छत्तीसगढ़ पंचायत राज (संशोधन) द्वितीय अध्यादेश , 2025.
छत्तीसगढ़ पंचायत राज अधिनियम, 1993 (क्रमांक 1 सन् 1994 ) के अग्रतर संशोधन हेतु अध्यादेश ।
गया, भारत गणराज्य के छिहत्तरवें वर्ष में छत्तीसगढ़ के राज्यपाल द्वारा प्रख्यापित किया यतः, राज्य विधान मंडल सत्र में नहीं है और छत्तीसगढ़ के राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियाँ विद्यमान हैं, जिनके कारण यह आवश्यक हो गया है कि वे तत्काल कार्रवाई करें ।
अतएव, भारत के संविधान के अनुच्छेद 213 के खण्ड (1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, छत्तीसगढ़ के राज्यपाल, निम्नलिखित अध्यादेश प्रख्यापित करते हैं:-
1 . (1 ) यह अध्यादेश छत्तीसगढ़ पंचायत राज (संशोधन) द्वितीय अध्यादेश, 2025 कहलाएगा.
संक्षिप्त नाम, विस्तार तथा प्रारंभ,
(2) इसका विस्तार सम्पूर्ण छत्तीसगढ़ राज्य में होगा.
(3) यह राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगा.
इस अध्यादेश के प्रवर्तित रहने की कालावधि के दौरान, छत्तीसगढ़ पंचायत राज अधिनियम, 1993 (क्र. 1 सन् 1994) (जो इसमें इसके पश्चात् मूल अधिनियम के रूप में निर्दिष्ट है) , इस अध्यादेश की धारा 3 से 10 में विनिर्दिष्ट संशोधनों के अध्यधीन रहते हुए प्रभावी होगा.
छत्तीसगढ़ पंचायत 2. राज अधिनियम, 1993 (क्रमांक 1 सन् 1994) का अस्थायी रूप से संशोधित किया जाना.

धारा 2 का संशोधन.
मूल अधिनियम की धारा 2 के खण्ड (उन्नीस) में, निम्नलिखित परन्तुक जोड़ा जाए, अर्थात्ः-
"परन्तु, अन्य पिछड़ा वर्ग की जनसंख्या से अभिप्रेत है , ऐसी जनसंख्या के आंकड़े , जिसका निर्धारण विहित रीति से किया गया हो; " छत्तीसगढ़ राजपत्र , दिनांक 23 जनवरी 2025

मूल अधिनियम की धारा 13 की उप- धारा (4) के खण्ड (दो) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात्ः-
धारा 13 का संशोधन.
"(दो) किसी ग्राम पंचायत में, जहाँ अनुसूचित जातियों और/ अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत से कम स्थान आरक्षित किये गए हैं, वहाँ यथासंभव निकटतम रूप से कुल स्थानों की संख्या के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए, शेष स्थान, अन्य पिछड़ा वर्ग के लिए, उनकी जनसंख्या के अनुपात में आरक्षित किये जाएंगे और ऐसे स्थान उस ग्राम पंचायत के भिन्न वार्डों को विहित रीति में, चक्रानुक्रम में कलेक्टर द्वारा आवंटित किये जाएंगेः
परन्तु, किसी ग्राम पंचायत में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत या पचास प्रतिशत से अधिक स्थान आरक्षित किये गये हैं, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा । "
5.
मूल अधिनियम की धारा 17 की उप- धारा (2) के खण्ड (दो) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात्ः-
धारा 17 का संशोधन.
"(दो) खण्ड में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों की जनसंख्या पचास प्रतिशत से कम है , वहाँ यथासंभव निकटतम रूप से खण्ड के भीतर ग्राम पंचायतों में सरपंचों के कुल पदों के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए , अनुसूचित जातियों और/ अथवा अनुसूचित जनजातियों के आरक्षण पश्चात् शेष स्थान अन्य पिछड़ा वर्ग, के लिए उनकी जनसंख्या के अनुपात में आरक्षित किए जाएंगेः
परन्तु, खण्ड में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों की जनसंख्या पचास प्रतिशत या पचास प्रतिशत से अधिक हो, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा । "
6.
मूल अधिनियम की धारा 23 की उप-धारा (3 ) के खण्ड (दो) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात्ः-
धारा 23 का संशोधन.
"(दो) किसी जनपद पंचायत में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत 138( 2)

से कम स्थान आरक्षित किये गये हैं वहाँ यथासंभव निकटतम रूप से कुल स्थानों की संख्या के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए. शेष स्थान अन्य पिछड़ा वर्ग , के लिये उनकी जनसंख्या के अनुपात में आरक्षित किये जाएंगे और ऐसे स्थान भिन्न-भिन्न निर्वाचन क्षेत्रों को विहित रीति में, चक्रानुक्रम में कलेक्टर द्वारा आवंटित किये जाएंगेः
परन्तु, किसी जनपद पंचायत में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत या पचास प्रतिशत से अधिक स्थान आरक्षित किये गये हैं, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा । "
7. मूल अधिनियम की धारा 25 की उप- धारा (2) के खण्ड (दो) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात्ः- धारा 25 का संशोधन.
"(दो) जिले में, जहाँ अनुसूचित जातियों और/ अथवा अनुसूचित जनजातियों की जनसंख्या पचास प्रतिशत से कम है, वहाँ यथासंभव निकटतम रूप से जिले के भीतर जनपद पंचायतों के अध्यक्षों के कुल पदों में से पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए, अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों के आरक्षण पश्चात् शेष पद अन्य पिछड़ा वर्ग, के लिए उनकी जनसंख्या के अनुपात में आरक्षित किए जाएंगेः
परन्तु, जिले में, जहाँ अनुसूचित जातियों और/अथवा अनुसूचित जनजातियों की जनसंख्या पचास प्रतिशत या पचास प्रतिशत से अधिक हो, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा । "
8.
धारा 30 का संशोधन,
मूल अधिनियम की धारा 30 की उप-धारा (3) के खण्ड (दो) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात्ः- " (दो) किसी जिला पंचायत में, जहाँ अनुसूचित जातियों और/ अथवा अनुसूचित जनजातियों, के लिए पचास प्रतिशत से कम स्थान आरक्षित किए गए हैं , वहाँ यथासंभव निकटतम रूप से कुल स्थानों की संख्या के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए, शेष छत्तीसगढ़ राजपत्र , दिनांक 23 जनवरी 2025
138(3) स्थान अन्य पिछड़ा वर्ग , के लिये उनकी जनसंख्या के अनुपात में आरक्षित किए जाएंगे और ऐसे स्थान भिन्न-भिन्न निर्वाचन क्षेत्रों को विहित रीति में. चक्रानुक्रम से कलेक्टर द्वारा आवंटित किए जाएंगेः
परन्तु, किसी जिला पंचायत में, जहाँ अनुसूचित जातियों और / अथवा अनुसूचित जनजातियों के लिये पचास प्रतिशत या पचास प्रतिशत से अधिक स्थान आरक्षित किये गये हैं, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा । "
9.
धारा 32 का संशोधन.
मूल अधिनियम की धारा 32 की उप- धारा (2) के खण्ड (दो) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात्ः-
" (दो) यदि राज्य में अनुसूचित जातियों और / अथवा अनुसूचित जनजातियों, के लिए पचास प्रतिशत से कम स्थान आरक्षित किए गए हों, तो यथासंभव निकटतम रूप से राज्य के भीतर जिला पंचायतों के अध्यक्षों के कुल स्थानों की संख्या के पचास प्रतिशत की अधिकतम सीमा के अध्यधीन रहते हुए, शेष स्थान अन्य पिछड़ा वर्ग के लिये उनकी जनसंख्या के अनुपात में आरक्षित किए जाएंगेः
परन्तु, यदि राज्य में, अनुसूचित जातियों और/ अथवा अनुसूचित जनजातियों के लिए पचास प्रतिशत या पचास प्रतिशत से अधिक स्थान आरक्षित हों, वहाँ अन्य पिछड़ा वर्ग के लिए कोई स्थान आरक्षित नहीं होगा । "
10.
मूल अधिनियम की धारा 129 -ङ की उप- धारा (3) का लोप किया जाये ।

CHHATTISGARH ORDINANCE
(No. 1 of 2025)
THE CHHATTISGARH PANCHAYAT RAJ ( SANSHODHAN ) SECOND ADHYADESH , 2025 .
An Ordinance to further amend the Chhattisgarh Panchayat Raj Adhiniyam , 1993 (No. 1 of 1994 ) .
Promulgated by the Governor of Chhattisgarh in the Seventy- sixth year of the Republic of India.
Whereas , the State Legislature is not in session and the Governor of Chhattisgarh is satisfied that the circumstances exist, which render it necessary for him to take immediate action .
Now, therefore , in exercise of the powers conferred by clause ( 1 ) of Article 213 of the Constitution of India , the Governor of Chhattisgarh is pleased to promulgate the following Ordinance: -
( 1 ) This Ordinance may be called the Chhattisgarh Panchayat Raj (Sanshodhan ) Second Adhyadesh , 2025 .
Short title , extent 1 . and commencement .
(2) It shall extend to the whole State of Chhattisgarh .
(3) It shall come into force from the date of its publication in the Official Gazette .
The Chhattisgarh 2. Panchayat Raj Adhiniyam , 1993 (No. 1 of 1994 ) to be temporarily amended .
During the period of operation of this Ordinance , the Chhattisgarh Panchayat Raj Adhiniyam , 1993 (No. 1 of 1994 ) ( hereinafter referred to as the Principal Act ) , shall have the effect , subject to the amendment specified in Section 3 to 10 of this Ordinance .
Amendment of 3. Section 2 .
After clause (xix ) of Section 2 of the Principal Act) , the following proviso shall be added, namely: -

138 ( 5) Backward Class means , such figures of population , which have been determined in the prescribed manner; "

Amendment of Section 13 .
For clause ( ii ) of sub - section (4) of Section 13 of the Principal Act , the following clause shall be substituted , namely : -
"( ii ) In any Gram Panchayat where less than Fifty percent seats have been reserved for Scheduled Castes and/ or Scheduled Tribes , then remained seats as nearly as possible shall be reserved for Other Backward Classes proportionate to their population but Subject to the Maximum limit of Fifty percent of the total seats and such seats shall be allotted by rotation to different wards in that Gram Panchayat by the Collector , in the prescribed manner :
Provided that in any Gram Panchayat where fifty percent or more than fifty percent of the seats have been reserved for the Scheduled Castes and/ or the Scheduled Tribes , no seat shall be reserved for the Other Backward Classes . "
5.
Amendment of Section 17 .
For clause ( ii ) of sub - section ( 2 ) of Section 17 of the Principal Act , the following clause shall be substituted , namely: -
" ( ii ) Where the population of Scheduled Castes and/ or Scheduled Tribes in the Block is less 138( 6)

than Fifty percent, then after providing reservation to Scheduled Castes and/or the Scheduled Tribes , remained seats as nearly as possible of Sarpanchas of Gram Panchayats within the Block shall be reserved for Other Backward Classes proportionate to their population but Subject to the Maximum limit of Fifty percent of the total seats:
Provided that in the block where the population of the Scheduled Castes and/ or the Scheduled Tribes is fifty per cent or more than fifty per cent , no seats shall be reserved for the Other Backward Classes .
Amendment of 6 . Section 23 .
For clause ( ii ) of sub - section ( 3) of Section 23 of the Principal Act , the following clause shall be substituted , namely : -
"( ii) In the Janpad Panchayat where less than Fifty percent seats have been reserved for Scheduled Castes and/ Scheduled Tribes , then remained seats as nearly as possible shall be reserved for Other Backward Classes proportionate to their population but Subject to the Maximum limit of Fifty percent of the total seats and such seats shall be allotted by rotation to different constituencies by the Collector , in the prescribed manner:

Provided that in any Janpad Panchayat where fifty percent or more than fifty percent of the seats have been reserved for the Scheduled Castes and/ or the Scheduled Tribes , no seat shall be reserved for the Other Backward Classes . "
7.
Amendment of Section 25 .
For clause ( ii ) of sub - section (2 ) of Section 25 of the Principal Act , the following clause shall be substituted , namely : -
" ( ii ) Where the population of Scheduled Castes and/ or Scheduled Tribes in the District is less than Fifty percent , then after providing reservation to Scheduled Castes and/ or Scheduled Tribes , remained seats as nearly as possible of President of Janpad Panchayats within the district shall be reserved for Other Backward Classes proportionate to their population but Subject to the Maximum limit ofFifty percent of the total seats:
Provided that in a district where the population of the Scheduled Castes and /or the Scheduled Tribes is fifty percent or more than fifty percent , no seat shall be reserved for the Other Backward Classes . "
Amendment of Section 30 .
8. For clause (ii ) of sub - section (3 ) of Section 30 of the Principal Act , the following clause shall be substituted , namely : -
"(ii ) In any Zila Panchayat where less than Fifty percent seats have been reserved for छत्तीसगढ़ राजपत्र , दिनांक 23 जनवरी 2025

Scheduled Castes and/ or Scheduled Tribes , then remained seats as nearly as possible shall be reserved for Other Backward Classes proportionate to their population but Subject to the Maximum limit of Fifty percent of the total seats and such seats shall be allotted by rotation to different constituencies by the Collector, in the prescribed manner :
Provided that in any Zila Panchayat where fifty percent or more than fifty percent of the seats have been reserved for the Scheduled Castes and/ or the Scheduled Tribes , no seat shall be reserved for the Other Backward Classes . "
Amendment of Section 32 . 9 .
For clause ( ii ) of sub - section (2) of Section 32 of the Principal Act , the following clause shall be substituted , namely: -
"( ii ) If less than Fifty percent seats in the State have been reserved for Scheduled Castes and / or Scheduled Tribes , then remained seats of President of Zila Panchayats within the State , as nearly as possible shall be reserved for Other Backward Classes , proportionate to their population but Subject to the Maximum limit of Fifty percent of the total seats :
Provided that in the State, if fifty percent or more than fifty percent of the seats have been reserved for the Scheduled Castes

Amendment of Section 129 - Ε .
