छत्तीसगढ़ कृषि उपज मंडी (संशोधन) अधिनियम, 2025 .
छत्तीसगढ़ कृषि उपज मंडी अधिनियम, 1972 (क्र. 24 सन् 1973) को और संशोधित करने हेतु अधिनियम ।
भारत गणराज्य के छिहतरवें वर्ष में छत्तीसगढ़ विधान मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित हो

यह अधिनियम छत्तीसगढ़ कृषि उपज मण्डी (संशोधन) अधिनियम, 2025 कहलायेगा । (1)
संक्षिप्त नाम, विस्तार तथा प्रारंभ.
(2) इसका विस्तार संपूर्ण छत्तीसगढ़ राज्य में होगा ।
(3) यह राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगा ।
धारा 31 का संशोधन.
2. छत्तीसगढ़ कृषि उपज मण्डी अधिनियम, 1972 (क. 24 सन् 1973) (जो इसमें इसके पश्चात् मूल अधिनियम के रूप में निर्दिष्ट है) की धारा 31 में, शब्द "निजी किसान उपभोक्ता प्रांगण" के पश्चात् तथा शब्द "या टर्मिनल मार्केट कॉम्पलेक्स" के पूर्व शब्द "या निजी ई-व्यापार मंच" अन्तःस्थापित किया जाए ।
धारा 32 का संशोधन.
3. मूल अधिनियम की धारा 32 की उप- धारा (1 ) के परन्तुक में, शब्द "अन्य प्रदेश" के पूर्व, शब्द "इस प्रदेश के एवं" अन्तःस्थापित किया जाए ।
धारा 32-क कासंशोधन.
4. मूल अधिनियम की धारा 32- क. की उप- धारा (1) के परन्तुक में, शब्द "अन्य प्रदेश" के पूर्व, शब्द "इस प्रदेश के एवं" अन्तःस्थापित किया जाए ।
धारा 32-ख का संशोधन.
5. (1) मूल अधिनियम की धारा 32- ख के शीर्षक में, शब्द "तथा निजी किसान उपभोक्ता प्रांगण" के स्थान पर, शब्द " निजी किसान उपभोक्ता प्रांगण तथा निजी ई - व्यापार मंच " प्रतिस्थापित किया जाए ।
(2) धारा 32-ख की उप - धारा (1 ) में, शब्द "निजी किसान उपभोक्ता छत्तीसगढ़ राजपत्र, दिनांक 16 सितम्बर 2025
1438 ( 1) प्रांगण " के पश्चात्, शब्द "तथा निजी ई - व्यापार मंच" अन्तःस्थापित किया जाए ।

धारा 33-क का संशोधन.
(1) मूल अधिनियम की धारा 33 - क के शीर्षक में, शब्द " तथा निजी किसान उपभोक्ता प्रांगण " के स्थान पर, शब्द " निजी . किसान उपभोक्ता प्रांगण तथा निजी ई - व्यापार मंच " प्रतिस्थापित किया जाए ।
(2) मूल अधिनियम की धारा 33 - क की उप - धारा (1 ) के खण्ड ( ग ) में, शब्द " किसान उपभोक्ता उप - मंडी प्रांगण " के पश्चात्, शब्द " निजी ई-व्यापार मंच " अन्तःस्थापित किया जाए ।
धारा 34- क का संशोधन.
7. मूल अधिनियम की धारा 34 - क की उप- धारा (4) में, शब्द " निजी किसान उपभोक्ता प्रांगण " के पश्चात्, शब्द " या निजी ई- व्यापार मंच " अन्तःस्थापित किया जाए ।
धारा 39 का संशोधन.
8. मूल अधिनियम की धारा 39 के खण्ड (पांच) के पश्चात्, निम्नलिखित खण्ड अन्तःस्थापित किया जाए , अर्थात्ः-
" (पांच- क) मंडी समिति में कार्यरत राज्य मंडी बोर्ड सेवा के अधिकारियों एवं सेवकों के वेतन, भत्ते तथा अन्य'संदाय का भुगतान । "
9.
धारा 48 का संशोधन.
(1) धारा 48 में, शब्द " वह दोषसिद्ध पर कारावास से, जिसकी अवधि छः मास तक की हो सकेगी या जुर्माने से, जो पांच हजार रूपये तक का हो सकेगा या दोनों से, दण्डित किया जायेगा " के स्थान पर शब्द " उसके दोषसिद्धि पर पांच हजार रूपये की शास्ति से दण्डित किया जायेगा " प्रतिस्थापित किया जाए ।
(2) धारा 48 में परन्तुक का लोप किया जाए ।
10. मूल अधिनियम की धारा 49 में,-
धारा 49 का संशोधन.
(1 ) उप- धारा (1 ) के स्थान पर, निम्नलिखित उप - धारा प्रतिस्थापित किया जाए, अर्थात्ः-
" (1 ) जो कोई, धारा 35 के उपबंधों के उल्लंघन में, कोई अप्राधिकृत व्यापारिक छूट देगा या लेगा, वह दोषसिद्धि पर , दो हजार रूपये की शास्ति से दण्डित किया जायेगा तथा पश्चात्वर्ती उल्लंघन की दशा में, पांच हजार रूपये की शास्ति से दण्डित किया जायेगा । "
(2 ) उपधारा (2 ) में , शब्द "जुर्माने " तथा " पांच हजार रूपये तक का 1438( 2)

हो सकेगा " के स्थान पर, क्रमशः शब्द " शास्ति " तथा "पांच हजार रूपये होगा " प्रतिस्थापित किया जाए ।
(3) उप-धारा (2) एवं (3 ) में, शब्द "जुर्माने " तथा "दो हजार रूपये तक का हो सकेगा " के स्थान पर, कमशः शब्द " शास्ति" तथा "दो हजार रूपये होगा " प्रतिस्थापित किया जाए ।
(4) उप-धारा (4) के खण्ड (ख) में, शब्द " जुर्माने " तथा " पांच हजार रूपये तक का हो सकेगा" के स्थान पर, कमशः शब्द " शास्ति " तथा " पांच हजार रूपये होगा " प्रतिस्थापित किया जाए ।
(5) उप-धारा (5) में, शब्द " जुर्माने " तथा " दो हजार रूपये तक का हो सकेगा " के स्थान पर, क्रमशः शब्द "शास्ति" तथा " दो हजार रूपये होगा " प्रतिस्थापित किया जाए ।
(6) उप-धारा (6) में, शब्द " जुर्माने ", " पांच हजार रूपये तक का हो सकेगा " तथा " एक सौ रूपये तक का हो सकेगा" के स्थानं पर, कमशः शब्द "शास्ति" , " पांच हजार रूपये होगा" तथा " पांच सौ रूपये होगा " प्रतिस्थापित किया जाए ,
(7) उप- धारा (7) में, शब्द "जुर्माने" तथा " दो हजार रूपये तक का हो सकेगा" के स्थान पर, क्रमशः शब्द " शास्ति" तथा " दो हजार रूपये होगा" प्रतिस्थापित किया जाए ।

THE CHHATTISGARH KRISHI UPAJ MANDI ( SANSHODHAN) ADHINIYAM , 2025 .
AnAct further to amend the Chhattisgarh Krishi Upaj Mandi Adhiniyam , 1972 ( No.24 of 1973) .
Be it enacted by the Chhattisgarh Legislature in the Seventy Six Year of the Republic of India , as follows : -
Short title , extent and commencement .
1. (1) This Act may be called the Chhattisgarh Krishi Upaj Mandi Adhiniyam , 2025 . (Sanshodhan)
(2) It extends to the whole State of Chhattisgarh .
(3) It shall come into force from the date of its publication in the Official Gazette .
Amendment of Section 31 .
2. In Section 31 of the Chhattisgarh Krishi Upaj Mandi Adhiniyam , 1972 (No. 24 of 1973 ) , ( hereinafter referred to as the Principal Act) , after the words " Private farmer consumer yards " and before the words " or Terminal Market Complex" , the words " or Private E-trading Platform " shall be inserted .
Amendment of Section 32 .
3. In proviso of sub - section ( 1 ) of Section 32 of the Principal Act , before the words " other State " , the words " this State and " shall be inserted .

Amendment of Section 32- B .
5. (1 ) In Heading of Section 32 - B of the Principal Act , for the words " and Private farmer consumer yard " , the words " Private farmer consumer yard and Private E - trading Platform " shall be substituted .
(2) In sub - section ( 1 ) of section 32 - B , after the words " Private farmer consumer yard " , the words " and Private E - trading Platform " shall be inserted .
Amendment of Section 33 -A .
6. ( 1 ) In Heading of Section 33 - A of the Principal Act , for the words " and Private farmer consumer yard " , the words " Private farmer consumer yard and Private E - trading Platform " shall be substituted .
(2) In clause ( c ) of sub- section ( 1 ) of Section 33 - A of the principal Act , after the words "/ farmer consumer sub - market yard " , the words " Private E - trading Platform " shall be inserted .
Amendment of Section 34 -A .
7 . In sub - section (4) of Section 34 - A of the Principal Act , after the words "Private farmer consumer yard " , the words " or Private E - trading Platform " shall be inserted .
Amendment of Section 39 .
8. After the clause ( v) of Section 39 of the Principal Act , the following clause shall be inserted , namely: - छत्तीसगढ़ राजपत्र, दिनांक 16 सितम्बर 2025
1438 ( 5) " ( v - a) Payment of salaries , allowances and other payments of officers and servants of the State Mandi Board Service working in the Mandi Samiti . "
Amendment of Section 48 .
9. (1 ) In Section 48 , for the words " on conviction , be punished with imprisonment for a term which may extend to six months or with fine which may extend to five thousand rupees , or with both, " the words " on conviction , be punished with a penalty of five thousand rupees " shall be substituted .
(2) In Section 48 , the proviso shall be omitted.
10. In Section 49 of the Principal Act , -
Amendment of Section 49 .
( 1 ) for sub - section ( 1 ) , the following sub- section shall be substituted, namely: -
" ( 1) Whoever in contravention of the provisions of Section 35 makes or recovers any unauthorized trade allowance shall on conviction be punished with a penalty of two thousand rupees and in case of subsequent contravention with a penalty of five thousand rupees . "
(2) in sub - section ( 2 ) , for the words " fine " and " may extend to five thousand rupees " , the words " penalty" and " will be five thousand rupees" shall be substituted , respectively .

(3) in sub - section ( 2) and (3 ) , for the words " fine " and " may extend to two thousand rupees " , the words " penalty " and " will be two thousand rupees" shall be substituted , respectively .
(4) in clause (b ) of sub - section ( 4 ) , for the words " fine " and " may extend to five thousand Rupees " , the words " penalty" and " will be five thousand rupees " shall be substituted , respectively.
(5) in sub - section ( 5) , for the words " fine " and " may extend to two thousand rupees " , the words " penalty" and " will be two thousand rupees" shall be substituted , respectively .
(6) in sub - section (6 ) , for the words " fine " , "may extend to five thousand rupees " and "may extend to one hundred rupees " , the words " penalty " , " will be five thousand rupees " and " will be five hundred rupees " shall be substituted , respectively .
(7) in sub - section ( 7) , for the words " fine " and " may extend to two thousand rupees " , the words " penalty" and " will be two thousand rupees" shall be substituted , respectively .
