अधिसूचना

क्रमांक RULE/170/2025-HOUSING.— छत्तीसगढ़ नगर तथा ग्राम निवेश अधिनियम, 1973 (क्र. 23 सन्‌ 1973) की धारा 85 की उप-धारा (1) सहपठित धारा 24 की उप-धारा (3) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतदद्वारा, छत्तीसगढ़ भूमि विकास नियम, 1984 में निम्नलिखित और संशोधन करती है, जो उक्त अधिनियम की धारा 85 की उप-धारा (1) द्वारा अपेक्षित किये अनुसार पूर्व में प्रकाशित किया जा चुका हैं, अर्थात्‌ :-

संशोधन

उक्त नियमों में, -

नियम 79-घ के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाए, अर्थात्‌ :-

''79-घ. ऊर्जा दक्षता एवं हरित रेटिंग प्रणाली - (1) ऊर्जा दक्षता भवन के संबंध में, आवासीय भवनों के लिए ईको निवास संहिता (ईएनएस) एवं वाणिज्यिक एवं कार्यालयीन भवनों हेतु छत्तीसगढ़ ऊर्जा संरक्षण भवन संहिता (सीजीईसीबीसी) के प्रावधान लागू होंगे। यह संहिताएं उन भवनों पर लागू होंगी, जिनका निर्मित क्षेत्रफल 2000 वर्ग मीटर से अधिक है और कुछ श्रेणियों के भवन जैसे मल्टीप्लेक्स, अस्पताल, होटल और कन्वेंशन सेंटर, चाहे उनका निर्मित क्षेत्रफल कुछ भी हो, संहिताओं का अनुपालन करेंगे।

(2) भवन अनुज्ञा अनुमोदन के समय, बिल्डर/स्वामी/डेवलपर, संबंधित शहरी स्थानीय निकाय/नगर तथा ग्राम निवेश कार्यालय को संहिता के अनुपालन की अनिवार्य आवश्यकता का पालन किये जाने के संबंध में शपथ पत्र प्रस्तुत करेंगे।

(3) पूर्णता एवं अधिभोग प्रमाणपत्र जारी करते समय, बिल्डर/स्वामी/डेवलपर, उक्त संहित्ताओं के प्रावधान अनुसार अधि—त तकनीकी विशेषज्ञ द्वारा जारी अनुपालन प्रमाणपत्र प्रस्तुत करेंगे, जिसमें यह सत्यापित किया जाएगा कि भवन का निर्माण संहिता के अनुरूप किया गया है। अनुपालन प्रमाणपत्र और छत्तीसगढ़ भूमि विकास नियम, 1984 के अंतर्गत अन्य आवश्यक अनुमोदन प्रस्तुत करने के पश्चात्‌, पूर्णता एवं अधिभोग प्रमाणपत्र जारी किया जाएगा।

(4) छत्तीसगढ़ भूमि विकास नियम, 1984 के प्रावधान अनुसार, सक्षम प्राधिकारी किसी भी नए भवन, परिवर्धन या परिवर्तन परियोजना के लिए, भवन के निर्माण के दौरान किसी भी चरण पर प्रगति निरीक्षण कर सकता है, ताकि यह सुनिश्चित किया जा सके कि भवन, संहिता का अनुपालन करता है। (5) हरित रेटिंग प्रणाली के संबंध में, भारतीय हरित भवन परिषद्‌ (आईजीबीसी), गृह रेटिंग अथवा राज्य शासन द्वारा मान्यता प्राप्त अन्य कोई रेटिंग प्रणाली के प्रावधान लागू होंगे। यदि किसी भूस्वामी अथवा विकासकर्ता द्वारा हरित रेटिंग प्रमाण पत्र प्रस्तुत किया जाता है, तो उक्त प्रमाणपत्र के आधार पर सक्षम प्राधिकारी द्वारा निम्न तालिका अनुसार निःशुल्क अतिरिक्त तल क्षेत्र अनुपात अनुज्ञात किया जा सकेगा :-

(6) नियम 79-ग में अंतर्विष्ट किसी बात के होते हुए भी, इस नियम के प्रावधान मान्य होंगे।''

क्रमांक RULE/170/2025-HOUSING.— भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में छत्तीसगढ़ भूमि विकास नियम, 1984 में संशोधन संबंधी इस विभाग की समसंख्यक अधिसूचना दिनांक 26-11-2025 का हिन्दी एवं अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्‌द्वारा प्रकाशित किया जाता है।

NOTIFICATION

No. RULE/170/2025-HOUSING.— In exercise of the powers conferred by sub-section (1) of Section 85 read with sub-section (3) of Section 24 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973), the State Government, hereby, makes the following further amendment in the Chhattisgarh Bhumi Vikas Niyam, 1984, the same having been previously published as required by sub-section (1) of Section 85 of the said Adhiniyam, namely:

AMENDMENT

In the said rules.-

For rule 79-D, the following rule shall be substituted, namely:-

"79-D. Energy Efficiency and Green Rating System. (1) In respect of energy efficient building, provisions of Eco Niwas Samhita (ENS) for residential buildings and Chhattisgarh Energy Conservation Building Code (CGECBC) for commercial and office buildings shall be applicable. These codes shall be applicable to buildings having built up area more than 2000 sq.m. and certain categories of buildings like multiplexes, hospitals, hotels and convention centers, irrespective of their built up area shall comply with the codes.

(2) At the time of building permission approval, the builder/owner/developer shall submit an affidavit to the concerned urban local body/Nagar and Gram Nivesh office, regarding compliance with the mandatory requirement of compliance with the codes.

(3) At the time of issuance of Completion and Occupancy Certificate, the builder/owner/developer shall submit a compliance certificate issued by the authorized technical expert as per the provisions of the said codes, certifying that the building has been constructed in accordance with the codes. After submission of Compliance Certificate and other necessary approvals under the Chhattisgarh Bhumi Vikas Niyam, 1984, Completion and Occupancy Certificate shall be issued.

(4) As per the provisions of the Chhattisgarh Bhumi Vikas Niyam, 1984, Competent Authority may conduct progress inspection at any stage during construction of building, for any new building, addition or alteration project, to ensure that the building complies with the Code.

(5) In respect of Green Rating System, the provisions of Indian Green Building Council (IGBC), GRIHA Rating or any other rating system recognized by the State Government shall be applicable. If Green Rating Certificate is submitted by a landowner or developer, then on the basis of the said certificate, Competent Authority may permit additional Floor Area Ratio free of cost as per the following table:-

(6) Notwithstanding anything contained in rule 79-C, the provisions of this rule shall be valid.''
