अधिसूचना

क्रमांक एफ 5-4/2024/आठ-परि. - मोटरयान अधिनियम, 1988 (क्रमांक 59 सन्‌ 1988) की धारा 111 की उप-धारा (1) तथा केन्द्रीय मोटरयान नियम, 1989 के नियम 118 में उप-नियम (2) के द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए और भारत सरकार, सड़क परिवहन और राजमार्ग मंत्रालय, नई दिल्ली की अधिसूचना क्रमांक एस.ओ. 5454 (ई), दिनांक 25.10.2018, सहपठित केन्द्रीय मोटरयान नियम, 1989 के नियम 125(एच) के अनुपालन में, मोटरयान अधिनियम, 1988 की धारा 2 के खण्ड (35) के अधीन परिभाषित (दोपहिया, ई-रिक्शा, तीन पहिया वाहनों और किसी भी परिवहन वाहन को छोड़कर, जिसके लिए मोटरयान अधिनियम, 1988 के अधीन परमिट की आवश्यकता नहीं है) सभी सार्वजनिक सेवा वाहनों में व्हीकल लोकेशन ट्रैकिंग डिवाइस और एक या एक से अधिक आपातकालीन पैनिक बटन लगाने हेतु राज्यपाल (प्रशासक), छत्तीसगढ़, एतद्‌द्वारा, राजपत्र में प्रकाशन की तारीख से अधिसूचित करते है, मानक एआईएस-140 के अनुरूप निर्दिष्ट होंगे, अर्थात्‌ः-

नोटः- अधिसूचना के प्रकाशन की तारिख से फिटमेंट अनिवार्य होगा। शर्तेः (1) वाहन लोकेशन ट्रैकिंग डिवाइस निम्नलिखित के संबंध में फिट किया जाएगाः- (क) 01 जनवरी, 2019 को या उसके पश्चात्‌ निर्मित वाहनों में, मानक एआईएस-140 के अनुरूप, वाहन निर्माता द्वारा या तो विनिर्माण चरण में या डीलरशिप चरण में व्हीकल लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन से सुसज्जित या फिट किया जाएगा।

(ख) 01 जनवरी, 2019 से पूर्व पंजीकृत परिवहन वाहनों की उपरोक्त श्रेणियां, जिसमें पहले से वाहन लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन फिट नही किया गया है, उपरोक्त समय-सीमा के अंदर परिवहन विभाग के सूचीबद्ध विक्रताओं में से किसी के द्वारा सुसज्जित या फिट किया जाएगा।

(2) छत्तीसगढ़ राज्य में संबंधित परमिट स्वीकृतकर्ता प्राधिकारी या पंजीयन प्राधिकारी यह सुनिश्चित करेगा कि पूर्वोक्त प्रत्येक श्रेणी के वाहनों में ''व्हीकल लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन'' फिट किया गया है और वाहन ट्रैकिंग के लिए डेटा और अलर्ट प्राप्त करने हेतु इन उपकरणों का विवरण, वाहन एप्लीकेशन में फीड किया गया है।

(3) व्हीकल लोकेशन ट्रैकिंग डिवाइस और इसमें लगे आपातकालीन पैनिक बटन, समय-समय पर एआईएस-140 में अनिवार्य किए गए सभी आवश्यक मापदंडों को प्रसारित करने में कार्यात्मक रूप से सक्षम होंगे।

(4) केन्द्रीय मोटरयान नियम, 1989 के नियम 126 में निर्दिष्ट किसी भी परीक्षण एजेंसी से फिट किए जाने वाले उपकरणों के संबंध में व्हीकल लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन के निर्माता को अनुमोदन प्रमाणपत्र प्राप्त करना होगा।

(5) कोई भी व्यक्ति वाहन पर लगे हुए व्हीकल लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन को नहीं खोलेगा, छेड़छाड़ नहीं करेगा अथवा हस्तक्षेप नहीं करेगा।

(6) किसी वाहन को ऐेसे उचित समय के लिए, परिवहन विभाग को कोई भी अधिकारी, जो मोटर वाहन निरीक्षक की श्रेणी से निम्न श्रेणी का न हो, रोकने के लिए अधिकृत है, क्योंकि यह आवश्यक है कि वह स्वयं संतुष्ट कर ले कि वाहनों में व्हीकल लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन एआईएस मानक-140 के अनुसार फिट किए गए है।

(7) वाहन के स्वामी का यह कर्तव्य होगा कि वाहन के चालक को व्हीकल लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन के आवश्यकता और महत्व के लिए प्रशिक्षित या शिक्षित करें।

(8) यदि, किसी भी समय, वाहन चालक या स्वामी द्वारा यह देखा जाता है कि, वाहन व्हीकल लोकेशन ट्रैकिंग डिवाइस और आपातकालीन पैनिक बटन ठीक से काम नहीं कर रहा है या किसी भी माध्यम से यह देखा गया है कि, डिवाइस, निर्दिष्ट डेटा और अलर्ट प्रसारित नहीं कर रहा है तो चालक या स्वामी आवश्यक सुधार के बाद ही वाहन चलाएंगे। (9) इस अधिसूचना के उल्लंघन के लिए मोटरयान अधिनियम, 1988 (1988 का 59) की धारा 177 के अधीन जुर्माना उपबंधित है।

यह अधिसूचना, राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगी।

NOTIFICATION

No. F 5-4/2024/VIII-Trans. -In exercise of the powers conferred bysub-section (1) of Section 111 of the Motor Vehicles Act, 1988 (No. 59 of 1988) and sub-rule (2) of rule 118 of the Central Motor Vehicle rules, 1989 and in compliance to the Government of India, Ministry of Road Transport and Highways, New Delhi, Notification No. S.O. No. 5454 (E), dated 25-10-2018 read with rule 125H of the Central Motor Vehicles Rules, 1989, the Governor (Administrator), Chhattisgarh, hereby, notifies, from the date of publication in the Gazette of Vehicle Location Tracking Device and one or more Emergency Panic Button in all the Public Service Vehicle defined under clause (35) of Section 2 of the Motor Vehicle Act, 1988 (except two wheelers, E-rickshaw, three wheelers and any transport vehicle for which permit is not required under the Motor Vehicle Act, 1988) specified conforming to the standard AIS-140, namely:-

Note:- Fitment shall be mandatory from the date of publication of notification.

Conditions:

(1) The Vehicle Location Tracking Device shall be fitted in respect of:-

(a) Vehicles manufactured on or after 1st January, 2019 shall be equipped or fitted by the vehicle manufacturer either in the manufacturing stage or at the dealership stage with a vehicle Location Tracking Device and emergency Panic Button, conforming to the standard AIS-140.

(b) The above categories of transport vehicles registered prior to 1st January, 2019 which are not already fitted with a Vehicle Location Tracking Device and emergency Panic Button shall be equipped or fitted by any of the empanelled vendors of this Transport Department within the above timeline.

(2) The permit granting Authority or Registering Authority concerned in the State of Chhattisgarh shall ensure that "Vehicle Location Tracking Device and emergency Panic Button" is fitted in each of the aforesaid classes of vehicles and the details of these devices were fed into the Vahan application to receive data and alerts from devices for tracking of vehicle.

(3) The Vehicle Location Tracking Device and emergency Panic Button so fitted shall be functionally capable of transmitting all the required parameters as mandated in AIS-140, from time to time.

(4) The manufacturer of the Vehicle Location Tracking Device and emergency Panic Button shall obtain a approval certificate in respect of their devices to be fitted from any of the testing agencies referred to in Rule 126 of the Central Motor Vehicles Rules, 1989.

(5) No person shall open, tamper or otherwise interfere with the Vehicle Location Tracking Device and emergency Panic Button fitted on the vehicle.

(6) Any officer of the Transport Department not below the rank of Motor Vehicle Inspector is authorized to stop a vehicle for such reasonable time, as is necessary to satisfy himself that the Vehicle Location Tracking Device and emergency Panic Button is fitted in accordance to the standards of AIS- 140.

(7) It shall be the duty of the owner of the vehicle to train or educate the driver of the vehicle about the necessity and importance of the Vehicle Location Tracking Device and emergency Panic Button.

(8) If, at any time, it is observed by the driver or the owner that the Vehicle Location Tracking Device and emergency Panic Button are not functioning properly or by any means it is observed that the devices are not transmitting the specified data and alerts, the driver or the owner shall ply the vehicles, only after necessary rectification.

(9) The penalty provided under Section 177 of motor Vehicles Act, 1988 (Act 59 of 1988) shall apply for violation of this Notification..

This notification shall come into force from the date of its publication in the Official Gazette.
