क्रमांक एफ 1-137/2024/18. - छत्तीसगढ़ नगरपालिका अधिनियम, 1961 (क्र. 37 सन् 1961) की धारा 355 सहपठित धारा 43 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ नगरपालिका (अध्यक्ष तथा उपाध्यक्ष का निर्वाचन) नियम, 1998 में निम्नलिखित अग्रतर संशोधन करती है, अर्थातः-
संशोधन
उक्त नियमों में,-
1. नियम 1 के उप-नियम (1) में, शब्द ''उपाध्यक्ष'' के पूर्व, शब्द ''अध्यक्ष तथा'' का लोप किया जाये। 2. नियम 2 में,-
(एक) खण्ड (ख) में, शब्द ''निर्वाचित'' के पूर्व, शब्द ''अध्यक्ष तथा'' अंतःस्थापित किया जाये।
(दो) खण्ड (ङ) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाये, अर्थात्ः-
''(ङ) 'पीठासीन अधिकारी' से अभिप्रेत है अधिनियम की धारा 55 की उप-धारा (2) के अधीन कलेक्टर द्वारा प्राधिकृत कोई अधिकारी;''
3. नियम 3 के उप-नियम (1) में, शब्द ''उपाध्यक्ष'' के पूर्व, शब्द ''अध्यक्ष तथा'' का लोप किया जाये।
4. नियम 4 में,-
(एक) उप-नियम (1) में, शब्द ''उपाध्यक्ष'' के पूर्व, शब्द ''अध्यक्ष तथा'' का लोप किया जाये।
(दो) उप-नियम (3) का लोप किया जाये।
5. नियम 6 में,-
(एक) उप-नियम (2) के खण्ड (क) में, शब्द ''यथास्थिति, अध्यक्ष या उपाध्यक्ष'' के स्थान पर, शब्द ''उपाध्यक्ष'' प्रतिस्थापित किया जाये।
(दो) उप-नियम (5) का लोप किया जाये। 6. नियम 8 में, शब्द ''पीठासीन प्राधिकारी'' के पश्चात्, शब्द ''क्रमशः अध्यक्ष तथा उपाध्यक्ष के पद हेतु'' का लोप किया जाये।
7. नियम 9 में,-
(एक) उप-नियम (1) में, शब्द ''उपाध्यक्ष'' के पूर्व, शब्द ''अध्यक्ष तथा'' का लोप किया जाये।
(दो) उप-नियम (3) का लोप किया जाये।
8. नियम 10 में,-
(एक) उप-नियम (1) में, वाक्यांश ''अध्यक्ष तथा उपाध्यक्ष के निर्वाचन हेतु अलग-अलग मतपेटी का उपयोग किया जायेगा तथा मतपेटी पर प्रमुख रूप से, यथास्थिति, शब्द ''अध्यक्ष'' या ''उपाध्यक्ष'' अंकित किया जायेगा'' का लोप किया जाये।
(दो) उप-नियम (5) का लोप किया जाये।
9. नियम 11 में, शब्द ''पीठासीन प्राधिकारी'' के पश्चात्, शब्द ''क्रमशः पहले अध्यक्ष से संबंधित और तत्पश्चात् उपाध्यक्ष से संबंधित'' का लोप किया जाये।
10. नियम 13 में, शब्द ''मत गणना पूरी हो जाने पर'' के पश्चात्, शब्द ''क्रमशः अध्यक्ष तथा उपाध्यक्ष के पद हेतु'' का लोप किया जाये।
11. नियम 16 में, शब्द ''उपाध्यक्ष'' के पूर्व, शब्द ''अध्यक्ष या'' का लोप किया जाये।
12. प्ररूप-अ में, शब्द तथा चिन्ह ''अध्यक्ष/'' जहाँ कहीं भी आया हो, का लोप किया जाये।
13. प्ररूप-आ में, शब्द तथा चिन्ह ''अध्यक्ष/'' का लोप किया जाये।
14. इन नियमों में, शब्द ''पीठासीन प्राधिकारी'' जहॉ कहीं भी आया हो, के स्थान पर, क्रमशः शब्द ''पीठासीन अधिकारी'' प्रतिस्थापित किया जाये।

क्रमांक एफ 1-137/2024/18. - भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में विभाग की अधिसूचना क्रमांक एफ 1-137/2024/18 दिनांक 13-02-2025 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. F 1-137/2024/18. - In exercise of the powers conferred by Section 355 read with Section 43 of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961), the State Government, hereby, makes the following further amendment in the Chhattisgarh Municipalities (Election of President and Vice-President) Rules, 1998, namely :-
AMENDMENT
In the said rules, -
1. In sub-rule (1) of rule 1, before the words "Vice-President", the words "President and" shall be omitted.
2. In rule 2,-
(i) in clause (b), before the words "the elected", the words "the President and" shall be inserted.
(ii) for clause (e), the following clause shall be substituted, namely :-
"(e) "Presiding Officer" means the officer authorized by the Collector under sub-section (2) of Section 55 of the Act;"
3. In sub-rule (1) of rule 3, before the words "Vice-President", the words "President and" shall be omitted.
4. In rule 4,-
(i) in sub-rule (1), before the words "Vice-President", the words "President and" shall be omitted.
(ii) sub-rule (3) shall be omitted.
5. In rule 6,-
(i) in clause (a) of sub-rule (2), for the words "President or Vice-President, as the case may be,", the words "Vice-President" shall be substituted.
(ii) sub-rule (5) shall be omitted.
6. In rule 8, after the words "The presiding authority shall,", the words "Sequentially, for the posts of President and the Vice-President," shall be omitted.
7. In rule 9,-
(i) in sub-rule (1), before the words "Vice-President", the words "President and" shall be omitted.
(ii) sub-rule (3) shall be omitted.
8. In rule 10,-
(i) in sub-rule (1), the protasis "Separate ballot-boxes shall be used for the election of the President and the Vice-President, and, as the case may be, the word „President" or „Vice-President" shall be prominently marked on the ballot-box." shall be omitted.
(ii) sub-rule (5) shall be omitted.
9. In rule 11, after the words "The presiding authority shall", the words "sequentially, first in respect of the President and thereafter in respect of the Vice-President," shall be omitted.
10. In rule 13, after the words "connecting of votes has been completed", the words "Sequentially, for the posts of the President and Vice-President," shall be omitted.
11. In rule 16, before the words "Vice-President", the words "President or" shall be omitted.
12. In Form-A, the word and symbol "President/", wherever they occur shall be omitted.
13. In Form-B, the word and symbol "President/" shall be omitted.
14. In these rules, for the words "Presiding Authority", wherever they occur, the words "Presiding Officer" shall be substituted, respectively.
