अधिसूचना
क्रमांक WELF-3001/8/2024-GAD-9. - भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए राज्य सरकार, एतद्द्वारा शासकीय सेवक संघो को पत्राचार हेतु मान्यता प्रदान करने के संबंध में निम्नलिखित नियम बनाती है, अर्थातः्-
1. संक्षिप्त नाम.- ये नियम छत्तीसगढ़ शासकीय सेवक (सेवा संघ) नियम, 2025 कहलाएंगे।
2. परिभाषाएं.- इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) ''राज्य सरकार'' से अभिप्रेत है छत्तीसगढ़ सरकार;
(ख) ''शासकीय सेवक'' से अभिप्रेत है कोई भी ऐसा व्यक्ति जिसको छत्तीसगढ़ सिविल सेवा (आचरण) नियम, 1965 लागू होते हों।
3. राज्य सरकार किसी संघ से केवल उस दशा में ही पत्र-व्यवहार करेगी जब कि उसको समाधानप्रद रूप में यह साबित कर दिया जाये कि ऐसा संघ शासकीय सेवकों के उस प्रवर्गं या उन प्रवर्गाें के, जिसका कि वह प्रतिनिधित्व करना चाहता है, कम से कम 20% का प्रतिनिधित्व करता है।
4. राज्य सरकार स्वयं का यह समाधान करने के प्रयोजन के लिये कि कोई संघ नियम 3 की अपेक्षा की पूर्ति करता है या नहीं, संघो से ऐसा अभिलेख जैसा कि वह उचित समझे, मांग सकेगा तथा उसकी परीक्षा कर सकेगी। संघ के प्रतिनिधित्व की प्रास्थिति के संबंध में राज्य सरकार का विनिश्चय अंतिम होगा।
5. नियम 3 एवं 4 की अपेक्षा की पूर्ति करने पर, शासकीय सेवक संघ को तीन वर्ष अथवा संघ के वर्तमान कालावधि (निर्वाचन की वैधता), जो भी पहले हो, तक के लिए शासन से पत्राचार की अस्थायी मान्यता प्रदान की जाएगी । 6. निरसन.- छत्तीसगढ़ शासकीय सेवक (सेवा संघ) नियम, 1967 एतद्द्वारा निरसित किये जाते हैं। नवा रायपुर अटल नगर, दिनांक 23 जून 2025 क्रमांक WELF-3001/8/2024-GAD-9. - भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में इस विभाग की अधिसूचना क्रमांक WELF-3001/8/2024-GAD-9, दिनांक 23 जून, 2025 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. WELF-3001/8/2024-GAD-9. - In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the State Government, hereby, makes the following rules, relating to recognition for correspondence with the Government Servants Associations namely:—
1. Short Title. – These rules may be called the Chhattisgarh Government Servants (Service Association) Rules, 2025.
2. Definitions. – In these rules, unless the context otherwise requires, –
(a) "State Government" means the Government of Chhattisgarh.
(b) "Government Servant" means anyç person to whom of the Chhattisgarh Civil Services (Conduct) Rules, 1965 apply.
3. The State Government shall correspond with an association only if it is satisfactorily proven that such association represents at least 20% of the Government Servants of the category or categories which it seeks to represent.
4. For the purpose of satisfying itself whether an association meets the requirement of Rule 3, the State Government may require such documents from the association as it deems appropriate and may examine the same. The decision of the State Government regarding the representative status of the association shall be final.
5. Upon fulfillment of the requirements under rules 3 and 4, the Government Servants Association shall be granted temporary recognition for correspondence with the Government for a period of three years or for the current term of the association (validity of election), whichever is earlier.
6. Repeal.- The Chhattisgarh Government Servants (Service Association) Rules, 1967 are hereby repealed.
