अधिसूचना
क्रमांक एफ 1-134/2024/18. - छत्तीसगढ़ नगरपालिक निगम अधिनियम, 1956 (क्र. 23 सन् 1956) की धारा 433 सहपठित धारा 11 तथा छत्तीसगढ़ नगरपालिका अधिनियम, 1961 (क्र. 37 सन् 1961) की धारा 355 सहपठित धारा 29-क द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ नगरपलिका (अनुसूचित जाति, अनुसूचित जनजाति, पिछड़ा वर्ग एवं महिलाओं के लिए वार्डो का आरक्षण) नियम, 1994 में निम्नलिखित अग्रतर संशोधन करती है, अर्थात्ः-
संशोधन
उक्त नियम में,-
1. नियम 2 के उप-नियम (3) के पश्चात्, निम्नलिखित उप-नियम अंतःस्थापित किया जाए, अर्थात्ः-
''(3-क) ''जनसंख्या'' से अभिप्रेत है ऐसी पूर्ववर्ती जनगणना, जिसके सुसंगत आंकड़े प्रकाशित किए जा चुके हैं, में अभिनिश्चित की गई जनसंख्याः
परंतु ''अन्य पिछड़ा वर्ग'' की जनसंख्या से अभिप्रेत है ऐसी जनसंख्या, जिसे अन्य पिछड़ा वर्ग कल्याण आयोग द्वारा विहित रीति से अभिनिश्चित किया गया हो।''
2. नियम 3 के उप-नियम (2) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाए, अर्थात्ः- ''(2) नगरपालिका की दशा में, जहाँ अनुसूचित जातियों तथा/अथवा अनुसूचित जनजातियों के लिए उप-नियम (1) के अधीन पचास प्रतिशत से कम स्थान आरक्षित किए गए हों, वहाँ यथासंभव निकटतम रूप से कुल स्थानों की संख्या के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए, शेष स्थान, अन्य पिछड़ा वर्ग हेतु उनकी जनसंख्या के अनुपात में आरक्षित किए जाएंगे तथा ऐसे स्थान लॉट द्वारा आवंटित किए जाएंगेः 3. नियम 3 के उप-नियम (4) के पश्चात्, निम्नलिखित परंतुक अंतःस्थापित किया जाये, अर्थात्ः- ''परंतु, उप-नियम (2) के अधीन आरक्षण की गणना करते समय, कुल आरक्षण, कुल स्थान के पचास प्रतिशत से अधिक नहीं होगा।''

क्रमांक एफ 1-134/2024/18. - भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में विभाग की अधिसूचना क्रमांक एफ 1-134/2024/18 दिनांक 10-12-2024 का अंंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. F 1-134/2024/18. - In exercise of the powers conferred by Section 433 read with Section 11 of the Chhattisgarh Municipal Corporation Act, 1956 (No. 23 of 1956) and of Section 355 read with Section 29-A of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961), the State Government, hereby, makes the following further amendment in the Chhattisgarh Municipalities (Reservation of Wards for Scheduled Castes, Scheduled Tribes, Other Backward Classes and Women) Rules, 1994, namely:-
AMENDMENT
In the said rule,-
1. After sub-rule (3) of rule 2, the following sub-rule shall be inserted, namely:-
"(3-a) "Population" means the population as ascertained in the preceding census of which the relevant figures have been published:
Provided that the population of ''Other Backward Classes" means such population which has been determined by the Other Backward Classes Welfare Commission in the prescribed manner."
2. For sub-rule (2) of rule 3, the following sub-rule shall be substituted, namely:-
"(2) In case of municipality where less than fifty percent seats are reserved for Scheduled Castes and/or Scheduled Tribes, under sub-rule (1), then as nearly as possible remained seats shall be reserved for Other Backward Classes proportionate to their population but subject to the maximum limit of fifty percent of total seats and such seats shall be allotted by lots:
Provided that, if under sub-rule (1), the total reservation for Scheduled Castes and/or Scheduled Tribes is fifty percent or more, no post shall be reserved for Other Backward Classes." 3. After sub-rule (4) of rule 3, the following proviso shall be inserted, namely:-
"Provided that, during calculation of reservation under sub-rule (2), the total reservation shall not be more than fifty percent of total seats."
