अधिसूचना
क्र./2066/एफ-11/02/2023/14-2.— छत्तीसगढ़ कृषि उपज मंडी (एक से अधिक मंडी क्षेत्रों के लिए विशेष अनुज्ञप्ति) नियम, 2006 में संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार, छत्तीसगढ़ कृषि उपज मंडी अधिनियम, 1972 (क्रमांक 24 सन् 1973) की धारा 79 की उप-धारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 79 की उप-धारा (1) द्वारा अपेक्षित किए गए अनुसार, उन समस्त व्यक्तियों, जिनके कि इससे प्रभावित होने की संभावना है, की जानकारी के लिए एतद्द्वारा प्रकाशित किया जाता है, तथा एतद्द्वारा सूचित किया जाता है, कि उक्त प्रारूप पर इस सूचना के राजपत्र में प्रकाशन की तारीख से पन्द्रह दिवस के अवसान के पश्चात् विचार किया जाएगा।
कोई आपत्ति या सुझाव, जो उक्त प्रारूप संशोधन के संबंध में किसी व्यक्ति से, विर्निदिष्ट कालावधि के पूर्व, कृषि उत्पादन आयुक्त/सचिव, छ.ग. शासन, कृषि विभाग, कक्ष क्रमांक-एस-4-10, मंत्रालय, महानदी भवन, नवा रायपुर अटल नगर के कार्यालय में कार्यालयीन समय में प्राप्त हो, पर छत्तीसगढ़ शासन द्वारा विचार किया जाएगा।
संशोधन प्रारूप
उक्त नियमों में,-
1. नियम 2 में,
(एक) खण्ड (2) म,ें शब्द ''धारा 11 के अधीन गठित यह'' के स्थान पर, शब्द ''धारा 11 के अधीन गठित वह'' प्रतिस्थापित किया जाए।
(दो) खण्ड (3) में, शब्द ''अधिनियम के अधीन नियुक्त किया गया'' का लोप किया जाए।
(तीन) खण्ड (4) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात् :-
''(4) ''अतिरिक्त प्रबंध संचालक'' से अभिप्रेत है छत्तीसगढ़ राज्य कृषि विपणन बोर्ड का अतिरिक्त प्रबंध संचालकय''
(चार) खण्ड (6) में, शब्द ''उप-संचालक'' के स्थान पर, शब्द ''संयुक्त संचालक'' प्रतिस्थापित किया जाए। (पाँच) खण्ड (7) में, शब्द ''संचालक'' के स्थान पर, शब्द ''प्रबंध संचालक'' प्रतिस्थापित किया जाए। (छः) खण्ड (9) में, शब्द ''उपसंचालक'' के स्थान पर, शब्द ''संयुक्त संचालक'' प्रतिस्थापित किया जाए। (सात) खण्ड (9) में, शब्द ''बोर्ड'' को लोप किया जाए।
(आठ) खण्ड (15) को विलोपित लोप किया जाए।
2. नियम 3 के उप-नियम (2) के परन्तुक का लोप किया जाए।
3. नियम 4 में,-
(एक) खण्ड (क) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात् :-
''(क) व्यापारी/प्रसंस्करणकर्ता/विनिर्माता/अभिकर्ता/परिवहनकर्ता'' - 25,000
(दो) खण्ड (ग), (ड.) का लोप किया जाए।
4. नियम 5 में,-
(एक) उप-नियम (1) में, वाक्यांश ''आवेदन प्ररूप विहित फीस के भुगतान पर बोर्ड के मुख्यालय की भण्डार शाखा (स्टोर सेक्शन) द्वारा उपलब्ध कराया जाएगा'' का लोप किया जाए।
(दो) उप-नियम (2) में, शब्द ''छत्तीसगढ़ कृषि विपणन बोर्ड, रायपुर'' के स्थान पर, शब्द ''कार्यालय अधिसूचित प्राधिकारी'' प्रतिस्थापित किया जाए।
(तीन) उप-नियम (3) में,-
(क) खण्ड (एक), में शब्द ''बैंक गारण्टी'' के पूर्व, शब्द ''नगद, एफ.डी.आर. या'' अन्तःस्थापित किया जाए।
(ख) खण्ड (दो) में, शब्द ''क्रय हेतु'' के पूर्व, शब्द ''वांछित'' अन्तःस्थापित किया जाए तथा शब्द'' उनका पृथक, अभिन्यास लेआउट'' का क्रमशः लोप किया जाए।
(ग) खण्ड (तीन) में, शब्द ''आढ़तिया'' के स्थान पर, शब्द ''विनिर्माता'' प्रतिस्थापित किया जाए। 5. नियम 6 में,-
(एक) उप-नियम (2) में, शब्द ''संभागीय उपसंचालक'' के स्थान पर, शब्द ''संभागीय संयुक्त संचालक'' प्रतिस्थापित किया जाए और शब्द ''उल्लिखित मंडी क्षेत्रों तथा क्रय केन्द्रों की'' का क्रमशः लोप किया जाए। (दो) उप-नियम (5) में, शब्द ''और क्रय केन्द्रों पर'' तथा शब्द ''और उनके अन्य क्रय केन्द्रों'' का क्रमशः लोप किया जाएय
6. नियम 7 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाए, अर्थात् :-
''7. प्रतिभूति.- आवेदक, प्ररूप-दो में घोषणा पत्र प्रस्तुत करेगा तथा घोषणा पत्र में यथा उल्लिखित दैनिक क्रय क्षमता तथा एक दिन की अधिकतम खरीदी के मूल्य की घोषणा करते हुए, दैनिक क्रय के अधिकतम मूल्य का नगद या बैंक ड्राफ्ट या बैंक गारण्टी के रूप में जमा करेगा और यदि अनुज्ञप्तिधारक उसके द्वारा घोषित की गई सीमा से अधिक क्रय करना चाहता है, तो अनुज्ञप्तिधारक को दैनिक क्रय क्षमता से अधिक क्रय के लिए अतिरिक्त प्रतिभूति की राशि तुरन्त प्रस्तुत करनी होगी। अधिसूचित प्राधिकारी/अधिकारी को यह शक्ति होगी कि वह संबंधित विनिर्दिष्ट मंडी क्षेत्रों में ऐसी कृषि उपज के क्रय तथा प्रेषण को प्रतिषिद्ध करे और संबंधित मंडी क्षेत्र के सचिव को ऐसे अनुज्ञप्तिधारक के अधिसूचित कृषि उपज के क्रय और प्रेषण को अविलंब प्रतिषिद्ध करने की शक्तियॉ होगी।'' 7. नियम 8 के खण्ड (क) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात् :-
''(क) अनुज्ञप्तिधारक द्वारा नगद या एफ.डी.आर. या बैंक गारण्टी के प्ररूप में प्रतिभूति निक्षेप की रकम बोर्ड खाते में जमा रहेगी। यदि अनुज्ञप्तिधारक द्वारा देय मंडी शुल्क और निराश्रित शुल्क का भुगतान नहीं किया गया है, तो नियम 7 के अधीन नगद /एफ.डी.आर./बैंक गारण्टी तथा दी गई प्रतिभूति निक्षेप की शेष रकम आवेदक को, अधिसूचित प्राधिकारी/अधिकारी की अभिरूचि से वापस की जाएगी। प्रतिभूति निक्षेप की शेष रकम, जो कार्यालय, अधिसूचित प्राधिकारी, एफ.डी.आर. या बैंक गारंटी के रूप में जमा है, आवेदक द्वारा मांग की जाने पर, विनिर्दिष्ट मंडी क्षेत्र के सचिवों से अदेय/अनापत्ति प्रमाण-पत्र प्राप्त होने पर वापस की जाएगी।''
8. नियम 10 के स्थान पर, निम्नलिखित नियम प्र्रतिस्थापित किया जाए, अर्थात् :-
''10 अनुज्ञप्ति जारी करना - अनुज्ञप्तिधारक कारबार के मुख्यालय पर अनुज्ञप्ति की मूल प्रति तथा विनिर्दिष्ट मंडी क्षेत्र में उसकी अभिप्रमाणित प्रति संप्रदर्शित/प्रेषित करेगा'' 9. नियम 11 के उप-नियम (क) में,-
(एक) खण्ड (4) में, शब्द ''प्रबंध संचालक'' के स्थान पर, शब्द ''अधिसूचित प्राधिकृत अधिकारी'' प्रतिस्थापित किया जाए।
(दो) खण्ड (क) के उपखण्ड (5), (9) (10) एवं (11) में, शब्द ''बोर्ड'' के स्थान पर, शब्द ''अधिसूचित प्राधिकारी'' प्रतिस्थापित किया जाए।
(तीन) खण्ड (14) के स्थान पर, निम्नानुसार खण्ड प्रतिस्थािपत किया जाए, अर्थात् :-
''(14) यदि पंजीयनधारक, किसी ऐसी निरर्हता के अध्यधीन, जैसा कि विहित किया जाए,'' प्रतिस्थापित किया जाए।''
10. नियम 11 के खण्ड (ख) में, शब्द ''उपसंचालक'' के स्थान पर, शब्द ''संयुक्त संचालक'' प्रतिस्थापित किया जाए। 11. नियम 14 मेें, शब्द एवं चिन्ह ''और मंडी/उपमंडी तथा अनुज्ञप्ति में विनिर्दिष्ट क्रय केन्द्रों पर ही'' का लोप किया जाए।
12. नियम 15 में,-
(एक) शीर्षक में, शब्द ''करार का निष्पादन'' के स्थान पर, शब्द ''क्रय-विक्रय की शर्तें'' प्रतिस्थापित किया जाए।
(दो) उप-नियम (1) में शब्द, ''क्रय केन्द्रों'' के स्थान पर, शब्द ''मंडी अधिनियम तथा उप विधि के अनुसार'' प्रतिस्थापित किया जाए।
(तीन) उप-नियम (1) में, शब्द एवं चिन्ह ''प्ररूप-5 में'' का लोप किया जाए।
13. नियम 16 में, शब्द ''उप संचालक'' के स्थान पर, शब्द ''संयुक्त संचालक'' प्रतिस्थापित किया जाए।
14. नियम 17 का लोप किया जाए।
15. नियम 19 में, शब्द ''प्रत्येक क्रय केन्द्र'' का लोप किया जाए और शब्द ''विक्रय, प्रसंस्करण या प्रेषण'' के पश्चात्, शब्द ''किया जाएगा।'' अन्तःस्थापित किया जाए।
16. नियम 20 में,-
(एक) उप-नियम (1) में, शब्द ''मंडी समिति, संभागीय उप संचालक और बोर्ड'' के स्थान पर, शब्द ''मंडी समिति, संभागीय संयुक्त संचालक'' प्रतिस्थापित किया जाए।
(दो) उप-नियम (2) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाए, अर्थात् :-
''(2) अनुज्ञप्तिधारक द्वारा विनिर्दिष्ट मंडी क्षेत्रों में क्रय की गई अधिसूचित —षि उपज के क्रय एवं विक्रय से संबंधित पाक्षिक विवरणियां, प्रशासनिक मंडी समिति के सचिव को प्ररूप-छः में प्रस्तुत की जाएगी। माह की एक तारीख से पन्द्रह तारीख की अवधि के लिए विवरणी पच्चीस तारीख तक प्रस्तुत की जाएगी और सोलह तारीख से माह की समाप्ति तक की विवरणी आगामी माह के दसवें दिन तक प्रस्तुत की जाएगी। यदि पाक्षिक विवरणी, विहित समय-सीमा में प्रस्तुत नहीं की जाती है, तो मंडी समिति सचिव/संयुक्त संचालक द्वारा पदस्थ, केन्द्र प्रभारी द्वारा अनुज्ञापत्र जारी नहीं किये जायेंगे। समस्त अधिसूचित —षि उपज के क्रय पर देय मंडी शुल्क का भुगतान किये बिना, —षि उपज का विक्रय, प्रेषण और प्रसंस्करण प्रतिषिद्ध रहेगा।
(तीन) नियम 20 के उप-नियम (4) का लोप किया जाए।
17. नियम 8, 9, 11 एवं 20 में, शब्द ''बोर्ड'' जहाँ कहीं भी आया हो, के स्थान पर, शब्द ''प्राधि—त अधिकारी'' प्रतिस्थापित किया जाए।
18. प्ररूप-एक में,-
(एक) सरल कमांक 11,12,13,14,15 तथा 21 का लोप किया जाए।
(दो) सरल कमांक 10 के कालम नंबर 4 में, शब्द, अंक एवं चिन्ह ''नियम 3 (2) देखिए'' का लोप किया जाए। (तीन) सरल क्रमांक 17 के कॉलम (3) के पश्चात्, कॉलम 4 में शब्द ''अधि—त किये गये व्यक्तियों की सूची'' अन्तःस्थापित किया जाए।
19. प्ररूप-दो में,-
(एक) सरल कमांक 1 में, शब्द ''मेरे/हमारे द्वारा स्थापित सभी कय केन्द्रों की'' का लोप किया जाए। (दो) सरल कमांक 5 में, शब्द ''प्रशासनिक मंडी समिति एवं'' का लोप किया जाए।
20. प्ररूप-चार, प्ररूप-पॉच तथा प्ररूप-सात का लोप किया जाए।
21. प्ररूप-दो एवं तीन में, शब्द ''बोर्ड'' जहाँ कहीं भी आया हो, के स्थान पर, शब्द ''प्राधि—त अधिकारी'' प्रतिस्थापित किया जाए।

NOTIFICATION
No./ 2066/F-11/02/2023/14-2.—The following draft of amendment in the Chhattisgarh Krishi Upaj Mandi (Special Licence for more than One Market Areas) Rules, 2006, which the State Government proposes to make in exercise of the powers conferred by sub-section (1) of Section 79 of the Chhattisgarh Krishi Upaj Mandi Adhiniyam, 1972 (No. 24 of 1973), is hereby published as required by sub-section (1) of the Section 79 of the said Adhiniyam, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of fifteen days from the date of publication of this notice in the Official Gazette.
Any objection or suggestion regarding the said draft received from any person, before the specified period during office hours by the office of the Agriculture Production Commissioner/Secretary, Government of Chhattisgarh, Department of Agriculture, Room No. S -4-10, Mantralaya, Mahanadi Bhawan, Nava Raipur Atal Nagar shall be considered by the Government of Chhattisgarh.
DRAFT AMENDMENT
In the said rule,-
1. In rule 2,
(i) in clause (2), for the words "constituted under section 11", the words "that is constituted under Section 11" shall be substituted.
(ii) in clause (3), the words "appointed under the Act." shall be omitted.
(iii) for clause (4), the following clause shall be substituted, namely:-
"(4) "Additional Managing Director" means the Additional Managing Director of Chhattisgarh State Agricultural Marketing Board."
(iv) in clause (6), for the words "Deputy Director", the words "Joint Director" shall be substituted.
(v) in clause (7), for the word "Director", the words "Managing Director" shall be substituted.
(vi) in clause (9), for the words "Deputy Director", the words "Joint Director" shall be substituted.
(vii) in clause (9), the word "Board" shall be omitted.
(viii) clause (15) shall be omitted.
2. The proviso of sub-rule (2) of rule 3 shall be omitted.
3. In rule 4,- (i) for clause (a), the following clause shall be substituted, namely:-
" (a) Trader/Processor/Manufacturer/Agent /Transporter" - 25,000
(ii) clause (c) and (e) shall be omitted.
4. In rule 5,-
(i) in sub-rule (1), for the protasis "Application Form will be provided by store section of the Board (Head Quarter) on payment of prescribed fee." shall be omitted.
(ii) in sub-rule (2), for the words "M.D. Chhattisgarh State Agricultural Marketing Board, Raipur", the words "Office of Notified Authority" shall be substituted.
(iii) in sub-rule (3),-
(a) in clause (i), before the words "Bank Guarantee", the words "Cash, FDR or" shall be inserted.
(b) in clause (ii), before the words "for purchase", the word "desired" shall be inserted and the words "their separate, layout," shall be omitted, respectively.
(c) in clause (iii), for the words "commission agent" the word "manufacturer" shall be substituted.
5. In rule 6,-
(i) in sub-rule (2), for the words "divisional Deputy Director", the words "Divisional Joint Director" shall be substituted and the words "mentioned market areas and purchase centers" shall be omitted, respectively.
(ii) in sub-rule (5), words "and on purchase centres" and "and on other purchase centres" shall be omitted, respectively.
6. For rule 7, the following rule shall be substituted, namely:
"7. Security.- The applicant shall submit the declaration Form, in Form-II and shall deposit the maximum value of daily purchase in the form of cash or bank draft or bank guarantee, declaring the daily purchasing capacity and the value of maximum purchase of a day as mentioned in the declaration form and if the license holder wants to purchase more than the limit declared by him, then the license holder for excess of purchase over and above the daily purchase capacity, will produce the amount additional security immediately. The notified authority/officer will have the power to prohibit the purchase and dispatch of such agricultural produce in the concerned specified market areas and the Secretary of the concerned market area to prohibit immediately the purchase and dispatch of notified agricultural produce of such licence holder."
7. For clause (a) of rule 8, the following clause shall be substituted, namely:-
"(a) The amount of security in the form of Cash or FDR or Bank Guarantee by the licence holder will remain deposited in the Board account. If the payment of the due market fees and Nirashrit Shulk is not made by the licence holder, then due payment from balance amount of the Cash/FDR/Bank Guarantee and Security given under rule 7, will be recovered along with the interest by the notified Authority/Officer. The remaining amount of security deposit in the office of the notified authority, FDR or Bank Guarantee will be refunded to the applicant on demand of receipt of No Dues/No Objection Certificate, from the Secretaries of the specified market area." 8. For rule 10, the following rule shall be substituted, namely:
"10. Issuance of license.– The licensee shall display/send the original copy of the license at the headquarter of the business and its attested copy to the specified market area."
9. In sub-rule (a) of rule 11,-
(i) in clause (4), for the words "Managing Director", the words "Notified Authorized Officer" shall be substituted.
(ii) in clause (5), (9), (10) and (11), for the word "Board", the words "Notified Authority" shall be substituted."
(iii) for clause (14), the following clause shall be substituted, namely:-
"(14) if the registration holder is subject to any such disqualification as may be prescribed." 10. In clause (b) of rule 11, for the words "Deputy Director", the words "Joint Director" shall be substituted.
11. In rule 14, the words and symbol "and in the market/sub-market yards, and at the purchase centers specified in the license" shall be omitted.
12. In rule 15,-
(i) in the title, for the words "Execution of the Agreement", the words "Terms of Sale and Purchase" shall be substituted.
(ii) in sub-rule (1), for the words "at the purchase centre", the words "as per Mandi Act and Bye- laws" shall be substituted.
(iii) in sub-rule (1), the word and figure "in Form-V" shall be omitted.
13. In rule 16, for the words "Deputy Director", the words "Joint Director" shall be substituted.
14. Rule 17 shall be omitted.
15. In rule 19, the words "every purchased centre" shall be omitted and for the words "will be made by", the words "shall be done" shall be substituted, respectively.
16. In rule 20,-
(i) in sub-rule (1), for the words "market committee, Divisional Deputy Director and the Board", the words "Market Committee, Divisional Joint Director" shall be substituted.
(ii) for sub-rule (2), the following sub-rule shall be substituted, namely:-
"(2) The fort nightly returns related to the purchase and sale of notified agricultural produce purchased by the license holder in the specified market areas will be submitted in Form-VI to the Secretary of the Administrative Market Committee. Returns for the period from first to fifteenth of the month shall be submitted by twenty-fifth and from sixteenth to the end of the month shall be submitted by tenth day of the next month. If fort nightly return is not submitted in the prescribed time limit then the permits will not be issued by the centre in charge, posted by the Secretary of the market committee/Joint Director. Without making payment of due market fees on purchase of all notified agricultural produce, the sale, dispatch and the processing of agricultural produce will be prohibited."
(iii) Sub-rule (4) of rule 20 shall be omitted.
17. In rule 8, 9, 11 and 20, for the word "Board" wherever it occurs, the words "Authorized Officer" shall be substituted.
18. In Form-I,-
(i) serial number 11, 12, 13, 14, 15 and 21 shall be omitted.
(ii) in column number 4 of serial number 10, the words, figures and symbol ''see rule 3 (2)'' shall be omitted.
(iii) after column (3) of serial number 17, the words "list of authorized persons" shall be inserted in column 4.
19. In FORM-II,-
(i) in serial no. 1, the words "of all the purchase centers established by me/us" shall be omitted.
(ii) in serial number 5, the words "administrative market committee and the" shall be omitted.
20. FORM-IV, FORM-V and FORM-VII shall be omitted.
21. In FORM-II and III, for the word "Board", wherever it occurs, the words "Authorized Officer" shall be substituted.
