क्रमांक 113/सी.एस.ई.आर.सी./2025.— विद्युत अधिनियम, 2003 की धारा 181 के अधीन, आयोग में निहित तथा उन समस्त शक्तियाेंं, जो आयोग को इस हेतु समर्थ बनाती हो, का प्रयोग करते हुए, छाीसगढ़ राज्य विद्युत नियामक आयोग (एतद् पश्चात् "आयोग") एतद् द्वारा, विनियम छाीसगढ़ राज्य विद्युत नियामक आयोग (कार्य संचालन) विनियम, 2009 (एतद् पश्चात "मूल विनियम") और इसका प्रथम संशोधन अधिसूचित किया है।
माननीय भारत के सर्वोच्च न्यायालय (सिविल अपीलीय क्षेत्राधिकार) द्वारा सिविल अपील क्रमांक 14697 सन् 2015 में दिनांक 12.04.2018 को पारित आदेश तथा माननीय अपीलीय ट्रिब्यूनल फॉर इलेक्ट्रिसिटी (Appellate Tribunal for Electricity) द्वारा ओ.पी. क्रमांक 1 सन् 2011 में दिनांक 02.12.2013 को पारित आदेश के अनुपालन में, छत्तीसगढ़ राज्य विद्युत नियामक आयोग मूल विनियमों में संशोधन करता है और निम्नलिखित विनियम बनाता हैः -
छाीसगढ़ राज्य विद्युत नियामक आयोग (कार्य संचालन) (द्वितीय संशोधन) विनियम, 2025 1. संक्षिप्त नाम तथा प्रारंभ-
1.1 इन विनियमों को छाीसगढ़ राज्य विद्युत नियामक आयोग (कार्य संचालन) (द्वितीय संशोधन) विनियम 2025, कहा जाएगा।
1.2 ये विनियम, छत्तीसगढ़ राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे।
1.3 यह सम्पूर्ण छत्तीसगढ़ राज्य में प्रभावशील होगी।
2. विनियम 7 के उप विनियम (1) (बी) का प्रतिस्थापनः-
विनियम 7(1)(बी), जिसे प्रथम संशोधन के माध्यम से संशोधित किया गया था, को अब निम्नलिखित द्वारा प्रतिस्थापित किया जाता हैः - परन्तु यह और कि, यदि रिक्ति या किसी अन्य कारण से आयोग का केवल एक सदस्य ही उपलब्ध है, तो आयोग की कार्यवाही के लिए कोरम एक होगी। परन्तु यह और भी कि, अधिनियम की धारा 86(1)(एफ) के तहत किसी भी न्यायनिर्णयन (adjudicatory) कार्य के लिए, यह अनिवार्य है कि कोरम/बैंच के सदस्य के रूप में विधि (कानून) का एक व्यक्ति सदस्य के रूप में उपस्थित हो।

NOTIFICATION
No. 113/CSERC/2025 - In exercise of powers vested under section 181 of the Electricity Act 2003 the Chhattisgarh State Electricity Regulatory Commission (herein after, the Commission) has notified "Chhattisgarh State Electricity Regulatory Commission (Conduct of Business) Regulations, 2009, (herein after, the Principal Regulations) and its first amendments.
The CSERC, in compliance of the order dated 12.04.2018 in Civil Appeal No. 14697 of 2015 issued by Hon'ble Supreme Court of India, Civil Appellate Jurisdiction and the order dated 02.12.2013 in OP No. 1 of 2011 issued by Hon'ble Appellate Tribunal for Electricity amend the Principal Regulations and make following Regulations.
CHHATTISGARH STATE ELECTRICITY REGULATORY COMMISSION (CONDUCT OF BUSINESS) (SECOND AMENDMENT) REGULATIONS, 2025
1. Short title and commencement:
1.1 This Regulation shall be called the "Chhattisgarh State Electricity Regulatory Commission (Conduct of Business) (Second Amendment) Regulations, 2025".
1.2 They shall come into force on the date of their Publication in the Chhattisgarh Rajpatra.
1.3 It shall extend to the whole of the state of Chhattisgarh.
2. Substitution of Regulation 7 (1) (b)
Regulation 7(1)(b), which was amended vide first amendment is now substituted by the following: - (b) The quorum for meeting of the Commission shall be two.
Provided further that, if there is only one Member of the Commission is available, due to vacancy or otherwise, the quorum of the proceedings of the Commission shall be one,
Provided further that, for any adjudicatory function under section 86(1)(f) of the Act, it is mandatory that there should be a person of law as Member to be member of the quorum/ bench.
