अधिसूचना
क्रमांक एफ 1-136/2024/18. - छत्तीसगढ़ नगरपालिक निगम अधिनियम, 1956 (क्र. 23 सन् 1956) की धारा 433 सहपठित धारा 18 की उप-धारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतदद्वारा, छत्तीसगढ़ नगरपालिक निगम (महापौर तथा अध्यक्ष का निर्वाचन) नियम, 1998 में निम्नलिखित अग्रतर संशोधन करती है, अर्थातः-
संशोधन
उक्त नियमों में,-
1. नियम 1 के उप-नियम (1) में, शब्द ''अध्यक्ष (स्पीकर का निर्वाचन)'' के पूर्व, शब्द ''महापौर तथा'' का लोप किया जाये।
2. नियम 2 में,-
(एक) खण्ड (ख) में, शब्द ''निर्वाचित'' के पूर्व, शब्द ''महापौर तथा'' अंतःस्थापित किया जाये।
(दो) खण्ड (ङ) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाये, अर्थात्ः-
''(ङ) 'पीठासीन अधिकारी' से अभिप्रेत है जिले का कलेक्टर;''
3. नियम 3 के उप-नियम (1) में, शब्द ''अध्यक्ष (स्पीकर)'' के पूर्व, शब्द ''महापौर तथा'' का लोप किया जाये। 4. नियम 4 में,-
(एक) उप-नियम (1) में, शब्द ''अध्यक्ष (स्पीकर)'' के पूर्व, शब्द ''महापौर तथा'' का लोप किया जाये। (दो) उप-नियम (3) का लोप किया जायेे।
5. नियम 6 में,-
(एक) उप-नियम (2) के खण्ड (ख) में, शब्द तथा चिन्ह ''यथास्थिति, महापौर तथा अध्यक्ष (स्पीकर)'' के स्थान पर, शब्द तथा चिन्ह ''अध्यक्ष (स्पीकर)'' प्रतिस्थापित किया जाये।
(दो) उप-नियम (5) का लोप किया जाये। 6. नियम 9 में,-
(एक) उप-नियम (1) में, शब्द ''अध्यक्ष (स्पीकर)'' के पूर्व, शब्द ''महापौर तथा'' का लोप किया जाये। (दो) उप-नियम (3) का लोप किया जाये।
7. नियम 10 में,-
(एक) उप-नियम (1) में, वाक्यांश ''महापौर तथा अध्यक्ष (स्पीकर) के निर्वाचन हेतु अलग-अलग मतपेटी का उपयोग किया जायेगा तथा मतपेटी पर प्रमुख रूप से, यथास्थिति, शब्द ''महापौर'' या ''अध्यक्ष (स्पीकर)'' अंकित किया जायेगा'' का लोप किया जाये।
(दो) उप-नियम (5) का लोप किया जाये।
8. नियम 11 में, शब्द ''पीठासीन प्राधिकारी'' के पश्चात्, शब्द ''क्रमशः पहले महापौर से संबंधित तथा तत्पश्चात् अध्यक्ष (स्पीकर) से संबंधित'' का लोप किया जाये।
9. नियम 13 में, शब्द ''मतगणना पूरी हो जाने पर'' के पूर्व, शब्द ''क्रमशः महापौर तथा अध्यक्ष (स्पीकर) के पद हेतु'' का लोप किया जायेे।
10. नियम 16 में, शब्द ''अध्यक्ष (स्पीकर)'' के पूर्व, शब्द ''महापौर या'' का लोप किया जाये।
11. प्ररूप-क में, शब्द तथा चिन्ह ''महापौर/'' जहाँ कहीं भी आया हो, का लोप किया जाये।
12. प्ररूप-ख में, शब्द तथा चिन्ह ''महापौर/'' का लोप किया जाये।
13. प्ररूप-ग में, शब्द तथा चिन्ह ''महापौर/'' का लोप किया जाये।
14. इन नियमों में, शब्द ''पीठासीन प्राधिकारी'' जहॉ कहीं भी आया हो, के स्थान पर, क्रमशः शब्द ''पीठासीन अधिकारी'' प्रतिस्थापित किया जाये।

क्रमांक एफ 1-136/2024/18. - भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में विभाग की अधिसूचना क्रमांक एफ 1-136/2024/18 दिनांक 13-02-2025 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. F 1-136/2024/18. - In exercise of the powers conferred by Section 433 read with sub-section (1) of Section 18 of the Chhattisgarh Municipal Corporation Act, 1956 (No 23 of 1956), the State Government, hereby, makes the following further amendment in the Chhattisgarh Municipal Corporation (Election of Mayor and Speaker) Rules, 1998, namely:-
AMENDMENT
In the said rules,-
1. In sub rule (1) of rule 1, before the word, "Speaker", the words "Mayor and" shall be omitted.
2. In rule 2,-
(i) in clause (b), before the words "the elected", the words "the Mayor and" shall be inserted.
(ii) for clause (e), the following clause shall be substituted, namely:-
"(e) "Presiding Officer" means the Collector of the District;"
3. In sub rule (1) of rule 3, before the word "Speaker", the words "Mayor and" shall be omitted.
4. In rule 4,-
(i) in sub rule (1), before the word "Speaker", the words "Mayor and" shall be omitted.
(ii) sub-rule (3) shall be omitted.
5. In rule 6,-
(i) in clause (b) of sub-rule (2), for the words "Mayor or Speaker, as the case may be,", the word "Speaker" shall be substituted.
(ii) sub-rule (5) shall be omitted.
6. In rule 9,-
(i) in sub-rule (1), before the word "Speaker", the words "Mayor and" shall be omitted.
(ii) sub rule (3) shall be omitted.
7. In rule 10,-
(i) in sub-rule (1), the protasis "Separate ballot-boxes shall be used for the election of the Mayor and the Speaker, and as the case may be, the word „Mayor" or „Speaker" shall be prominently marked on the ballot-box" shall be omitted.
(ii) sub-rule (5) shall be omitted.
8. In rule 11, after the words "The presiding authority shall", the words "sequentially, first in respect of the Mayor and thereafter in respect of the Speaker," shall be omitted.
9. In rule 13, after the words "has been completed,", the words "sequentially, for the posts of Mayor and the Speaker," shall be omitted.
10. In rule 16, before the word "Speaker", the words "Mayor or" shall be omitted.
11. In Form-A, word and symbol "Mayor/", wherever they occur shall be omitted.
12. In Form-B, the word and symbol "Mayor/" shall be omitted.
13. In Form-C, the word and symbol "Mayor/" shall be omitted.
14. In these rules, for the words "Presiding Authority", wherever they occur, the words "Presiding Officer" shall be substituted, respectively.
