अधिसूचना

क्रमांक एफ 2-13/दो-गृह/रापुसे/2025.— भारतीय नागरिक सुरक्षा संहिता, 2023 (क्र. 46 सन्‌ 2023) की धारा 173 की उप-धारा (1) के द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुये, राज्य सरकार, एतद्‌द्वारा, संज्ञेय मामलों के संबंध में सूचना (इत्तिला) से संबंधित निम्नलिखित नियम बनाती है, अर्थात्‌ :-

नियम

1. सूचना का लेखबद्ध किया जाना :- (1) किसी पुलिस थाने में प्राप्त संज्ञेय अपराध के घटित होने के संबंध में प्रत्येक सूचना को उस पुलिस थाने के भारसाधक अधिकारी द्वारा अभिलेख पर लिया जाएगा, जहॉँ सूचना प्राप्त हुई है और अनुलग्नक 'क' में दिए गए प्रारूप के अनुसार उसे पंजी (रजिस्टर) में दर्ज किया जाएगा;

2. पंजी (रजिस्टर) का जारी किया जाना ः- (1) उक्त पंजी (रजिस्टर) पर पृष्ठ अंकित किया जाएगा और इसे संबंधित एसडीओपी (अनुविभागीय पुलिस अधिकारी) द्वारा आरंभिक पृष्ठ के साथ-साथ अंतिम पृष्ठ पर सत्यापित किया जाएगा।

(2) जब पंजी (रजिस्टर) पूर्ण हो जाए, तो उसे पुलिस अधीक्षक कार्यालय में जमा कर दिया जाएगा।

(3) नयी पंजी (रजिस्टर) प्राप्त करने का अनुरोध, संबंधित एसडीओपी (अनुविभागीय पुलिस अधिकारी) के माध्यम से पुलिस अधीक्षक (मुख्यालय) के कार्यालय को किया जाएगा।

3. मजिस्ट्रेट को प्रतिवेदन (रिपोर्ट) अग्रेषित करने के संबंध में संबंधित पुलिस थाने के भारसाधक अधिकारी के कर्तव्य :- (1) संबंधित पुलिस थाने का भारसाधक अधिकारी, प्रथम सूचना प्रतिवेदन के दर्ज किये जाने से 24 घण्टे के भीतर संबंधित मजिस्ट्रेट को प्रतिलिपि भेजेगा।

(2) संबंधित पुलिस थाने का भारसाधक अधिकारी यह सुनिश्चित करेगा कि नियम 1 में कथित अनुसार संज्ञेय अपराध की जानकारी के संबंध में पंजी (रजिस्टर) में एक प्रविष्टि की जाए।

4. धारा 173 के अधीन पंजी अपराधों की विवेचना धारा 176 के प्रावधान के अनुसार की जायेगी।अनुलग्नक ''क'' पंजी (रजिस्टर)

NOTIFICATION

No. F2-13/Two-Home/SPS/2025.— In exercise of the powers conferred by sub-section (1) of Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (No. 46 of 2023), hereby, makes the following rules regarding the information about cognizable cases namely:-

1. Recording of Information.- Every information relating to the commission of cognizable offence received in a police station shall be taken on record by an officer-in-charge of the Police Station where the information is received and shall be recorded in a register as per the format given in Annexure 'A'.

2. Issuance of Register.- (1) The said Register shall be page marked and shall be attested by the concerned SDPO(Sub Divisional Police Officer) at the front page as well as on the last page.

(2) As and when the register is completed the same shall be deposited with the SP Office.

(3) The request for getting new register shall be made to the office of Superintendent of Police (Head Quarter) through concerned SDPO(Sub Divisional Police Officer).

3. Duties of the officer in charge of concerned police station in respect of forwarding the report to the Magistrate.- (1) The Officer in charge of the concerned police station shall send copy to the concerned Magistrate within 24 hours from the date of filing of the FIR.

(2) The officer in charge of the concerned police station shall ensure that an entry is made in the register regarding the information of cognizable offence as stated in rule 1.

4. The investigation of crime registered under Section 173 will be done as per the provision of Section 176.
