार होगा।''
2.़ नियम 4 के उप-नियम (4) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाए, अर्थात् :-
''(4) किसी ग्राम पंचायत में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत से कम स्थान आरक्षित किये गए हैं, वहाँ यथासंभव निकटतम रूप से कुल स्थानों के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए, किन्तु शेष स्थान, अन्य पिछड़ा वर्ग के लिए, उनकी जनसंख्या के अनुपात में आरक्षित किये जाएंगे और ऐसे स्थान अनुसूचित जातियों और अनुसूचित जनजातियों के लिये आरक्षित वार्डो को छोडकर अन्य वार्डो में कलेक्टर द्वारा चक्रानुक्रम से तथा लॉट निकालकर आवंटित किये जाएंगेः परन्तु किसी ग्राम पंचायत में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत या पचास प्रतिशत से अधिक स्थान आरक्षित किये गये हैं, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा।''
स्पष्टीकरण :- अन्य पिछड़ा वर्ग की जनसंख्या से अभिप्रेत हैं, छत्तीसगढ़ पिछड़ा वर्ग कल्याण आयोग द्वारा अन्य पिछड़ा वर्ग की जनसंख्या के संबंध में, मान्य किये गये सांख्यिकीय आंकड़े।''
3. नियम 6 के उप-नियम (1) के परन्तुक के स्थान पर, निम्नलिखित परन्तुक प्रतिस्थापित किया जाए, अर्थात् :-
''परन्तु अनुसूचित क्षेत्रों में, अनुसूचित जातियों और अनुसूचित जनजातियों के लिए स्थानों का आरक्षण, अधिनियम की धारा 129-ङ के उपबंधों के अनुसार होगा।''
4. नियम 6 के उप-नियम (4) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाए, अर्थात् :-
''(4) किसी जनपद पंचायत में और किसी जिला पंचायत में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत से कम स्थान आरक्षित किये गये हैं वहाँ यथासंभव निकटतम रूप से कुल स्थानों के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए, किन्तु शेष स्थान, अन्य पिछड़ा वर्ग, के लिये उनकी जनसंख्या के अनुपात में आरक्षित किये जाएंगे और ऐसे स्थान अनुसूचित जातियों और अनुसूचित जनजातियों के लिये आरक्षित निर्वाचन क्षेत्रों को छोड़कर, निर्वाचन क्षेत्रों में विहित प्राधिकारी द्वारा चक्रानुक्रम से तथा लॉट निकालकर आबंटित किये जाएंगेः
परन्तु किसी जनपद पंचायत में और किसी जिला पंचायत में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत या पचास प्रतिशत से अधिक स्थान आरक्षित किये गये हैं, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा।
स्पष्टीकरण :- अन्य पिछड़ा वर्ग की जनसंख्या से अभिप्रेत हैं, छत्तीसगढ़ पिछड़ा वर्ग कल्याण आयोग द्वारा अन्य पिछड़ा वर्ग की जनसंख्या के संबंध में, मान्य किये गये सांख्यिकीय आंकड़े।''

NOTICE
No./1360/2024/22-1/5572.— The following further draft amendment in the Chhattisgarh Panchayat Nirvachan Niyam, 1995, which the State Government proposes to make, in exercise of the powers conferred by sub-section (1) of Section 95 read with Section 43 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994), in consultation with the State Election Commission, is hereby, published as required by sub-section (3) of Section 95 of the said Adhiniyam, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of Seven days from the date of publication of this notice in the Official Gazette.
Any objection or suggestion regarding the said draft received from any person, before the specified period, during office hours by the office of the Joint Secretary, Government of Chhattisgarh, Department of Panchayat and Rural Development, Room No. S-3-31, Mantralaya, Mahanadi Bhavan, Nava Raipur Atal Nagar, District Raipur shall be considered by the Government of Chhattisgarh.
DRAFT AMENDMENT
In the said rule, –
1. For proviso of sub-rule (1) of rule 4, the following proviso shall be substituted, namely:-
"Provided that in Scheduled areas, the seats for Scheduled Castes and Scheduled Tribes shall be reserved in accordance with the provisions of Section 129-E of the Act."
2. For sub-rule (4) of rule 4, the following sub-rule shall be substituted, namely:-
"(4) In any Gram Panchayat where less than Fifty percent seats have been reserved for Scheduled Castes and/or Scheduled Tribes, then for Other Backward Classes remained seats as nearly as possible shall be reserved proportionate to their population but subject to the maximum limit of Fifty percent of the total seats and such seats shall be allotted by the Collector in the wards excluding the wards reserved for the Scheduled Castes and Scheduled Tribes by rotation and drawal of lots:
Provided that in any Gram Panchayat where fifty percent or more than fifty percent of the seats have been reserved for the Scheduled Castes and/or the Scheduled Tribes, no seat shall be reserved for the Other Backward Classes.
Explanation:- Other Backward Classes population means the statistical data recognized by the Chhattisgarh Backward Class Welfare Commission, regarding the population of Other Backward Classes."
3. For proviso of sub-rule (1) of rule 6, the following proviso shall be substituted, namely:--
"Provided that in Scheduled areas, the seats for Scheduled Castes and Scheduled Tribes shall be reserved in accordance with the provisions of Section 129-E of the Act."
4. For sub-rule (4) of rule 6, the following sub-rule shall be substituted, namely :-
"(4) In any Janpad Panchayat and in any Zila Panchayat where less than Fifty percent seats have been reserved for Scheduled Castes and/or Scheduled Tribes, then for Other Backward Classes remained seats as nearly as possible shall be reserved proportionate to their population but subject to the maximum limit of Fifty percent of the total seats and such seats shall be allotted by the prescribed authority in the constituencies excluding the constituencies reserved for the Scheduled Castes and Scheduled Tribes by rotation and drawal of lots:
Provided that in any Janpad Panchayat and in any Zila Panchayat where fifty percent or more than fifty percent of the seats have been reserved for the Scheduled Castes and/or the Scheduled Tribes, no seat shall be reserved for the Other Backward Classes.
Explanation:- Other Backward Classes population means the statistical data accepted by the Chhattisgarh Backward Class Welfare Commission, regarding the population of Other Backward Classes."
