यतः 16-रायगढ़ (cid:607)वधान सभा (cid:607)नवा(cid:181)चन (cid:179)े(cid:269) के (cid:605)रट(cid:643)न(cid:652)ग अ(cid:608)धकारी (cid:529)ारा उ(cid:183)त (cid:607)नवा(cid:181)चन का प(cid:605)रणाम 03 (cid:606)दस(cid:207)बर, 2023 को घो(cid:607)षत (cid:607)कया गया था। इस (cid:274)कार, (cid:607)नवा(cid:181)चन (cid:557)य का लेखा दा(cid:612)खल करने क(cid:655) अ(cid:613)(cid:202)तम तारीख 02 जनवरी, 2024 थी; और यतः, (cid:611)जला (cid:607)नवा(cid:181)चन अ(cid:608)धकारी, रायगढ़, छ(cid:521)ीसगढ़ के (cid:529)ारा (cid:274)(cid:215)तुत और मु(cid:184)य (cid:607)नवा(cid:181)चन अ(cid:608)धकारी, छ(cid:521)ीसगढ़ के प(cid:269) सं. क-21/चार/(cid:607)व.स.चु./ई.ई.एम/2023-24/66 रायपुर (cid:606)दनांक 30.01.2024 के ज(cid:605)रए अ(cid:256)े(cid:607)षत (cid:605)रपोट(cid:181) के अनुसार सु(cid:284)ी गु(cid:418)वारी जीनत परवीन जो छ(cid:521)ीसगढ़ (cid:607)वधान सभा का साधारण (cid:607)नवा(cid:181)चन 2023 के (cid:607)नवा(cid:181)चन (cid:179)े(cid:269) 16-रायगढ़ से लड़ने वाली अ(cid:206)यथ(cid:441) ह(cid:452), (cid:607)व(cid:608)ध (cid:529)ारा यथापे(cid:610)(cid:179)त री(cid:607)त से अपने (cid:607)नवा(cid:181)चन (cid:557)य का कोई भी लेखा दा(cid:612)खल करने म(cid:449) (cid:607)वफल रही ह(cid:452); और, यतः, (cid:611)जला (cid:607)नवा(cid:181)चन अ(cid:608)धकारी, रायगढ़, छ(cid:521)ीसगढ़, और मु(cid:184)य (cid:607)नवा(cid:181)चन अ(cid:608)धकारी, छ(cid:521)ीसगढ़ क(cid:655) उ(cid:183)त (cid:605)रपोट(cid:463) के आधार पर भारत (cid:607)नवा(cid:181)चन आयोग (cid:529)ारा (cid:607)नवा(cid:181)चन(cid:461) का संचालन (cid:607)नयम 1961 के (cid:607)नयम 89 के उप (cid:607)नयम (5) के अंतग(cid:181)त (cid:607)नवा(cid:181)चन (cid:557)य (cid:274)(cid:215)तुत नह(cid:440) करने के (cid:609)लए सु(cid:284)ी गु(cid:418)वारी जीनत परवीन को कारण बताओ नो(cid:606)टस सं. 76/ छ(cid:521)ीसगढ़-(cid:607)व.स./16/2024/सी. ई. एम.एस.-III, (cid:606)दनांक 26 जुलाई, 2024 जारी (cid:607)कया गया था; और
यतः, (cid:607)नवा(cid:181)चन(cid:461) का संचालन (cid:607)नयम 1961 के (cid:607)नयम 89 के उप-(cid:607)नयम ( 6 ) के अनुसार, (cid:606)दनांक 26 जुलाई, 2024 के उपयु (cid:181)(cid:183)त कारण बताओ नो(cid:606)टस के ज(cid:605)रए सु(cid:284)ी गु(cid:418)वारी जीनत परवीन को (cid:607)नदेश (cid:606)दया गया था (cid:607)क वे इस नो(cid:606)टस के (cid:274)ा(cid:203)त होने के 20 (cid:606)दन(cid:461) के अंदर लेखा न (cid:274)(cid:215)तुत कर पाने के कारण(cid:461) को (cid:570)(cid:562) करते (cid:403)ए (cid:609)ल(cid:612)खत (cid:418)प म(cid:449) अपना अ(cid:206)यावेदन (cid:274)(cid:215)तुत कर(cid:449) और साथ ही, (cid:607)नवा(cid:181)चन (cid:557)य का अपना लेखा दा(cid:612)खल कर(cid:449); और
यतः, (cid:611)जला (cid:607)नवा(cid:181)चन अ(cid:608)धकारी, रायगढ़ ने अपने प(cid:269) सं(cid:184)या 5647/ (cid:607)नवा(cid:181). पय(cid:181)./(cid:557)य लेखा/2024 रायगढ़, (cid:606)दनांक 11 नव(cid:207)बर, 2024 के ज(cid:605)रए आयोग को सूचना द(cid:653) गई (cid:607)क उ(cid:183)त नो(cid:606)टस अ(cid:206)यथ(cid:441) के (cid:529)ारा (cid:606)दनांक 09.08.2024 को (cid:274)ा(cid:203)त (cid:607)कया गया था, और
यतः, (cid:611)जला (cid:607)नवा(cid:181)चन अ(cid:608)धकारी, रायगढ़, (cid:529)ारा अपने प(cid:269) सं(cid:184)या 5685 / (cid:607)नवा(cid:181).पय(cid:181)./ (cid:557)य लेखा / 2024 रायगढ़, (cid:606)दनांक 06.12.2024 के (cid:529)ारा अ(cid:256)े(cid:607)षत कर भेजी गई, अनुपूरक (cid:605)रपोट(cid:181) म(cid:449) यह बताया गया है (cid:607)क सु(cid:284)ी गु(cid:418)वारी जीनत परवीन, ने न तो कोई भी अ(cid:206)यावेदन (cid:607)कया और न ही अपने (cid:607)नवा(cid:181)चन (cid:557)य का लेखा दा(cid:612)खल (cid:607)कया है। इसके अ(cid:607)त(cid:605)र(cid:183)त उ(cid:202)ह(cid:461)ने भारत (cid:607)नवा(cid:181)चन आयोग का स(cid:207)यक् नो(cid:606)टस (cid:608)मलने के उपरांत भी उ(cid:183)त (cid:607)वफलता के (cid:609)लए न तो कोई कारण बताया है और न ही कोई (cid:570)(cid:562)ीकरण (cid:606)दया है; और,
यतः, आयोग का यह समाधान हो गया है (cid:607)क सु(cid:284)ी गु(cid:418)वारी जीनत परवीन (cid:607)नवा(cid:181)चन खच(cid:463) का लेखा दा(cid:612)खल करने म(cid:449) (cid:607)वफल रही ह(cid:452) और उनके पास इस (cid:607)वफलता के (cid:609)लए कोई भी उ(cid:609)चत कारण अथवा औ(cid:609)च(cid:198)य नह(cid:440) है; और
यतः, लोक (cid:274)(cid:607)त(cid:607)न(cid:608)ध(cid:198)व अ(cid:608)ध(cid:607)नयम, 1951 क(cid:655) धारा 10क म(cid:449) अनुबं(cid:608)धत (cid:607)कया गया है (cid:607)क:-
"य(cid:606)द (cid:607)नवा(cid:181)चन आयोग का समाधान हो जाता है (cid:607)क कोई (cid:557)(cid:604)(cid:183)त -
(क) (cid:607)नवा(cid:181)चन (cid:557)य(cid:461) का लेखा उस समय के भीतर और उस री(cid:607)त म(cid:449) जैसी इस अ(cid:608)ध(cid:607)नयम के (cid:529)ारा या अधीन अपे(cid:610)(cid:179)त है, दा(cid:612)खल करने म(cid:449) असफल रहा है; तथा ख उस असफलता के (cid:609)लए कोई अ(cid:501)ा कारण या (cid:202)यायो(cid:609)च(cid:198)य नह(cid:440) रखता है, तो (cid:607)नवा(cid:181)चन आयोग शासक(cid:655)य राजप(cid:269) म(cid:449) (cid:274)का(cid:609)शत आदेश (cid:529)ारा उसको (cid:607)नर(cid:631)ह(cid:652)त घो(cid:607)षत करेगा और ऐसा (cid:557)(cid:604)(cid:183)त उस आदेश क(cid:655) तारीख से तीन वष(cid:181) क(cid:655) कालाव(cid:608)ध के (cid:609)लए (cid:607)नर(cid:631)ह(cid:652)त होगा;

No. 76/Chhattisgarh-LA/16/2023/CEMS-III.⸺ WHEREAS, the General Election to 16-Raigarh, Legislative Assembly of Chhattisgarh 2023 was held vide Notification No. 08/चार/(cid:607)वस(cid:607)न/2023 dated 21.10.2023.
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and,
WHEREAS, the result of the said election along with 16-Raigarh Assembly Constituency was declared by the concerned Returning Officer on 03rd December, 2023. Hence, the last date for lodging the account of Election Expenses was 02nd January, 2024; and,
WHEREAS, as per the report submitted by the District Election Officer, Raigarh, Chhattisgarh and forwarded by the Chief Electoral Officer, Chhattisgarh vide their letter No. क- 21/चार/(cid:607)व.स.चु./ई. ई. एम/2023- 24/66 रायपुर (cid:606)दनांक 30.01.2024 Ms. Guruwari Jeenat Parveen, a contesting candidate of Chhattisgarh from 16- Raigarh, Assembly Constituency of Chhattisgarh has failed to lodge account of her election expenses, in the manner, as required under law; and,
WHEREAS, on the basis of the reports of the District Election Officer Raigarh, Chhattisgarh and the Chief Electoral Officer, Chhattisgarh a Show-Cause notice, 76/Chhattisgarh-LA/16/2024/CEMS-III dated 26.07.2024 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Ms. Guruwari Jeenat Parveen, for not lodging the account of Election Expenses; and, WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 26.07,2024, Ms. Guruwari Jeenat Parveen, was directed to submit her representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,
Whereas, District Election Officer, Raigarh informed the Commission through the letter No. 5647/(cid:607)नवा(cid:181). पय(cid:181)./(cid:212)यय लेखा/2024 Raigarh, dated 11 November, 2024 that the said notice was received by the candidate on 09.08.2024, And
WHEREAS, the District Election Officer, Raigarh, in his Supplementary Report forwarded vide the letter No. 5685/ (cid:607)नवा(cid:181). पय(cid:181)./(cid:212)यय लेखा/ 2024 Raigarh dated 06 December, 2024 reported that Ms. Guruwari Jeenat Parveen, neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, she neither furnished any reason, nor explanation for the said failure; and,
WHEREAS, the Commission is satisfied that Ms. Guruwari Jeenat Parveen, has failed to Lodge the account of election expenses and has no good reason or justification for the failure,
WHEREAS, Section 10 A of the People Act, 1951 provides that:-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order";
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Ms. Guruwari Jeenat Parveen, Purani Basti Dhimrapur, Raigarh a contesting candidate from 16-Raigarh, Assembly Constituency of the State of Chhattisgarh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
