अधिसूचना
क्रमांक 677/289/2025/16 .- ठेका श्रमिक ( विनियमन तथा उत्सादन) छत्तीसगढ़ नियम , 1973 में संशोधन का निम्नलिखित प्रारूप , जिसे राज्य सरकार , ठेका श्रम (विनियमन एवं उत्सादन) अधिनियम , 1970 ( 1970 का 37) की धारा 35 द्वारा प्रदत् शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है और उक्त अधिनियम के द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों , जिनके कि इससे प्रभावित होने की संभावना है , की जानकारी के लिए एतद् द्वारा प्रकाशित किया जाता है तथा एतद् द्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से तीस दिवस के अवसान के पश्चात विचार किया जावेगा ।
कोई आपत्ति या सुझाव , जो उक्त प्रारूप के संबंध में किसी व्यक्ति से विनिर्दिष्ट कालावधि के पूर्व सचिव / उप सचिव, श्रम विभाग , छ० ग ० शासन , महानदी भवन , मंत्रालय , नवा रायपुर , अटल नगर के कार्यालय में कार्यालयीन समय में प्राप्त हो , पर छ० ग ० शासन द्वारा विचार किया जावेगा ।
संशोधन प्रारूप
उक्त नियमों में, -
1. नियम 25 के उप नियम (2) के पश्चात्, निम्नलिखित उप नियम अन्तःस्थापित किया जावे , अर्थात्: -
"(3) रात्रि पाली में महिला ठेका कर्मकारों के नियोजन एवं शर्ते - ठेकेदार द्वारा , जिन पर यह अधिनियम लागू होता है , महिला कर्मकार को रात्रि 07:00 बजे से सुबह 06:00 बजे तक आवश्यकता होने पर निम्नलिखित शर्तों के अध्यधीन नियोजित किया जा सकेगा : -
(एक) रात्रिकालीन पाली हेतु महिला कर्मकार की सहमति प्ररूप - 6 - क में लिया जाना आवश्यक होगा ।
(दो) रात्रि पाली में कम से कम 3 महिला कर्मचारी का नियोजन किया जाना आवश्यक होगा । (तीन) रात्रि पाली में नियोजित महिला कर्मकारों को कार्यस्थल से उनके निवास तक सुरक्षित रूप से पहुंचाने हेतु सुरक्षा गार्ड के साथ समुचित वाहन की व्यवस्था की जायेगी । पुलिस द्वारा सत्यापित वाहन , वाहन चालक एवं सुरक्षा गार्ड का विवरण इत्यादि तथा अन्य अपेक्षित जानकारी नियोजक द्वारा रखी जायेगी ।
(चार) प्रत्येक ठेकेदार, कार्यस्थल पर सहजगोचर स्थान पर स्थानीय पुलिस थाना , पुलिस कंट्रोल रूम एवं महिला सहायता केन्द्र का फोन नंबर प्रदर्शित करेगा ।

(पाँच ) प्रत्येक ठेकेदार द्वारा दुकान / स्थापना में महिला कर्मियों के लिए पृथक से मूत्रालय एवं शौचालय की व्यवस्था की जायेगी , जिसके दरवाजे में केवल अंदर की ओर से सुरक्षा सिटकनी की व्यवस्था होगी ।
(छः ) किसी महिला कर्मकार को मातृत्व हितलाभ अधिनियम , 1961 ( 1961 का सं. 53 ) के अधीन मातृत्व हितलाभ प्रावधानों के विरूद्ध नियोजित नहीं किया जायेगा ।
(सात) प्रत्येक कार्यस्थल में पर्याप्त प्रकाश, हवा के साथ - साथ स्वास्थ्य अनुकूल वातावरण उपलब्ध कराया जायेगा ।
(आठ) प्रत्येक कार्यस्थल, जहाँ कि कर्मकारों से लगातार खड़े होकर कार्य की अपेक्षा की जाती हो वहाँ प्रत्येक कर्मकार के लिए पृथक से बैठने की व्यवस्था नियोजक द्वारा की जायेगी, जिससे कि कर्मकार नियत अन्तराल में आवश्यकतानुरूप बैठ सके ।
(नौ) प्रत्येक ठेकेदार , अग्नि से सुरक्षा संबंधी समुचित प्रावधान का पालन करेगा ।
(दस ) कार्यस्थल पर महिलाओं का लैंगिक उत्पीड़न ( निवारण , प्रतिषेध एव प्रतितोष) अधिनियम , 2013 (2013 का सं. 14 ) , जो स्थापनाओं पर लागू हो , के उपबंधों का अनुपालन किया जायेगा ।
(ग्यारह) शाम 07:00 बजे से प्रातः 06:00 बजे के मध्य किसी भी कारखाने या खतरनाक श्रेणी के कार्य में ठेकेदार द्वारा महिलाओं का नियोजन पूर्णतः प्रतिबंधित रहेगा ।

महिला ठेका कर्मकारों द्वारा रात्रि पाली में कार्य करने के संबंध में सहमति मैं कुमारी / श्रीमती पिता / पति का नाम पता पता वर्तमान में ( ठेकेदार का नाम एवं पता) में .पद पर कार्यस्थल का अवधि से कार्यरत हूं एवं रात्रि पाली में ठेका कार्य निरंतरित संचालित होने के कारण एवं ठेका श्रमिक ( विनियमन तथा उत्सादन) छत्तीसगढ़ नियम, 1973 के प्रावधानों के अनुरूप कार्यस्थल पर महिला कर्मियों के स्वास्थ्य एवं सुरक्षा के साधन होने से , कार्यस्थल से निवास स्थान तक सुरक्षागार्डो की उपस्थिति में वाहनों से मेरे निवास तक पहुंचाये जाने की व्यवस्था तथा रात्रि पाली में कम से कम 03 महिला कर्मी बजे तक कार्यरत होने की जानकारी होने के कारण मैं रात्रि पाली में कार्य करने हेतु सहमति प्रदाय करती हूं । बजे से

NOTIFICATION
No. 677 / 289 /2025 / 16.- The following draft of amendment in the Contract Labour (Regulation and Abolition ) Chhattisgarh Rules , 1973 , which the State Government , proposes to make in exercise of the powers conferred by Section 35 of the Contract Labour ( Regulation and Abolition ) Act , 1970 ( 37 of 1970 ) , is hereby , published as required by the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of thirty days from the date of publication of this notification in the Official Gazette ;
Any objection or suggestions regarding the said draft received from any person before the specified period , in office hours in office of the Secretary/ Deputy Secretary , Department of Labour , Government of Chhattisgarh , Mantralaya , Mahanadi Bhawan, Nava Raipur Atal Nagar , shall be considered by the Government of Chhattisgarh .
DRAFT AMENDMENT
In the said rules , -
1. After sub - rule ( 2) of rule 25 , the following sub - rule shall be
inserted , namely: -
" (3 ) Employment and conditions of the women contract workers in night shift.- The contractor to whom this Act applies can employ women workers as per requirement from 07:00 pm to 06:00 am subject to the following conditions : -
(i) The consent of woman worker for night shift is necessary in Form VI - A.
(ii) It is necessary to have at least 3 women workers employed in the night shift .
(iii) Arrangements of security guards alongwith suitable vehicles shall be made for the women workers employed in the night shift to pick - up and drop to their residence from the workplace safely . Details of the vehicle , driver and security guard etc. verified by the police and other required details shall be kept by the employer .
( iv) Every contractor shall display the phone number of local police station , police control room and women's help center at an easily visible place of the workplace .
(v) Every Contractor shall arrange separate urinals and toilets for women workers in the shop / establishment where the doors shall have safety latch only from inside .
(vi) No women worker shall be employed against the maternity benefit provisions laid down under the Maternity Benefit Act , 1961 (No. 53 of 1961 ) .
(vii) Every workplace shall provide adequate light , air as well as health friendly environment .

( viii ) Every workplace where workers are expected to stand continuously for work , arrangements for sitting separately for each worker shall be made by the employer so that the workers can sit in required intervals .
(ix) Every contractor shall comply with the relevant provisions of fire protection .
(x) The provisions of the Sexual Harassment of Women at Workplace ( Prevention , Prohibition and Redressal ) Act, 2013 (No. 14 of 2013 ) , as applicable to the establishments , shall be complied.
(xi ) Employment of women by the contractor in any factory or hazardous category work shall be completely prohibited between 07:00 pm to 06:00 am . "
